Appeal upheld: Houli cops extra whack for strike

THE AFL has succeeded in its historic first-ever appeal of a Tribunal decision, with Richmond defender Bachar Houli’s ban for striking Carlton’s Jed Lamb increased to four matches.

Lamb was left unconscious after the hit and has been ruled out of the side to face Adelaide at the MCG on Saturday.

Houli accepted the decision after the verdict was handed down, with the Tribunal originally handing him a two-game suspension.

“The decision’s been made and I accept it,” Houli said.

“Point number two, my concern is and always has been for Jed and I hope he recovers really quickly.

“The other thing is we move on with life and I’ll do my best to help the team prepare for the next few games.”

He will miss matches against Port Adelaide, St Kilda, the Brisbane Lions and Greater Western Sydney.

The AFL’s legal counsel Andrew Woods argued three points:

The original penalty was manifestly inadequate

There was an error of law when the Tribunal made its judgement

The decision was so unreasonable that no Tribunal acting reasonably could have come to that decision

Richmond was led by Michael Tovey QC and Sam Tovey – the same lawyers representing Houli at the Tribunal.

The three Appeals Board members were Peter O’Callaghan QC (chairman), Brian Collis QC and Michael Green and came to a decision in about 10 minutes.

When explaining the decision, O’Callaghan said the character references from Prime Minister Malcolm Turnbull and Gold Logie winner Waleed Aly were not relevant to his act on the football field.

He explained why the Appeals Board saw a greater punishment necessary.

“A blow from a person of exemplary character has just the same impact of a person of bad character,” O’Callaghan said.

AFL football operations manager Simon Lethlean said in a prepared statement the decision, which came after a hearing lasting more than two hours, was the right outcome for the game.

“The Appeals Board tonight has reinforced the AFL’s position on the importance of protecting the head and the health and safety of our players. I’m satisfied with that result,” Lethlean said.

“He’s a leader in our game, a player and a person of great integrity, his remorse for his actions were clear after the completion of the match.

“Our actions in appealing the Tribunal decision were about protecting players from injury to the head and this is very important to us.

“I want to reassure Bachar that he will continue to be held in the highest standard.”

While this is the first time the AFL has ever appealed a Tribunal decision, only two of 16 players have been successful in front of the Appeals Board.

Melbourne midfielder Jack Viney had a two-game suspension overturned in 2014 for a rough conduct charge on Adelaide forward Tom Lynch.

The other successful challenge was in 2009 when Collingwood defender Nick Maxwell successfully fought a rough conduct charge for a bump on West Coast tough nut Patrick McGinnity.

The last time an appeal was held was when Fremantle’s Nat Fyfe failed to have a two-match ban for striking then-Hawthorn midfielder Jordan Lewis overturned in August 2014.

Narco agents searching for Cassie Sainsbury for a WEEK – before catching her just moments before she boarded a plane

Accused drug mule Cassie Sainsbury was being chased by Colombian narco agents for a week before she was caught at Bogota Airport with 5.8 kilograms of cocaine in her suitcase.

The 22-year-old from Adelaide, South Australia, was initially reported to have been caught at Bogota airport after a last-minute tip-off from the US Drug Enforcement Agency (DEA).

But it has now been revealed local police were put on alert about the alleged drug smuggler on April 5th – seven days before her arrest on April 11.

In an interview published by SBS, the ports and airports director for Colombia’s anti-narcotic police, told a journalist authorities had been placed on high alert about Ms Sainsbury.

Jorge Mendoza told the journalist authorities were all aware of Ms Sainsbury’s name, nationality and appearance, and were confused when she failed to turn up on travel logs.

Left stranded in their search for a potential cocaine smuggler, it wasn’t until the U.S. DEA provided the last minute tip when Ms Sainsbury’s ticket was bought in Hong Kong by an unknown person that they tracked her down.

Mr Mendoza refused to speculate on whether the Australian woman is guilty, saying earlier this week he doubted she wasn’t aware of the drugs in her suitcase.

‘Her explanation is not credible. Everyone we catch says they didn’t know it was in their luggage,’ he said.

It comes as Ms Sainsbury’s fiance told media he had no doubt about her innocence, but refused to answer questions during a press conference on Friday.

Scott Broadbridge, 23, fronted reporters on Friday with his own lawyer Steven Kenny – Cassie’s second legal representative – to clear the air about his wife-to-be.

But aside from a short prepared statement declaring his love for Cassie and intention to marry her, Mr Broadbridge did little to set the record straight about the conflicting stories emerging about why she was alone in Colombia in the first place.

The bodybuilder repeatedly said ‘no comment’ when asked by reporters about the cleaning company he claimed Cassie worked for overseas – at odds with her own family’s assertion she was there in part to promote her personal training business.

He also kept quiet about questions regarding Cassie’s plane ticket home to Australia, which was reportedly bought last-minute in Hong Kong by an ‘unknown party’.

Instead, it was up to his newly-appointed lawyer – who openly said he ‘did not have answers to many of the questions being asked’ – to field a range of media inquiries.

Mr Kenny said he was confident the Australian woman would get a fair hearing in the Colombian courts.

‘We have great faith in the Colombian legal system and will be doing everything we can to provide her with the best possible defence,’ he said.

Richmond’s Bachar Houli banned for four matches by AFL Appeal Board

Richmond defender Bachar Houli was suspended for four matches on Thursday night after the AFL’s appeal against the decision of its own tribunal was upheld.

The AFL argued that the two-week sanction imposed on Tuesday night by the tribunal had been “manifestly inadequate.”

In particular the league had taken umbrage at the tribunal’s decision to take into account evidence about Houli’s off-field character, including character reference from television personality and Richmond supporter Waleed Aly, and Prime Minister Malcolm Turnbull, who has worked with Houli as part of the defender’s off-field work growing football in the Muslim community.

The board agreed, indicating that they were not relevant considerations.

Houli spoke briefly after the hearing, saying he accepted the decision and that his concern “is and always has been for Jed, and I hope he recovers really quick.”

“We move on with life, and I’ll do my best to help the team prepare for the next few games,” he added.

Lethlean also stopped for a brief statement, noting that Houli would continue to be held in “high regard” despite his indiscretion.

“Our actions in appealing the tribunal decision were about protecting players from injury to the head, and this is very important to us,” Lethlean said.

“I want to reassure Bachar that he will continue to be held in high standing and high regard in our game, and in our community.”

AFL counsel Andrew Woods drew the analogy that taking into account a player’s off-field behaviour in determining a sanction for an on-field incident was like considering whether a member of the public was a good footballer in deciding on a sentence for a criminal matter.

Woods said that doing so would set a “dangerous and cumbersome precedent.”

Even if character were to be taken into account, Woods said it should be a factor in determining whether Houli’s suspension should be limited to four matches, not whether it should lead to a sanction of fewer than four games.

The AFL claimed that four matches should be the base sanction, leaving open the prospect that the Appeals Board could suspend Houli for more than four games.

The league had also sought to have a fresh medical update on Lamb tendered as evidence on the basis that concussion is not a static condition. However the board said that as Lamb’s injury was already known to be “severe” it was unnecessary for new evidence to be allowed. Lamb was on Thursday night left out of the Blues team for Saturday’s match against Adelaide at the MCG despite his mandible not being fractured.

Houli’s lawyer Michael Tovey QC noted how Houli had sought out Lamb’s phone number to apologise, and contended that Houli’s work with the Muslim community was of “unique and extraordinary importance.” They also argued that Houli’s act had not been “an intentional strike to the head” but rather “an intentional strike resulting in contact to the head.”

Houli’s counsel also made note of tribunal member Wayne Henwood’s level of experience, ridiculing the suggestion that he wouldn’t appreciate which factors to take into consideration.

Sitting alongside Richmond football chief Neil Balme, Houli averted his eyes as the footage of Sunday’s incident was shown on a television monitor.

Houli, 29, has never previously been suspended during his 162-game career. The one-time Essendon player has played all 13 games this season for the Tigers, averaging more than 23 disposals per game.
