Reforma eléctrica afectaría a 47% de la capacidad de generación

La iniciativa preferente para modificar la Ley de la Industria Eléctrica presentada por el presidente Andrés Manuel López Obrador impactará a 260 plantas de generación eléctrica privadas en operación comercial en el país, con una capacidad instalada de 32.6 gigawatts, es decir, 47% de la capacidad instalada en México, de acuerdo con cálculos realizados por las asociaciones de energía renovable del país.

Cabe recordar que entre los cambios planteados a 12 artículos y transitorios de esta ley que entró en vigor en el 2015 como parte de la reforma energética, está la revisión de contratos previos a la creación del mercado que se diseñó mediante estos ordenamientos, con lo que los productores independientes de energía (PIE) que le venden a la Comisión Federal de Electricidad (CFE) y quienes cuentan con un contrato legado de autoabasto podrían verse obligados a modificar sus contratos si son considerados ventajosos por parte de la autoridad.

Además, la denominada contra reforma –cuya discusión inicia este jueves 11 de febrero a partir de las 11:00 horas vía remota en el Canal del Congreso de la Unión mediante la modalidad de Parlamento abierto con la participación de expertos– incluye también un orden de prelación para el despacho de energía a la red que beneficia a la CFE por encima de los productores privados de cualquier régimen, legado o de la nueva legislación, que incluye a los generadores de las subastas y a quienes tienen contratos de generación para vender directamente al mercado o en contratos bilaterales con consumidores.

De ahí que durante su argumentación en contra de la Política de confiabilidad, seguridad, continuidad y calidad en el Sistema Eléctrico Nacional –ordenamiento suspendido por la Suprema Corte hace una semana tras la sentencia de inconstitucionalidad a favor de la Comisión Federal de Competencia Económica (Cofece)– las empresas agrupadas en la Asolmex, Amdee, Cogenera, AME y la Asociación Mexicana de Energía Hidroeléctrica, detallaron que además hay 56 proyectos con una capacidad de 8.4 gigawatts en pruebas y 130,000 sistemas de generación distribuida operando en el país.

La inversión privada en el sector eléctrico del país ha generado 81,500 empleos directos e indirectos asociados con estos proyectos que hoy están dispersos en todas las entidades del país. En términos de inversiones ejecutadas, en la última década ascienden a 44,000 millones de dólares de inversión extranjera directa, pero se calcula que entre 2021 y 2033 ascenderá a 24,000 millones de dólares con 113,000 empleos asociados. Lo anterior, derivado del potencial para instalación de renovables como eólica y solar con que cuenta el país.

De los proyectos privados en operación del país, el 58% corresponde a tecnología térmica, mientras que 19% ya es energía eólica y 12% fotovoltaica. Del resto, 7% son proyectos de cogeneración, 3% es energía solar distribuida y 1% son hidroeléctricas.

Pero de los proyectos en construcción o pruebas, 51% de la tecnología es solar fotovoltaica, 27% son proyectos térmicos (principalmente ciclos combinados a gas natural) y 22% corresponde a energía eólica.

ICC alerta por efectos negativos de iniciativa

Ayer, la Cámara Internacional de Comercio (ICC) pidió al pleno de los diputados rechace la iniciativa de reforma de la industria eléctrica, y con ello se evite someter al país en juicios de amparo y/o arbitrajes nacionales e internacionales, a los que acudirían las numerosas empresas para defender sus inversiones en el país.

El organismo privado consideró “innecesario” llevar al país a un debate cuando la Suprema Corte de Justicia de la Nación (SCJN) ya sentenció en contra de los principales argumentos de la reforma preferente.

La ICC, capítulo México solicitó al Congreso de la Unión “rechazar la Iniciativa Preferente enviada por el presidente de la República para reformar la Ley de la Industria Eléctrica, turnada a la Cámara de Diputados el pasado 29 de enero ya que, además de afectar a toda la industria productora de energías limpias, perjudicaría también profundamente y a largo plazo la reputación de nuestro país frente a los inversionistas privados nacionales y extranjeros”.
