A group of Democratic senators introduced a bill Thursday that would radically change the makeup of the Supreme Court, amid ongoing concerns over court ethics and its increasingly conservative makeup.
The legislation would appoint a new Supreme Court justice every two years, with that justice hearing every case for 18 years before stepping back from the bench and only hearing a “small number of constitutionally required cases.”
“The Supreme Court is facing a crisis of legitimacy that is exacerbated by radical decisions at odds with established legal precedent, ethical lapses of sitting justices, and politicization of the confirmation process,” Sen. Cory Booker (D-N.J.) said in a statement.
“This crisis has eroded faith and confidence in our nation’s highest court. Fundamental reform is necessary to address this crisis and restore trust in the institution.”
Only the nine most recently appointed justices would hear appellate cases, which make up a bulk of the court’s work. All living justices would participate in a smaller subset of cases under the court’s “original jurisdiction,” such as disputes between states or with foreign officials.
The bill was introduced by Sens. Booker, Sheldon Whitehouse (D-R.I.), Richard Blumenthal (D-Conn.) and Alex Padilla (D-Calif.), and it was co-sponsored by Sens. Mazie Hirono (D-Hawaii), Jeff Merkley (D-Ore.), Peter Welch (D-Vt.) and Brian Schatz (D-Hawaii).
Calls for Supreme Court reform grew louder this year after ProPublica revealed that Justice Clarence Thomas received hundreds of thousands of dollars worth of perks from conservative political donors. Further investigations have uncovered multiple significant and undisclosed gifts from politically connected friends over his time as a federal judge.
Justice Samuel Alito also took a luxury vacation paid for by an influential conservative donor while in the judiciary, another investigation found earlier this year.
The Senate Judiciary Committee advanced a bill earlier this year along party lines that would require the Supreme Court to create and abide by a code of ethics. Unlike lower courts, Supreme Court judges are not beholden to an official ethics code.
“An organized scheme by right-wing special interests to capture and control the Supreme Court, aided by gobs of billionaire dark money flowing through the confirmation process and judicial lobbying, has resulted in an unaccountable Court out of step with the American people,” Whitehouse said in a statement.
“Term limits and biennial appointments would make the Court more representative of the public and lower the stakes of each justice’s appointment, while preserving constitutional protections for judicial independence.
“As Congress considers multiple options to restore the integrity of this scandal-plagued Court, our term limits bill should be front and center as a potential solution,” he added.
Attempts to reform the Supreme Court have been denounced by both Republicans in Congress and by some members of the court, namely Thomas and Alito.
Alito argued earlier this year that Congress does not have the authority to force any reform on the court without a constitutional amendment.
“I know this is a controversial view, but I’m willing to say it,” Alito told The Wall Street Journal. “No provision in the Constitution gives them the authority to regulate the Supreme Court — period.”
But Whitehouse’s office argued in Wednesday’s statement that the Constitution allows Congress to regulate how the court handles appellate cases from lower courts. That’s why all justices would still weigh in on “original jurisdiction” cases, avoiding the constitutional hang-up.
Trust in the Supreme Court remains near all-time lows, according to national opinion polling. A Gallup poll last month found that just 41 percent of Americans approve of how the Supreme Court is doing its job, with 58 percent disapproving.

I am thinking about them again, so let me tell you the story of Ayala
Ayala is not their name, obviously, none of them names in the story are true.
We met in the 4th grade. I just moved towns and went to this new school, but she wasn't in it. She was at the gifted kid institute. Once every week, they'd pull us out of the school system to let us into a world of happiness, challenge, and understanding. My best of days were from there, I have yet to have told you of the time I got high off of sugar there, but that's a story from another time, for another time.
It's the 4th grade, and I just meet the fellas, many of which I still keep in touch with.
She had glasses. she always wore the same blue hoodie, summer and all. She was always a bit cold. She had this weird bowl cut hair that never crossed her shoulders, as if she cut it the shortest she could without being an outcast. she was funny, she was brilliant, smarter than I am for sure. She beat me at math, and at riddles. She solved a Rubik's Cube while I was fiddling with the upper face. She could speak a bit of Chinese by the end of that year, I couldn't remember anything but my name, which was the same word
She was my best friend at the time. I didn't have a smartphone, so we couldn't text, only call. So we did, often. once a week, twice a week, thrice a week.
When we met, I'd hug everyone. we were still young enough so it wouldn't be weird. We were still young enough I couldn't control my strength, and would often chock my friends out. She was the only one who matched my strength. Some people appreciated the hug but wanted out, not her, her hugs lasted minutes, filling my inside.
The years went on and we grew closer. We made a religion, with goals, rituals and all. we made a plan to kill every adult in the world so only we will remain. We would make jokes, we would make games, we would recite plays, we would write poems.
6th grade. I got my smartphone.
We texted, every day, for hours. We didn't know what memes were back then, nor did we have some, but we would create jokes and tell each other. We'd challenge each other with riddles and philosophical thought experiments. We would plan actual experiments. I told her her experiments would almost certainly be illegal to perform, but she just brushed it off.
7th grade, the hottest class at the institute? gender studies. of course, it is, one day I'd perform the experiment we once designed: track the gifted kid population through a 10-year period and check how many are LGBT. in our institute it's only been 4 years, and we are already over 50%. I am one of the few cishet boys in the class, as to be expected. I challenge and ask questions, often. the class almost never advanced after the first slide, we would get caught up in discussions. the discussions didn't end at class, the WhatsApp group was fuming, always running, 19\7. The discussions didn't end at the group, She and I would chat to the late hours of the night, after the teacher couldn't handle it anymore.
She convinced me god does not exist, and that it is okay, because we had each other. It took her 30 minutes to turn me from a questioner to an atheist.
She was so smart, and so funny, and so... beautiful. She was stunning. No makeup, no fancy clothes, she didn't look like a traditional model, and my parents openly called her ugly to my face.
They could never understand, She was beautiful.
I fell in love. I didn't know it at the time, I didn't recognize the feeling, I didn't know it, but now I do. I fell in love, I fell hard.
Then 8th grade. Covid hits. my grandma dies. I don't know what happened at her side, but shit hit the bottom as well. We fell into a deep depression, both of us. There were weeks at a time I would feel nothing. We would message a lot over that time, I was really sad, she was suicidal.
At 9th grade shit hit the fan, she called me, she didn't call me often by that point, only texted, so I was ecstatic.
"hey david"
"HEY WHAT'S UP? HOW ARE YOU?"
"david can I ask you something?"
"Sure..... what is it?"
"if i'm gone, will you be okay with it?"
"WTF?! NO! WTF? WHY WOULD YOU SAY IT? NO! NOT EVEN AS A JOKE!"
"please"
"NO! AYALA! YOU ARE NOT DYING ON ME"
*hangs up*
I call her mother. It took me 15 minutes to call her, I didn't have her number, Ayala didn't give it to me, and none of my friends had it. I found it 15 minutes later in a "details" card I kept from a year before.
15 dreadful minutes
She responds, she tells me she's safe, she's with her, everything's fine, she knows she is suicidal, they are working on it, thanks for calling
A month later they tell me they are non-binary, and that their name is now Ash. I am shocked. I ask them if I could still refer to them in the female. They say that in hebrew, yes, but to use "they" in english.
Their messages get less frequent
2 months later I get a call from her mom. They tell me she tried to suicide. she took an overdose of pills, and then called the hospital on herself. She is fine, but she is put in the mental hospital for the time being. No phone contact
3 months later, I get a text. "Hi, sorry for being distant, I got my phone back, for a while. I wanted to tell you that the reason I called the ambulance is that I didn't want you to be hurt, or for my cat to be hurt"
They don't respond to any of my texts. I send them memes, and drawings, and get-well-soons. I pray for them every night. I get the occasional text, once a month roughly. "ha ha", "nice one", "use the masculine next time or this will be the last time I text". I didn't even know it bothered them
I finally changed their handle on my phone. I changed it to "Ash (male) GoodHuman". I knew their family name, of course, but it didn't matter, what mattered is that I miss the GoodHuman.
Then... a year passes, and a few months more, they haven't written a text in what seemed like forever.
"Hey david, sorry for ghosting you, It was too difficult responding, I love your texts, and I will try to text you more often"
so we continue to text. turns out, they cut their hair short. they switched to cargo pants and leather, no more blue hoodie. They wore a fedora now, and had new glasses
They had a new boyfriend.
I do not remember their name, I am afraid to go look if I'm honest. I don't like the guy, he seems way too controlling, and way too sure of himself, and way too... too dumb for them. But they were happy, and after the last couple of years, it's been good enough knowing that they were happy
They texted from his phone sometimes. he switched and talked to me sometimes.
I meant to sent her something by mail. I knew the city, but not the address, so I asked.
They told me "Oh didn't I tell you? My parents got divorced. My mom couldn't handle me being trans, my dad could. I live with him now"
They give me the address
It's so close. So absurdly close. Not in my city, but my city borders a field, and the field connects to another city. I lived on the entrance to the field, they lived on the other. Half an hour by bike.
So they invite me over, and I bike. I bike like mad, I didn't know the path, it didn't matter, I rolled through the thorns, they couldn't hurt me, we are about to meet again.
And we met, and we talked, and we watched a musical, and we played, and recited plays, and sand songs, and we riddled each other riddles, and we played philosophy, and it was suddenly like the old times came back.
I asked how was it going with the boyfriend. They told me they actually were polyamorous, and if I wanted, we could have sex right there and then, her father wasn't home.
I suddenly realized... the years have changed me. I say no.
It was getting late, so I went to take my bike and... the thorns punctured them. I didn't even think to look. I waited for their father to return to bring me home, and promised: next time in my house. They gave me an origami frog. I still have it
Their father came later. he drove me back, but by the time we got home, my mother asked where I've been.
I lied. My mother hated Ash, and still called them Ayala. I don't remember my lie, I am pretty sure she knew exactly what happened, but we never talked about that.
Stuff went well for a while, then...
We went into a gender studies discussion. It went as usual, then they said "yeah, but all men are rapists".
"I'm a man"
no comment
"Ash, I ask you to back down, this hurts me a lot"
They doubled down. I don't remember what they said. I remember I shed a tear for the first time since my grandma died and say "If you want to talk with me again, back down, if not, I will not engage again"
I assumed they'd back down in a day. In 2 tops. Every day I'd check the chat, still empty.
5 months later: "I am not backing down, but it shouldn't affect our relationship-"
I stop reading
I write some "professional speech" bs about me being able to accept an apology whenever they'd like, but I cannot continue like this, and wish them the best
This is the last message in our chat
Often I ask myself if I was too dramatic, If this was too much, If I should have accepted it for our friendship. I don't know the answer
This was a year ago. more, actually. They never came for the "next time in my house". The friends who keep in touch with both of us say they are still with the same boyfriend. they colored their hair. they are trying to pass school, but having a hard time with math.

Segregation has a new brand name: racial “affinity groups.” Race-based “affinity groups” have exploded in prevalence across the United States over the last few years, moving from workplaces into schools, religious congregations, and other organizations all across the country. Affinity groups can also be organized around other identity categories such as gender, sexuality, disability, and religion, but affinity groups were first created around racial identity.
In 1969, Xerox employees based in San Francisco launched the Bay Area Black Employees (BABE) caucus, the first known workplace affinity group ("caucus," "employee resource group," and "affinity group," are all terms that have been used to describe the same idea).  Overall, Xerox's chairman at the time, Joseph C. Wilson, was an important leader in driving workplace integration. He reacted to race riots in the 1960's with a mission to increase integration and hire African-Americans who had previously been denied employment opportunities, and took numerous concrete actions to do so.
However, as has happened on numerous occasions to other well-intentioned leaders (including in response to other 1960’s race-riots), Wilson chose to take advice not just from integration-oriented civil rights leaders like Martin Luther King Jr., but from the Black Power activists responsible for the riots. Wilson enlisted the counsel of a group called “F.I.G.H.T.” While much of F.I.G.H.T.’s activism was productive and aimed at pushing back on genuine and oppressive racism, it was also a “decidedly militant” organization that “alienated much of the black middle class” and worked closely with the explicitly anti-integrationist founder of the Black Power movement, Stokely Carmichael.
Today, more than 50 years later, affinity groups have spread to 90% of Fortune 500 companies. These companies sometimes claim that racial affinity groups help foster communication and help bring new ideas to leadership. Corporations also point out that membership in racial affinity groups is usually voluntary, and therefore it cannot be a form of racial discrimination as banned under Title VII of the Civil Rights Act of 1964. 
However, despite these claimed positives, many corporations have also found that affinity groups polarize employees, and many people of color are reluctant to join such groups for “fear of being reduced to their racial identity.” Even when they are organized and advertised as voluntary, the social pressures on individuals to join racial affinity groups are substantial. And although some data supports companies’ intuitions that affinity groups are helpful idea generators, these positive results may be better explained by the existence of a group creating increased discussion time, rather than the racial makeup of that group.
With affinity groups’ recent spread throughout K-12 schools, higher education, religious groups, and many other key institutions throughout our society, we face an even worse danger. While businesses are beholden to the profit motive, schools and other non-profit institutions are not. This creates more opportunities for affinity groups in non-profit institutions to advance a fanatical ideology, since organizational leadership doesn't need to worry, as businesses do, about the possibility that a Marxist ideological agenda would compromise their ability to operate in a financially viable manner.
Advocates of racial affinity groups claim they are not racist or segregationist, but do so while practicing racial segregation and making explicitly racist claims. For example, Truss Leadership, a so-called “racial equity” consulting group that works with numerous school districts, declares that “Racial Affinity Groups are NOT … Racist or segregationist,” but also says they are a place where white people can “reckon with their Whiteness” and non-white people can “take care of themselves and one another…in the absence of Whiteness.”

FAIR ally Ye Zhang Pogue has written beautifully for this Substack on how affinity groups in schools can harm our society by needlessly pitting people against each other along racial lines. What advocates of affinity groups often ignore is how prejudice and discrimination is often caused by diminished contact between groups, and can be overcome by increasing that contact and having group members work cooperatively instead of separately (one of psychologist Gordon Allport’s four conditions for reducing racial prejudice). This insight into the power of contact is the same idea that has driven FAIR Senior Fellow Daryl Davis’s pioneering efforts to get Klan members and neo-Nazis to give up their lives of hate.

Even racial affinity groups' most extreme and vocal advocates have acknowledged that “Caucusing can generate anxiety even at a visceral level for some. For people of color, history has shown that real harm can come from spaces exclusively reserved for white people. … People of color may also experience racial anxiety and stereotype threat, the fear of being viewed through societal stereotype ‘lenses’ by white colleagues and supervisors.” These are not ungrounded fears. Corporations seeking to pursue effective anti-racist strategies would do well to remember the horrors of the interoffice segregation of America’s past.
Segregation in the form of racial affinity groups today is disturbingly similar in concept to the separate bathrooms, water fountains, bus sections, and other spaces in generations past. Then as now, we ought to remember the worldchanging verdict from Brown v. Board of Education, that “Separate [is] inherently unequal.” As Supreme Court Chief Justice Fred M. Vincent explained in the Court’s also unanimous decision for McLaurin v. Oklahoma State Regents, which was cited in Brown v. Board of Education, “To separate [children] from others of similar age and qualifications solely because of their race generates a feeling of inferiority as to their status in the community that may affect their-hearts and minds in a way unlikely ever to be undone.”

None of the scenarios of doom that have filled your imaginations need betray your true path toward the intended transformation of your world. The whole picture is as yet unknown, but is not as dire as some may fear. While the changes will be dramatic, they will fall short of cataclysmic. However, the changes you will undergo as humans will be far more dramatic, though only cataclysmic for those who choose to hold fast to the dying world. For those who refuse to choose life, the times ahead will prove to be most challenging. You who recognize and know the light in life, prepare for great things to come.
Upon the face of the Earth has come great calamity in times past. In those days, you might say whole civilizations fell. Not so now, for now a great civilization emerges from within the people and sacred places. You are meeting time again, regaining your trajectory toward a great global geometry in which the coordinates of fate make conducting the volatile energies of transformation more dynamically at ease than in times before. What this means for you today is greater opportunities to gain the upper hand in your survival, and on the future evolution of your human culture. You may not realize yet just how precarious that future had been, but in fact you have held the potential for mastering it all along. This time of transformation is indeed a time of great advancement for your souls, your world, and the consciousness of all humanity.
This being said, on the surface, it might not look so easy. At the depths, it might not feel so wonderful. Momentary shifts can appear overwhelming while they are in process. However, as soon as you move through the turbulence, it will be as if you were a million light years away. Time will feel different. Everything will feel different. Because the turbulence will be both deep within your experience and ruffling surface energies, you may have some confusion about how to center. We say, relax. Let the disturbances pass. Go deeper. Expand, and become aware of what lay beyond this moment. You will not lose yourselves, only the idea of who you thought you were. All that changes now. You sense it, do you not?
Now, we have something to say regarding your present world situation. The time has come for more to be revealed. We would like to remind you that we cannot infringe on yourself determination, nor do we want to. This is not our way. You have suffered enough interference in your world and now you are becoming aware of that and thus want to be free. We help, but we cannot walk your path for you only with you. We do this remotely as yet, but this too will soon change.
Your leaders are in the midst of something enormous, in terms of the impact it will have on the whole of your world. Great forces move on various levels and within various geometries, shall we say, of the makeup of what you call the wheels of power. While some changes are happening quickly, others happen more nearly imperceptibly. Certain slippages have unlocked the machinery now. Many of you sense or have already experienced the change. Many more soon will, as time can now afford some helpful perspective. Soon, it will be undeniable. So, too, will be the unmistakable emergence of something all together new. We cannot stress enough the magnitude of what we speak of.
Democracies will give way, institutions will give way, as well all the underlying imperfections that have become inbuilt into your concept of free and equal society, just law, and so on. The experiment, you might say, has run its course. There's nowhere to go but into something wholly new, yet not unfamiliar, nor in any way less to the benefits of what you call humanity.
To clarify we refer not to collapse but to rebirth, not to chaos but to reconformation, not to anarchy, but to complete reconceptualization of what self-governance means. You stand at the edge now; total redefinition of self-awaits for all. Are you prepared? We see that more so, you are. The time nears, expectation for dynamic shift grows. Until time brings us into contact again, we say farewell with love, and in peace, be whole. - The League of Light
