Patent applications can be filed at the United States Patent and Trademark Office (USPTO). Prior to June 7, 1995, the duration of a US utility patent was 17 years from patent issuance. Since that date, the duration of the US utility patent is 20 years from the earliest effective filing date. However, patent term adjustment or extension are possible if the USPTO fails to issue a patent within 3 years after filing the full application, subject to various conditions on the applicant.[circular reference] The rules for drafting and filing a patent application are set out in the Manual of Patent Examining Procedure (MPEP).
Pre-grant publication (PG Pub) Since the American Inventors Protection Act, the USPTO publishes patent applications 18 months after the earliest priority application (which often is a provisional application) is filed. This time limit can be extended under certain circumstances, for an additional fee. The applications may be published before a patent has been granted on them if the patent is not granted within the 18-month time frame. Applicants can opt out of publication if the applications will not be prosecuted internationally.

U.S. Federal District Courts (FDCs) Litigation in the Federal District Courts remains the main remedy for patent infringement. 5000-6000 patent cases are filed each year in the United States. The two most popular districts for patent cases are E.D. Texas and D. Delaware.
U.S. International Trade Commission (ITC) In cases involving importation of a patented product into the US, the patent holder may wish to pursue a cause of action in the United States International Trade Commission (ITC) instead of, or in addition to, the court system. The ITC is an agency of the U.S. federal government empowered to enforce patent holders' rights under Section 337 of the Tariff Act of 1930. In contrast to courts, which have a wide range of remedies at their disposal, including monetary damages, the ITC can grant only two forms of remedy: exclusion orders barring infringing products from being imported into the United States, and cease-and-desist orders preventing the defendants (known as respondents) in the ITC action from importing infringing products into the United States. In addition, the ITC can grant temporary relief, similar to a preliminary injunction in U.S. federal court, which prevents importation of allegedly infringing products for the duration of the ITC proceeding.[34] In some cases, this may provide a quicker resolution to a patent owner's problems.
Court of Appeals for the Federal Circuit (CAFC) The Court of Appeals for the Federal Circuit hears appeals from US Federal District Courts and from the International Trade Commission. The decisions of the CAFC can be appealed to the US Supreme Court, but only on discretionary basis via a petition for a writ of certiorari.
Utilization and importance A survey of 12 industries from 1981 to 1983 shows that patent utilization is strong across all industries in the United States, with 50 percent or more patentable inventions being patented.
However, this is not to say that all industries believe their inventions have relied on the patent system or believe it is a necessity to introduce and develop inventions. Another survey for the same time period show that, of those 12 same industries, only two—pharmaceuticals and chemicals—believe thirty percent or more of their patentable inventions would not have been introduced or developed without having patent protection. All others—petroleum, machinery, fabricated metal products, primary metals, electrical equipment, instruments, office equipment, motor vehicles, rubber, and textiles—have a percentage of twenty-five or lower, with the last four of those industries believing none of their inventions relied on the patent system to be introduced or developed.

(1) Please stop assuming "transformative works" means "copyright infringement". It does not. Disney is happy to let us think it does, but notice a distinct lack even of threats of Disney v Organization for Transformative Works. It's not like Disney hasn't had time or doesn't have lawyer money. So it's real hard to avoid the conclusion that either Disney thinks the damage to their reputation by suing over Encanto incest fanworks would exceed the damage to their reputation by suing daycares that decorated with Disney characters or, much more likely imo, Disney thinks the only reason the daycares didn't win is because the daycares, unlike the OTW, had no IP lawyers:
(2) AI generated anything lacks IP protection altogether. Same reason the monkey selfie does:
Meanwhile, the creators of transformative works retain IP protection to those elements of the work that they themselves created:
Sooo I am not a lawyer, just someone who's been writing fanfic more than half my life and got a two-year degree in paralegal, but I have a sneaking suspicion that legal precedent re genAI is not gonna be on point re fanworks created by real live humans.
You're all aware that ordinary fan art drawn by humans falls under the same "this is identical to our copyrighted characters" claim that Disney is using to sue midjourney, right? You know that in the eyes of the Mouse the only difference between you and midjourney is a matter of scale, right?

Image : Unsplash Utiliser un antivirus pour votre ordinateur ;
Mettre à jour ses témoins web (cookies) ;
Ne pas donner nos informations personnelles à des personnes qu’on ne connaît pas ;
Etc.

[ad_1] Freelance job scams are on the rise in Canada amid increasing unemployment and a growing threat of cybercrimes targeting Canadians. The Canadian Anti-Fraud Centre issued an alert on Aug. 25, warning people of an increase in job opportunity fraud that could take advantage of those looking for work.Scammers send an email or text offering freelance jobs to “boost” products, apps or videos, with the promise of payment in cheque, bank transfer or cryptocurrency, the CAFC said.The offer will prompt victims to install software that enables fraudsters to send instructions on so-called tasks to complete.“Victims might receive a small payment or commission in order to convince them that the job is legitimate,” the centre said in its alert. 1:32 At least $530M lost to cybercrime in Canada in 2022, RCMP says Several variations of this type of fraud have been reported to the CAFC. Story continues below advertisement In one instance, victims are offered $300 to $500 per week to wrap their vehicles with a company logo.Those who fall into this trap could end up with a counterfeit cheque that could end in the recipient losing money.Scammers also target people who post their resumes online and offer different positions, including caregiver, data entry clerk, quality control officer, personal assistant, mystery shopper and financial agent.Besides incurring financial losses, these scams also pose a risk of arrest for money laundering, the CAFC warned. 1:34 Beware of ‘car wrap’ easy money scam Last year, more than $530 million in financial losses were reported to the centre for various types of cybercrime and fraud, according to the RCMP.The Canadian Centre for Cyber Security released a report Monday, saying that cybercrime activity “will very likely increase” in Canada over the next two years. Story continues below advertisement In particular, the agency categorized ransomware — in which digital files are held hostage or encrypted until a fee is paid — as the “most disruptive” form of cybercrime facing Canada. How to protect yourself from job scams The CAFC is urging anyone who has become a victim of job opportunity fraud to report it to local police as well as the centre. Trending Now Montreal renters are turning to apartment swapping amid ‘crazy’ affordability crunch Climate protester throws paint on Tom Thomson art at Canadian gallery “It a job sounds too good to be true, it probably is,” the CAFC says.The centre offers some helpful dos and don’ts on its website for individuals and businesses on how to protect themselves from scams and frauds.As a rule of thumb, never give out your personal information on unsolicited calls. 4:11 Protecting yourself from online frauds and scams Sometimes, it can be hard to differentiate between a scam and a legitimate offer, but there are a number of red flags. For instance, a company using a web-based email address, like Gmail, instead of a personalized domain is among them. Story continues below advertisement “If you are asked to ‘boost’ apps, videos or merchandise, you will more than likely be providing fake reviews to fraudulent products,” CAFC warned.Caller ID, email and website spoofing lets criminals appear to be a legitimate source, which is why extra caution is needed.The CAFC is seeing an increase in job scams. Using the names of real companies in Canada, the fraudsters are offering victims freelance job opportunities to “boost” products, apps or videos using software created by the fraudsters.
