Construction Lien Law in Utah

In Utah, construction lien laws are primarily governed by Title 38, Chapter 1a of the Utah Code, which details the requirements and procedures for establishing and enforcing construction liens. Here is a comprehensive overview:

Preliminary Notice

Requirement: Any person furnishing labor, service, equipment, or materials for a construction project must file a preliminary notice with the State Construction Registry (SCR) within 20 days after starting work on the project. This notice is crucial as it preserves the right to later file a construction lien if payment issues arise (Utah Code § 38-1a-501).

Filing: The notice must be filed online at the SCR website. Failure to file this notice within the 20-day period may result in the loss of lien rights.

Contents: The notice of construction lien must include:

The name of the reputed owner or, if unknown, the record owner.

The name of the person who employed the claimant.

The dates when the claimant first and last provided labor or materials.

A description of the property sufficient for identification.

The claimant’s name, address, and phone number.

The amount claimed.

The claimant’s signature.

An acknowledgment or certificate as required by Title 57, Chapter 3.

For liens on owner-occupied residences, a statement on the steps the owner can take to remove the lien (Utah Code § 38-1a-502).

Recording: This notice must be recorded in the county where the property is located, and the county recorder will index it accordingly. The notice is considered effective from the time of recording, giving public notice of the lien.

Service: Within 30 days after filing, the claimant must deliver or mail a copy of the notice to the reputed owner or record owner. Failure to do so can preclude the claimant from recovering costs and attorney fees in a lien enforcement action.

Filing Deadlines

Lien Filing: A lien must be filed within 180 days after the final completion of the original contract, the final inspection, or the issuance of a permanent certificate of occupancy. If a notice of completion is filed, the deadline is shortened to 90 days.

Lien Enforcement: To enforce the lien, a lawsuit must be filed within 180 days after the lien is recorded. This is very important.

Bonding and Waivers

Bonding: If a lien is contested, the property owner can post a bond to discharge the lien. The bond amount varies: 150% of the lien value if the claim is $25,000 or more, 175% if between $15,000 and $25,000, and 200% if less than $15,000.

Utah woman gets plea deal after pulling teens skirt down in viral TikTok video

A Utah woman who went viral and was dubbed a “Karen” after she allegedly pulled down a young woman’s skirt that she found to be too short and revealing in public has entered into a plea deal on a misdemeanor sexual battery charge. Ida Lorenzo, 49, confronted a young woman on April 20 at a St. George, Utah, eatery in a spat partially caught on camera. In the video, posted April 21, she appears to brag that she works for the state as she admonished the young woman for her skirt. Ida Lorenzo. “I happen to work for the state and if I have to watch your ass cheeks hanging out again I will call CPS,” Lorenzo said in the clip, referring to Utah’s Child Protective Services. The video was filmed by a female in the group and was captioned: “Karen gets upset my friend is wearing a mini skirt, so she aggressively grabs it, yanks it down and says ‘you’re probably underage, you probably shouldn’t be wearing that’ then causes a scene in a busy restaurant.” In the clip the young woman in the skirt is not visible. Lorenzo is seen talking to a group of the young girls who defend their friend saying, “She’s over 18. She is 19 years old” and “You don’t get to touch her,” and urge her to call the police. Lorenzo ended up calling St. George Police on April 21, one day after the incident, after seeing the video on social media. She called dispatch saying that she holds a position with the state and that the video caused a threat on her life, according to the probable cause affidavit. She told police that she confronted a young woman at a restaurant who was wearing “explicit clothing” that exposed her private parts with children present. Lorenzo told law enforcement that she felt it was her responsibility to address the woman and she attempted to pull the woman’s skirt down to cover “exposed genitalia,” the affidavit said. An officer asked why Lorenzo, who assumed the young female was a minor, would find it appropriate to touch her. She responded saying she never touched the woman, just her skirt. She told police that the woman and her friends filmed a portion of the incident and posted it to social media with the tagline of being a “Karen,” the affidavit said. On April 22, the woman who was allegedly wearing the short skirt came forward to police saying she was sexually assaulted in the lobby of a restaurant on April 20. She said that Lorenzo confronted her while her back was turned and without any warning, “she felt cold hands go up her skirt, touching her buttocks before she felt her skirt being pulled on.” The victim stated “she was startled by the encounter, and felt violated,” the probate cause affidavit said. The victim and seven other witnesses came forward and filled out witness statements. The female victim said she was wearing underwear and shorts under her skirt, making it impossible to have been exposing herself. Lorenzo was charged with sexual battery as a class A misdemeanor. However, that charge was lowered to a class B misdemeanor in a plea deal filed on Aug. 7, according to Washington County court records. She entered a plea in abeyance, no contest. Under that agreement, there will be no sentence imposed for a year as long as she complies with the terms — she’s not allowed to commit any crimes, may not contact the victim and must undergo a mental health evaluation. Susanne Gustin, Lorenzo’s attorney, said Tuesday that Lorenzo has declined to comment on the plea agreement. The same day she was charged, Lorenzo was sent a termination letter from the Utah Attorney General’s Office where she worked as a legal secretary for less than two months, Utah News Dispatch reported. The letter of termination cited that she had “not passed your probationary employment period successfully” and cited “your non-compliance with policies and standards related to performance,” the paper reported. The Twisted World of Warren Jeffs: Former FLDS Members Speak Out

Exclusive Interviews With Ex-FLDS Members Offer New Picture of Covert Community.

When polygamy was outlawed by the Mormon Church in 1890, splinter groups formed, including the Fundamentalist Latter-Day Saints, or FLDS, in which members could practice polygamy – or "plural marriage" – discreetly, without persecution.

The FLDS was able to flourish in a remote enclave nestled along the border of Utah and Arizona near Zion National Park in a community called Short Creek.

In the FLDS community, the most important person is the prophet, and members believe that God communicates directly through him. Among the core beliefs of the community is that the more wives a man has, the closer he gets to salvation.

From 1986 to 2002, Rulon Jeffs Served as FLDS Prophet and President.

As Rulon Jeffs' health declined, his son Warren Jeffs slowly took control of the FLDS community. Rulon Jeffs died in 2002, and Warren Jeffs succeeded him as prophet.

FLDS members were used to taking direction from Warren Jeffs but, over time, his orders became more restrictive – and, to some, alarming.

Jeffs banned television, movies, popular music, and fictional books. He also executed strict mandates on behavior, dress, and language. Women were told to "keep sweet," suppress emotions and feelings, obey their husbands, and above all, obey Jeffs — the all-knowing prophet.

Briell Decker, Jeffs' 65th wife, told ABC, "'Keep Sweet' meant you could have no emotions except for sweetness. That was the only emotion allowed."

ABC's new special, "Truth and Lies: The Doomsday Prophet," streaming now on Hulu, features exclusive, never-before-seen interviews with FLDS members filmed inside the community.

Beneath what appeared to be an attempt to present an ideal community of content and obedient followers, Jeffs allegedly used his power to pursue twisted exploits.

ABC sat down with Jeffs' daughter, Rachel Blackmore, who alleged her father sexually abused her for years during childhood. "When your parent does something like that, it feels shameful on you, too. And then it kept happening," Blackmore told ABC.

While Jeffs accumulated brides, some of them young teens, underage marriages were common in the broader community.

At the age of 14, Elissa Wall was married off to her 19-year-old first cousin. Wall said she had no choice but to go through with the marriage, which was officiated by Jeffs.

Ruth Stubbs, another member of the FLDS community, was married off when she was 16. Her husband, Rodney Holm, was 32. He was a police officer in Short Creek and was already married to two other women. Holm was arrested for bigamy and unlawful sexual conduct with a minor and spent a year in prison.

Warren Jeffs' alleged involvement in facilitating marriages between underage girls and adult men led to him being placed on the FBI's 10 Most Wanted list in May 2006. Criminal charges had been brought against him in Utah and Arizona.

Jeffs eventually fled Short Creek and went on the lam, hiding out in various cities around the United States per his journals – or "priesthood records" – that were later presented at his trial. While on the run, Jeffs had a compound built in Eldorado, Texas – where he would send hand-picked followers, telling them they were being called to Zion, or "heaven on earth." Jeffs named the compound the YFZ Ranch (or "Yearning for Zion" Ranch).

"People were slowly disappearing [from Short Creek] at that time," said Charlene Jeffs, a former FLDS member who was then married to Warren Jeffs' brother, Lyle. Several of Charlene's children, Ammon, Susie, and Thomas, were called to Zion, she said.

"It was supposed to be an honor to have them called forth. But all it was, was heartache," said Charlene Jeffs, who was exiled from the FLDS community in 2012.

In August 2006, Jeffs' journey on the run came to a halt when his car was pulled over for a routine traffic violation outside of Las Vegas. Then, court proceedings began.

Wall testified against Jeffs in 2007. Wall told ABC it was an empowering experience: "I was forced to face him. I was forced to get on the stand, face him, and say 'you did this' ... I was no longer just an innocent little girl who just did everything out of fear. I had a voice and it was starting to become heard."

Jeffs was found guilty of accomplice to rape for facilitating Wall's underage marriage. He was sentenced to 10 years in prison. The charges would be overturned on appeal in 2010, and Jeffs was never retried. However, by that point, other evidence against Jeffs was found at the YFZ Ranch after law enforcement raided the ranch, leading to new charges.

"[Officers] saw scrapbooks and letters supporting the fact that these girls were being married off at a very young age and were having babies," said Angela Goodwin, a district attorney in Texas.

During the raid, officers found horrific evidence incriminating Jeffs – including an audio recording of him having sexual relations with a 12-year-old. Officials also discovered a pregnant 15-year-old at the ranch who was carrying Jeffs' child.

Former FLDS members allege Jeffs still runs the church from behind bars in Palestine, Texas, and releases revelations that his devout followers adhere to. One revelation from the summer of 2022 has been particularly concerning to former members, especially those with family members still in the religion.

"The revelations say that within five years, the children will be translated to heaven. But the problem is … you have to die first," Roger Hoole, a private attorney involved in many FLDS cases, told ABC.

Amid current concerns about Jeffs' revelations, Short Creek is moving on – and perhaps nothing is more indicative of the vast progress in the community than the election of Donia Jessop as mayor of Hildale, on the Utah border of Short Creek.

Jessop is the first female mayor and first former FLDS member elected to office. Jessop has implemented modernization in the community – for example, she is working with the United Effort Plan to completely transform the former FLDS meetinghouse.

"We want to recreate a place, a community building, where we can come together and celebrate in the things that we've always loved, the programs, the dance, the arts. We want to create a safe haven for the people," Mayor Jessop told ABC.

Another major development in the community was the creation of the Short Creek Dream Center, a place of refuge for people transitioning out of the FLDS – and anyone fleeing oppressive or abusive environments.

The Dream Center, symbolically, was the former home of Warren Jeffs. Briell Decker, one of Jeffs' former wives, was granted the 28,000-square-foot home after escaping the FLDS – and she helped create the Dream Center.

Decker, who experienced so much pain and trauma in her early life, says she is proud to now help others at the center.

"I feel like I'm safe. I feel like more lives are being touched than I could have ever possibly imagined," Decker told ABC.

Wall, now an activist and author, moved back to Short Creek several years ago and noticed an emotional shift in the community.

"The most important change that I think Short Creek has undergone in the last decade is healing. As people returned and came back, bringing all of their experiences, for them they were coming home," Wall said.

As veteran journalist Mike Watkiss tells ABC, "This is a story about a culture, a community, that has chronically oppressed women. The women are the victims, and the women have been the forces and instruments of change."

Classified documents discovered over the MLK holiday weekend in a birdcage at President Biden's beach house has thrown the White House into a tizzy. The top secret papers were promptly delivered to the National Archives, bird poop and all, along with Biden's vintage 1967 Corvette convertible that had been employed to spirit them away. Spokeswoman Karine Jean-Pierre said the president is cooperating fully with authorities in hopes he can get the car back quickly. “It's kind of like a security blanket,” she told reporters, adding, “they can keep the birdcage.” Upon hearing the news, former president Donald Trump said, “Hypocrite, hypocrite, na, na, na, na, na.” The controversy is bad news for Attorney General Merrick Garland, who can't very well prosecute Trump without investigating Biden, too. It all adds up to one political cluster (expletive deleted). So it's King's X for Trump — that's the good news. The bad news is it will rob him of a lot of publicity — the kind he needs to rile up the red-hatted MAGA militias who have gone to ground since Trump disciple Kari Lake vanished in Arizona. Meanwhile, Biden continues to whistle past the graveyard repeating the same old tune: “I'm not Trump.” But maybe something else would be more apropos, like “Knockin' On Heavens Door.”

“AS ST. GEORGE TURNS,” THE ROM-COM OF DRAG

The atmosphere may be burning up, there's horrendous flooding, endless drought and fires beyond control. But in St. George they've got real problems — drag shows. This could get dicey. There are F-bombs and C-bombs and who knows what all. It all started last fall when HBO staged “We're Here,” a drag show in Town Square Park that drew some 1,400 onlookers. KABOOM! Satanic worship, cried some. Grooming children, cried others. Cute outfits, whispered some. The dust devil turned into a whirlwind that became a tempest in a teapot. Then the LGBT Student Association at Utah Tech hosted a drag show of its own. What is the world coming to. This isn't New York City where sin is like a plague. This is St. George, Utah, founded by nice, Mormon people who believe women have a special place under God's heaven and they didn't mean hairy men in fishnet stockings and sparkly heels. Who are you going to call — a crisis manager, of course. He will give perverted progressives a taste of their own medicine, with F-bombs and C-bombs and nastiness. Oops! Backfire! Maybe fighting drag shows with profanity isn't exactly the best way to go. After all, one of Brigham Young's sons was a drag queen, Madame Patterini. Hey Wilson, what's the big deal with George Santos, anyway. Everyone wants him to resign from Congress. So what if he told a few lies when running for a House seat from Long Island. Getting an education can be a hindrance when trying to think. Kevin McCarthy knows that all too well. Santos may have prevaricated a little about being the grandson of Holocaust refugees. But he didn't say he is a Jew, Santos said he is “Jew-ish.” Get it. He's actually Catholic. But who cares and besides Kevin McCarthy needs his vote: without it he wouldn't be speaker and going forward the GOP holds only a nine-vote majority in the House. And hey, Lying isn't illegal. Is a Burger King Whopper really as big as it is in the ads? Did Bill Clinton have sex with that woman? Did Saddam Hussein have “weapons of mass destruction.” The Washington Post counted 30,573 false or misleading statements by Trump during his presidency. George Santos has got a lot of prevaricating to do to catch up or even be seen as a decent liar. But as long as Kevin McCarthy and the GOP need him the country will be better off. And that's not the truth, either.
