3 Killed Off Oregon Coast When Commercial Crab Boat Capsizes in “Most Dangerous Catch” Waters
The commercial fishing community around Newport, Oregon is in mourning today, after three men were killed Tuesday night in waters made famous by the Discovery Channel’s “Most Dangerous Catch” franchise.
Mary B. II Crab Boat Strayed Into “Dumping Grounds” Just Before it Capsized
Because of swiftly deteriorating conditions, the U.S. Coast Guard was escorting returning fishing boats into Yaquina Bay Tuesday night.
According to Chief Warrant Officer Thomas Molloy, the Mary B. II appeared on the horizon sometime before 10:00 p.m. Although the crew indicated they were not asking for assistance, Molloy told The Oregonian that he chose to be “proactive” and began to escort the vessel to the tip of a jetty roughly a mile away.
“We met them at buoy No. 1 and explained our procedure for safely crossing the bar,” he said.
Apparently, the Mary B. II strayed north as it approached the Yaquina Bay bar. As a result, the boat was exposed to breakers off the north tip of the jetty, as well as shallows to the west dubbed the Dumping Grounds by local sailors.
“Most fishermen here know to avoid them,” Molloy continued. “The boat did not come starboard in time and was swamped. A wave washed right over the top of the pilot house. The boat was washed around the North Jetty and onto the beach.”
U.S. Coast Guard Rescue Efforts Failed Due to High Seas
The high seas, including occasional 20-foot waves, hindered efforts to rescue the three crewmembers aboard the Mary B. II.
Around 11:20 p.m., a Coast Guard helicopter did manage to pull one man from the sea. He was flown to a Newport hospital, but pronounced dead upon arrival.
The body of the Mary B. II’s Skipper was recovered from the its haul on Wednesday morning, after the boat washed up on a jetty. The Newport Fire Department located the remains of the third crewmember on Nye Beach.
The dead have been identified as:
A 50-year-old man from Barnegat Township, New Jersey, said to be the boat’s Skipper.
A 48-year-old man from South Toms River, New Jersey.
A 50-year-old man from Toledo, Oregon.
Yaquina Bay Bar Considered One of Oregon Coast’s Most Dangerous Areas
According to media reports, the New Jersey men were long-time friends who had recently purchased the 42-foot Mary B. II crabbing boat and relocated to the Newport area in November.
Both had been fishermen in Barnegat Light, New Jersey before making the move.
Early reports of the tragedy identified the Mary B. II as one of the boats featured on “Deadliest Catch: Dungeon Cove.” On Wednesday, however, the Discovery Channel confirmed that neither the boat nor its crew had ever appeared on the program.
A spinoff of the popular “Deadliest Catch” series filmed in Alaska, “Dungeon Cove” focuses on Newport’s crabbing fleet and highlights the dangers the vessels face while crossing the Yaquina Bay bar.
Apparently, currents from the Pacific Ocean and Yaquina River converge at the bar.  Their collision can create hazardous conditions, particularly during a storm.
In fact, the Yaquina Bay bar is considered one of the most dangerous areas along the Oregon Coast.
Boat Owners Had Little Experience with West Coast Crabbing
Although the owners of the Mary B. II had spent years fishing off the coast of New Jersey, the third crewmember had apparently expressed concerns before he died.
“He told friends that the crew was inexperienced,” one woman told The Oregonian. “Those were his words. It’s very sad. Because he was a responsible person he went out on the trip and never returned home. I’m really having a hard time with it.”
Unlike his fellow crewmembers, the Toledo man was native to the area and known by many in the Newport commercial fishing community. Few were surprised when he offered to help two New Jersey fisherman with little experience crabbing along the West Coast.
“… his light just shone,” another friend said. “He was kind and gentle and loving and giving. He would help whoever he could. People were attracted to him because he was a gentle, humble guy.”

Trump Administration Set to Slash Offshore Drilling Regulations Inspired by Deepwater Horizon Explosion
The Trump Administration is targeting a number of important offshore drilling regulations enacted in the wake of the deadly and environmentally disastrous Deepwater Horizon oil rig explosion.
The push to weaken the regulations coincides with an administration effort to vastly increase offshore oil and gas drilling in the United States.
Regulatory Failures Contributed to Deepwater Horizon Offshore Oil Rig Explosion
The April 2010 Deepwater Horizon oil rig explosion in the Gulf of Mexico killed 11 workers and injured dozens of others.
The incident also spawned one of the largest oil spills in U.S. history, causing more than $17 billion in damages to natural resources.
A national commission created to investigate the disaster determined that significant regulatory failures contributed to a series of mistakes by BP, Haliburton and Transocean that led to the catastrophe.
Trump Administration Targets “Well-Control”, Other Offshore Drilling Regulations
Those findings inspired a regulatory overhaul intended to prevent future Deepwater Horizon disasters. But 7 years later, the U.S. Bureau of Safety and Environmental Enforcement (BSEE) under President Donald J. Trump is preparing to gut many of those vital regulations, including.
Rules that require the streaming of real-time data of oil production operations to onshore facilities.
Requirements for third-party inspections of blowout preventers and other critical equipment.
The “well-control” rule, which requires the use of certain safety equipment and operations aimed at reducing the risk of explosions.
The current head of BSEE – a drilling industry advocate – contends that the Obama Administration went too far in overhauling regulations following the Deepwater Horizon explosion. His agency also asserts that the offshore drilling industry has learned from the disaster and has implemented changes since 2010 that make strict regulation unnecessary.
Trump Administration Set to Open Nearly All Federal Waters to Offshore Drilling
The Trump Administration claims that reducing regulations will save the oil industry $900 million over 10 years. Notably, the regulatory purge is being proposed just as the administration is set to open nearly all U.S. coastal waters to offshore drilling.
Earlier this month, the U.S. Department of the Interior proposed auctioning off the right to drill in federal waters in the Arctic,  Atlantic and Pacific oceans and the eastern Gulf of Mexico – areas where drilling has been banned for decades.
The governors of New Jersey, Delaware, Florida, Maryland, Virginia, North Carolina, South Carolina, California, Oregon and Washington – some of them Republicans – have all voiced opposition to the Trump Administration’s offshore drilling plans.
Following a meeting with the Republican Governor of Florida, Rick Scott, Interior Secretary Ryan Zinke reversed plans to allow drilling off the coast of that important swing state. However, there appears to be little willingness on the part of the administration to grant a similar reprieve to other coastal states.

Interior Department Nixes Study Aimed at Improving Offshore Drilling Inspections
The Trump Administration’s campaign to stymie regulatory efforts targeting the offshore oil and gas industry continued this month, as the Interior Department halted a study aimed at improving the way the Bureau of Safety and Environmental Enforcement (BSEE) conducts safety inspections of offshore drilling operations.
BSEE Study One of Several Undertaken In Response to Deepwater Horizon Explosion
The study, which the BSEE requested in 2016, was being conducted by the National Academies of Science, Engineering and Medicine.
It was also one of a series of studies undertaken by the National Academies, the Government Accountability Office, and a special presidential commission reviewing the causes of the April 2010 BP Deepwater Horizon oil rig explosion that killed 11 workers and injured 17 others.
According to the Times-Picayune, the Interior Department issued a “Stop Work Order” to the National Academies on December 7th.  No reason was given for the decision to halt the project, and officials at the BSEE and Interior did not respond to a request for additional information.
Contract to Conduct Study Could be Terminated Within 90 Days of Stop-Work Order
Entitled “Review and Update of Bureau of Safety and Environmental Enforcement Offshore Oil and Gas Operations Inspection Program,” the study was to have lasted 21 months.
Within 90 days, the stop-work order will either be lifted, allowing the study to resume, or the contract to perform the research will be terminated.
The Interior Department’s decision to halt the study has already drawn sharp criticism from environmentalists.
“One thing we should all be able to agree on is that safety is of paramount importance, so preventing a study like this simply flies in the face of common sense,” Jacqueline Savitz, senior vice president for U.S. oceans with the environmental group Oceana, told the Times-Picayune.
BSEE Refuses to Enact Offshore Worker Protections
The decision to halt the BSEE study is just the most recent indication of the Trump Administration’s intention to weaken offshore drilling regulations.
Last month, the BSEE refused to enact rules proposed under the Obama Administration that would have allowed personnel aboard offshore rigs to order a work stoppage in the event of safety concerns. The proposed rules would have also provided offshore rig workers with whistleblower protections against retaliation.
The U.S. Chemical Safety Board (CSB) proposed the regulations in 2016, after its investigation into the Deepwater Horizon explosion found that BP and its contractors had cut corners and ignored early warnings of a blowout.
Jordan Barab, a former CSB investigator and deputy assistant secretary at OSHA, warned that the failure to implement the protections could cost lives in the future.
“You’re just inviting these kinds of accidents to happen over and over again,” he told The Houston Chronicle.

Two Months After Port Aransas Barge Explosion, U.S. Coast Guard Scrutinizes Response
Nearly two months after a deadly explosion killed two crewmembers aboard a barge off the coast of Port Aransas, Texas, officials with the U.S. Coast Guard and other agencies gathered to discuss their response to the tragedy.
“Whether it’s tug and towing companies, whether it’s the barge companies, whether it’s the Coast Guard, whether it’s the Port, whether it’s the Port police, all those folks are here to kind of share their experiences,” Zachary Pickett, Port Preparedness Planner with the U.S. Coast Guard, said during the December 11th meeting in Corpus Christi.
One Crewmember Remains Missing
The explosion aboard the Bouchard Transportation oil barge occurred around 4:30 a.m. on Friday, October 20th. The vessel was being towed by the Buster Bouchard, which at the time was pulling up anchor about 3 miles from shore.
Two of the vessel’s eight crew were reported unaccounted for after the incident.
The remains of Dujour Vanterpool, 26, of Houston, were discovered the following Monday, about six miles south of the Malaquite Pavilion in the Padre Island National Seashore.
Zachariah Jackson, 28, of Salt Lake City, remains missing and is presumed dead.
The remaining crew escaped the burning barge without injury.
Responders from the U.S. Coast Guard and the Port of Corpus Christi were able to extinguish the resulting fire by Friday evening.
Cause of Explosion Remains Under Investigation
Monday afternoon’s meeting was intended to provide the Coast Guard and other agencies with a forum to address the aspects of the response that went well, as well as the areas that could be improved.
“We had great communications, we did pretty well on responding to the oil pollution as well too, but there are many things we can probably do better,” Pickett said.
The barge remains in a secure facility in the Port of Corpus Christi, while the Coast Guard and the National Transportation Safety Board work to determine the cause of the explosion.
“The barge is still being looked at, and it’s still being investigated, because we want to make sure that the tragic loss of those two lives never occur again,” Pickett said.

Trump Administration Scraps Offshore Worker Protections Proposed in Wake of Deepwater Horizon Explosion
  New rules meant to protect those working in the offshore drilling industry have been scrapped, after the Bureau of Safety and Environmental Enforcement (BSEE) refused to enact the regulations.
According to the Houston Chronical, the refusal comes as the BSEE under President Trump endeavors to eliminate what it considers to be unnecessary regulations.
Proposed Rules Allowed Offshore Rig Workers to Order Work Stoppages, Protected Them from Retaliation
The proposed rules would have allowed personnel aboard offshore oil rigs to order a work stoppage in the event of safety concerns. The regulations would have also provided offshore rig workers with whistleblower protections against retaliation.
The U.S. Chemical Safety Board (CSB) recommended the regulations in 2016, after its investigation into the April 2010 Deepwater Horizon offshore oil rig explosion established that BP and its contractors had cut corners and ignored early warnings of a blowout. The disaster left 11 workers dead and injured 17 others.
Earlier this month, the BSEE refused to implement the new regulations, arguing that they were not a priority. The agency also suggested that the power to enact the rules were outside the scope of its authority.
CSB Lacks Authority to Enact Recommendations
The CSB is tasked with investigating major chemical disasters. While the Board can make recommendations based on the outcome of an investigation, it has no power to enact its recommendations.
Citing confusion over which agency should implement the proposed offshore rules – the BSEE, the U.S. Occupation Safety and Health Administration (OSHA), or the Coast Guard — the Board voted 3-to-1 to withdraw the recommendations earlier this month.
Board member Rick Engler cast the only opposing vote, arguing that the BSEE has oversight authority.
“Safety cannot be achieved without the meaningful engagement of workers,” he told The Houston Chronicle. “There is evidence of retaliation against whistleblowers in the Gulf of Mexico, but no effective measures for workers to seek out.”
Trump Administration Working to Relieve Offshore Drilling Industry of So-Called “Unnecessary” Regulations
The BSEE was created in response to regulatory failures that contributed to the Deepwater Horizon tragedy. But a spokesperson for the Bureau told the Chronicle that, under President Trump, it is now focused on relieving the offshore oil and gas industry of “unnecessary” regulations, purportedly without jeopardizing worker safety.
The head of the BSEE’s offshore regulatory program has indicated that the agency should cooperate with industry groups to develop voluntary guidelines aimed at protecting offshore workers.
However, Jordan Barab, a former CSB investigator and deputy assistant secretary at OSHA, suggested that abandonment of the proposed regulations could prove disastrous.
“You’re just inviting these kinds of accidents to happen over and over again,” he told The Houston Chronicle.

Cause of Deadly Oil Barge Explosion Off Port Aransas Continues to Elude Investigators
The U.S. Coast Guard has yet to determine the cause of a deadly oil barge explosion that killed two crewmembers off the coast of Port Aransas, Texas, last month.
Crew Member Remains Missing
Dujour Vanterpool, 26, of Houston and Zachariah Jackson, 28, of Salt Lake City, Utah, died tragically when the forward section of a Bouchard Transportation oil barge suddenly exploded around 4:30 a.m. on October 20th.
Vanterpool’s body was discovered the following Monday, about six miles south of the Malaquite Pavilion in the Padre Island National Seashore.
Jackson’s remains have not been found.
The remaining six crewmembers were able to safely escape from the vessel.
Oil Barge was Carrying a New Crude When It Exploded
The cause of the explosion remains unknown nearly a month after the incident. However, Captain Jason Smith, Deputy Sector Commander, Coast Guard Sector Corpus Christi, recently suggested that the vessel’s cargo may have played a role in the tragedy.
“What we do know is there was some explosion that occurred,” Smith during a November 14th meeting of the Port of Corpus Christi Commissioners. “The product that they’re carrying is a new crude…it’s relatively new to us as well. So we’re trying to explore how that type of crude oil would explode like that.”
According to Smith, rescue crews were on scene just 40 minutes after the explosion occurred. He praised the various responding agencies for the swift reaction, strong communication among responders, and the effective use of available resources.
“We plan for these kinds of events, and then in the rare opportunity that we have to exercise them, we have those relationships already in place.”
Coast Guard Continues to Monitor Beaches, Gulf of Mexico for Possible Environmental Impacts
The crippled barge was heavily damaged in the explosion and ensuing fire, causing the vessel to spill hundreds of barrels of oil into the Gulf of Mexico. Some of that oil washed up on Mustang and South Padre Islands.
According to Smith, a 140-person cleanup crew spent two weeks ridding the beaches of oil.
“Both the Coast Guard and all of our local, state and county partners, are out their monitoring the beach and water to make sure there’s no long-term impact,” he said.
Bouchard Transportation Responsible for Cleanup and Response Costs
Bouchard Transportation will be responsible for all costs related to response and cleanup, though a final figure has yet to be determined.
Just one day before the Port Aransas oil barge explosion, Bouchard Transportation and its affiliates agreed to pay $13 million to resolve remaining federal and state natural resource damages claims related to their role in the April 2003 Buzzards Bay Oil Spill off the coast of New England.
Bouchard had previously paid $6 million to settle claims for injuries to shoreline and aquatic resources, coastal recreational uses, and piping plovers stemming from the Buzzards Bay spill. The company also agreed to pay $10 million to resolve criminal charges and entered into an $11 million class action settlement related to the incident.

Investigation Underway After Shell Oil Rig Fire Injures Two Workers, Forces Evacuation of Gulf of Mexico Platform
The U.S. Coast Guard and the Bureau of Safety and Environmental Enforcement (BSEE) are investigating an offshore oil rig fire in the Gulf of Mexico that left two maritime workers injured.
The fire aboard Royal Dutch Shell’s Enchilada platform was reported to the Coast Guard in New Orleans, Louisiana, around 1:20 a.m. on Wednesday, November 8th.
The fixed-leg platform is located about 112 miles from Louisiana’s Vermillion Bay.
Two Shell Employees Airlifted to Galveston Hospital
46 workers were aboard the offshore oil rig when the fire broke out. All were evacuated and transferred to the nearby Salsa platform by the offshore supply vessel C-Liberty.
Two platform workers – both Shell employees – were injured in the incident:
A 59-year-old man, flash burns and concussion
A 29-year-old man, sprained wrist and concussion
A Shell emergency helicopter airlifted the two men to the University of Texas Medical Branch, Galveston. Both have since been released from the hospital.
30-Inch Gas Export Pipeline Implicated in Shell Offshore Rig Fire
Shell said in a statement that the fire was associated with a 30-inch gas export pipeline.
The blaze was contained by Wednesday afternoon, though a gas discharge (3-6 foot flame) was allowed to continue burning while the pipeline was depressurized.
“No harm to people or the environment is ever acceptable and Shell deeply regrets that this incident occurred,” the company said.
Shell has shut-in the Enchilada platform, as well as the nearby Salsa and Auger. The 30-inch gas export pipeline and nearby fields were also shut.
There is no timeline for restarting operations at the Enchilada platform.
“Though the structure is visibly sound, crews will continue to determine the integrity of the platform and formulate a plan for damage repair,” a company spokesperson told Reuters.
No Additional Reports of Pollution
A light sheen of oil was spotted in the water north of the Enchilada oil platform just after the fire broke out. A Clean Gulf Association oil spill response vessel was mobilized as a precautionary measure.
An update posted by the U.S. Coast Guard on Thursday indicated that there have been no additional reports of pollution.
The cause of the fire is not known. The Coast Guard and BSEE continue to investigate the incident.

1 Crewmember Tragically Killed and Another Still Missing After Barge Explodes and Catches Fire Off Coast of Port Aransas, Texas
A crew member remains missing and another was tragically killed following a barge explosion and fire off the coast of Port Aransas, Texas on October 15, 2017.
Oil barge B255 was under tow by the Buster Bouchard, about 3 miles off Port Aransas, when an explosion occurred at its fore peak around 4:30 a.m.
The tug was pulling up anchor at the time. The U.S. Coast Guard Sector in Corpus Christi received a mayday from the tug’s captain at approximately 4:35 a.m., reporting that the barge was on fire and that two crew were unaccounted for.
The vessel’s six other crew members were able to escape to safety.
Responders had extinguished the fire by Friday afternoon.
Crew Member’s Body Recovered from Padre Island on October 20
The missing crew members were identified as Zachariah Jackson, 28, of Salt Lake City, Utah, and Dujour Vanterpool, 26, of Houston.
Vanterpool’s body was recovered from a Padres Island beach on Monday, October 20th.
Jackson remains missing. As barge captain, he would have been positioned at the vessel’s forepeak, the site of last month’s explosion.
Investigation into Cause of Barge Explosion Continues
Within a week of the explosion, the barge has been moved to Occidental Petroleum’s Oxy-Ingleside Energy Center Terminal, a crude oil storage and export terminal.
The cause of the explosion remains unknown. The U.S. Coast Guard and National Transportation Safety Board have launched an investigation into the incident, but there is no timeline for its completion.
“It could take days, it could take weeks, it could take months,” Morgan Jackson, Zachariah’s brother, recently told KRIS-TV. “It’s just a matter of getting everything in order.”
“I know that they’re doing the best they can. I know it’s a process,” he continued. “And I have faith that the NTSB and the U.S. Coast Guard are going to do a thorough, aggressive investigation.”
Oil Spill Forced Port of Corpus Christi to Close
The barge was carrying about 133,000 gallons of oil when it exploded. Some of that oil did leak, forcing officials to close the Port of Corpus Christi to prevent its spread.
Cleanup crews spent days working to rid Mustang and Padres Islands of oil that had washed ashore.
Within a week of the blast, some 73 cubic feet of oil had been cleared from the beaches. However, remnants of oil could continue to turn up onshore for some time.
Barge Owner Settled Oil Spill Charges One Day Before Port Aransas Explosion
The barge involved in the Port Aransas explosion was owned by Bouchard Transportation, which had only a day earlier agreed to pay $13 million to settle remaining state and federal charges in connection with the April 2003 Buzzard’s Bay oil spill off the New England coast.
Bouchard had previously paid $11 million to resolve a class action lawsuit that resulted from the spill, as well as $6 million to settle claims connected with the destruction of aquatic and shoreline resources.
The company was also assessed a $10 million criminal fine for its role in the Buzzard’s Bay oil spill.

Unemployment Continues to Plague Offshore Workers, Despite Oil & Gas Rebound
Unemployment among offshore workers remains high, despite signs that the worst oil and gas recession in 30 years is beginning to ebb.
Low Oil Prices Weigh on Offshore Production
More than 200,000 oil and gas drilling jobs have been lost since 2014, when energy prices began their decline.
Oil reached a high of $107 per barrel in June 2014 but fell as low as $26 per barrel in early 2016. Though prices have crept upward since then, the modest recovery has only produced about 30,000 new jobs. Most of these employment opportunities are located onshore, as shale drilling in Texas, New Mexico and the Dakotas has far outpaced offshore activities in the Gulf of Mexico.
According to a recent report from the Houma Courier, shale drillers can break even with oil prices at $40 a barrel or lower. However, the break-even price for deep-water offshore drillers in the Gulf stands at around $60 per barrel. The U.S. Energy Information Administration has predicted that Brent crude, which serves as the international benchmark price for oil, will average $53 per barrel this year and $56 in in 2018.
Offshore Drillers Eye Automation for Rig Maintenance and Other Jobs
Even if offshore production does recover, there’s no guarantee that employment in the industry will ever reach pre-2014 levels. That’s because a growing number of offshore employers are exploring the potential for automation.
“A lot of companies are looking at what the alternative might be to just plain rehiring,” Rachel Everaard, head of the oil and gas human resources team for the consulting firm EY, recently told the Houston Chronicle. “Certainly you’re not going to replace all drillers with remote operations next year, but you’ll start to see them hire fewer and fewer, as they start to do things differently.”
Areas ripe for automation include rig maintenance, which can be performed by robots operated by workers onshore.
Do Low Oil Prices Endanger Offshore Worker Safety?
Low oil prices can impact more than an offshore worker’s employment prospects. When energy companies face price pressures, they look to cut costs. All too often, offshore drillers will delay or cancel important rig maintenance and upgrades, force fewer employees to work longer hours, and implement other measures that compromise worker safety.
Consider the April 2010 Deepwater Horizon explosion in the Gulf of Mexico that killed 10 offshore workers and injured 17 others. A 16-month investigation by the Bureau of Ocean Energy Management, Regulation and Enforcement determined that BP’s efforts to control costs on the doomed rig were among several factors that contributed to the catastrophe. The report noted that while BP employees aboard the Deepwater Horizon rig were awarded for implementing cost-saving measures, they were not incentivized in the same way for increasing safety. According to The Washington Post, the Bureau cited five BP decisions to cut costs and reduce drilling time that also increased risks aboard the offshore platform.
“BP’s cost or time saving decisions without considering contingencies and mitigation were contributing causes of the Macondo blowout,” investigators concluded.

$12 Million Settlement Recovered for Jones Act Back Injury
  Our Maritime & Jones Act Lawyers are proud to announce the recovery of a $12 Million settlement for our client who suffered a nearly fatal back injury while working for a major offshore oil and gas company.
Ryan Zehl obtained the settlement for the offshore worker following the injury, a fall from height while onboard a jack up rig.
The Houston-based Defendant fought on liability, tried to minimize the extent of our client’s injuries, and refused to offer more than $1.5 Million to settle the case at mediation.
After our maritime attorneys took 16 depositions in the case, including the CEO of the company, and established that the Defendant was in violation of both its own and federal safety procedures, the defendant agreed to settle the case for $12,000,000–the highest settlement amount  paid out in that company’s history.
The settlement exceeded our client’s expectations and will make sure that he and his family never have to worry about their finances ever again.
