This entry is intended to bring a little educational understanding to those who are unsure of what all the different terms mean in the world of people with drug/alcohol/behavioral issues. For the sake of discussing the individual, he/she/they are known as such and will be in active use, active recovery, or active wellness (complete remission, perhaps). There are those that will state that one cannot be cured and there is only a state of recovery because the individual is never not addicted to whatever caused problems. I contend that an individual can achieve active wellness which would include complete abstinence and a life without psychoactive substances and/or other excessive repetitive patterns know as behavioral addictions (e.g., gambling, sex, shopping &c.) in healthy, sustainable, and satisfying ways.

Yes, if someone who has been in the throes of chemical dependency or behavioral disorder return to the substance and/or behavior, the cycle begins where it left off for many biological reasons. The point is it is absolutely possible and very much achievable to never return to that way of existing. If you follow medical orders after realizing a high blood pressure diagnosis, the problem becomes completely manageable. If you get your blood pressure down then revert back to a lifestyle which caused it to increase then guess what, it will return with a vengeance. Same exact thing.

I’ll step off of my “You can live well” pulpit and get into the terminology because the layers to wellness are many, deep, and worthy of their very own post(s) .

What is drug addiction, and should we use the term or its derivatives?

According to the National Institute of Drug Abuse (NIDA, 2019), it is “a chronic disease characterized by compulsive, or uncontrollable, drug seeking and use despite harmful consequences and changes in the brain, which can be long-lasting”. Note how it is considered a medical disease by the established medical community. This gets some people in a tizzy and those are often heard exclaiming, “You did this to yourself!, It’s not a disease!, Cancer is a disease!”, &c. The number one cause of death in these United States is heart disease caused largely by; you guessed it, the sufferer (Weatherspoon, 2019). Smoking, diet, overweight, sedentary, all contribute significantly to this problem. Those previously mentioned anger mongers will often retort “Yeah, well it is also genetic!”, and so is chemical dependency (Johns Hopkins, 2021).

Whether or not the term is used or not is always up for debate, and only time will determine its existence. Addiction as a term is fairly straightforward and accurate; however, the term addict is filled with negative connotation, stereotype, and stigma. I can assure you that easily half of everyone I have ever treated looks and behaves just like every other citizen walking around in any neighborhood anywhere. Rich, poor, elderly, young, and all points in between describe people with substance use disorders and behavioral addictions, many of whom you would never guess. I have also known many straight edge folks who the average American might easily mistake for someone who abuses drugs based on appearance alone.

How does someone get diagnosed?

Well, it must be done by a licensed and qualified medical professional who has spent many years in study and has the student debt to prove it. Or you can generally ask someone who is suspected of having a problem with drugs, alcohol, or circumstance and they will know if it can be controlled or if help is needed. This does not take into account those in denial or fear of losing something by the very nature of the question (like safety, shelter, liberty, &c). In the case of the former, the Diagnostic and Statistical Manual of Mental Disorders Fifth Edition (DSM-V) by the American Psychiatric Association (APA) uses the following criteria to determine whether a problem exists and/or the degree of severity if present (APA, 2013):

A. A problematic pattern of [insert substance or circumstance] use leading to clinically significant impairment or distress, as manifested by at least two of the following, occurring within a 12-month period:

1.     [insert substance or circumstance, e.g., alcohol, opioids, gambling, &c.]  are often taken in larger amounts or over a longer period than was intended.

2.     There is a persistent desire or unsuccessful efforts to cut down or control [insert substance or circumstance] use.

b.     [insert substance or circumstance]  (or a closely related substance) are taken to relieve or avoid withdrawal symptoms. (Note: This criterion is not considered to be met for those individuals taking [insert substance or circumstance]  solely under appropriate medical supervision.)

Questions? Anyone? Let’s keep moving. Now with this information held firmly in your mind, you still need to be properly credentialed in order to affix a legitimate diagnosis to anyone, so this is for informational purposes only. Here are a few more terms to add to your lexicon though:

1.     Drug Intoxication. This is elusive because many people with a substance use disorder(s) have been using for so long that their strange and erratic behavior has become accepted traits. Often the presence of intoxication is a sudden change in demeanor, i.e., one moment a person is restless and anxious, they go to the bathroom and after emerging proceed to pass-out after sitting down anywhere (opioids). Or an individual is nervous and even a little shaky but after a few moments alone returns happy, smooth in gait, and chatty (alcohol). Perhaps a loved one is lethargic and grumpy, but after returning from the bathroom is full of energy and talking a mile a minute (cocaine, methamphetamine). Of course, there are many indicators, but you get the point.

2.     Drug Abuse. The continued use of a psychoactive drug or behavioral patterns despite the knowledge that it is causing social, occupational, psychological, or physical problems (APA, 2013). Put simply, doing something to excess where the consequences outweigh the benefits; An ice cream cone is great, a half-gallon  makes you vomit (in most cases).

3.     Drug Dependence. Maladaptive pattern of use resulting in significant impairment or distress, as shown by compulsive use, increased tolerance, withdrawal, and obsessive thoughts about it (APA, 2013).

 You know, the word withdrawal has been presented several times in this post and it deserves its own little section because it is this experience alone that keeps more people in active use than any other single precipitating factor. The human mind is in a constant state of seeking homeostasis or normal acceptable functioning. All people, not just those with drug/alcohol issues seek the avoidance of pain. Ok, somewhere there is a body builder claiming no pain no gain but let that pain be a sciatic or tooth nerve and he/she is reduced to a tower of gelatin seeking immediate relief.

 This next sentence is a value statement directly from the horse; withdrawal is an exquisitely harrowing experience engulfing the entirety of the human experience and reducing it to the most detestable overall sensation of prolonged living death. The only relief which is desperately sought and despised simultaneously is more of the substance that caused it. I really don’t know a better way to explain it. I know of septuagenarian Rockwellesque grandmothers who have sold themselves for heroin because their medical provider overprescribed opioids for years and due to pressure from governing authorities cut them off, just to avoid withdrawal. People question this but its sadly true, and not even the worst of the stories.

how to begin // disorientation

“It matters how we arrive at the places we do.” (2)

“Orientations are about how we begin; how we proceed from ‘here’, which affects how ‘there’ appears, how it presents itself.” (8)

I’m writing this at the beginning of my independent study, curious about how to proceed. The ‘here’ of the internet. 

I am beginning: in a spirit of inquiry, curiosity, creativity.

Orientations are not simply given. When we orient towards some thing or some one, we are also turning away from something. As Ahmed says, what is present or near is not “casual”, but has appeared because of certain lines followed, paths taken or not. 

The writing table: “In this book, I bring the table to ‘the front’ of the writing in part to show how ‘what’ we think ‘from’ is an orientation device. By bringing what is ‘behind’ to the front, we might queer phenomenology by creating a new angle” (4). Ahmed is calling for a politics of location, intersectionality, being situated. To queer phenomenology would be to acknowledge where one is beginning, bringing what is usually in the background to the front and thus creating a different angle, a different dialogue. 

“After all, phenomenology is full of queer moments; as moments of disorientation that Maurice Merleau-Ponty suggests involve not only ‘the intellectual experience of disorder, but the vital experience of giddiness and nausea, which is the awareness of our contingency, and the horror with which it fills us’“ (4). 

“When we are orientated, we might not even notice that we are orientated: we might not even think ‘to think’ about this point.” (5) 

“It is by understanding how we become orientated in moments of disorientation that we might learn what it means to be orientated in the first place.” (6)

I walk in to the studio. Where do I face? What do I do? Do I start on the ground? standing? with music? Lately I have been using this score of “bad dancing” because it makes me question and look at what I think is “good dancing”. One way to look at where I am oriented.

I think that all practices of somatics are in essence practices of disorientation. When I arrive at a somatic practice I am often not aware of how I hold my body and move through the world. Or, I am aware, but it has become so natural and habitual to me that I no longer feel it as new, unique. The experience has faded to the background. By feeling, thinking, and moving differently my sense of self is (at least momentarily) shaken loose. I remember my first Feldenkrais lesson in which we balanced books on our feet for an hour. When I got up, I felt like I’d been given a new pair of feet they were so alien, alive, and richly complex.

How can somatics remain flexible and rooted in community practices as opposed to rigidly codified systems? We are not given a body that we then have to try to discover the user manual for, but instead are a body and are continually investigating ourselves and our way of moving through the world.

Side note: I find it interesting that somatics often relies on others, either people or objects, to disorient. I’m interested in this inherent relationality. We need another in order to see and feel differently. 

Desire / Lines

“The lines we follow might also function as forms of ‘alignment’, or as ways of being in line with others.” (15)

“Following lines also involves forms of social investment. Such investments ‘promise’ return (if we follow this line, then ‘this’ of ‘that’ will follow), which might sustain the very will to keep going. Through such investments in the promise of return, subjects reproduce the lines that they follow” (17). Inheritance, wealth, safety. Codified structures. Pathways. Certain ways of being that we know white supremacy and capitalism will reward.

Can desire function as a kind of guiding principle (note to self: read adrienne maree brown’s Pleasure Activism next). Pleasure guiding scholarship and research. 

What do I choose to practice? How do these practices shape me? 

I am reminded of one of the first pages in Octavia Butler’s Parable of the Sower:

“All that you touch You Change. All that you Change Changes you. The only lasting truth Is Change. God Is Change.“

“Somatics is: a path, a methodology, a change theory, by which we can embody transformation, individually and collectively. Embodied transformation is foundational change that shows in our actions, ways of being, relating, and perceiving. It is transformation that sustains over time. Somatics pragmatically supports our values and actions becoming aligned. It helps us to develop depth and the capacity to feel ourselves, each other and life around us...Somatics is a practice-able theory of change that can move us toward individual, community, and collective liberation.” (17)

I notice the use of the words change and transformation. Within oneself and one’s community and society. Concentric rings. We cannot just focus on ourselves. A theory of change and transformation -- not seeking a rigid neutrality. Balance is never still but always slightly oscillating. 

The Orient and Other Others (Queer Phenomenology Chapter 3)

“And then the occasion arose when I had to meet the white man’s eyes. A unfamiliar weight burdened me. The real world challenged my claims. In the white world the man of color encounters difficulties in the development of his body schema. Consciousness of the body is solely a negating activity. It is a third-person consciousness. The body is surrounded by an atmosphere of uncertainty. I know that if I want to smoke, I shall have to reach out my right arm and take the pack of cigarettes lying at the other end of the table. The matches, however, are in the drawer on the left, and I shall have to lean back slightly. And all these movements are made not out of habit, but out of implicit knowledge.” - Frantz Fanon, Black Skin, White Masks

Bodily awareness - 

I recently had a conversation in which we discussed intention and reception (in regard to someone not wearing a mask because they were unaware of the science behind it *extreme eye roll*). Privilege is not having to think about how something is received. It is feeling comfortable that your good intention will be seen and not having to think far enough ahead to reception. 

“Where phenomenology attends to the tactile, vestibular, kinesthetic, and visual character of embodied reality, Fanon asks us to think of the ‘historic-racial’ scheme, which is, importantly, ‘below it’.” (110)

“For Fanon, racism ‘stops’ black bodies inhabiting space by extending through objects and others; the familiarity of ‘the white world’, as a world we know implicitly, ‘disorients’ black bodies such that they cease to know where to find things--reduced as they are to things among things. Racism ensures that the black gaze returns to the black body, which is not a loving return but rather follows the line of the hostile white gaze. The disorientation affected by racism diminishes capacity for action. For Fanon, racism ‘interrupts’ the corporeal schema.” (111) I write these words and recognize the wisdom and learning in them but I also want to push back or question a little bit. I wonder about Ahmed taking away agency in this section of writing. Or rather, I wonder, as some things are not as in reach or possible when Black, what other things that are not in the white imagination become available? 

“process of racialization...consider racism as an ongoing and unfinished history, which orientates bodies in specific directions, affecting how they ‘take up’ space” (111). I really appreciate this reframing of racism as a process. It is active, we are active. But we can also bring attention to and redirect this activity. Racism is not a structure we are passively sitting inside of, that exists outside of us.

Entrepreneur’s Relief – Tricky bits – Meeting the Tax Conditions

Entrepreneurs’ relief (ER) reduces the rate of capital gains tax (CGT) on disposals of certain business assets from 20% to 10%, to be able to claim ER, a series of conditions have to be met and one of them is  where the shares are sold, the company must be a trading ( or Holding company of a trading group ).

Summarising the effect of ER :

10% CGT rate on disposal of qualifying assets;

whole or part of a sole trade or partnerships;

assets used in a business; or

shares in a trading company;

£10m lifetime limit per individual;

The individual, if selling shares, needs to fulfil all the following:

be a director / employee up to the date of disposal;

own 5% of share capital – note this is based on the nominal value, rather than simple number of shares;

be entitled to 5% of voting rights;

1 year holding period and employment / directorship required to qualify;

Where shares are sold, the company must be a trading company (or holding company of a trading group;)

Shares acquired by exercising qualifying EMI share options don’t need to meet the 5% rule above

The recent first-tier tribunal case re-emphasises the importance of ‘trading activities’, but it also clarifies that a company can diminish or temporarily suspend its trading activities without being treated as ceasing to trade. It also addresses the issue of when an investment activity leads to the loss of ER.

Mr and Mrs Potter were shareholders in a company called Gatebright Ltd which had traded as a broker on the London Metal Exchange. Mr Potter dealt with trading, and Mrs Potter dealt with the administration of the business.

Gatebright was a successful business and had built up reserves of over £1m when the financial crash happened in 2008/09. In order to safeguard the reserves, Gatebright invested £800,000 of the company cash reserves in a six year investment bond which matured in November 2015. The bond paid interest of £35,000 a year and it appears that this was distributed by way of dividend. The remaining funds, approximately £200,000, were retained as working capital.

As a result of the crash, the volume of trade declined dramatically and the last invoice issued by Gatebright was in March 2009.

From 2009 until June 2014, Mr Potter suffered some ill-health and other domestic misfortune which meant that he was unable to work and so the trading activities diminished or were temporarily suspended. However, having been in the business for 30 years, Mr Potter had many contacts among banks and clients and he stayed in touch with them with a view to starting new negotiations. Evidence was produced demonstrating that the company was actively seeking trading income right up to June 2014.

The company went into Members voluntary liquidation (MVL) in June 2015. ER was claimed but denied by HMRC on grounds that the company ceased trading in 2009, more than three years before the 2015 disposal date.

A key requirement for the availability of ER in a share disposal is that the company is a trading company or a holding company of a trading group throughout the qualifying period.

In order to meet the trading company requirement, a company’s activities must not include non-trading activities to a significant extent. Although ‘significant’ is not defined in the legislation, HMRC’s manual looks at ‘indicators’ or ‘factors’ that might be useful in establishing whether there is substantial overall non-trading activity. This is traditionally taken to be 20% and this figure is included in HMRC’s guidance. The guidance is, of course, just that. It is not legislation.

The tribunal observed that the legislation focuses on ‘activities’, in other words ‘what is the company actually doing?’

The tribunal concluded that, although Gatebright was not actually carrying on any trade after it issued its last invoice in 2009, it was considered to be ‘preparing to carry on its old trade once the economic environment permitted it’. The expenditure and the time spent by the officers/employees of the company on non-trading activities were nil. Once Gatebright put the money into the bonds it did not, and could not, do anything else in relation to them until they matured. There were no investment activities.

While the asset and income position of the company were factors against trading activities, the expenses incurred, and time spent by the directors/employees, were factors pointing to trading activities.

The tribunal supports the view that a trading company may be able to make a substantial long-term passive investment without fear of losing its ER trading company status.

It also highlights the importance of actions taken with the judge stating in reference to a period of suspended trade ‘it does not seem to me that a company would stop and start being a trading company in a period simply because trading activities are temporarily suspended for some reason. Carried to a logical extreme, if this is wrong, a company would cease to be a trading company every weekend and become one again every Monday morning. If, overall, the company is carrying out trading activities during a period but there are temporary gaps in the activities, in my view it can be said that the company is a trading company “throughout” the period.’

The subwoofer is one of the largest I’ve seen on any system, measuring 11 inches wide by 14 inches deep and 16 inches high. The rear speakers feature both forward-facing and upward-firing drivers and are tethered to the sub by a 30-foot cable (the connection between the soundbar and the sub is wireless). The cable was long enough to drape behind my couch and along the side of the living space to the sub at the front, but the length could be an issue for some installations. 

Vizio claims the system is capable of 107 decibels, and I did find it was quite loud, so no worries about filling even the largest living spaces. The Elevate includes a wall-mount bracket in the box (BYO screws, however), and Vizio designed the bar to mate seamlessly with the Vizio OLED TV.

A mountain of features

Connectivity is excellent with two separate HDMI inputs, as well as a third, labeled “HDMI Out,” which supports eARC. There’s also an optical digital input, a 3.5mm analog audio and a 3.5mm “voice assistant” input, USB and Bluetooth. The Elevate connects to your network via Wi-Fi and supports Spotify Connect and Chromecast built-in. The Elevate also lacks a built-in voice assistant, found on the Arc and other soundbars, but I don’t see this as a major disadvantage. Using Alexa or Google Assistant on a soundbar can be annoying as the volume will mute if it hears the wake word, which means you could miss some of your show. If you want to use a voice assistant to listen to music through the Elevate it’s easy to set the soundbar up as the default speaker for an inexpensive Google or Echo speaker nearby.

The remote looks like the ones that come with cheaper Vizio soundbars but differs in two important aspects. There’s an LCD display at the top, and four buttons which help with setup at the bottom. Having both Effect and EQ options is a little confusing because they perform very similar tasks, and navigating menus via the different buttons takes a little getting used to.

Adjusting the volume of the subwoofer was easy enough with the Level button but not everything was intuitive, and you will need to know to download the Vizio SmartCast app to complete the setup of Wi-Fi, for example. I also had some issues updating the firmware from the website, but Vizio told me it was because one of the files was misnamed and assured me it was now fixed.

In comparison the Sonos Arc was a simple pleasure to use, install and update, although that speaker’s setup does heavily favor iPhone ($599 at Apple) users — Sonos’ TruPlay calibration app is not available on Android. I had some issues with the Arc initially and these were helped by using TruPlay (on an iPad ($385 at eBay)).

High and mighty sound

The Elevate is twice the price of the existing SB36512, but you can’t expect twice the performance. I was unable to test the two models side-by-side, but in my experience there are always diminishing returns when going from an excellent, affordable speaker to a much more expensive one. 

For these tests I compared the Elevate side-by-side against the Sonos Arc, because the two are roughly the same price. The Vizio acquitted itself very quickly with authoritative sound quality across all kinds of material. Unlike the Arc, which performs better at home theater than music, the Elevate was equally capable with both — a rare feat among soundbars.

I started my tests with music, Radiohead’s My Iron Lung to be precise, and I found that the Arc wasn’t quite as accomplished as the Vizio. The Arc played the song at a remove, slightly boxy and distant. By fiddling with the EQ I was able to improve definition to the percussion, but Thom York still gave the impression he was phoning it in. The Vizio was the opposite, lively and punchy thanks to that subwoofer. It wasn’t quite perfect, though, as I needed to back off the treble a little, but much more listenable overall.

I moved to something more ethereal with Yulunga (Spirit Dance) by Dead Can Dance, and the Arc improved somewhat, with a crispness and presence in the stereo shaker eggs for example, even if it wasn’t able to dig deep on the larger drums. The Vizio’s authority was evident from the first few bars of the song. Lisa Gerrard’s voice floated free of the speakers, and the string accompaniment was easier to hear. The sub was able to let the drums and gong sounds fully resonate in my testing room.

I moved to movies and TV next, starting with the infamous egg-stealing Chapter 10 of The Mandalorian. The episode features a chase scene through clouds and an inevitable canyon run (it wouldn’t be Star Wars if you couldn’t flip your ship vertically or had to contend with guard rails on gang planks). During this scene the Arc was able to convey a real sense of height as the Razor Crest descended into the frosty planet’s atmosphere, pursued by two X-wing fighters.

As lovely as the Arc sounded, it was the Vizio’s dedicated rears and sub which really helped anchor the action. The Elevate’s surround effects were much more pinpoint and the metallic thud of the ship as it skidded across the floor of the icy canyon sounded impactful and scary. It didn’t have the same vertiginous feeling of height as the Arc however.

The sub and rears again helped the Vizio convey a sense of space in my next test, the Thanator chase scene from Avatar. Insects buzzed around the listening position, dialogue was clear and explosions bombastic. In comparison with the Arc, it could occasionally send an insect-like click to my right that made me think the Elevate’s rears were somehow still working, but the sense of surround was much less palpable.
