Isabel of Castile, First Duchess of York

Isabel was the third of four children of King Pedro I, also known as Pedro the Cruel, who ruled the Crown of Castile from 1350. Her mother was the vivacious and intelligent Maria de Padilla, often described as Pedro's mistress. In 1361, when Isabel was only six, her mother died. The following year, Pedro declared that he and Maria had been lawfully married before he was forced to espouse his estranged French wife, Blanche of Bourbon, who was by then also dead, some said murdered by her husband. His claim of an earlier marriage was subsequently endorsed by the Cortes, thus legitimising Pedro's children by Maria. Pedro was killed by his illegitimate half-brother and deadly enemy Enrique of Trastámara in March 1369. Trastámara became King Enrique II of Castile.

Isabel accompanied her elder sister Constanza to England, and married Edmund of Langley, son of Edward III and Philippa of Hainault, in 1472 at Wallingford, as part of a dynastic alliance in furtherance of the Plantagenet claim to the crown of Castile. Isabel was only 16 or 17 to Edmund’s 31, and brought him no lands or income or even the promise of such because her sister Constanza – who married Edmund’s elder brother John of Gaunt as his second wife – was their father’s heir. John and Constanza spent many years trying unsuccessfully to claim her late father’s throne from her illegitimate half-uncle Enrique of Trastamara, while Edmund and Isabel were required to give up any claims to the kingdom of Castile and were not compensated.

As a result of her marriage, Isabel became the first of a total of eleven women who became Duchess of York. She was appointed a Lady of the Garter in 1379. In their twenty years of marriage, the Duke and Duchess of York had three children:

Contemporary sources suggest that Edmund and Isabel were an ill-matched pair and their relationship was a rocky one, with Isabel accused of having an affair with John Holland, Duke of Exeter and half-brother to Richard II. The affair is believed to have started as early as 1374 and likely continued for a decade. As a result of her indiscretions, Isabel left behind a tarnished reputation. The chronicler Thomas Walsingham considered her to have somewhat loose morals.

John Holland has also been suggested as the real father of Isabel’s youngest son, Richard of Conisburgh, who was the grandfather of Edward IV and Richard III. The fact that his father Edmund of Langley and brother Edward, both, left him out of their wills has fuelled this theory. However, leaving a son out of your will was not entirely unusual, and Richard had died when his brother made his will.

Isabel of Castile died in December 1392 at the age of about 37 and was buried at Langley Priory in Hertfordshire. In her will, Isabel left items and gifts of money to close relatives by blood or marriage, and to numerous servants of hers, men and women. Isabel referred to Edmund of Langley as her "very honoured lord and husband of York", and left him all her horses, all her beds including the cushions, bedspreads, canopies and everything else that went with them, her best brooch, her best gold cup, and her "large primer". Isabel named King Richard II as her heir, requesting him to grant her younger son, Richard, an annuity of 500 marks. Isabel left nothing at all to her older sister Constanza, duchess of Lancaster, and failed even to mention her. Isabel doesn't forget John Holland in her will, at this time married to Elizabeth of Lancaster, John of Gaunt's daughter.

About 11 months later her widower married Joan Holland, niece of Isabel's supposed lover, John Holland. In another bizarre family twist, it was Joan’s brother, Edmund Holland, Earl of Kent, who had an affair – and an illegitimate daughter – with Constance of York, the daughter of Edmund and Isabel. In Edmund’s own will of 1400 he requested burial ‘near my beloved Isabele, formerly my consort.’  Despite Isabel of Castile's bad reputation and supposedly having been involved in a court scandal that humiliated her husband, Edmund seems to have felt great affection for her as demonstrated by his willingness to rest eternally with Isabel and not with his second wife.

that didn't stop her from coming back to court at fifteen, though her stay there would be even shorter. the strong will she had could not be contained by the queen who would then advice (truly, almost demand) that the rykker's mother to deal with mere somehow. the method chosen was the citadel. the life of a novice was the last thing merry would care to indulge. the life of a maester seemed like a nightmare, certainly a punishment that mother wasn't even qualified to bestow upon her (hadn't her mother been just as bad of a hellion in her youth, sailing all the way from saath to westeros?), yet, she went. the convincing part of it was the knowledge she could pry from the teachers: you needn't take the vows, she was promised.

and truly, it wasn't all bad. she enjoyed some subjects — she would go on to forge four chains: black iron (raven), copper (history), bronze (astronomy), lead (poisoning) — and made some acquaintances she'd hold dear, but patience could only hold to a certain time. on the eve of the date of another chain test, she chose to board a ship out of westeros instead. if anything, that was on her mother, who had fed her such stories of success — she wanted nothing but to redo it, forge her own path the way she wanted to. it wasn't all nice nor pretty, not the way she would tell people later on. when the money ran out, she was ready to join a pillow house before she saw a performance of a traveling trope that would take her in.

with them, she went around most of the free cities until some three years ago, when she became the mistress of the magistrate of lys. it was around there that she first met aerys targaryen, though it would take her years to entirely leave her very comfortable position to follow a beggar prince — not until the dragons were born again and it was like mere was three again, eating up mistified tales of a family of old. she's always struggled to believe, but maybe in this — in this, she can find something that sticks.

El hecho de que pudiera tener derecho a una pensión por invalidez no obsta a esta reparación por tratarse de un beneficio previsional, a cuya obtención contribuyó económicamente el causante. Por eso, a las ventajas derivadas de las Jubilaciones, pensiones y seguros se las ha calificado con acierto como “compradas” (LL, 95-617). POr lo demás, hacer Jugar esos beneficios en favor del responsable del hecho ilícito, para evitar un supuesto enriquecimiento de la víctima, es invertir radicalmente su Il-nalidad: la protección del damnificado; importando igualmente un injusto enriquecimiento del culpable (Orgaz, «EL Daño Resarcible”, ed. 1952, núm, 53, ps. 207-9, y BOr. da “Obligaciones’, 23 ed., t. I, núm. 160, P. 147).

Aunque aquí no se trata de una indemnización laboral, sino civil a —donde, por no estar legislada, la materia es de elaboración doctrinaria y Jurisprudencial—, la ley de accidentes de trabajo autoriza expresamente en su art. 13 bis, agregado por la ley 12.647, la acumulación de beneficios.

La compensación del daño moral es indiscutible puesto que se está frente a un hecho ilícito (art. 1076, según reforma de la ley 17.711). El importe fijado en la sentencia no es objeto de agravio.

4.º Por tales fundamentos, votó en parte por la afirmativa, debiendo confirmarse la sentencia apelada, pero modificando el monto de la condena, que se reduce a la suma de $1.150.000. Con costas de alzada, por tratarse de una acción indemnizatoria.

Los doctores Padilla y Cichero, por análogas razones a las expuestas por el doctor Fliess, votaron en el mismo sentido.

—En atención a lo que resulta de la votación de que instruye el acuerdo que antecede, se confirma en lo principal la sentencia apelada, pero modificando el monto de la condena, que se fija en la suma de $ 1.150.000, con intereses dispuestos y las costas de ambas instancias., Jorge F. POLICÍA FEDERAL: Accidente en y por acto de servicio. Concepto. Ley aplicable.

1.— La exigencia contenida en la disposición reglamentaria vigente, en cuanto requiere que para que un accidente sea reputado como producido en y por acto de servicio, que provenga de un riesgo específico de las funciones policiales, no resulta violatoria del texto legal reglamentado, habida cuenta que se ajusta a la naturaleza excepcional del beneficio concedido por la ley y al criterio de interpretación restrictivo que ha privado en materia de beneficios previsionales a los miembros de las fuerzas de seguridad o de las Fuerzas Armadas de la Nación; no alterando la conclusión expuesta el hecho de que el accidente sufrido haya operado como concausa de las lesiones que determinaron la afección invalidante, por no llenarse de tal forma las exigencias del régimen legal.

2.— La modificación introducida por el decreto 4024/63 al art. 490 del decreto 6580/58, resulta aplicable a todos los casos que a la fecha de su sanción no tuvieron resolución firme (art. 29), circunstancia esta que, ante la ausencia de impugnación concreta y oportuna con base constitucional por parte del apelante, determina su aplicación en el sub judice.
