Copy Right and Public Domain in 2024

Happy 2024 all! its also Public Domain Day! a magical holiday here in America where things enter the public domain. Works published in the year 1928 (or 95 years ago!) have entered the public domain, which means they belong to us, all of us, the public!

Mickey's Back!

Yes! I'm sure you've heard, but Mickey Mouse (and Minnie Mouse too) is entering the Public Domain today. This has been news for a few years and indeed Disney's lobbying in the late 1990s is why our copy right term is SO long. So what exactly is now public domain?

Most people know about Mickey's first appearance Steamboat Willie, but a second short film, Plane Crazy was also released in 1928 so will also be public domain. So what's public? well these two films first of all, you're allowed to play them, upload them to YouTube or whatever without paying Disney. In theory you'll be allowed to cut and sample them, have them playing in the background of your movie etc. Likewise in theory the image of Mickey and Minnie as they appear (thats important) in these films will be free to use as well as Mickey's character as he appears in these works will be free to use. Now Mickey's later and more famous appearance

will still be protected. Famously the Conan Doyle Estate claimed that Sherlock Holmes couldn't be nice, smile, or not hate women in works because they still held the copyright on the short stories where he first did those things even though 90% of Sherlock Holmes stories were public domain. It's very likely Disney will assert similar claims over Mickey, claiming much of his personality first appeared in works still copyrighted.

Finally there's copyright vs trademark. Copyright is total ownership of a piece of media and all the ideas that appear in it, copyright has a limited set term and expires. Trademark is more limited and only applies to things used to market and sell a product. You can have a Coke branded vending machine in your movie if you want, but it couldn't appear anywhere in the trailer for your movie as thats you marketing your movie.

Where trademark ends and copyright begins and how trademarked something in the public domain is allowed to be are all unsettled areas of law and clearly Disney in the last few years as been aggressively pushing its trademark not just to Mickey in general but Steamboat Willie Mickey in particular

Ultimately the legal rights and wrongs of this might not matter so much since few people have the money and legal resources of the Walt Disney corporation so they might manage to maintain a de facto copyright on Mickey through legal intimidation, but maybe not?

And Tigger Too!

All the talk about Mickey Mouse and Steamboat Willie has sadly overshadowed other MAJOR things entering the public domain today. Most people are aware Winnie the Pooh entered the public domain in 2022, but they might not realize his beloved friend Tigger didn't. Thats because Tigger didn't appear till A. A. Milne's second (and last) book of Pooh short stories, The House at Pooh Corner in 1928.

Much like Mickey Mouse only what appears in The House at Pooh Corner is public domain so the orange bouncy boy from the 1960s Disney cartoon is still on lock down. But the A. A. Milne original as illustrated by E. H. Shepard is free for you to use in fiction or art. His friend Winnie the Pooh has made a number of appearances since being freed, most notably in a horror movie, but also a Mint Mobile commercial so maybe Tigger too will have a lot of luck in the public domain.

Other works:

Peter Pan; or the Boy Who Wouldn't Grow Up

Peter Pan is a strange case, even though the play was first mounted in 1904, and the novelization (Peter and Wendy) was published in 1911, The script for the play was not published till 1928 (confusing!) meaning while the novel as been public domain for years the play (which came first) hasn't been, but now it is and people are welcome to mount productions of it.

Lady Chatterley's Lover

The iconic porn novel that was at the center of a number of groundbreaking obscenity cases in the 1960s and helped establish your right to free speech.

All Quiet on the Western Front and The Threepenny Opera in their original German (but you can translate them if you want), The Mystery of the Blue Train by Agatha Christie, and Orlando by Virginia Woolf will also be joining us in the public domain along with any and all plays, novels, and books published in 1928

for Films we have The Man Who Laughs who's iconic image inspired the Joker

Charlie Chaplin's The Circus, Buster Keaton's The Cameraman, Should Married Men Go Home? the first Laurel and Hardy movie, Lights of New York the first "all talking" movie, The Passion of Joan of Arc, The Wind, as well as The Last Command and Street Angel the first films to win Oscars for Best Actor and Best Actress respectively will all be entering public domain

For Musical Compositions (more on that in a moment) we've got

Mack the Knife by Bertolt Brecht, Let’s Do It (Let’s Fall in Love) by Cole Porter, Sonny Boy by George Gard DeSylva, Lew Brown & Ray Henderson, Empty Bed Blues by J. C. Johnson, and Makin’ Whoopee! by Gus Khan are some of the notables but any piece of music published in 1928 is covered

Any art work published in 1928, which might include works by Frida Kahlo, Georgia O'Keeffe, Alexej von Jawlensky, Edward Hopper, and André Kertész will enter the public domain, we are sure those that M. C. Escher's Tower of Babel will be in the public domain

Swan Song, Public Domain and recorded music

While most things are covered by the Copyright Act of 1976 as amended by the Digital Millennium Copyright Act, none of the copyright acts covered recordings you see when American copyright law was first written recordings did not exist and so through its many amendings no one fixed this problem, movies were treated like plays and artwork, but recorded sound wasn't covered by any federal law. So all sound recordings from before 1972 were governed by a confusing mess of state level laws making it basically impossible to say what was public and what was under copyright. In 2017 Congress managed to do something right and passed the Music Modernization Act. Under the act all recordings from 1922 and before would enter the public domain in 2022. After taking a break for 2023, all sound recordings made in 1923 have entered the public domain today on January 1st 2024, these include.

Happy 2023 everybody! It's a new year meaning I've got new goals to meet. 21. Drink of choice (not just alcoholic)

Tea for everyday drinking, absolutely. While I don’t see Snape as a teetotaler, I think that in his private life he’s not much of a drinker. Maybe a lager or ale down the pub when he’s in Spinners End (otherwise his dad’s friends come looking for him to make sure he’s as fine as he always says he is), but that’s to be sociable. It’s the same for wine or spirits at a dinner party. He’ll have a bit of wine with dinner, but mostly because otherwise Lucius will sulk. Lucius sets great store by his wine cellar.

When Severus feels particularly frisky and is at home he might buy a bottle of squash.

Ton!Severus is similar, but his favorite comfort beverage is proper drinking chocolate, made with full fat milk.

This is a difficult one on the dislikes because I don’t see Severus as being terribly picky in general.

Favorites:

·        Curry – he has a map of the UK marked off with his favorite restaurants.

·        Cheese and leek pie – his mother could work miracles with minimal ingredients. It was a special occasion food, though, since cheese was rather dear.

·        Rhubarb crumble – Mrs. Evans made one that would make stone weep with joy, especially doused in custard

Despise:

·        Poorly cooked vegetables. Give this man a boiled sprout and you’ll be wearing it.

·        Pâté – from the smell to the flavor (and knowing how it comes to be), he cannot abide it. Mushroom pâté, though, isn’t so bad.

·        Poorly fried fish – fish and chips is an occasional indulgence and he will get shirty if the fish is soggy. He once spent half his summer perfecting home fried fish and chips out of spite and ate his deliciously crunchy fish right next to the substandard chippy.

⊹ emma talks. first request and i know it's very choppy TT but pls bear with me! It's been almost two years since I've properly written something TT lmk if you found anything wrong and I'll fix it!! I'd love it if i get any feedback!! Constructive criticism is also welcome as long as it's not you just bashing me for my bad writing 💔

Bella looks around as she enters the sugar rush ride music video set. Looking at the camera, " today is our first day of filming for our title song, sugar rush ride in Korea. I heard my shoot is with butterflies in my hand! Of course I know they're not real butterflies but I'm excited to shoot for the upcoming days!! Fighting!!" She says excitedly. She laughs when yeonjun mentions he feels like winnie the pooh. Looking at the eldest whose hands are currently busy with the honey.

When the lights went out during Soobin's shoot, she let out a scream to which she quickly apologized embarrassed. She stayed and watched everybody's individual filming and cheered for everyone! During the group scene, she was seen standing in the corner with her hands and legs spread out. When asked why, she replied "I don't like the feeling of glitter on my skin hahaha that's why I'm standing like this". When beomgyu heard her say this, he immediately ran to her and hugged her which made her scream at him and they chased each other for a bit before calming themselves down.

For the next outfit change, when they were fixing their hair and makeup, she asked soobin, "are you not wearing anything inside?" To which he replied "yea I'm quite cold".

She looked at taehyun with pure eyes of adoration as he spoke to the camera "our muscles are a part of our outfits. The choreography this time started off as refreshing and sexy but it's been corrupted to just sexy sexy haha. That's our choreography. I was really surprised to see ruby's muscles. I knew she worked out but i didn't know she hit the gym everyday" she laughed at his speech.

" There are a lot of points where we have to sit and then stand which makes the choreo very tiring " ruby said with a pout on her face while fanning herself and monitoring the group performance.

" But we'll have to overcome it to have the best performance, " she said while the rest of the group were trying to go through the choreography once again.

Laughing at Beomgyu's antics, she and Taehyun were bouncing around to which the other members except yeonjun soon joined.

After the last scene, the group finally finished their first day of filming. Gathering as a whole, they stood in front of the camera and ruby next to beomgyu and soobin when huening kai spoke about how their first day of filming had come to an end. Taehyun explained that it was their only shoot in Korea and most of it was dancing and asked them how they felt.

Ruby replied " I think the image shots came out really well and of course our choreography scenes always look really cool so I'm really excited for it!! The camera movements were very cool too!!"

She finished when Huening added that he was there too and soon one by one the members were starting to add themselves in as Bella laughed at their childishness. "Yeah yeah but it came out well so we're happy and let's do our best in the remaining shoot!! Well done everyone!" Huening kai said as the group followed with a 'lets meet at Bali!!'.

"Shoutout to our Indonesian fans," Yeonjun said as he pressed a kiss onto the camera with his hands. " It's my first time here in Bali but it's so nice and it feels like heaven!!" Ruby exclaimed as she looked around at nature.

" Ooh there are goats here!!" Ruby said to soobin and he and Beomgyu turned back to look where she was pointing. "The goats here are the size of Maltese" soobin said to which beomgyu replied "these two love little things. You can see their likes right here" ruby gave Beomgyu a side eye when he started singing baby goat and explained that the goats would come if he called like this which made the staff around them burst out in laughter.

Ruby saw that soobin and Beomgyu were running around chasing each other which brought a smile to her face. Her turn was to run with yeonjun. Him and Bella were standing there waiting when Yeonjun said it was too hot to which Bella agreed, fanning her face.

She then ran along with Yeonjun laughing and looking around when the director instructed them to. When they heard 'cut', they ran to their original place. "It's soo beautiful here. I can't believe a place like this actually exists". Yeonjun exclaimed looking at the beautiful place they were at, to which Ruby agreed by saying " i know right! I can definitely see why we decided to shoot here! So when we were checking on how the scenes turned out, it looked so beautiful" soon they were starting the group and the choreography scenes.

They were running around happily and smiling and laughing at each other.

Waiting to start the choreo, bella spotted a bug near soobin to which upon seeing it she lightly screamed startling poor beomgyu who was next to her. Soon they were done with the second day of total filming and first day of filming in bali. They once again gathered as a group to end the video for that day while clapping.

The second day of filming in bali, they were at a natural waterfall and the members were all taking pictures of the place and some sneaky pictures of Bella because she looked absolutely ethereal. "Why do you look like an angel today" beomgyu asked her which made her chuckle and ask him if it was a compliment or a genuine question.

She laughed along with soobin as he teased huening kai for stirring the water like it was iced tea. She pouted when she heard that Soobin had to get into the water for his scenes. She could see his shivering from where she stood. She went up to their stylist and asked her to bring a few more towels for soobin. After soobin finished, all the staff and the members clapped for him because he worked so hard. For the group scene, she had to walk in the water a few meters next to beomgyu. They were preparing to shoot in a new location and Bella looked mesmerized by Yeonjun who was quietly filming his scenes. "Waah Choi yeonjun you're soo cool".

Bella said as soon as he finished it and he gave her a genuine smile. As Yeonjun was filming his scene, beomgyu called out for kai and ruby. "yah bella and kai feel my heartbeat" to which the two younger ones kept their hand on his chest to feel them. Kai laughed at the elder who's heartbeat quickened because of a honeybee.

The group monitored their dance as Bella tried to steady her breath. They continued their choreo passionately. They filmed their last scene for the night and the members left quickly just waving to the camera.

The last day and it was to be spent on the beach. Bella was seen wowing at the water's colors and pointing it out to yeonjun who stood next to her because of the girl's fear of the water. They filmed the scenes and when they were monitoring, Yeonjun, who found a hermit crab, called out to bella. The group soon huddled around the poor crab.

They film their own scenes and bella is seen emotionally looking into the ocean while sitting down on the shore in a position which seems like she's been washed ashore. She nods while beomgyu explains it to the camera. They end the group scenes with yeonjun, her and taehyun run around on the beach and then walk tirelessly to just run back again.

The four members, huening kai, soobin, beomgyu and taehyun talk to the camera explaining that the four of them are done with shoots and only bella and yeonjun are left. Soon a wild yeonjun and a calm ruby are seen running up to the rest of the members and the group conclude their three day shooting in bali as a successful one.

Bella is seen on the beach as she watches the boat turned upside down and she turns around to the camera in tears and then the screen turns black.

Bella is the only person left and she turns to the camera, " we've completed our shooting for our title track sugar rush ride!! It's our first time here in Bali and it's so pretty and it's really meaningful now because it's our first overseas location!! We've worked very hard for this comeback so I hope everyone is looking forward to it!! Bye!!"

how lucky am i to have something that makes saying goodbye hard to. - winnie the pooh.

That would make my nostalgic heart happy. I wish Disney+ would add their early 90s Disney shows on there. Under the Umbrella Tree? Adventures in Wonderland? The MMC? Welcome to Pooh Corner? Dumbo’s Flying Circus? Can PBS can get a 90s streamer? I would very much like to watch Wishbone and Ghostwriter again.
