After receiving £170 of various fines in a week, the transport for London wetties tried to parr me...
To whom it may concern, I am writing to appeal against the alleged contravention. The penalty charge notice received states that at 14:28pm on the 29/08/14 I was in contravention of "Contravention 31; Entering and stopping in a box junction when prohibited". The alleged contravention did not occur and I would argue that TFL is attempting to obtain a profit through means of deception (section 15a, Theft act 1968). It can be shown that the yellow box at the junction of Battersea Bridge Road/ Westbridge Road fails to meet a number of requirements specified inpart 2 of schedule 18 – chapter 5 Traffic Signs Manual. The legislation states that the yellow box must go right up to the curb (shown in diagram 1043), in this case the junction does not adhere to this legislation. Additionally the legislation states; “the carriageway beyond the junction should be free from obstruction (this may necessitate the imposition of waiting or loading restrictions, or the adjustment of bus stops on the lengths concerned)”. Again the legislation has been ignored, there is a bus stop located after the junction and it can be shown in the evidence provided that during the time of the alleged contravention there is a bus stationary. Box junctions that deviate from the legislation require approval from the department of transport, as such I request proof of this. Even if such proof exists, I still contend that the alleged contravention did not occur for the following reason. When I entered the Yellow Box junction, the vehicle in front of me was moving. That vehicle then stopped after I had entered the junction in order to allow a bus to pull out forcing me to stop within the yellow box. The offence is committed when one enters the box. I therefore require the full video evidence to show that I entered the yellow box junction when the vehicle in front of me was stationary. I feel these blatant profit schemes enforced by local authorities are dependent on the ignorance and in some cases laziness of the public. This has offended me and caused me to feel patronised, as a result should my appeal be successful TFL will be invoiced for the time taken to research this case and subsequently write this letter.
