ahlak üzerine bir deneme-1 (okuma süresi yaklaşık 2 dakika)

Elimizde kötülüğü ölçecek bir aracın var olması iyiliği tersinden ölçecek bir araç olduğu anlamına gelmez.

Diyelim elimizde zeka geriliğini gösteren bir test varsa, bunu ileri zekayı ölçmek için kullanamayız. IQ testlerinde düşük puan alan insanlara zeka geriliği teşhisi koyabilmek, yüksek puan alanların ileri zekalı olduğu anlamına gelmez. İleri zekalılık birtakım testler geçmekten daha başka bir şey gerektirir ve varsa ibda edilen eser sayesinde ortaya çıkar. Bu da sadece zeka ile değil, daha çok çalışma ve imkan bulmakla ilgili bir durum. Albert Einstein ve Alan Turing'in ikisinin de ileri zekalı olduğunu söyleyebiliriz, ancak Turing Einstein'ın veya Einstein Turing'in uğraştığı problemlerle uğraşsaydı devrim yapabilirler miydi? Muhtemelen hayır. Bu sebeple üstün zeka bir gerek olsa da yeter gibi görünmüyor. Hemen hemen anlamsız bir ölçü.

Benzer bir durum ahlak alanında da var. Ahlaksızlığın ve kötülüğün ne olduğunu bilmek bize ahlaklılığın veya iyiliğin ne olduğunu göstermez. Üzerinde ittifak etmenin kolay olduğu tecavüz kötülüktür gibi bir ölçüden, cinsel ilişkiden daima uzak durmak iyiliktir sonucu çıkmaz. Cinayet kötülüktür üzerinde uzlaşabiliriz, ancak bundan insan üretmek iyiliktir sonucunu çıkaramayız. Bir şeylerin iyilik olması için, kötülüğün zıddı olmasından başka kriterler de taşıması gerekir.

İyiliklerin hemen tamamı üstün zeka gibi belli bir hedef ölçüsünde iyilik anlamına gelir. Einstein'ın zekasının her alanda işe yaramaması gibi bir fiilin kötülük olmaması iyilik olduğu anlamına gelmez. İyilik olması için bir yerde hangi dünya, hangi yaşam biçimi, hangi mesele için iyilik? sorusunu cevaplamak gerekir.

İnsanların çoğunun kötülük konusunda ortak bir fikri var. Neyin kötülük olduğunu anlatmak için fazla uğraşmayız. Ancak iyilik üzerinde o kadar kolay uzlaşılabilir bir mesele değil. Siyasetin de devletin de hedefinin kötülüğü engellemek olması gerekir (soru işareti), daha küçük, birbirini tanıyan ve benzer bir hayat tarzı için yaşayan insanların derdi olmalıdır.

Especialistas debatem a regulamentação do Fiagro

Assunto terá destaque durante o Congresso Brasileiro de Direito do Agronegócio

O Congresso Brasileiro de Direito do Agronegócio, marcado para 19 de março de 2024, em São Paulo, reunirá especialistas para abordar um tema atual para o agro e o mercado de capitais: os Fundos de Investimentos nas Cadeias Produtivas Agroindustriais (Fiagro), que devem receber uma normalização específica neste ano, após encerramento da consulta pública feita pela Comissão de Valores Mobiliários (CVM) em meados deste primeiro bimestre. As inscrições para participar do evento, com transmissão virtual gratuita, estão abertas no site oficial.

Os Fundos de Investimentos nas Cadeias Produtivas Agroindustriais (Fiagro) têm apresentado um crescimento exponencial. Em janeiro deste ano, o patrimônio líquido dos Fiagros atingiu R$ 34,4 bilhões, o que representa um aumento de 42,1% ante o primeiro mês de 2023. “Até o momento, as regras utilizadas para os Fiagros funcionaram muito bem. Mas é um amadurecimento natural dos produtos de securitização ter uma norma específica. O Fiagro é um fundo muito flexível e interessante, assim, ter uma regra específica vai consolidar ainda mais seu crescimento”, avalia Rafael Gaspar, Sócio do Pinheiro Neto Advogados, que será um dos debatedores do painel Agronegócio e Mercado de Capitais – A Regulamentação do FIAGRO, ao lado de Bruno Gomes, Superintendente de Agronegócio e Securitização da CVM, Cesar Junior, Gerente Executivo de Soluções para o Agronegócio na Serasa Experian, Flavia Palacios, Coordenadora da Comissão de Securitização da Anbima. O debate será moderado por José Angelo Mazzillo Júnior, Consultor da CNA, ex-Secretário de Política Agrícola do MAPA.

Durante o painel, os especialistas contextualizarão a aproximação do agro com o mercado de capitais, abordarão os acertos da regulamentação provisória do Fiagro, o que foi inserido na consulta pública da CVM e a expectativa com a regulamentação final. Também serão tratados temas relacionados ao mercado, como os tipos de transações realizadas e as empresas que podem se beneficiar com esse instrumento, e os assuntos ligados ao desenvolvimento tecnológico e a digitalização, que foram importantes para dar mais transparência e segurança para as operações.

Idealizado pelo Instituto Brasileiro de Direito do Agronegócio – IBDA, o Congresso contará, ainda, com mais três painéis, que versarão sobre temas fundamentais para a segurança jurídica, crescimento econômico e competitividade do setor: Direito de Propriedade, Função Social e Contratos Agrários; Gestão de Risco, Crédito e Recuperação Judicial; e Transição Verde: Bioeconomia e Instrumentos Jurídicos.

A programação será aberta pelo ex-Ministro da Fazenda Maílson da Nóbrega, economista e sócio da Tendências Consultoria, que ministrará a palestra inaugural Tributação e Ordem Econômica. O IBDA prestará, ao longo do evento, uma homenagem a um dos mais importantes juristas do Brasil, o advogado, professor e escritor Arnoldo Wald, sócio e fundador do Wald, Antunes, Vita e Blattner Advogados.

God’s Attributes of Glory: Part 14

Ibda’ (Originating Uniquely)

Ibda’ means that God Almighty creates without there be anything before to imitate and in a unique, unequalled, and unprecedented way. In place of ibda’, the words ihdas (innovation), ihtira’ (creating out of nothing), ijad (invention), and sun‘ (making) can be used, although there are slight differences among them. In fact, these words express different aspects of Takwin (Making Exist). In several verses such as the following ones, the manifest Qur’an presents to our view God’s unprecedented origination and calls upon us to notice the beauties of His Art:

The Originator of the heavens and the earth with nothing preceding Him to imitate. When He decrees a thing, He does but say to it, “Be!” and it is (2:117).

The Originator of the heavens and the earth with nothing before Him to imitate (6:101).

Insha’ (Producing)

Literally meaning gathering together certain ingredients or components and elements to produce a new thing, Insha‘ is the Attribute of God which denotes gathering together certain essential ingredients or components that have already been created to produce something new. In dozens of explicit verses, the glorious Qur’an reminds us of this mighty reality. For example:

He it is Who produces gardens (and vineyards, and orchards) trellised and untrellised, and date-palms, and crops varying in taste, and olives, and pomegranates, resembling one another and yet so different (6:141).

He it is Who has made for you (the faculty of) hearing, and eyes, and hearts (23:78).

He it is Who developed you from a single human self and has appointed for each of you a lodging-place where you will stay permanently, and a place where you will stay temporarily (6:98).

Say: “He Who produced them in the first instance will give them life (anew)” (36:79).

Ihya’ and Imata (Giving Life and Reviving, and Causing to Die)

Both Ihya’, which means granting life, favoring with life, and reviving, and Imata, which means causing to die or dealing with death, are among the Attributes of action of the Giver of Life and the One Who causes death. These two Attributes are mentioned in the Qur’an in different verb forms, sometimes together and sometimes separately. Some examples are as follows:

Surely in the creation of the heavens and the earth, and the alternation of night and day, and the vessels sailing in the sea with profit to people, and the water that God sends down from the sky, therewith reviving the earth after its death and dispersing therein all kinds of living creatures, and His disposal of the winds, and the clouds subservient between the sky and earth—surely there are signs (demonstrating that He is the One God deserving worship, and the sole Refuge and Helper) for a people who reason and understand (2:164).

God sends down from the sky water and therewith revives the earth after its death. Surely in that there is a sign for people ready to hear (the truth) (16:65).

A clear sign for them (of God’s Oneness and Lordship) is the dead earth: We revive it and bring forth from it grain (36:33).

And He it is Who causes to die and gives life (53:44).

How can you disbelieve in God, seeing that you were dead, and He gave you life? Then He causes you to die. Then He will bring you to life again; and then you will be returned to Him (2:28).

They will say: “Our Lord! You have made us die twice, and given us life twice, so we acknowledge our sins” (40:11).

Abraham said, “My Lord is He Who gives life and causes to die.” (2:258).

Surely it is also We, We Who give life and cause to die (15:23).

God (He alone) gives life and causes to die; and whatever you do, God sees it well (3:156).
