Lallybroch: copyright vs. trademark

An excellent question was asked by our friend @rosfrank in the comments thread to 'The door faces North' post and given the cosmic amount of uninformed bullshit being ventilated for almost ten years in this fandom, I think it's time to answer it once and for all:

Whenever we are informally talking about 'owning the rights to something', I think it's very important to bear in mind a fundamental distinction between two different categories of ownership rights: copyright and trademark.

The copyright is the most familiar one to many of you. It is what you usually find on those annoying and apparently useless first or last pages of all the printed or digital editions on this planet. Something like this:

In the US, copyright issues are regulated by the Copyright Act of 1976, as included in Title 17 of the US Code. The US public authority competent for registering and managing copyright is, as predictable, the US Copyright Office.

Perhaps the most seminal US Supreme Court decision, as far as copyright is concerned, is the 1991 Feist Publications, Inc., v. Rural Telephone Service Co. In it, the Court ruled that mere compilations of information or facts (such as, for example, telephone books) are not protected by copyright, according to US law. In other words, the ancient legal concept of 'sweat of the brow' (which simply means the amount of work required to gather and compile those facts/information) is not enough to qualify a work for copyright protection, if no creative effort is added to enhance its content. This is why I have always considered absolutely ridiculous Marple's efforts to watermark public information screenshots: it is useless (to the extent that it legally protects her from nothing) and, as her timelines, a mere compilation of facts (legally ditto). A similar approach is preferred by the UK and also by many Roman law legal systems, such as the French one - just making things clearer, here, by the way.

But I am rambling. In my view, Lallybroch, as a pivotal concept used in Diana Gabaldon's books, is protected by the copyright granted to each and every of her books mentioning it, according to the Roman law principle 'accessorium sequitur principale' (the accessory follows the principal). So it will remain protected for at least 70 years since the last of her books mentioning it would have been published under copyright. Unless she chooses to separately protect the entire finished cycle as a whole, once Book Ten (fingers crossed) is published, preferably during our foreseeable lifetimes.

That being said, that goes only for one copyright category: (published) text - you cannot copyright that secret diary in your drawer, LOL. This is why, the current US Copyright Office records concerning Lallybroch look like this:

Sony Pictures Television Inc owns the copyright to the fictional name Lallybroch in the motion pictures category, as it is the title of the Episode 12, in Season 1 - DG has been handsomely compensated for this, no worries. And someone I have no idea about owns the rights to an original musical score she has written and titled Lallybroch in the music category, since October 2013.

Onwards to the trademark. This is something different and this is all about making your name/concept/idea profitable. It is all about branding it, putting it on a product and selling it under that brand. It includes all the graphic elements and the logo of the brand (accessorium...) - in short, its visual identity to the consumers. In the US, trademark issues are regulated by the 1946 Lanham Act and the public competent authority is the good old US Patent and Trade Office (USPTO).

Right now, the situation for the Lallybroch trademark is as follows:

So, we see three different trademarks: two of them, owned by Diana Gabaldon, are classified as 'dead' (cancelled and/or abandoned) and the third, Lallybroch Spirits, owned by S's Great Glen Company is pending approval - he will not be able to label any booze bottle Lallybroch Drink Me before permission is granted by the USPTO.

Let's unpack:

Both Lallybroch trademarks formerly owned by Diana Gabaldon were filed at the USPTO on February 21, 2000 and granted on December 12, 2000. The first was aimed at producing 'tartan fabrics for the manufacturer of clothing' and it was abandoned in December 2003:

The reason is that the owner did not file in any Statement of Use after the trademark was granted. She had three years to do so, and since she chose not to do anything about it, the trademark was deemed abandoned (Stacy K. Smith is the attorney hired by Herself, btw). That means she specifically implied not to intend using it in the future. As such, she may claim NO rights on a now free to use mark:

The second trademark was aimed at producing 'clothing, namely, t-shirts, dresses and headwear' and also 'jewelry, namely, rings, pins and necklaces'- to cut the story short: OL merchandise - and it was cancelled on March 1st, 2013:

The reason is that the owner did not file the Section 8 declaration (of continuous use for five years) within the allowed legal timeframe (6 months after the fifth anniversary of the trademark granting renewal). Her trademark federal rights are now deemed canceled (but not her state law and/or common law rights!) and if she wants to ever use that name again, she would have to start the whole process over, bearing in mind the trademark could have been granted to someone else, in the meanwhile (not her case).

And for anyone who might ask, 'Erself does not own any other trademarks whatsoever:

The other (Doll Lab - LOL for ages) Diana Gabaldon is a pharmacist from Albuquerque, NM. Chill. 🤣🤣🤣

YAMATO PROPAGANDA-

He read a samurai's diary that was so cool he decided to become that samurai. This required him to adopt the male gender. He is also a dogguy :) [Pollrunner's Note: Yamato spends the vast majority his life as a young adult literally in chains, and an important moment for him is him screaming that he "wants to live freely". He is introduced from the very start as a man and literally growls at people who misgender him in any way. Right before taking a break from the manga, Oda released a chapter where Yamato and a transfem character, Okiku, get to have the most gender-affirming scene of all time when they use the separated male and female public bathrooms. It's a tradition of the series where characters have a party and hang out in an onsen before parting ways- this was the only chapter that was released in the month of June. Right after this chapter was released, the One Piece wiki, which had been strict on only using they/them pronouns for Yamato, switched exclusively to he/him and locked his page. I have been working on an essay about him and how media and the people who consume it treat transmaculine people for SEVERAL YEARS NOW. To me, he is the epitome of transmasc swag]

I don't think they've ever talked about any of it for S2? Except that bit about the trial that Delainey was asked on her own as one of the most vulnerable actors in the crew to answer something like that (a young, black woman early in her career).

Even though it still flew over some fan's heads, they did used to mention racial elements of the plot more in the Episode Insider and also the podcast, which was hosted by a black woman. Interviews otherwise used to ask about it too. All of that has p much....vanished.

Off the top of my head, there's stuff like the difference between America and Europe for Claudia and Louis, Armand leading the coven but the coven still largely being white and the tension that is there bcuz of it (something I was trying to convey here), the trial is prbly the biggest one. Claudia and Madeleine. Morgan and Louis. Armand's painting and brief life history we hear about at times. Daniel's comments to Rashid and everyone else in Dubai, which rly ramped up this season. The way Claudia is treated through her diaries reflecting how she was treated in life and the general topic of misogynoir (even now, ppl still call the SA "lazy writing" and "shock value," despite her character displaying v realistic trauma reactions to it in S2 in *multiple* episodes, trauma that influences choices she makes). I know there's a lot more.

They've never talked about *any* of that.

If they don't talk about it, the fandom will not talk about it. Even if they did, it wouldn't be *the* topic here, but it'd still be seen much more than any fan here posting things. It's been disgusting to see the trial entirely written off as "well u see what u want to see lol" when, as I've said so many times, those references of slavery / lynching don't just accidentally fall into a scene like that. it's not in the books, either. so it looks v fucking dumb to say fans who *do* see it were "reading too much" into it, but most fans will still side with that take bcuz it's the side that says u don't have to do any work or think too much after all. this is what "white fandom" is made of. u don't have to be white to be in it, it's all about making sure whiteness stays comfortable in fandom spaces above all else. "all lives matter" type propaganda.

all fandoms have major issues with racism, but the fact that this show centers it as a topic to the plot itself and we still can't talk about it? the bullying is even more severe *because* ppl don't want anyone talking about it? it's so fucking gross.

Yellowjackets season 2 predictions

(as of 3/18/23, just under a week before s2 begins)

it's ritual cannibalism not survival cannibalism (I feel like we're all on the same page with this one)

Lottie's cult incorporates saints/martyrs, the first two of whom are Laura Lee and Jackie

hunting is part of the ritual, perhaps inspired by the shrooms-fueled hunting of Travis last season

Jackie's necklace is used to mark whoever is chosen as the next sacrifice to hunt

Shauna joins the cult in large part because worshipping Jackie is the only thing that feels big enough to remotely match the level of guilt she feels for her death (also remember "I liked the saints. they were all so tragic.")

Nat and Travis are the only two who never, ever join the cult. hence the s1 convo where the others recall how they never would have made it without Nat; hence Travis and Nat's codependent closeness.

the coach has gotta die pretty early on in this season right?

Taissa is the one who eventually gets them rescued, probably by trying another hike out that is more successful than the wolf-attacked one in s1. this theory based entirely on the overheard line in her campaign ad where she says she wants to "lead New Jersey out of the woods." this might happen in a later season tho.

idk what's gonna happen with Shauna's baby but if it does get eaten she isn't one of the ones who eats it, because Jeff was v accepting of whatever he read in her diaries and I think that would be beyond the pale even for our favorite himbo wife guy.

Do you have any hc about Damon's season 1 powers? I'm especially interested in shapeshifter!damon. The whole concept is quite fun to imagine. Also why do you think he has these extra powers? Personally after the whole lily thing I like to imagine that Damon is an untrained heretic. Also a scenario where hos powers would be revealed to scooby gang and/or the mikaelsons.

okay, okay so. Prepare for a short essay. (Sorry)

Intro!! So, in the Vampire Diaries books, vampires have Powers (capital letter and all) that feature things like weather manipulation, shapeshifting, flying, elemental control, telepathy, I think they can see auras or sense other vampire's Power. The books and the show are only like barely related. A lot was changed to make the show. (The Salvatores' ages, for one--they'd been Renaissance era men who'd killed each other in a duel over, you guessed it, Katherine. A ton of characters had personality changes (show Bonnie is better, imo), and book Caroline was an antagonist, plus Jeremy straight up didn't exist, Elena had a v young sister. So on, so forth, everything ended up super different.)

The show started off a (teeny) bit closer to the source material, but sharply diverged, including getting rid of the Powers thing. Something about it being too supernatural???? in the vampire show??? idk might have to fact check me on that one think I read it somewhere random.

But, as we know, it's heavily implied, and outright stated in some cases in early S1 that Show!Damon has access to some kind of power. Controlling the weather, controlling animals (perhaps shapeshifting, but maybe just a connection), and a long distance kind of hypnosis.

What we know about it:

In episode 1, a crow is seen following Elena around. It shows up multiple times. In the car with Bonnie, at the graveyard, when she goes to the Salvatore House for the first time. The crow heralds Damon's reappearance to his brother. Stefan says, "Crow's a bit much-" which implies this is a Thing that he knows about. Damon replies, "Wait until you see what I can do with fog."

The very first scene Damon is in, the opening with the couple on the way back from some concert (i think) it's foggy. They mention something about it that implies it shouldn't be foggy, or that it wasn't previously. Like, "What's with all the fog?" At the graveyard, Elena sees a crow, then it starts becoming much more foggy.

Bonnie, at some point, touches Elena and says she sees a crow, some fog, and a man.

It's foggy when Vicki is attacked.

So. We've established those two things. Moving on.

There's that one scene where Damon is locked up and long distance compels Caroline to free him--i think after calling the crow into his cell and eating it to gain that strength? maybe--it's heavily implied because he fed on her they have a connection he can use to influence her mind without direct compulsion.

OKAY!! now that that's been established, time for the fun headcanon stuff.

Firstly, I also love shapeshifting!Damon! Tis good fun and it lets me project gender envy i mean it's a great metaphor about vampires being inhuman!! Yes! That! Nothing else ahahahahaha. Something something, predator's perspective, something something instincts. In the book Damon could turn into a large crow and a wolf. Highkey wish they'd kept the crow thing as more than just the occasional motif. It could have been so much fun!! Crow minions!!! Crow friends!!!! Crows bothering the fuck out of people he wants to annoy!!!!! Damon trades shinies and food for things!! Somehow always has a snack on him. Crow drama??? Just casually mentions weird lil bird rivalries. Crows are Smart! They are super social!!! They hold grudges!! They absolutely have Drama on par with Mystic Falls. It could also be played for angst; Katherine announces her return with with a bunch of bird corpses in the Boarding House. Damon, who is unsympathetic to human deaths could be visibly upset by this!! Also nicely plays into the 'likes animals but pretends he doesn't bc it's a weakness' thing.

Comes home and there is feathers in his hair, nearly blending in. Except, on closer look, they're positioned oddly, like they'd been growing from him instead of just settling there. Then he brushes them off or shakes his head and they fall away. Maybe Stefan notices he's a bit more prone to tilting his head at things to get a better looks. Is a bit more easily distracted/more prone to notice shiny things.

A crow follows Elena around and maybe she makes friends with it. Or a crow comes across Stefan having some angst fest in the forest and bothers him into a better mood.

I like the heretic thing!!! I also just think the Salvatore bloodline is magic charged bc it's a doppelganger line!! They've got Silas germs!! Maybe Damon is a little bit more psychic than he should be. Maybe his compulsions require less effort and his dream-walking is better than vampires twice his age!!! Mild telekinesis would also fit in with early S1 nonsense! moving doors to creep Elena out!

As for his powers being revealed... I mean. Suddenly he's more valuable to the Originals? Not as much as Elena was, but there would prob be more recruitment efforts than in canon. Plus, Kol would be more interested in him as more than a batting target. Klaus and Elijah may press the 'saved ur life thing' more. Hm... I guess it would depend on when in the show? Early seasons and it just makes him more a threat. Stefan maybe assuming he did something to a witch??? Later in the seasons and if he develops those powers it's fun to imagine him having to learn to use/control them + having to deal with increased need for blood to fuel them. If it was a matter of him keeping them secret, I'm sure the Drama will manifest with 'how could you not tell me!!' and so on and so forth. Technically speaking, I imagine it'd be put in the same place as Jeremy's medium powers. Brought up when needed. not entirely sure, may think on it later
