To hear Donald Trump tell it, America’s cities are in dire shape and in need of a federal intervention. “We’re going to rebuild our cities into beacons of hope, safety and beauty – better than they have ever been before,” he said during a recent speech to the National Rifle Association in what has become a common refrain on the campaign trail. “We will take over the horribly run capital of our nation, Washington DC.” Trump has for years railed against cities, particularly those run by Democratic officials, as hotbeds for crime and moral decay. He called Atlanta a “record setting Murder and Violent Crime War Zone” last year, a similar claim he makes frequently about various cities.
His allies have an idea of how to capitalize on that agenda and make cities in Trump’s image, detailed in the conservative Project 2025: unleash new police forces on cities like Washington DC, withhold federal disaster and emergency grants unless they follow immigration policies like detaining undocumented immigrants and share sensitive data with the federal government for immigration enforcement purposes.
Project 2025’s Mandate for Leadership: The Conservative Promise, an extensive document breaking down each part of the federal government and recommending changes to be made to advance rightwing policy, was created by the Heritage Foundation, with dozens of conservative organizations and prominent names contributing chapters based on their backgrounds. This part of the project is another Republican attempt at a crackdown on so-called “sanctuary” cities, places around the country that don’t cooperate with the federal government on enforcing harsh immigration policies.

The threat of withholding federal funds
Republicans, cheered on by Trump, have worked to make immigration a key issue in cities across the country by busing migrants from the US-Mexico border inland, to places run by Democrats like New York, DC and Chicago, overwhelming the social safety net in these cities. The idea of using federal funds granted by the Federal Emergency Management Agency (Fema) to force immigration changes are included in a chapter about the Department of Homeland Security, written by Ken Cuccinelli, Trump’s former deputy secretary of homeland security.
The chapter’s initial recommendation is to dismantle DHS entirely, create a border-focused agency comprised of other immigration-related organizations and farm out the rest of its components to existing agencies (or privatize them, in the case of the Transportation Security Administration). It’s not directly clear whether the aim is to use all Fema funds – including those that help cities and states in the immediate aftermath of an emergency like a tornado or flood – or large grant programs for things like emergency preparedness. One line in the chapter says “post-disaster or nonhumanitarian funding” could be exempt from the immigration policy requirements. The chapter also suggests that cities and states should take on more of the burden of financially responding to disasters.

One of the conditions Project 2025 suggests is requiring states or localities to share information with the federal government for law and immigration enforcement, and specifies that this would include both department of motor vehicle and voter registration databases. This is of particular interest in many cities because 19 states and Washington DC allow undocumented people to get drivers licenses, the Niskanen Center, a thinktank that delved into the project’s immigration aims, points out. These licenses help with public safety by decreasing the potential for hit-and-runs and increasing work hours, among other benefits, the center writes. If a city or state is forced to choose between issuing licenses and then sharing this information for use by immigration authorities, or accessing emergency funds for their whole population in a crisis, it’ll be tough for them to deny Fema money, said Cecilia Esterline, an immigration research analyst at the Niskanen Center.
Donald Trump’s war on urban cities is part of the wretched far-right Project 2025 plan, including crackdowns on sanctuary cities.

"Homeland Security Investigations (HSI) returned an impressive collection of dinosaur fossils to Mongolia’s Ambassador to the United States, Batbayar Ulziidelger, at a ceremony at the Library of Congress on Aug. 3. The fossils were recovered through HSI investigations conducted by our offices in Arizona, New York, and Wyoming, and the collection was represented by a tyrannosaurus bataar skull, protoceratops fossil, alioramus skull, and saurolophus skull. The alioramus, which resembles a smaller version of a tyrannosaurus rex, is exclusively found in Mongolia – the source of many, extremely rare fossils. The specimen on display at the ceremony is considered one of the best-preserved fossils ever found of the dinosaur that lived approximately 70 million years ago.

“Today’s event is dedicated to acknowledge the solid contributions of the officers and special agents from Homeland Security Investigations, U.S. attorneys, judges, scientists, and all individuals present here at ceremony as well as those who are absent due to their duty, who made this day possible,” said Ambassador of Mongolia Batbayar Ulziidelger. “This ceremony is a testament to the strong partnership between the Government of Mongolia and the Unites States and we are fortunate to witness the first-ever public display of these Mongolian dinosaur fossils.” “We have gathered here to witness the return of dinosaur fossils from the United States to their homeland – Mongolia; these fossils, once lost to time and distance, now find their way back to the land, where they were first discovered,” said Minister for Foreign Affairs of Mongolia Battsetseg Batmunkh. “The remarkable journey of these artifacts demonstrates the strength of collaborative diplomacy and a solid dedication to preserving our cultural heritage. I am delighted to acknowledge the valuable contributions of law enforcement officers and special agents, agencies, attorneys, judges… our collective efforts demonstrated the potential to effectively fight illegal smuggling, both bilaterally and multilaterally.” The first of these cases began in May 2012 when HSI New York initiated a cultural property investigation after receiving information alleging the illicit sale of protected fossils by a U.S.-based auction house. The investigation revealed that an individual, who later pled guilty to criminal counts of illegal importation of dinosaur fossils, was selling a fossilized alioramus skull through the auction house; that skull is part of the collection being returned. That same year, HSI Casper, Wyoming office received an HSI Tip Line report that a retail store was selling a fossilized tyrannosaurus bataar skull. HSI Casper began its investigation relating to the illegal importation and subsequent sale of dinosaur fossils originating from Mongolia, which has strong patrimony laws that prohibit the export of prehistoric fossils. These investigations led to multiple seizures of a wide range of paleontological fossils illegally taken from their country, including:a rare juvenile tyrannosaurus battar skull; a fossilized gallimimus skeleton; a tarbosaurus bataar skeleton; nests of dinosaur eggs; a saber-toothed cat skull; a complete psittacosaurus skeleton; and a protoceratops skull. Some of these dinosaurs lived more than 100 million years ago in an area now known as the Gobi Desert."

from the article: After Governor Kathy Hochul proposed ending the paid sick days that New Yorkers infected with COVID-19 have been guaranteed since the beginning of the pandemic, a budget deal with the state legislature agreed to the change but pushed back the date of the repeal to next year.
But the state has stripped away COVID sick leave from its own employees, effective immediately. The state's Office of Employee Relations informed executive agencies in March that the hundreds of thousands of New Yorkers who work for the state would no longer get additional COVID-specific sick days.
"The decision to circumvent state law makes all employees and the public that has to interact with us less safe," said one state worker, who asked for anonymity because they aren’t authorized to speak to the press. "The government should be leading by example here and making it easier for state employees to stay home when infectious with COVID to avoid making others sick."

The Revolving Door Project on Monday released a set of reports on corruption and mismanagement in executive agencies during the Trump presidency, calling on the media to focus on presumptive Republican nominee Donald Trump’s poor governing record as he campaigns to retake the Oval Office.
The new reports, called “retrospective memos,” show that Trump’s executive branch was rife with cronyism and corporate influence from 2017 until 2021. RDP, a watchdog group focused on the executive branch, released the reports as a way to fight “Trumpnesia” and focus the political discussion on the governance records of Trump and President Joe Biden, a Democrat seeking reelection.
“Donald Trump’s most important legacy as president wasn’t what he said, or even what bills he signed, but how he turned the federal government into a favor machine to benefit his family and cronies,” Jeff Hauser, RDP’s executive director, said in a statement. “The media should not focus on the aesthetics of this week’s presidential debate but rather cover the Biden vs. Trump election as a comparison between how each president administered the immensely important executive branch.”
“It’s important to revisit how poorly he ran the executive branch his first time round.”
RDP issued eight memos, covering disaster management, the environment, financial regulation, housing, immigration, labor, education, and transportation.
Each provides evidence of a Trump administration that was “utterly indifferent to the public interest,” as Timi Iwayemi, RDP’s research director, said in the statement.
In many cases, Trump appointees were hostile to the original aims of the agencies they served.
Mick Mulvaney, Trump’s choice to lead the Consumer Financial Protection Bureau, tried to roll back rules limiting predatory payday lending—a practice that “preys on the working poor,” the financial regulation memo says.
Mulvaney—who’s now suggesting a “revenge-a-thon” against Trump’s foes—also appointed political cronies and failed to undertake the enforcement actions against companies that were the CFPB’s raison d’être. A 2019 feature in The New York Times Magazine was titled, “Mick Mulvaney’s Master Class in Destroying a Bureaucracy From Within.”
Trump’s National Labor Relations Board was led by Peter Robb, a management-side lawyer who was the Reagan administration’s lead attorney on litigation dealing with the air traffic controllers’ strike of 1981, in which the federal government fired about 11,000 workers and banned them from being rehired. Like Trump’s Department of Labor, which was ultimately run by the son of former Supreme Court Justice Antonin Scalia, the NLRB under Robb was pro-management—and reportedly dysfunctional.
Other federal agencies were hardly more committed to serving the public interest in the late 2010s.
“Trump’s Interior Department advanced the interests of extractivist industry on public lands while refusing to account for how its actions would worsen climate change,” according to RDP’s environment memo. “The Trump administration auctioned off over 10 million acres of land and water to oil and gas drilling, including by drastically reducing the size of national monuments like Bears Ears in Utah, a sacred homeland to five tribal nations, in order to open them up to development.”
The Department of Housing and Urban Development, run by former presidential candidate Ben Carson, was plagued by “handouts to friends and family,” a series of “deadly budget cut proposals,” and a “war on fair housing,” according to the RDP’s housing memo.
Trump’s disaster management choices were particularly consequential. The Federal Emergency Management Agency ” horrifically” mismanaged the response to two consecutive hurricanes that hit Puerto Rico in 2017, which got minimal—and very delayed—relief compared to Texas communities that were hit by a hurricane during that period.
RDP’s catalog of Trump administration failures is designed to clarify the stakes of the 2024 election.
“The series serves as a reminder to the public that the president’s primary responsibility is to direct the vast apparatus known as the executive branch of the federal government,” RDP said. “Sadly, former president Donald Trump either neglected this responsibility or wielded it in favor of corporations throughout his four years in office.”
Iwayemi said “Even as current conversations wisely focus on Project 2025 and Trump’s promise to leverage executive power to harm political enemies, it’s important to revisit how poorly he ran the executive branch his first time round as a cure to the public’s apparent Trumpnesia.”

Usually, you know something was a hate crime because the perpetrator yelled a racist slogan or told the police he was motivated to attack the victim because of the victim’s race or religion. Sometimes, the attacker’s social-media accounts contain racist writings.
But in this case, according to author Rozina Ali, it was the exact opposite.
With regard to the Oct. 7 pogrom perpetrated by Hamas in southern Israel that killed 1,200 men, women and children, here’s what the “anti-Palestinian” Eaton wrote on X on Nov. 16: “What if someone occupied your country? Wouldn’t you fight them?”
Although Ali quoted only one of Eaton’s posts, there was at least one more in the same vein. This is what Eaton tweeted on Oct. 17 (which was quoted by the Vermont-based news agency Seven Days on Dec. 6): “The notion that Hamas is ‘evil’ for defending their state from occupation is absurd. They are owed a state. Pay up.”
That crashing sound you hear is the shattering of the myth that the Vermont shooting was Islamophobia. No wonder the police have not charged Eaton with a hate crime: his social-media accounts clearly indicate he is a supporter, not a hater, of the Palestinian Arabs. Ali and others have reported that Eaton has a long history of personal problems. That would seem to be what was behind this crime.
But that didn’t fit the narrative that Palestinian advocates prefer. So, as long as that critical information was confined to the local Vermont press, they could keep claiming that the shooting was “anti-Palestinian hate.” Now the jig is up. It has been acknowledged by The New York Times.
This matters because the fight for public opinion regarding Israel’s war against Hamas in the Gaza Strip revolves around the question of sympathy. In the immediate aftermath of the Oct. 7 mass murders, most of the public’s sympathy was with Israel. But after months of nonstop biased media reporting, some Americans’ sympathies have shifted.
The attention being paid to rising antisemitism creates sympathy for Jews and, by extension, for Israel. Supporters of the Palestinian Arabs want to reduce that sympathy, by claiming that they, too, are the victims of bigotry.
Statistics about hate crimes show that antisemitism is on the rampage, while Islamophobia is minuscule. That reality is bad for the Palestinian cause. So, advocates seize every opportunity to claim that some incident was anti-Arab or anti-Muslim.
Last November, an Ohio man named Hesham Ayyad claimed a driver yelled “Kill all Palestinians!” and “Long live Israel!” at him and then ran him over. The Council on American-Islamic Relations (CAIR) and similar groups yelled “Hate crime!” But security footage showed Ayyad and his brother got into a fistfight on that street corner, which is what caused his injuries. Ayyad has been charged with lying about the incident. CAIR still won’t admit that it was a hoax.

Aug. 20 (UPI) -- The U.S. intelligence community said Monday that Iran was behind a recent hack of Donald Trump's presidential campaign and efforts to infiltrate the presidential campaign of the Democratic Party.
The confirmation came in a joint statement from the FBI, the Office of the Director of National Intelligence and the Cybersecurity and Infrastructure Security Agency as the presidential race nears the general election on Nov. 5 when the U.S. public will choose between Trump and Vice President Kamala Harris for president.
The agencies have warned during the election cycle that Iran was employing efforts to influence the presidential contest, and on Monday said they have "observed increasingly aggressive Iranian activity" targeting the U.S. public and the two presidential campaigns.
"This includes the recently reported activities to compromise former President Trump's campaign, which the IC attributes to Iran," the security agencies said in the brief statement.
"The IC is confident that the Iranians have through social engineering and other efforts sought access to individuals with direct access to the presidential campaigns of both political parties."
The agencies said Iran's intent was "to influence the U.S. election process."
The statement confirms reports the Trump campaign on Aug. 10 said some of its internal communications had been pilfered by foreign sources. The campaign was reportedly infiltrated through a spear-phishing effort targeting a high-ranking official in Trump's campaign.
A spear-phishing attack attempts to steal sensitive information from gaining access to a computer system through sending messages that are spoofed to appear legitimate, according to the DNI.
Days later, the Harris' presidential campaign said it was warned by the FBI it had also been targeted.
The statement from U.S. intelligence community did not elaborate on the attacks but said Iran and also Russia has employed these tactics not just in the United States during this and prior federal election cycles but also worldwide.
"Iran seeks to stoke discord and undermine confidence in our democratic institutions," the agencies said.
"Iran has furthermore demonstrated a longstanding interest in exploiting societal tensions through various means, including through the use of cyber operations to attempt to gain access to sensitive information related to U.S. elections."
Iran has denied the allegations through its mission in the United Nations. In a statement to The New York Times, it said: "The Iranian government neither possesses nor harbors any intent or motive to interfere in the United States presidential election."

On June 13, 1942, President Franklin D. Roosevelt issued Executive Order 9182, consolidating a number of different government information offices into the Office of War Information (OWI). The mission of the new agency was to gather public information and to spread it across the U.S. and abroad through the press, radio, motion pictures, and other media. Its aim, in the middle of World War II, was to develop “an informed and intelligent understanding, at home and abroad, of the status and progress of the war effort and of the war policies, activities, and aims of the Government.”
The United States had experimented with a government information bureau during World War I. After the U.S. declared war on Germany on April 6, 1917, the Secretaries of State, War, and the Navy asked the president to create a Committee on Public Information (CPI) to unify Americans behind the war. They had watched as artists whipped up enthusiasm for enlisting to fight the Germans as early as 1915, with the sinking of the Lusitania, and wanted to create a similar shared experience over the war itself.
On April 13, 1917, President Woodrow Wilson created the committee through an executive order, then put newspaperman George Creel in charge of it. Creel had organized a committee of friendly newspapermen to promote Wilson's reelection in 1916. Strongly opposed to the idea of government censorship during the war, he instead promised to create an agency that, as he later wrote, would use “every possible media…to drive home the justice of America’s cause. Not to combat prejudices and disaffection at home was to weaken the firing line.” The CPI set out to reach every person in the U.S. by flooding the media zone with pamphlets, newspapers, posters, films, and short speeches given by so-called Four Minute Men, local figures who embellished talking points handed out by the CPI.
In 1940 the Council on Foreign Relations, a nonpartisan foreign relations think tank in New York City that had grown out of Wilson’s internationalism, published a book by Harold Tobin and Percy Bidwell titled Mobilizing Civilian America. It set out plans for putting the nation’s manufacturing and military on a war footing. It also noted that in the modern world, in which war was often about domestic production as much as numbers of troops, “victory may depend not so much on the skill of generals or the fighting quality of their troops, as on the loyalty and stamina of the men and women on the home front.” 
With that in mind, the authors examined the Committee on Public Information and concluded that while the committee had done brilliantly at informing the public of the facts, the Four Minute Men and other local writers during World War I had spread “hysterical and fanatical outbursts,” sometimes in connection with bond drives, that had whipped up communities against their foreign-born neighbors and other alleged “spies in our midst.” After the war, Americans were so disgusted by their own campaign of hatred and violence against German-Americans, the authors wrote, that they were hugely resistant to anything they saw as propaganda. 
Nonetheless, the authors said, if the U.S. got involved in another war, the government must be prepared for a public relations campaign. In such a case, they said, it was crucial for the government to make sure it stuck firmly to the truth and did not permit the kind of freelancers whose extreme rhetoric had hurt the CPI. 
That advice seemed prescient in the months after the bombing of Pearl Harbor ushered the U.S. into World War II. Information came from different departments and bureaus, but no one seemed to be explaining what America’s goals were or what it was doing to achieve them. FDR was reluctant to set up an agency that his political opponents would charge was a propaganda outlet, but gradually he greenlit small agencies to explain the war to the country. 
In June 1942, FDR pulled those agencies together as the Office of War Information, putting popular news commentator Elmer Davis in charge. Davis vowed to focus not on building morale but on delivering news that would enable people to understand what was at stake. OWI officials were chagrined to learn that in summer 1942 almost a third of Americans said they did not know what the country was fighting for, while Representative Joe Starnes (D-AL), for example, complained, “I think it is an insult to the intelligence of the American people to say that we do not know why we are fighting.” 
In the three years it operated, the Office of War Information created radio programs that explained to Americans which nations were at war and why and others that portrayed life on the home front, and film documentaries about Japanese American incarceration, military training, and so on. Overseas, the OWI established the Voice of America, which is still the official U.S. international broadcasting service, as well as running secret radio stations and disseminating propaganda to harass enemy forces in combat zones. The OWI also examined scripts for Hollywood movies—1,652 of them before the war ended—to make sure they supported the Allies’ mission. 
The OWI ran into trouble quickly as reporters determined to explain facts were overridden by advertising men who wanted to sell the war with positive stories, and both were often tripped up by military leaders who withheld information, especially negative stories, for “public safety.” By 1944, OWI operated mostly overseas, as FDR’s opponents insisted its domestic efforts were designed to help him politically. In September 1945, with the war over, president Harry Truman ended the OWI by executive order after congratulating it for its “outstanding contribution to victory.”
In the years to come, especially after the government’s disinformation regarding the Vietnam War, the idea of government propaganda fell into even more disrepute in the United States than it had in the aftermath of World War II, as the excesses possible under someone like the chief propagandist for Germany’s Nazi Party, Joseph Goebbels, became clear. 
But we have been far less guarded against the ways in which other actors shape public opinion. 
In February, cyber experts said that Russia was already spreading disinformation to influence the 2024 election, and in April, Senator Mark Warner (D-VA), the chair of the Senate Intelligence Committee, warned that the U.S. is more susceptible to Russian influence operations than it has ever been, despite the understanding of the importance of Russian influence operations on the 2016 election. “With polarization in this country, and the lack of faith in institutions, people will believe anything or not believe things that come from what used to be viewed as trusted sources of information,” Warner told Julian E. Barnes of the New York Times. “So there’s a much greater willingness to accept conspiracy theories.” 
Also in April, Microsoft said it had uncovered fake social media profiles run by Chinese operatives to destabilize U.S. politics, and in May, TikTok said it took down thousands of accounts from fifteen covert influence operations in the first four months of 2024. Last week, NewsGuard reported on a network of 167 Russian disinformation sites fronted by a former deputy sheriff from Florida.
On June 6 the State Department’s top official on digital and cyber policy, Nate Fick, told an audience: “I don’t think most American citizens really viscerally understand how much of the content they see on social platforms is actually a foreign intelligence operation…. I just don’t think we viscerally get how much of what we see is bot-generated or foreign intelligence service–generated.”
Today, officials from the Office of the Director of National Intelligence (ODNI) told lawmakers that Russian influence operations aimed at undermining support for Ukraine and faith in democratic institutions provide the top threat to the upcoming U.S. election. China is the second-greatest threat but is more cautious because it is concerned about U.S. blowback, while the third, Iran, acts primarily as a “chaos agent,” trying to confuse voters. The ODNI officials said they have been issuing warnings to political candidates, government officials, and others targeted by foreign groups. 
Senator Angus King (I-ME) urged Director of National Intelligence Avril Haines to make threats known to the public. “I’m worried that you may be overly concerned with appearing partisan and that that will freeze you in terms of taking the actions that are necessary,” he said. “Please ramp it up. We’ve got about six months and...we know that these adversaries are going to be coming at us.”
The modern propaganda flooding the U.S. portrays us as bitterly divided along lines of race and gender, religion and ethnicity. In contrast to this version of America is the one portrayed during World War II by the OWI documentary photography unit. Photographers who had been moved into the agency from the Farm Security Administration documented war work, women in the factories, and civil rights struggles, including those of the incarcerated Japanese Americans as well as Black and brown Americans, showing them at work or in their small towns or cities. The images were of ordinary Americans, often singled out as heroic individuals in their own frames, to represent the American people as a whole. 
And these images were some of the most lasting and vital elements of the OWI’s work. If the hero of the military was the ordinary soldier, the G.I., as newspaper reporters wrote, the hero of the home front was the ordinary American who, in order to make sure that the G.I. had supplies, went to work in a factory or on a farm. 
That image was central to the shaping of postwar America.

Flynn helps on cases when he can, especially at night when Calli is running through ideas and theories. He listens and offers his thoughts. He loves seeing how invested she is in the community and that she doesn't see any cause as "too little".
Kate wants to be a detective, but she hasn't quite mastered the art of subtlety yet plus with the baby Calli feels it's not the right time. However, Kate insisted she make the agency's official cupcake flavor: lemon (for light) - blueberry (for the sea) cupcake with vanilla frosting with gold dust and a white chocolate lighthouse
Naomi helps quite a bit when she is off duty and sometimes when she is on duty (🤫 ). She and Calli grow very close through the cases.
Grant doesn't have a lot of time to help, but he offers legal services to Calli for anything she needs to help

The government seizes a lot of the Sterling's finances, but with what's left over she keeps a modest amount for her daughter and donates the rest to the workers at the docks who's back the town was built on.

Dear Mr. Chairman:
On May 7, following the much - discussed television
appearance of Mr. Cyrus Eaton on the Mike Wallace show, I
made a speech at Hunter College in New York City in which I
commented on Mr. Eaton's charges against the security agencies
of this country. Enclosed is a copy of that part of the speech
dealing with the Eaton matter which I inserted in the Congressional
Record on May 12, entitled "Aid and Comfort to the Enemy."
Subsequently on May 15 I wrote you, sending
copies to the other members of the  Committee
on Un-American Activities,
stating that in my opinion the Committee had no alternative except
to call Mr. Eaton and ask him to tell us what information he had
to support his charges against the security agencies of this
country, including the Federal Bureau of Investigation.
   It has been pointed out that Mr. Eaton had a perfect right
under our Constitution to make whatever attack he saw fit against
these agencies even though because of his prominence such charges
were used by the Communist propaganda apparatus all over the
world to the detriment of the United States. It has been made
clear that, if there is any basis for Mr. Eaton's charges, then
our Committee has the duty under its charter and under the rules
of the House to investigate the operation of any agency in the
executive branch which would be operating in the manner suggested by
Mr. Eaton, and , if his charges were sustained by the evidence, to
recommend to the House the necessary legislation to correct such
practices.

While, as I stated, Mr. Easton has the right to say what he pleases, the Congress and its Committees, also have the right to let the people who have been influenced by his statements know the facts, whatever they might be. Mr. Eaton should also have the opportunity to explain to the American people if there is any relation between the charges he has made against the agencies of this government and his frequent and intimate associations with the very top officials of the Russian government.
The charter of our Committee charges us with investigating propaganda harmful to the United States. The Congress and the people are entitled to know whether or not Mr. Eaton's Communist associates are furnishing him with any information on which he bases his charges against agencies of the government of the United States.
There is no question in my mind that Mr. Easton is a loyal American; however, you and I, as the result of our experience on this Committee, know full well that one of the successful techniques of the Communist apparatus is to use, whenever it can, prominent but often misguided loyal Americans to help promote Russian policy. This, as you know, has happened time and time again, as disclosed by an over-abundance of evidence in the record of our hearings.
Nothing that happened at the meeting in my office on Wednesday, June 11, has caused me to change my mind one iota about the necessity of calling Mr. Eaton, particularly since he saw fit to have dinner at the Russian Embassy the following night. This meeting with the Russian Ambassador was apparently more satisfactory and amiable than the one the preceding day with the representatives of the Congress.
I respectfully recommend that you call a meeting of the Committee at the earliest possible time so that a time and place can be set for Mr. Eaton's appearance.

The far-right domination of the U.S. Supreme Court has rightly drawn public scorn and outrage over its draconian rulings on reproductive health, voting rights, and gun laws as well as other extremist decisions. Their repeated handouts to corporate interests—from public regulatory protections to worker and union rights—must also be viewed in tandem with the threat to democracy and the public interest.
Its ruling Thursday on behalf of Starbucks, overturning an injunction to reinstate seven Memphis Starbucks workers fired for union organizing in 2022, marks another step to erode hard won labor law protections for unions and workers.
As the New York Times reported, workers, who called themselves the "Memphis Seven," said that they were fired for their unionization efforts and that the company didn’t typically enforce the rules they were accused of violating. The National Labor Relations Board found that Starbucks had violated federal law by engaging in protected “concerted activity” which led to a federal judge ordering their restitution.
In response, AFL-CIO President Liz Shuler rightly noted the court had “sided with corporate power… in a direct attack on the fundamental freedom to organize a union on the job. The NLRB exists to resolve labor disputes and ensure workers can exercise our right to join a union, free from intimidation and retaliation. The board obtained an injunction in federal district court to reinstate the Memphis Seven while deciding the case. The system worked as it is supposed to—until the Supreme Court got involved.”
The court "sided with corporate power… in a direct attack on the fundamental freedom to organize a union on the job."
Similarly, Starbucks Workers United President Lynne Fox noted that “working people have so few tools to protect and defend themselves when their employers break the law. That makes today’s ruling by the Supreme Court particularly egregious. It underscores how the economy is rigged against working people all the way up to the Supreme Court.” Starbucks workers, Fox added, “are continuing to organize…Workers’ momentum is unstoppable and they will not let the Supreme Court slow them down.”
In its decision, the Court majority held that the NLRB was imposing a stricter standard than other agencies requiring a finding of “irreparable harm” for a preliminary injunction, not just “reasonable cause” that that the case would ultimately be won.
Section 10(j) of federal labor law was added under the infamous 1947 Taft-Hartley Act as an amendment to the1935 National Labor (Wagner) Act while implementing multiple impediments to undermine the 1935 NLRA. It permits the National Labor Relations Board (NLRB) to seek an injunction to prevent irreparable harm while the NLRB’s administrative processes determines whether a violation has occurred. But there was also a consequence of a lengthy legal process for workers seeking justice while battling intransigent employers.
The Court decision was 8–1, with a dissenting concurrence by Justice Ketanji Brown Jackson. She accepts the majority position that a “regulatory enactment” must meet a “clear and valid legislative command” for “equity relief” in ascertaining “congressional intent” of the Taft-Hartley statute for issuing an injunction. But in a textbook analysis, Jackson rightly explains what is so fundamentally wrong with the ruling.
“To put it bluntly,” Justice Jackson writes, “courts exercising their equitable discretion amidst labor disputes today do so against the backdrop of an ignominious history of abuse.” The NLRA she notes, was directly enacted to “eliminate the causes of certain substantial obstructions to the free flow of commerce” by protecting workers’ rights, codifying the right of workers to form and join unions, collectively bargain, and to strike. It’s a valuable reminder.
To address rampant employer abuses against those rights, Congress did not “leave it up to the courts” to protect those rights, but specifically “created an expert agency, the (NLRB) to investigate, adjudicate, and stop unfair labor practices.” However, “delay in vindicating labor rights during the ‘notoriously glacial’ course of NLRB proceedings can lead to their defeat.”
In the Starbucks case, the employer fired members of the organizing committee in February 2022, “just as a campaign for unionization was building momentum,” and the case remains pending “now more than two years later.” It was precisely “to respond to situations such as this one,” says Jackson, that Congress “gave the Board specific power to seek preliminary injunctive relief” with a 10(j) preliminary injunction.
And, she adds, “there is broad consensus about why Congress allowed the Board to seek §10(j) injunctions.” The Senate Report on Taft-Hartley stated:
“Time is usually of the essence in [labor disputes], and consequently the relatively slow procedure of Board hearing and order, followed many months later by an enforcing decree of the circuit court of appeals, falls short of achieving the desired objectives — the prompt elimination of the obstructions to the free flow of commerce and encouragement of the practice and procedure of free and private collective bargaining. Hence we have provided that the Board, acting in the public interest and not in vindication of purely private rights, may seek injunctive relief in the case of all types of unfair labor practices.”
In fact, 10(j) injunctions are exceedingly rare, as Jackson adds. Of some 20,000 unfair labor practice charges filed last year, the NLRB only sought a 10(j) injunction 14 times. In contrast to the majority decision arguing a 10(j) should only be issued when there is conclusive evidence the union will ultimately prevail in the final decision, Jackson concludes, that “means that, by the time the district court gets a (rare) §10(j) request, the Board has already deemed an unfair labor charge likely meritorious, and has determined that preservation of the status quo is needed to facilitate its own likely judgment.”
The current Supreme Court and judges appointed by Trump in his first term, and his commitment to appoint many more if he wins again. It is an important reminder of why the presidential election in November is critical for worker’s rights.
Historically, the “irreparable harm” is more often to a union’s campaign to win a fair collective bargaining agreement more than just re-instating workers fired for union organizing. Employers know full well they can exploit the delays baked into what Jackson calls the “glacial” legal hurdles allowing them to stall, delay, and sabotage bargaining for years even after a union has won an organizing election in the face of massive union busting by employers and the millions of dollars they spend on anti-union campaigns.
For decades under every Republican president, the NLRB has been stacked with management attorneys who protect corporate interest not workers and their ability to form unions to improve their lives and their workplace conditions. The current NLRB, with a pro-worker, pro-union majority appointed by President Biden reversed that trend, replacing the hostile management attorneys appointed by ex-President Trump.
That’s why the Washington Post reports, “legal experts say the decision could have a chilling effect on union drives during a period of heightened labor activism.” Further, the decision could fuel an increasing reluctance of NLRB Regions to even consider efforts to seek 10(j) relief, thus effectively chilling the exercise of rights purportedly guaranteed by the NLRA.
Rutgers University labor law professor James Cooney tells the Post, “this could hurt unions from obtaining relief through the board, particularly if you have a district court judge who doesn’t know labor law or quite frankly is a real conservative and is going to always back the business.”
In other words, the current Supreme Court and judges appointed by Trump in his first term, and his commitment to appoint many more if he wins again. It is an important reminder of why the presidential election in November is critical for worker’s rights, and why real legislation, such as the Protecting the Right to Organize (PRO Act) bill, is essential to redress the injustices of decades of anti-union neoliberal policies.
