To my USA friends,

STERN reminder that using AI tools in a healthcare job that deals with sensitive information is a violation of HIPAA.

I'm especially referring to the ones that do things for you or live in the documents you create.

These are the ones my employees keep asking me about:

- Microsoft copilot for 365 (EVEN when accessed by enterprise credentials)

- ChatGPT (ESPECIALLY Agent Mode)

And I'm sure there's more, but all of these allow the tools to have access to data that you have no guarantee is secured.

OpenAI does not enter into Business Associate Agreements (BAAs) with covered entities. This means that healthcare providers, health plans, and their business associates cannot use ChatGPT to process or store electronic Protected Health Information (ePHI).

Unless a tool specifically states they have BAA support, encryption, AND secure hosting. Steer clear away from it. Your compliance specialist will thank you.

If you have any questions about a specific tool, talk to your compliance officer or IT department. And if they don't know, do your own research and be smart about it. (Or even better, ditch AI tooos entirely.)
