With the Indian Child Welfare Act (ICWA), which has kept Native children from being purposefully removed from Native families into non-Native foster families since 1978, being reevaluated in the US Supreme Court, it is at risk of being greatly weakened and undoing decades of work to stop the systematic erasure of Native cultural identity.
(It may also re-designate the term "Indian" in the bill to mean a racial classification rather than political, reversing precedent with regard to tribal sovereignty. Native tribes must remain independent entities in the law rather than just a race to protect their rights to self-governance.)
The Lakota People's Law Project is asking US citizens to ask their state lawmakers to enact similar legislation at the state level which codifies the rights and protections ICWA gives to Native children should it be weakened in the Supreme Court. This is not protection for the ICWA itself, although they do have action you can take for that on their website as well. In the link is a pre-written email which you can personalize and easily send to your state lawmakers.

The Protect ICWA Campaign was established by four national Native organizations: the National Indian Child Welfare Association, the National Congress of American Indians, the Association on American Indian Affairs, and the Native American Rights Fund. Together, the Campaign works to serve and support Native children, youth, and families through upholding the Indian Child Welfare Act. The Campaign works to inform policy, legal, and communications strategies with the mission to uphold and protect ICWA.
The Indian Child Welfare Act (#ICWA) was put in place over 40 years ago to curb generations of harm resulting from the targeted assimilation of Native kids. On November 9th, it is being challenged in front of #SCOTUS, in Haaland v. Brackeen. @protecticwa invites families, leaders, singers, dancers, traditional practitioners, elders, knowledge keepers, youth, and allies to join them as they respectfully demonstrate support for ICWA at the Supreme Court on November 9th, the day of oral arguments for Haaland v. Brackeen. If opponents succeed in dismantling ICWA, they will have cleared the way for a larger attack on Native families, Native land, and tribal sovereignty. We all must stand up for ICWA.

As Thanksgiving approaches, many people think about the terrible way that sellers stole Native land and displaced their families. But did you know the harm continued for years afterwards? First, many indigenous people were taken by the government and put into boarding schools where they were forced to hide and remove all visible elements of their cultures. They were banned from speaking their languages, denied their stories and history, and punished for any expression of their culture. But the harm continued even after that. In the generations afterwards, the government took a more subtle, but just as harmful approach. Citing neglect or child abuse (often just poverty), it removed countless Native children from their homes and placed them with families with no connection to their culture. So many children have been denied their heritage, their language, their communities through these acts. Thankfully, when the Indian Child Welfare Act (ICWA) was passed, it guaranteed that if children needed to be removed from their living situation, they would be placed with other family members or community members from their tribe. This act, preserving culture while keeping kids safe, has been shown to be one of the most effective child welfare acts that exists. But it is under attack right now. Share the stories of Indigenous adoptees, survivors of residential schools, and the families involved in Brackeen v Haaland

Educate yourself on Tribal Sovereignty, residential schools and the 60s scoop, and cultural genocide as a tool of genocide.
Educate yourself on MMIP/MMIWG2S and familiarize yourself with the tactics those against Tribal Sovereignty use to undermine us.
Learn exactly who is fighting to get rid of ICWA and why. Hint: Gibson Dunn (representing the Brackeens) is the same law firm that supported the Dakota Access Pipeline (DAPL) Now I wonder who benefits from slowly but surely removing Indigenous people from our lands? 🤔

hey y'all- i just wanted to remind everyone Friday Nov 25th is Native American Heritage Day in the united states, and that
**there is a case in the u.s. supreme court (brackeen-v-haaland) which directly affects the rights of native americans and their tribal sovereignty. **
The Indian Child Welfare Act pushes for Native children to be adopted by Native families. .... When it was passed in 1978, ICWA was landmark legislation, setting unprecedented protections to address the assimilationist policies that led to state child welfare and private adoption agencies systematically removing almost a third of all American Indian and Alaska Native children from their homes. (Yes, almost a third; you read that correctly.) Eighty-five percent of those children were placed in non-Indian homes. ICWA’s constitutionality is now being challenged in a lawsuit [Brackeen v. Haaland] brought by Texas, Indiana, Louisiana and various individual plaintiffs. It is the first time a state has sued the federal government over ICWA’s constitutionality. X

today the supreme court will hear arguments opposing ICWA from this white evangelical couple, who claim it to be a form of racial discrimination. and if the court rules in favor of them, the consequences will be devastating for both native families and tribal sovereignty.
historically speaking, our cultures, traditions, languages, and children have been stolen from us. we cannot allow for this to happen once again.

the empty rituals of a dying empire are so exhausting. I wrote I don't celebrate genocide on my hands and worked an eight hour shift at a grocery store today. I gotta find something better that's not trapped in christofascist hegemony. but like even people I know saw that on my hands wished me a happy holidays or a happy thanksgiving quote unquote. Can they not put two and two together or was it deliberately spiteful. There's nothing happy or holy about this nightmare. Trying to say so literally brings me to tears. Or do they truly think this has nothing to do with genocide or colonialism. Some old customer saw my hands and figured out that I was saying celebrating thanksgiving is celebrating genocide and took back wishing me a happy one and just said that they hoped I would have a good day regardless. It was like the one and only interaction about it I had. I'm such a coward. I want a more explicit anti usa or anti colonial shirt I guess, scribbling on the hands is too easily ignored by most I guess. Having writing or images speak for me is nice, I have such anxiety. I hate being here and collaborating and compromising with the nightmare. I mostly let each wish slide away with no comment to at least try to make it pointedly awkward that I clearly don't celebrate it but ugh. I've been putting "linktr.ee/ProtectICWA" on a lot of the papers we give customers thru the quote unquote pick up department, hoping someone would look it up and care and do something. Idk. I hate christianity, I hate capitalism. I'm so shocked at the filters and glasses and tunnels everyone has for this nightmare. They ignore the screams of terror and torture... the spectacle overpowers their senses and desensitizes them. grocery stores are such a significant part of the spectacle of colonialism it's fucking ridiculous. they substantiate collect and legitimize the nightmare. so many fascists and or old coots come here to feel safe, you can tell.

Today, the Supreme Court will hear a challenge to the #ICWA. Don't be confused, dismantling this law would be dismantling a protection against ongoing colonialism and genocide. This is a continuation of the legacy of cultural destruction, forced assimilation and more.
Indigenous children deserve protection. Indigenous children deserve to be allowed to be Indigenous. Indigenous Nations deserve sovereignty over their own people and culture. The silence around this issue is complicity. #ProtectICWA
