Ben Eakle, West Virginia inmate 3577171, born 1994, incarceration intake March 2017 at age 22, scheduled for release March 2048
Sexual Assault, with a history of failed attempts at probation.
Failed at probation for a Sexual Assault conviction (2 Counts); was sentenced to 30-70 years in prison.
The Judge also imposed a 50-year period of court-supervised release, should Ben Scott Eakle ever make it out of prison.
The Assistant Prosecutor asked the court for the sentence imposed.
The Public Defender sought either another chance at alternative sentencing for his client, or a stay of sentencing so that he could try to find placement for the defendant in a group home.
Eakle asked for one last chance at probation.
His recent stay at a rehabilitation center, which was followed up by a stint at jail, opened up his eyes and also left him with two broken ribs, Eakle said. He said he believes he could make it on probation if he was kept away from any internet access.
“I feel like if I go to prison, I ain’t going to come out of there a man. ... I’m probably going to come out of there dead,” Eakle said.
At the end of the hearing, the Judge said he would entertain a motion for reduction of sentence. While the judge didn’t promise anything, he said he would seriously consider changing the sentence to 15-35 years, which would be achieved by running the sentences concurrently, rather than the consecutive terms imposed.
Even Eakle acknowledged he was given multiple chances by the state for his crimes.
The state’s forbearance stemmed in part because Eakle had been a juvenile at the time, and in part because he had been a victim himself, according to prior statements in court.
But the Judge indicated this processed marked a turning point, one where, following all of the chances, the scales tipped toward the interests of protecting society.
Eakle actually was convicted of three counts of first-degree sexual assault, with three different victims. However, one of those counts was bumped back to juvenile status by the Judge to get Eakle into a treatment program in North Carolina while he was still under age 18.
Eakle hasn’t committed any similar crimes since that treatment, inferring that his client had profited from program and also begun to mature, the Public Defender told the court. Eakle’s problems have been with violating rules, the Public Defender commented.
But trying to get Eakle into a halfway house or some other group home has proved tough, the Public Defender told the Judge.
Eakle will have substantial credit for time already served, and it will apply to both sentences. If the Judge doesn’t reconsider, and Eakle never makes parole, he could be released in about 35 years through maximum good behavior credit.
