Well, this is embarrassing, fresh Russian troops on the front lines in Ukraine — where it's damn cold — don't have long johns. “[Y]our fighters that you sent to us in the Stavropol region... are practically naked,” said a troop leader to military higher-ups in a video. It gives the draft a whole new meaning — it's absolutely chilling. Reports reveal Russian troops scavenged deserted, war-town Ukrainian towns in search of socks and long underwear. Hey Wilson, have you ever had that dream where you go to school or work and around 10 o'clock you look down and notice you forgot to put your pants on? Imagine forgetting your pants in Ukraine in December. As those grunts were freezing their butts off, they may fantasize about Russia's female soldiers marching in Moscow's Victory Day Parade in Red Square. They're dubbed “Putin's miniskirt army” for their skimpy uniforms that show more than a little thigh. (We're not making this up.) What a sight, leagues of young Russian women marching in unison in something akin to Broadway dancers — call them the Russian Rockettes. Their uniforms weren't designed for winter, either. Still, those Russian conscripts might not mind reinforcements from the miniskirt army. If you can't have long johns, then... well, never mind.

WHO THE HELL IS ST. GEORGE

Lately St. George, Utah, has made national headlines for such things as drag shows and drug trafficking. Not exactly the pubic relations campaign the Mormon majority had in mind. “Come to St. George, we've got Zion National Park, Snow Canyon, cool drag queen shows and good deals on meth and fentanyl.” People all over the country must be wondering, hey, the Mormons don't have saints, so who the hell is St. George. Saints, of course, are a Catholic phenomenon — and Brigham Young wasn't no Catholic and he sure wasn't no saint, neither. Well, OK, he was a Latter-day Saint, but it isn't the same. And no Wilson, St. George is not in the book of Mormon. One thing is for sure — the Utah town wasn't named for the patron saint of Ethiopia, which has, perhaps, the oldest orthodox church in Christendom. Ethiopia also boasts a Belgian lager beer called — you guessed it — St. George. Sooner or later some Utah brewer will name a beer St. George. But we digress. The town was settled in 1861 by Mormons as a place to grow cotton. It got the handle Dixie because it's so much like Mississippi — NOT. But why St. George? Brother George or Bishop George — that's understandable. But St. George? At least we know who Murray, Utah, was named for: Bill Murray, of course. Everyone knows that.

Utah is just darn lucky to have Burgess Owens in Congress so he can be, as he so astutely put it, “a vocal warning beacon against the left’s strategy to usurp our constitutionally granted free speech rights.” You see, Owens grew up in the deep South where he witnessed the war waged upon the African-American community by those racists — the progressive left. Well, at least that's what he wrote in a guest opinion piece in the Deseret News.“Seeing firsthand the destructive nature of the progressive left, I chose to stand recently as the only “present” vote in the House in regard to the Respect for Marriage Act.” The dastardly and ungodly legislation grants federal protection to same-sex and interracial couples. Earlier this month, Congress passed the bill and President Biden signed it into law. But Owens stood firm: with the “present” designation, he neither voted for it or against it, a brave move to blunt the left's stealth deception and tactic of “incremental success.” The protection of same-sex and interracial marriage, Owen said, is nothing but a tool to divide good people. The former football star and motivational speaker sure knows how to frame an argument through the looking glass. Or as Alice would say, “It would be so nice if something made sense for a change.”

Saddened to read the passing of Actor Wilford Brimley (1934-2020)

Wilford Brimley, the mustachioed actor who appeared on the big screen, television shows and Quaker Oats commercials, has died. He was 85.

Brimley died On 8/12020 while hospitalized in St. George, Utah, He'd been at the ICU, where he was getting treatment for medical problems and was on dialysis.

His movie credits date to the 1970s and include "The China Syndrome” “The Electric Horseman” “Absence of Malice” “The Firm” “Hard Target” “Cocoon," "The Natural" and "The Thing." He also starred in several television shows, including “The Walton’s” “Our House" as a gruff widower who asks his daughter-in-law and her children to live with him.

In addition to Quaker Oats, he also appeared in commercials for the American Diabetes Association, where he used his raspy baritone to urge people to check their blood sugar often.

Over the years, he earned a new legion of fans -- many born decades after his movie appearances -- drawn to memes paying tribute to his mustache.

Brimley is survived by his wife, Beverly, and three sons.

Thirty Three Years (and a Day) Gone

On May 4th, 1988, a loud explosion rocked the entire Southern Nevada Valley.  The ground rumbled, windows shook and, in many places, shattered completely.  Residents at first thought it was an earthquake.  Others who saw a mushroom cloud rising over  Henderson thought a nuclear nightmare might be unfolding in the industrial city.

In reality, it was an industrial disaster that occurred  at the Pacific Engineering Production Company of Nevada which was commonly referred to as PEPCON.  The plant, located in Henderson, was one of two American producers of ammonium perchlorate which is an oxidizer in solid rocket fuel boosters for the Space Shuttle and the military's Titan Missile  program.

The other American manufacturer, Kerr-McGee, was located less than five miles away from the PEPCON plant and well with-in the area that suffered blast damage.

A little background information:  After the Challenger Space Shuttle disaster in January, 1986, the United States government continued their contract with PEPCON for ammonium perchlorate.  Despite the freeze on the Space Program, the company continued to manufacture the product at the same rate as before the Shuttle disaster.  Since there was no delivery of the product going on due to the freeze and no guidance from the government as to where to ship it to, the company stored the compound on site in plastic drums. These drums were housed on the parking lots around the plant.  The Las Vegas Review Journalreported in the aftermath that "nearly 9 million (yeah, you read that right) pounds of the chemical was consumed by the flames or explosions."

According to Wikipedia, a fire started by "a cigarette that had been discarded into a barrel of scrap ammonium perchlorate."  Nearby, workers were repairing a steel frame with fiberglass walls that had suffered damage in a recent windstorm.  They were using a welding torch.  The fire spread quickly once it reached the fiberglass material.  This led, according to the Las Vegas Mercury account by Gregory Crosby, to the first small explosion:

This small explosion raised the alarm "that enabled most workers to escape before a second larger explosion occurred on the heels of the first." 

Company comptroller Roy Westerfield "was on the phone reporting the emergency, explaining the urgency of the situation, "We've had an explosion and everything's on fire" he told a dispatcher.  (Las Vegas Review Journal)

The Henderson Fire Department responded to the fire.  When the Fire Chief arrived he saw a massive white and orange fireball and dozens of people running across the desert towards him.  The second explosion happened at 11:54 and the shock wave shattered the windows in the Chief's car.  A heavily damaged vehicle approached and its driver advised the chief that the danger was growing.  The Chief turned around and headed towards safety.

Inside the plant, Roy Westerfield was still trying to herd people to safety.  He was talking by phone to a dispatcher when  few seconds later he said "Get 'em all out of here".  These were quite possibly his last words. 

It was the third massive explosion that sent Henderson and Las Vegas residents running for their windows, radios and television news.   Local Channel 3 anchor Gwen Castaldi went on the air and began letting Valley residents know what was happening.  "It was a real moment of urgency and tragedy in the community." (Personal interview with Castaldi, 2005).

It was the third blast, according to Gregory Crosby, "that sealed the plant's fate when that 9 million pounds of chemical literally went up in smoke."  

The blast was so forceful that it knocked an arriving fire engine over two lanes.  Another arriving fire truck had its windows shattered.  Cars were overturned.  The explosion created a visible shock wave.  This explosion almost destroyed the Fire Chief's car but he was able to drive to a nearby hospital to seek treatment for his passenger and himself.

Inside the plant, Roy Westerfield and Bruce Halker, two employees who were shepherding people out of danger were killed.   More than 300 people were injured.

The marshmallow factory next door, Kidd and Co., suffered the brunt of the explosion.  Due to faulty equipment there were fewer employees working that day.  Those employees who were there evacuated at the first sign of trouble.  The marshmallow factory was destroyed. 

"The final explosion went off and PEPCON basically disappeared.  Boulder Highway looked like a war zone.  There was glass everywhere.." Eyewitness  and PEPCON employee Joe Hedrick.

The last explosion registered 3.5 on the Richter scale by the National Earthquake Information Center 600 miles away in Colorado.  A crater estimated at 15 feet deep and 200 feet wide was left in the storage area. 

A 747 on approach to McCarran Airport was reportedly buffeted by the shock wave.  The Airport, 11 miles away from the blast, suffered cracked windows.  An analysis later estimated the blast damage the equivalent of 250 tons of TNT. 

Nearby Basic High School suffered serious damage and damage was reported at McDoniel Elementary, Burkholder Middle School and Southern Nevada Vocational-Technical Center.  The last blast blew out the windows at Basic High School.

"We thought someone was out there with a shotgun" remembered teacher Michael Neighbors, "Like fools, we went right for the windows.  We literally pushed the kids out of the building.  It was like an air pocket.  The back of my hair parted." (Las Vegas Review Journal). 

The large plume of smoke could be seen around the valley and residents throughout the valley worried about chemical fall-out.   Luckily, the wind that day was only 20 to 25 mph and kept much of the chemical from settling in the valley.  Local health officials predicted that lives were saved because of the winds.

Damage was estimated at $74 million dollars.  The nearby Fire Station was heavily damaged and there was structural damage to a nearby warehouse.

PEPCON, renamed Western Electrochemical Company, relocated to Iron County, Utah.  Now some 14 miles northwest of St. George, they began the relocation a mere three months after the devastating explosion at the Henderson plant.  Kerr-McGee moved their plant 17 miles northeast of Las Vegas to Apex.   For awhile Kerr-McGee continued to manufacture the more stable liquid form of the chemical on site.  But in 1998, ten years after the disaster, the parent company of PEPCON/Western Electrochemical Company bought out the remaining ammonium perchlorate contracts and moved all production to Utah.

Senior Company official, Fred Gibson, Jr tried to shift blame from PEPCON to Southwest Gas by saying that a ruptured gas line caused the fire.  However, this conflicted with eyewitness testimony by employees.  PEPCON attorney told the Las Vegas Review Journal, three days after the disaster, "Nothing ignites ammonium perchlorate.  It does not burn.  It is not flammable."  Chemists from around the world immediately disputed the attorney and called the product "unstable and highly flammable." 

After the explosion it came out that the facility had been cited numerous times since 1974 for safety violations.  There had been a small explosion in 1980 that had injured a worker. 

More than 50 law firms represented dozens of insurance companies and corporations in lawsuits.  The case ran up tens of millions of dollars in attorneys fees and produced 1 million pages of depositions.

The case wound its way through the judicial system from 1989 to 1992 when a $171 million settlement was reached before going to a jury trial.  Insurance companies that had reimbursed some 17,000 claimants received almost 100 cents on the dollar.

Clark County agreed to pay $3.8 million to insurance companies as a result of shoddy inspections that had taken place at the plant over the years. 

Southwest Gas also agreed to settle because according to their attorney "it was a practical decision made because of the uncertainty of what a jury might do at trial." (Las Vegas Review Journal).

Southwest Gas later found out what a jury would do.  In a trial that lasted a little over a month, PEPCON's insurance company argued that gas, which is lighter than air, had leaked from a pipe then moved horizontally underground toward the plant 670 feet away.  The gas was then to make a 90-degree turn upward and ignited with an unknown source. Following final arguments, the attorneys hadn't even gotten back to their offices before the call came from the court house that a jury had reached a verdict.  It took less than a half hour for the jury to laugh that idea out of court.

2H 2018 Quick Links, Part 3 (Keyword Advertising)

* St. George Executive Shuttle LLC v. Western Trails Charter & Tours LLC, 2018 WL 3350348 (D. Utah July 9, 2018). This is a competitive keyword advertising lawsuit involving the purported trademark “St. George Shuttle” (St. George is a city in Utah). The court denies the defendant’s motion to dismiss as premature. What are the odds the court will void the plaintiff’s “trademark” before this lawsuit is over?

* LegalForce RAPC Worldwide v. Swyers,  3:17-cv-07318-MMC (ND Cal. July 17, 2018).

Plaintiffs allege that TTC and Trademark LLC “are among the largest purchasers of online advertising (including Google and Bing) for trademark filing-related search terms/keywords”, and that said entities “purchase[ ] advertisements whenever consumers perform online search[es] of terms related to the practice of trademark filing, including ‘trademark attorney’ and ‘trademark lawyers'[,] with copy that misleads consumers into believing that they will be represented by attorneys or at least will provide the services by lawful means”. According to plaintiffs, TTC and Trademark LLC also “make[ ] false comparisons directly by purchasing keywords that include the term ‘Trademarkia,’ the website through which [LegalForce RAPC] perform[s] only attorney-led trademark filing services, and falsely comparing it with the unauthorized practice of law services of TTC [and Trademark LLC].” (see also FAC ¶ 32.e (alleging TTC and Trademark LLC “use[ ] advertising links that appear to be describing an attorney-led service by bidding on Google Adword keywords such as ‘trademark attorney’ as a bait to attract consumers to click on them, but then direct[ ] these same consumers to [their respective] trademark services provided by nonattorneys”).)

The TTC Defendants and the Trademark Defendants argue plaintiffs have not complied with Rule 9(b). Again, plaintiffs do not argue they have so complied, but, rather, argue Rule 9(b) does not apply, which argument, the Court, for the reasons stated above, finds unpersuasive. Further, plaintiffs have not complied with Rule 9(b), as they fail to identify the “copy” in the “advertisements . . . that misleads consumers”, fail to identify the content of any statement that “falsely compar[es]” LegalForce RAPC’s services with those of TTC and/or Trademark LLC, fail to identify who published the advertisements and made the challenged statements therein, and fail to state when such acts occurred.

Further, to the extent the claim is based on a theory that consumers who, after performing an internet search using terms such as “trademark attorney, “trademark lawyers,” or “Trademarkia” in an effort to locate an attorney, ended up viewing TTC’s website, such a claim, to be cognizable under the Lanham Act, would require a showing that TTC’s website was “likely to mislead consumers” into believing TTC was affiliated with an attorney. See TrafficSchool.com, 653 F.3d at 827-28 (holding defendant website known as “DMV.org” was designed in manner “likely to mislead consumers into thinking [defendant] was affiliated with a government agency”). Here, however, plaintiffs fail to allege sufficient facts to support a finding that such consumers would be likely to believe they were viewing a website operated by attorneys, particularly, given plaintiffs’ acknowledgement that TTC’s website states TTC “is not a law firm and,” that “its trademark filing service is not a legal service,” and that it “may not perform services performed by an attorney.”

Accordingly, to the extent the Lanham Act claim is based on the use of keywords, the claim is subject to dismissal.

* Lasoff v. Amazon.com, Inc., 2018 WL 3720029 (9th Cir. Aug. 6, 2018):

We first turn to the infringement claim. The district court determined that Mr. Lasoff owns a valid and protectable trademark in the term “Ingrass.” Mr. Lasoff argues that Amazon infringed that trademark by purchasing the term Ingrass as part of its keyword advertising program. But we have held that Amazon is permitted to use a trademarked search term to direct consumers to competing products, as long as the search results are clearly labeled. Mr. Lasoff did not provide any evidence that the search results here were not clearly labeled.

At oral argument, Mr. Lasoff argued that Multi Time Machine is distinguishable because it involved competing watches, while Mr. Lasoff’s product is artificial turf. He argued that consumers are more easily confused in the turf market because the products are more similar than the items for sale in the watch market. We disagree. The question is whether consumers are confused by the search results, and those results display the trademarked product names. The display of names in a set of search results is not made more or less confusing simply because the underlying products might be watches or turf.

Mr. Lasoff argued more generally that the law should be different and that most people he talked with agreed with him that what Amazon did was improper. We are not sure that his assertion is correct, but that is an argument that would need to be addressed to Congress. Mr. Lasoff would like to ask a jury to decide what the law should be, but that is not the function of a jury. A jury determines facts, based on the law as it is instructed by the court. Amazon’s use of “Ingrass” in search engine advertising did not violate Mr. Lasoff’s trademark under the law, and a jury could not change that.

Mr. Lasoff also argued that disputed facts should have precluded summary judgment. He noted that, before the district court, he contested the extent of Amazon’s control over its keyword advertising program. According to Mr. Lasoff, this control was relevant to the question of whether Amazon’s use of the Ingrass trademark was a “use[ ] in commerce” for purposes of the Lanham Act. He also noted that he contested Amazon’s argument that it was not liable because the keyword advertising program was “fully automated.” But the district court decided both of those issues in Mr. Lasoff’s favor. Thus, Mr. Lasoff failed to establish the materiality of any purportedly disputed fact.

Finally, we turn to the false advertising claim. Mr. Lasoff’s false advertising claim fails because it was duplicative of his infringement claim. False advertising and infringement are two distinct bases of liability. False advertising claims are based on “false representations in advertising concerning the qualities of goods or services.” Here, Amazon did not make any statements about the quality of Mr. Lasoff’s products.

* Boost Beauty, LLC v. Woo Signatures, LLC, 2018 WL 5099258 (C.D. Cal. Oct. 15, 2018). The following allegation survived a motion to dismiss:

Plaintiff clearly alleges that it owns the trademark “BoostLash®” and that defendants “purchased the Google AdWords ‘Boost’ and ‘Lash,’ and used the words ‘Boost’ and ‘Lash’ together with a space added in between as ‘Boost Lash’ as a search engine advertisement to drive traffic to their website, and sold a same, but competing, product.” In so doing, plaintiff claims that defendants “used, and are using in commerce the confusingly similar ‘Boost Lash’ mark in connection with the promotion, marketing, advertising of eye-lash enhancement products in a manner which is likely to cause confusion.” Plaintiff claims that defendants are confusing consumers into thinking that defendants’ product is associated with plaintiff’s.

* Engineered Tax Services, Inc. v. Scarpello Consulting, Inc., 2018 WL 3899223 (S.D. Fla. July 31, 2018). Competitive keyword ad lawsuit fails when the court concludes that “Engineered Tax Services” is descriptive and the putatitve owner didn’t show sufficient secondary meaning.

If the married couple is legally separated but not divorced, a spouse wishing to adopt does not need spousal consent.

How Do You Pay For Your Adoption Expenses?

All your expenses related to adoption are considered an act of charity. They must be reasonably and clearly related to the adoption. Dollar amounts must also be deemed reasonable. Such as if money is being used to pay for the adoption expenses of the biological parents. What constitutes a reasonable expense? They need to be adoption-related in the form of living expenses, travel, counseling, maternity, medical, or legal expenses. All adoption expenses must be formally reported by the adoptive parents. This has to be done before the final adoption decree is submitted. This report must include all property, gifts, expenses, fees, etc. Anything of value that was received or given relating to the adoption.

In some cases, the judge may appoint another person to take consent. If an agency is granted legal custody by the judge, they may authorize the birth mother’s consent.

Is The Birth Mother The Only Person Required To Consent?

Sometimes, yes. But not in every case. When applicable, here are other people who are required to give consent to legally validate the adoption. • If the birth mother is legally married, the spouse must consent. • If the child is 12 or older (and they have full mental capacity), they must consent. • If, before the birth mother consented to adoption, a man filed a voluntary declaration of paternity, he must consent. • If, before the birth mother consented to adoption, a man was declared by a judge as the biological father, he must consent. • If the birth mother intends to have the child adopted by the unmarried biological father, he must consent. He must also: a. initiate paternity proceedings b. acknowledge his paternity c. agree to develop a substantial relationship with the child d. agree to provide support to the child More Concerning Unmarried Biological Fathers • If the child’s birth was the result of a sexual offense, his consent is not required. • If he fails to initiate paternity proceedings, his consent is not required. • If his declaration of paternity is revoked, his consent is not required. • It is possible for an interested party to petition that the unmarried biological father’s rights be terminated. If the court agrees, his consent is not required. Can There Be A Situation Where Parental Consent Is Not Needed? There are other possible scenarios where parental rights could be previously terminated. In these cases, a teen does not need parental consent to be adopted.

Can The Consent of Birth Parents Become Irrevocable?

Yes. Once it’s signed, it’s irrevocable. A birth mother cannot undo her signed consent.

What Adoption Rights Does An Unmarried Father Have?

Unmarried fathers can file a notice to be notified of adoption proceedings. They must do this through the Office of Vital Records. Yes. Home studies are not approved in every case. In almost all cases where it isn’t, it’s usually because the person has a felony constituting one of the following: • domestic violence • aggravated robbery, burglary, arson, assault • a sex offense • kidnapping • child abuse homicide • manslaughter • child endangerment • disabled child abuse or neglect • domestic violence in the presence of a child • child abuse • drug-related offense

What Is A Post-Placement Study And What Are The Requirements?

It’s an evaluation that happens after the home study and after the final adoption hearing has taken place. The purpose is to provide a final determination that the placement is or isn’t in the best interest of the child. Many prospective parents quickly become overwhelmed with each of the avenues of adoption and confused about which ones they qualify for. Many states allow adult adoption, where an adult legally adopts a younger adult as his or her child.
