Ticketmaster jacks us for billions so it can pocket millions

NEXT WEEKEND (June 7–9), I'm in AMHERST, NEW YORK to keynote the 25th Annual Media Ecology Association Convention and accept the Neil Postman Award for Career Achievement in Public Intellectual Activity.

Corruption is a system of concentrated gains and diffused costs: cheaters make a lot of money, and their victims each lose a little. The cheater has a much larger pool of money to spend on keeping the scam going, and the victims need to pay again to fight the cheater.

Actually, it's worse. The victim pays once when they are cheated, then, they pay a second time (in time and/or money) when they fight back against the cheater.

But in order to fight back effectively, the victims need to band together – it doesn't make sense for one victim to pony up to counter the cheater, because the cheater stole from a lot of people and can therefore spend far more than the victim lost and still come out ahead.

This is the third time the victim pays: they pay the "collective action" tax of locating other victims, agreeing to a common strategy for fighting back, and then coordinating with all those co-victims to keep the campaign up.

But actually, it's even worse. Because most corruption isn't just dishonest, it's incredibly wasteful. Corruption involves stealing ten dollars from you to make a dime for the cheater. The polluter who gives you cancer rather than cleaning up their industrial process costs you millions in medical bills – and maybe costs your family the lifelong trauma and expense of living with your death. They pocket an infinitesimal fraction of those costs. The rest is just wasted. They're setting your house on fire to spare themselves the cost of a match to light their cigar.

This is yet another way in which the deck is stacked in favor of corruption. A victim of corruption is placed in a condition of precarity and misery from which is it difficult to marshal a counteroffensive. The cheater, meanwhile, is made stronger and more comfortable by their corrupt activities. Immiserated victims must undertake the hard, ongoing work of acting together to be effective against the cheater. The cheater answers only to themself, avoiding the collective action costs that the victims pay every time they seek to act.

All of this is why we have governments. A government is (said to be) a democratically accountable way to meet the concentrated power of the corrupt with the concentrated power of the victims of corruption. Governments are many things, but they are especially a way of solving the collective action problem of enforcing the rules against cheaters. This is partially in service to justice – no one likes to be cheated, and a society of rampant and routine cheating is unstable and prone to collapse.

But it's also a matter of efficiency. While it makes a certain kind of selfish sense for the cheater to liquidate our dollar to make their penny, from a societal perspective, it's a catastrophe. Letting Wall Street slumlords corner regional markets in single family dwellings makes large amounts of money for their investors, but it costs those cities unimaginable amounts in public services as their housing stock decays, homelessness spikes, and schools and public services crumble for want of local taxes.

The paltry sums that Flint's creditors extracted by insisting on switching to a chlorinated water-supply that leeched lead out of the city's water infrastructure are crumbs compared to the vast, lifelong costs of giving an all the children in a city lead poisoning, to say nothing of the costs to the city as a city nor forever tainted by this unspeakably evil crime.

This is why inequality – and its handmaiden, monopoly – is so dangerous. The more concentrated private wealth becomes, the harder it is for the state to police, and the more likely it is that this private wealth will corrupt our officials. We see this all around us – for example, when Supreme Court justices receive lavish gifts from billionaires whom they later rule in favor of:

Through the neoliberal era – the past forty years of billionaire-friendly Reaganomics – we've seen increasing concentration in wealth, coupled to increasing collusion between the wealthy and the government to protect the corrupt against the public. Think of the IRS's long decay, in which it turned a blind eye to increasingly blatant tax evasion by the ultra-wealthy, while training its fire on working people who fudge a few bucks on their returns:

This emphasis on benefits cheating and indifference to corporate crime really highlights the drag that corruption places on a society's efficiency. Even if you believe that there's a lot of welfare fraud (there isn't!), the dollar in "undeserved" food stamps spent by a cheater costs society…a dollar. Meanwhile the dollar that a corporate criminal makes by skimping on workplace safety costs society thousands of dollars to care for the worker who is then maimed on the job.

This is very easy to see in the world of corporate environmental crime. The "social cost of carbon" measures the total cost of pollution: the injuries caused by marinating in fossil fuel extraction, processing and combustion byproducts; as well as the loss of life and property from climate events. Governments that sleep on corporate crime are objectively governing badly. That's why the antitrust failures of every US presidential administration from Carter to Trump are so damning: they set the stage for later corruption that would not only be carried out on a larger scale than smaller firms could accomplish, but also for those large firms to corrupt the political process.

This is the Ticketmaster story. The superpredator that is today's Ticketmaster is the end-point of a series of ever-more corrupt mergers, waved through by every-more pliable presidential administrations. It was bad enough when Bush I allowed Ticketmaster to gobble up Ticketron in 1990. After all, the company had already proven itself to be a cesspit of corrupt, bullying activity.

The Ticketron acquisition kicked off a two-decade-long corporate crime-spree that produced a mountain of evidence proving Ticketmaster's nature as an inherently corrupt enterprise that acquired power for the purpose of abusing that power, at the expense of creative workers, the public, and the owners of venues:

Despite this, the Obama administration waved through an acquisition that was obviously far more dangerous that the Ticketron caper: the 2010 merger between Ticketmaster and the concert promoter Live Nation:

After a decade and a half of vertical monopoly power – Ticketmaster/Live Nation controlling ticketing, promotion and venues – the company has grown from a dangerous octopus with its tentacles twined around the industry into a kraken that is strangling every kind of live event and everyone who earns a living from them. This has produced an ever-more obvious string of scandals, most notably the company's assault on Swifties:

A combination of mounting public outrage (with Swifties at the vanguard) and the Biden administration's generational enthusiasm for smashing corporate power has led, at last, to a reckoning with the Ticketmaster kraken:

Ticketmaster is a famously opaque organization. When Rebecca Giblin and I were working on Chokepoint Capitalism, our book on monopoly and creative labor markets, we were able to speak on the record to insiders from every part of the industry, except live performance:

As soon as we raised Ticketmaster/Live Nation with club owners and other events industry insiders, they'd go pale and quiet and tell us that they didn't feel comfortable staying on the record. TM/LN has a well-deserved mafia-style reputation for savage retaliation against snitches.

With the DOJ Antitrust Division chasing Ticketmaster through the courts, we're starting to get a rare, on-the-record glimpse of TM/LN's operations, as its internal documents find their pay into court records. In response Ticketmaster's spokesliars have embarked on an epic spin campaign, to "contextualize" these damning numbers and paint the company as a weak, low-margin business that has been unfairly set-upon by the bullies at the DOJ.

Stoller starts with Ticketmaster's insistence that it is barely profitable. Though this is true on paper, the numbers just don't add up. For one thing, anyone who's bought a ticket can see, printed on its face, TM's junk fees: "a 'service fee' without any obvious service [and] a 'convenience fee' that is anything but convenient."

Far more damning is a comparison between the price of a Ticketmaster ticket in the US vs the EU. The EU has legally mandated competitive ticketing, and the tickets there are far cheaper. A US ticket to see Taylor Swift will run you $2,600 – the same ticket costs $340 in the EU. As Stoller writes:

An American could fly to Paris, spend a few nights at a nice hotel, see a Taylor Swift concert, and fly back, for less than it costs to see that same show in the U.S.

How to make sense of this contradiction? How can Ticketmaster show such a low profit margin on its books but somehow end up costing event-goers such an absurd premium?

Start with the fact that Ticketmaster has three businesses, not just one. They sell tickets, but they also promote concerts (that is, front the money for personnel, travel and marketing), and they also own a bunch of the largest and most profitable venues in the country.

This allows them to play a shell-game that's very similar to (and possibly not actually different from) money-laundering, where money is shuffled between entities in order to shield it from creditors, suppliers or tax agents:

But this presents a problem for Ticketmaster. They're a publicly traded company and their investors demand high returns. And unlike performers or venue owners, investors have power over Ticketmaster management. Keeping "margin per ticket" number as low as possible lets Ticketmaster minimize the revenue it has to share with the people who actually do the work and invest the capital in live performances. But for investors, they need to show another number, one that's as high as possible, to keep the investors happy.

That number is "Adjusted Operating Income" or AOI. While gross margins are the difference between the face value of a ticket and the sum remitted to the venue and the performer, AOI factors in all the other revenue TM/LN books from that ticket, like kickbacks. TM/LN's AOI is very healthy: it's 37% on tickets and 61% on promotions.

Those sums delight TM/LN's investors, and they express their joy through lavish executive compensation packages. CEO Michael Rapino is America's fifth-highest paid CEO, at $139m/year (that's eight times the Fortune 500 average). His sidekick Joe Berchtold is America's highest paid CFO, at $54m. The total AOI for TM/LN is $732m/year – and 19% of that is being paid to two of its execs.

But LN/TM has a third line of business: operating venues. The AOI for these venues is just 1.7%. If this were a normal, cutthroat business, you'd expect those same return-focused investors to insist on their handsomely compensated execs selling off that low-margin turkey. But nevertheless, TM/LN keeps those venues on its books.

When those execs talk to the public, they use the poor profit margins of ticketing and the poor AOI on venues to plead poverty: "how can we be a monopoly when we're barely scraping by?"

But when they talk to the investors who decide whether to pay them 800% of the S&P500 average, they are more forthcoming.

Keeping the margins low on tickets – and making up the money with kickbacks and other corrupt payments – means that potential rival ticketing firms can't afford to get into the business. Without the venue and promotion business, those rivals wouldn't be able to command kickbacks. They'd have to subsist on the rock-bottom margins that are competitive with Ticketmaster.

Likewise those venues: ownership of key venues lets Ticketmaster/Live Nation force out credible rivals in important markets, and keep new ones from emerging, because again, they'd have to make a living on that paltry 1.7% AOI (or the even lower profit margins!).

As Joe Berchtold, the highest-paid CFO in America, told an analyst:

I don't think Concerts AOI per fan is a logical way to look at it. I think if you look at how we've talked about our business, we've talked about our business across the multiple pieces. So you have to look at it, what's the concerts plus sponsorship plus ticketing AOI per fan.

Berchtold is paid roughly $26,000/hour. Those words take roughly 25 seconds to utter, so that's a $7.20 explanation, but it contains a wealth of information – it's basically the DoJ's case in a nutshell.

But Stoller points out a curious fact that isn't captured here. Remember when I told you that TM/LN's NOI is $732m/year? What I didn't mention is the company's gross revenue: $16.7 billion.

When TM/LN talks about how shitty their business is, and therefore they can't be a monopoly, this is the trump card. How could a company creaming off a mere $732 million off $16.7 billion in gross revenue be a monopolist with "pricing power"?

This is where understanding corruption helps clarify our understanding and cut through the bullshit. Corruption is vastly wasteful. In order to extract $732m from $16.7b, TM/LN has to engage in a lot of wasteful and corrupt activities. They have to bribe other key players in the system, spend vast fortunes on lobbying, and generally do a lot of unproductive things with their money.

This is concentrated gains and diffuse losses. In order to command the highest salary of any American CFO, Berchtold has to cook up and maintain this process. In order to earn his $139m/year, Rapino has to play mafia don and keep everyone is his supply chain sufficiently terrorized or sufficiently greased to maintain omerta.

These two men take home a fifth of Ticketmaster's net income because they possess a rare and valuable skill. They are able to obfuscate a corrupt arrangement, enrobing it in layers of performative complexity, until the average musician, concertgoer, or lawmaker, can't understand it. Any attempt to unravel it will induce a deadly, soporific confusion. The investment industry term for his is MEGO (My Eyes Glaze Over), the weaponization of complexity. A skilled MEGO artist can convince you that the pile of shit they're peddling is so large that there must be a pony under it somewhere.

Here's Stoller, de-MEGOfying the TM/LN story:

Live Nation has a giant capital intensive unprofitable division of putting on concerts, from which it skims for its real cash flow. But this leverage among different subsidiaries means that it has an incentive to push up the cost of concerts overall, not just for its own profit. This incentive operates in two different ways. One, since ticket fees are based on the price of a ticket, Live Nation seeks higher prices for tickets so it can move more cash to its Ticketmaster subsidiary. And two, since Live Nation itself gets rebates by overpaying for venues, it has the incentive to push up the cost of shows. No one can undercut Live Nation, as it’s a monopoly.

You might think that this is a lot of mental energy to expend on understanding live performances. If you're not trying to see Taylor Swift, does any of this matter?

It assuredly does. Understanding how Ticketmaster's shell-game works is critical to understanding the similar shell-games played by many other kinds of monopolists, who have wrapped their tentacles around all the other parts of our lives. As David Dayen and Lindsay Owens write for The American Prospect, the companies that avoided monopoly prosecution by ripping off suppliers have bled those suppliers dry, and now they're coming for their customers:

From groceries to plane tickets, rent to cab rides, Amazon to Ticketmaster, we are living through the "Age of Recoupment," when the long con of lowering prices to secure monopolies flips enters it final stage: greedflating the shit out of customers, and using the monopolist's power over regulators to avoid consequences.

Today, everywhere consumers turn, whether they are shopping for groceries at the local Kroger or for plane tickets online, they are being gouged. Landlords are quietly utilizing new software to band together and raise rents. Uber has been accused of raising the price of rides when a customer’s phone battery is drained. Ticketmaster layers on additional fees as you move through the process of securing seats to your favorite artist’s upcoming show. Amazon’s secret pricing algorithm, code-named “Project Nessie,” was designed to identify products where it could raise prices, on the expectation that competitors would follow suit. Companies are forcing you into monthly subscriptions for a tube of toothpaste. Banks have crept up the price of credit, so customers who cannot afford price-gouging in their everyday transactions get a second round of price-gouging when they put purchases on credit. Expedia is using demographic and purchase history data to set hotel pricing for an audience of one: you.

When these companies end up in front of angry attorneys general, DOJ lawyers, or an FTC investigation, they'll use the Ticketmaster/Live Nation playbook to try and wriggle off the hook. They'll point to some barely-profitable (or money-losing) part of their business and say, "How could a monopolist possibly be running a business this shitty?"

If the DOJ makes its case against Ticketmaster, it will set a precedent, both in court and in policy circles, for understanding how a monopolist's corruption works. Monopolists aren't always businesses with gigantic margins. Like other criminals, their corruption can produce spectacular wealth and spectacular waste at the same time.

How rich is Tony Stark?

Throughout his superhero career, Tony's net worth in the MCU has always been between $10 and $20 billion. How much is that? Let's talk about Tony Stark's real financial resources and purchasing power.

The numbers themselves don't tell us anything, so we'll compare. Some real billionaires are much richer than him (Elon Musk - $210 billion, Jeff Bezos - $195 billion, Bill Gates - $129 billion). Huge difference, don't you think?

Let's list Tony's expenses: he founded and funded Damage Control. He covered the cost of the destruction caused not only by the Avengers, but by everyone they fought. He funded scientific projects and charitable foundations. He covered all the Avengers' expenses (compound, equipment, tech, vehicles, quinjets, food, medical and legal services, staff, team members' salaries, etc.). He made Iron Man suits and equipment for himself, Peter, Rhodey, and later Pepper. It takes a LOT of money to cover all of this. And it's all pure expense. He didn't make any profit from it.

Reminder: He's not nearly as rich as Musk, Bezos or Gates. How much can these guys do, buy and finance? Less than you think. Now divide by 10 to get an idea of ​​how much Tony could.

EARLIER THIS WEEK, two Democratic senators announced they have requested a criminal investigation into Supreme Court Justice Clarence Thomas — regarding, in part, a loan for a luxury RV provided by a longtime executive at UnitedHealth Group, one of America’s largest health insurers. Thomas apparently recused himself in at least two cases involving UnitedHealth when the loan was active, according to a Rolling Stone review. Yet, he separately chose to participate in another health insurance case and authored the court’s unanimous opinion in 2004. The ruling broadly benefited the industry — shielding employer-sponsored health insurers from damages if they refuse to cover certain services and patients are harmed. Thomas’ advice to patients facing such denials? Pull out your checkbook.

While UnitedHealth was not a party to the case, the company belonged to two trade associations that filed a brief urging the Supreme Court to side with the insurers.  “As we saw so starkly this term, Supreme Court decisions can have sweeping collateral implications: If the court rules in favor of one insurance giant, for instance, it tends to be a boon for all the other insurance giants, too,” says Alex Aronson, executive director at the judicial reform group Court Accountability. “That was the case here, and it’s a perfect example of why justices shouldn’t accept gifts — especially secret ones — from industry titans whose interests are implicated, whether directly or indirectly, by their rulings.” The public had no way of knowing about Thomas’ RV loan at the time of the decision: The loan was only exposed by The New York Times last year. Senate Democrats investigating Thomas believe that much or all of the loan, for a $267,230 motor coach, was ultimately forgiven. Sens. Sheldon Whitehouse (D-R.I.) and Ron Wyden (D-Ore.) recently requested the Justice Department investigate whether Thomas reported the forgiven portion of the loan on his tax filings, after he failed to disclose it in ethics forms.

Meanwhile, Thomas’ health insurance opinion has had wide-ranging, long-lasting ramifications, according to Mark DeBofsky, an employee benefits lawyer and former law professor.  “It hasn’t been rectified. The repercussions continue,” DeBofsky tells Rolling Stone. “People who are in dire need of specific medical care, and [their] insurance company turns around and says, ‘That care is not medically necessary,’ and there’s an adverse outcome as a result of the denial of the treatment, or hospitalization, or service — there’s no recompense for what could have been an unnecessary death or serious injury.” Since last year, the Supreme Court has faced an unprecedented ethics crisis, with much of the focus aimed squarely at Thomas. ProPublica reported that Thomas received and failed to disclose two decades worth of luxury gifts from a conservative billionaire, Harlan Crow, who allegedly provided free private jet and superyacht trips to Thomas and his wife; bought a house from Thomas and allowed the justice’s elderly mother to live there for free; and paid for at least two years of boarding school tuition for Thomas’ grandnephew.

Thomas does not appear to have explained his decision to withdraw from the two matters that directly involved UnitedHealth. Thomas did not take similar steps in Aetna Health Inc. v. Davila, a case that broadly affected the health insurance industry. He instead authored the court’s opinion, which expanded insurers’ favorite tool for limiting liability: ERISA. Congress passed the Employee Retirement Income Security Act, commonly known as ERISA, in 1974 to protect employee benefits. The law is relatively vague when it comes to “welfare benefits,” and contains a broad preemption clause. The courts have filled in the blanks — including in the Aetna Health case — with distressing results for patients. Half of Americans have employer-sponsored health insurance coverage; nearly all of these plans are governed by ERISA.

I can talk about the NYC fiscal crisis, let me get my lecture notes.

As I talked about with the list of NYC mayors, NYC had been borrowing money for a while. The underlying cause was that NYC's industrial economy had started shrinking in the 1950s, sapping the city's tax base and population. To try to cope with the social consequences of this economic decline, the city had been increasing spending on police, teachers, and welfare benefits. For a good while, the city had been able to paper things over by increasing taxes and various creative accounting measures, and had managed to keep things rolling over.

And then the 1973-1975 recession hit. All of the sudden, the city loses 38,000 jobs, unemployment rises, which means demand on social services increase, and all of the sudden that poor bastard Abe Beame is looking at a $1.5 billion annual hole in the budget that's ballooning NYC's debt.

But at the same time, another part of the story is that NYC's banks aren't doing too hot: as Joshua Freeman notes in Working-Class New York, the same NYC banks that had been encouraging city government to borrow more (because municipal bonds were a good profit source) had lent money very unwisely to developing nations and needed to cover their losses. So they started selling off their municipal debt holdings and started pushing the city to increase the interest rates they were offering.

However, they also asked for major policy changes. They wanted the city to fire public sector workers, they wanted the city to cut spending on social services and capital projects, and until the city agreed to make these changes, they wouldn't buy or underwrite city bonds. To me, the telling detail is that they started asking for more policy changes - raise the subway fares from ¢35, end free tuition at CUNY - that wouldn't affect the city's budget at all, since neither the MTA nor CUNY were city agencies. This wasn't just creditors wanting their debtor to improve their budget outlooks: this was a capital strike aimed at disciplining the unions, poor minorities, and the middle class into accepting a worse standard of living.

And so the city went to the Ford Administration for emergency aid, and Ford turned them down because he wanted to make NYC an example of what happened to liberal governments. Ford's Treasury Secretary said that the Federal government would only provide aid if the rescue package was "so punitive, the overall experience made so painful, that no city, no political subdivision would ever be tempted to go down the same road."

Ultimately, the city was forced to knuckle under. It eventually got a state bailout, but only by giving in to every conceivable demand that capital had made and giving them and the state government control over the city's taxes, bonds, and budget for decades. The result was that:

a quarter of the city's workforce lost their jobs;

the city's schools saw their teacher-student ratios shoot up and their wraparound services cut to shreds;

CUNY shrank by 62,000 students and became 50% whiter as black and brown students could no longer afford to attend;

the subway became more expensive, less reliable, and more dangerous;

public hospitals closed, leading to diverging health outcomes between rich and poor;

fire houses closed, leading to increasing response times that were the key factor behind the Bronx burning;

and on and on.

At the end of the decade, NYC had lost a million residents and would not recover fully until the turn of the millenium. But hey, at least the books were balanced!

Of the incalculable amount of money stolen from drivers by Uber and Lyft through various accounting shenanigans, $328m will be paid back to them and their lawyers in a settlement announced earlier this week.

Uber agreed to pay $290 million and Lyft $38 million in what New York Attorney General Letitia James called the largest wage-theft settlement her office has ever secured. The money will be distributed to cheated drivers who will get back pay along with mandatory paid sick leave and other benefits. Eligible drivers can file a claim to receive the money owed.

Uber deducted sales taxes and other fees from drivers' pay rather than adding it to customers' tabs, and lied about it in its terms of service. Lyft did likewise, through the cunning device of applying an "administrative charge" equal to sales tax.

A statement from New York Attorney General Letitia James: "For years, Uber and Lyft systemically cheated their drivers out of hundreds of millions of dollars in pay and benefits while they worked long hours in challenging conditions. Yesterday, in a long story about “the petty feud between the [New York Times] and the White House,” Eli Stokols of Politico suggested that the paper’s negative coverage of President Joe Biden came from the frustration of its publisher, A. G. Sulzberger, at Biden’s refusal to do an exclusive interview with the paper. Two people told Stokols that Sulzberger’s reasoning is that only an interview with an established paper like the New York Times “can verify that the 81-year-old Biden is still fit to hold the presidency.” 

For his part, Stokols reported, Biden’s frustration with the New York Times reflects “the resentment of a president with a working-class sense of himself and his team toward a news organization catering to an elite audience,” and their conviction that the newspaper is not taking seriously the need to protect democracy. 

A spokesperson for the New York Times responded to the story by saying the idea that it has skewed its coverage out of pique over an interview is “outrageous and untrue,” and that the paper will continue to cover the president “fully and fairly.”

Today, Biden sat for a live interview of more than an hour with SiriusXM shock jock Howard Stern. Writer Kurt Andersen described it as a “*Total* softball interview, mostly about his personal life—but lovely, sweet, human, and Biden was terrific, consistently clear, detailed, charming, moving. Which was the point. SO much better than his opponent could do.”

Also today, the Treasury Department announced that the pilot program of the Internal Revenue Service (IRS) that enabled taxpayers to file their tax returns directly with the IRS for free had more users than the program’s stated goal, got positive ratings, and saved users an estimated $5.6 million in fees for tax preparation. The government had hoped about 100,000 people would use the pilot program; 140,803 did.

Former deputy director of the National Economic Council Bharat Ramamurti wrote on social media, “Of all the things I was lucky enough to work on, this might be my favorite. You shouldn’t have to pay money to pay your taxes. As this program continues to grow, most people will get pre-populated forms and be able to file their taxes with a few clicks in a few minutes.” Such a system would look much like the system other countries already use. 

Also today, the Federal Trade Commission announced that Williams-Sonoma will pay a record $3.17 million civil penalty for advertising a number of products as “Made in USA” when they were really made in China and other countries. This is the largest settlement ever for a case under the “Made in USA” rule. Williams-Sonoma will also be required to file annual compliance certifications. 

FTC chair Lina Khan wrote on social media: “Made in USA fraud deceives customers and punishes honest businesses. FTC will continue holding to account businesses that misrepresent where their product[s] are manufactured.” 

In another win for the United Auto Workers (UAW), the union negotiated a deal today with Daimler Trucks over contracts for 7,300 Daimler employees in four North Carolina factories. The new contracts provide raises of at least 25% over four years, cost of living increases, and profit sharing. This victory comes just a week after workers at a Volkswagen plant in Chattanooga, Tennessee, voted overwhelmingly to join the UAW. 

Today was the eighth day of Trump’s criminal trial for his efforts to interfere with the 2016 election by paying to hide negative information about himself from voters and then falsifying records to hide the payments. David Pecker, who ran the company that published the National Enquirer tabloid, finished his testimony. 

In four days on the stand, Pecker testified that he joined Michael Cohen and others in killing stories to protect Trump in the election. Trump’s longtime executive assistant Rhona Graff took the stand after Pecker, and testified that both Karen McDougal and Stormy Daniels were in Trump’s contacts. Next up was Gary Farro, a bank employee who verified banking information that showed how Michael Cohen had hidden payments to Daniels in 2016.

Once again, Trump appeared to be trying to explain away his lack of support at the trial, writing on his social media channel that the courthouse was heavily guarded. “Security is that of Fort Knox,” he wrote, “all so that MAGA will not be able to attend this trial….” But CNN’s Kaitlan Collins immediately responded: “Again, the courthouse is open [to] the public. The park outside, where a handful of his supporters have gathered on [trial] days, is easily accessible.”

Dispatch Politics noted today that when co-chairs Michael Whatley and Lara Trump and senior campaign adviser Chris LaCivita took over the Republican National Committee (RNC), they killed a plan to open 40 campaign offices in 10 crucial states and fired 60 members of the RNC staff. According to Dispatch Politics, Trump insisted to the former RNC chair that he did not need the RNC to work on turning out voters. He wanted the RNC to prioritize “election integrity” efforts. 

The RNC under Trump has not yet developed much infrastructure or put staff into the states. It appears to have decided to focus only on those that are key to the presidential race, leaving down-ballot candidates on their own. 

While Trump appears to be hoping to win the election through voter suppression or in the courts, following his blueprint from 2020, Biden’s campaign has opened 30 offices in Michigan alone and has established offices in Wisconsin, Pennsylvania, Nevada, Arizona, Georgia, North Carolina, New Hampshire, and Florida.

Finally today, news broke that in her forthcoming book, South Dakota governor Kristi Noem wrote about shooting her 14-month-old dog because it was “untrainable” and dangerous. “I hated that dog,” she wrote, and she recorded how after the dog ruined a hunting trip, she shot it in a gravel pit. Then she decided to kill a goat that she found to be “nasty and mean” as well as smelly and aggressive. She “dragged him to the gravel pit,” too, and “put him down.”  

Noem has been seen as a leading contender for the Republican vice presidential nomination on a ticket with Trump, and it seems likely she was trying to demonstrate her ruthlessness—a trait Trump appears to value—as a political virtue. But across the political spectrum, people have expressed outrage and disgust. In The Guardian, Martin Pengelly said her statement, “I guess if I were a better politician I wouldn’t tell the story,” was “a contender for the greatest understatement of election year.”

Abdullah and Fadime Halil were newlyweds, young and in love. Abdullah felt lucky to finish university and to obtain a government job as an accountant. When the 1977 elections held no victor; however, he could feel the tensions rise in the city. One by one coworkers fled or disappeared or they asked him for money and favors. Arriving to work to find his desk in disarray and records missing, he called home and instructed Fadime to pack their bags. To his surprise she was quietly already doing so, a terrifying note left on the door. Abdullah, despite the lowly appearance of his job, had come across evidence that could sway support in a coup d’état. His choices were to lose his honor or his life; moreover, failure to decide fast enough would result in his and Fadime’s death.

The decision to seek asylum in the United States was not an easy one, but Abdullah had hoped he could find another accounting job in a big city. Having heard the great New York City immigration stories of old, he thought it would be a nice place to start his new life. It was a long process to be approved to leave Turkey and a longer process still to become U.S. citizens. Abdullah had tried and tried again to find a respectable job as an accountant, but no one would take him, prejudice and politics slammed door after door in his face. With family back home expecting him to pay their way to America too, he took a job as a cab driver and Fadime cleaned houses. After a few smart remarks, Abdullah wiggled his way into an accounting position for the cab company, giving it the opportunity to expand and for him to get the letters of reference he was lacking in his field so that he could get that ‘respectable’ job.

If there was one thing the immigrants never pictured it was a life lived paycheck to paycheck. With time it became more complicated with both of their parents crammed into their one bedroom apartment. While this provided Fadime and Abdullah with free childcare, by the time their third child was on the way, they had enough and Abdullah applied to jobs and pled with people to pass his name along. He did the taxes of people in the building, offered his services for minimal fees for the shops on their streets, and, then he got an unexpected call for a phone interview. The town of Cape Elizabeth, Maine was looking for an assessor and a friend of a friend had heard of him, a hardworking family man looking to get out of the big city. Naturally, they took the plunge.

Moving to Cape Elizabeth proved to be an absolute blessing. The government job provided them with temporary housing until they could buy a home on Abdullah’s new salary. That salary and the cost of living gave them a three level home where the grandparents took the basement, family time was shared in the center, and the upstairs rooms gave a master to Abdullah and Fadime, a soft pink room to their eldest child, Ayşe, a room off equal size and painted green to their middle child, Yasin, and a small nursery to their incoming boy, Emirhan. Unfortunately, life could not be so simple for the Halils and their extended family. On November 3rd, a heavy snow had fallen and as the ambulance took Fadime and Abdullah to the hospital for the birth of Emirhan, the crowded station wagon carrying all four of Emirhan’s grandparents and his two siblings lost control and crashed into the woods. The ambulance drove on, sending out a call for help as the stress sent the couple into further panic.

Only Ayşe and Yasin had survived the crash, but the trauma of sitting in a freezing car with blood and death of their love ones haunted them. Ayşe, who was nearly ten, suffered from night terrors. Yasin, at age six, began to act out or refused to speak at all, and there seemed to be no rhyme or reason behind his extreme mood swings. While Abdullah continued to work, Fadime stayed at home, caring for the children to the best of her ability, and pouring as much hope and love into Emirhan as possible. He seemed, for all intents and purposes, a happy baby. She had tried to have him made aware of his grandparents by wrapping him in their clothes and telling him stories, but once he could crawl he seemed to roam around too much for such things. Fadime packed up the rooms and left little of their memories out, which seemed to help Ayşe and Yasin. Then, Emirhan began to talk and the family was given a great shock.

Despite Ayşe and Yasin speaking solely English, Emirhan’s first words were in Turkish. He would walk to the shelf and touch the pictures and say “Merhaba dede!” or “Seni özledik”. While some parents may have found that sweet, the Halils were staunch Turkish Muslims that believed in Jinn and the Evil Eye. They feared for their son and put talismans in his room and Qu’ran verses in the common areas of the home. As he grew up and became more curious, Emirhan stumbled across the boxes of his grandparents belongings and found himself fascinated by them. He snuck item after item back to his room. Where he found stories and communication in the objects, relaying that to his family had concerning responses. For example, he brought up Dede’s watch and the inscription on the back, a verse about love and how it had been recited at Fadime and Abdullah’s wedding. They were surprised to hear it, but then more concerned when Emirhan looked to his siblings and said Dede wanted Ayşe and Yasin to carry love and happiness in their lives too. Was it wisdom or a curse?

They hoped their son was observant and intuitive, but they scolded him when these things happened in public to strangers. Emirhan learned slowly to keep his psychometry to himself, his own parents refusing to believe it, despite the evidence. The Halil children went through school and were considered to be odd. This led to different lifestyle choices and interests for each of the children, but also increased the bond between them, despite their age differences. However, Emirhan remained the sort of odd child out. Regardless of people believing in Heaven or Hell, ghosts and demons, a spirit world or intuition, Emirhan believed in what he saw or heard and always trusted his gut. In the end, that decision, despite his decision to not discuss his belief in psychometry (once he could put a word to the skill) would save lives and put others at peace.

With no fear of death and little interest in spending an excessive amount of money or time in school, Emirhan chose to be a mortician. However, to prevent being a burden on his father, who was already paying for the tuition of his older siblings, he chose to do so in the military. The idea alone terrified Abdullah and Fadime, but they let him go because they knew he was too strong willed to be told no. With their consent, he enlisted in the United States Navy, completing his training at Fort Lee, Virginia in 2011 before finding out he would immediately be sent to Afghanistan. Emirhan was fluent in Turkish and English, understood Arabic and could read it, and he was competent in Spanish, which he had taken in high school. Knowing he would be going to the Middle East encouraged him to learn Pashto and Dari, two similar languages, and to perfect his Arabic.

On paper, the job description was this: In a small unit of two or three Hospital Corpsmen and with volunteer security or local support, Emirhan would search areas for hasty or unmarked graves, unburied dead, personal effects, and identification media. They would also prepare, preserve, and ship the remains. This meant that he would frequently be in danger and then travel out of Afghanistan to Germany, Korea, or Puerto Rico, depending on the circumstances of his findings. In most cases, his trips were back to Germany and the remains made the next trip without him. As a result, Emirhan decided, after a couple of years of living on the Ramstein Air Base when he wasn’t in Afghanistan, he decided to rent a flat in Frankfurt.

Given the significantly higher rates of PTSD in his field, the military morticians were given longer and more regular periods of leave. Emirhan regularly uses these breaks to attend funerals in the states, leaving letters on the graves of those that have passed, to be found by the families. Passing on what he is given has largely been his way of coping with the terror of the world he lives in, but he does still have moments of overwhelming empathy that have impacted his personal life. From shaking a blind date’s hand and brushing against a bracelet that belonged to her mother, Emir could find himself catching flashes of a person’s personal life or the sorrow of a grandmother long gone. Other times he could be carefully moving through an antique store where his date had insisted they visit so he could get a second chair or more lamps, his fingers could brush the keys of a piano and he could be overwhelmingly compelled to sit and play. Then, despite never having training, if he indulged the urge the tune would come out. His partners had always, eventually, come to the conclusion that he was emotionally unstable or weird.

Despite the difficulties of his job, his interests, and the conflicts with his faith, Emirhan explored the world with hope and optimism. From learning Spanish guitar in Catalonia to praying in the Hagia Sophia before exploring the streets his parents grew up on in Turkey, traveling on the Lattice opened his eyes. Emirhan believes there is a delicate balance of cruelty and love in the world and that through travel, the balance can be tipped for good. While you may see him pausing awkwardly while exploring a museum, crying when he picks up items that spilled out of a stranger’s purse, or rubbing his temple as he tries to recall something he’d just said in a language he doesn’t actually know, Emirhan prides himself in his life having purpose.
