In the modern day, I think that Ludwig has mostly quit smoking cigarettes, but Gilbert has not. (I've said it before and I'll say it again, what's the point of being a semi-immortal being if you can't have a goddamn vice; also Gilbert went through the scare of 'hey maybe I am dying' so I think he'd have all the more reason to just do what he wants.)

However, being around his older brother does make Ludwig more inclined to get pulled into his vices, such as smoking on a cold winter day while waiting for the S-Bahn or ordering that next round of beers when he really shouldn't because he has an early morning meeting and it's way past his bed time, but Gil already made the order and it's already here, so who is he to waste a perfectly good German beer?

And I think as much as he complains and scolds his brother for encouraging bad habits, there's another part of him that appreciates having the "excuse" to let loose for a moment, to indulge himself. And more importantly, to be able to do that with his older brother while he's still alive and well.
