LAS PIÑAS, NATIONAL CAPITAL REGION -- Something is really big during the 10th Moving Up Ceremony at the Las Piñas National High School (LPNHS) but feels so illegal to perform as students who have all graduated ahead of Holy Week last Monday morning (April 14th, 2025 -- Las Piñas local time) for the batch of 2024-2025 as some students are moving on to the Senior High for batches 2025-2026 by mid-June of this year.
hololive Production (HP) and Department of Education-Schools Division Office - Las Piñas (DepEd-SDO-LP) accidentally shocked the world as one MAPEH teacher (Music, Arts, Physical Education and Health) brought up the idea to have the students graduating from Junior High to perform and sing the song out of Japan.
As you may not know about it, 'Breaking Dimensions' is a song from hololive English's 2nd concert. The song is about breaking free from limitations and pushing beyond one's boundaries in life. The lyrics are inspiring, and the catchy melody makes it a global fan favorite among Hololive enthusiasts. The song was made by 'hololive English' with the VTuber groups 'Myth', 'Promise', and 'Advent', from the biggest names of 'Gawr Gura', 'Watson Amelia' and among others. They were previously performed last year in late-August 2024 at the Kings Theater in Brooklyn, New York, United States of America (U.S.A.).
The video of the performance praising the students' energy and coordination where it was exploded on social media with 94,000 views and a potential worth of U$D188 to U$D940 dollars (or PHP10,710.55 to PHP53,552.74 Philippine pesos) based on the statistical payout rates per monetized view. 'Sarah Jane Melgar', who is a 10th Grade MAPEH teacher at LPNHS showcases impressive performance. A video was obtained and independently verified to OneNETnews features the Las Piñas students singing and dancing in perfect sync to the song. The choreography is intricate, with the students moving in unison and performing complex dance moves. The energy in the room is palpable, with the students clearly enjoying themselves in.
But, the questions need to be asked. Is it legal to perform this at school? The MAPEH teacher in charge of the performance is the mastermind behind this impressive feat. An individual, who wishes to remain anonymous due to lowered age told OneNETnews, that the group fan member of hololive is Advent's "Nerissa Ravencroft", collectively known as the Jailbirds. Melgar shared their personal YouTube account by accident, she really doesn't know about hololive. Experts say, in theory, they need to travel to Japan for the entire tour on what was behind the scenes about hololive. She may have a chance to meet Ravencroft from Tokyo, and other hololive VTubers in person, via virtual conversations in teleconferencing or both.
Ravencroft responded to one Jailbirds' fan on hololive from Las Piñas City, she really acknowledged on stream about in-real-life performance: "It made me so happy like, I was already beaming and so excited. What a way to end off my day but, there is no way I was so happy! So, whatever Jailbird you are, thank you for liking and watching my stuff here at hololive. And thank you for showing your mom about Breaking Dimensions", she said.
The performance lacked official permission from hololive, which created uncertainty about the required music license. The Filipino Society of Composers, Authors and Publishers (FILSCAP) functions as the main entity in the Philippines which handles music royalties. Theoretically, the school might need to secure a music license by next year in 2026 to perform copyrighted songs like 'Breaking Dimensions'. However, it's unclear if hololive would be willing to share music royalties with the MAPEH teacher. We reached out to Nerissa Ravencroft via the X Network (formerly Twitter, owned by X Corporation), but were yet to respond to our comment.
LPNHS's 10th Moving Up Ceremony showcased the creative and enthusiastic spirit of the students through their Breaking Dimensions performance. Despite potential music licensing issues outside Japan, the show delivers an outstanding performance. VTubers legacy must preserve history before hololive's graduation despite in-real-life performance out of Las Piñas for a better National Capital Region (NCR).

Facts:
FILSCAP is an aggregation of copyright owners in the Philippines, acting as a non-stock, non-profit corporation, whose members assign to it the right to grant permission or licenses to third parties to use, perform, mechanically reproduce, or synchronize their musical works. FILSCAP also collects license fees and royalties for its members.
Wolfpac Communications, Inc. (Wolfpac) markets and promotes mobile phone applications and aggregates content from third-party content providers, distributing ringback tones.
In 2004, FILSCAP discovered an advertisement by Wolfpac in the Philippine Daily Inquirer promoting "Listen B4 Download," which allowed prospective consumers to listen to a 20-second portion of a song before downloading the full ringback tone for a fee.
FILSCAP alleged that Wolfpac’s pre-listening service constituted unauthorized utilization and exploitation of copyrighted musical works and public performance without payment of royalties. Wolfpac argued that the pre-listening service was free, the samples were not reproductions, and it fell under fair use.
In 2008, the Regional Trial Court (RTC) dismissed FILSCAP’s complaint, ruling that the 20-second pre-listening function did not constitute public performance and that Wolfpac’s use of the samples was justified under the fair use doctrine. FILSCAP’s motion for reconsideration was denied.
A Memorandum of Agreement (MOA) existed between FILSCAP and Wolfpac, which gave Wolfpac the authority to convert musical works into downloadable ringtones and sell them to the public, with FILSCAP receiving royalties. Wolfpac contended this MOA implied consent for the pre-listening. FILSCAP asserted the MOA did not cover advertising or pre-listening.
Issues:
Whether Wolfpac’s use of sample ringtones in the pre-listening function on its website constitutes public performance or communication to the public.
Whether Wolfpac’s use of the samples constitutes copyright infringement or is justified under the fair use doctrine.
Ruling (Main Decision):
Answer: The Supreme Court DENIED FILSCAP’s Petition for Review on Certiorari and AFFIRMED the RTC’s judgment.
Wolfpac's pre-listening function does not constitute public performance or communication to the public under the Intellectual Property Code.
Wolfpac’s use of the samples falls under the fair use doctrine, and thus, does not constitute copyright infringement.
Legal Basis:
Intellectual Property (IP) Code of the Philippines:
The IP Code defines "communication to the public" and "public performance" as distinct rights.
Section 171.3 defines "communication to the public" as making a work available to the public by wire or wireless means in a way that individuals can access it from a place and time of their choosing.
Section 171.6 defines "public performance" as the recitation, playing, or rendering of a work, audible to a substantial number of persons outside a normal circle of family and social acquaintances.
Section 184 (Limitations on copyright) and Section 185 (Fair Use of a Copyrighted Work) outline the exceptions to copyright infringement.
The four factors for determining fair use are: (a) purpose and character of the use (commercial vs. non-profit educational), (b) nature of the copyrighted work, (c) amount and substantiality of the portion used, and (d) effect of the use upon the potential market or value of the copyrighted work.
International Treaties: The Berne Convention addresses public performance rights (Article 11(1)), and the WIPO Copyright Treaty (WCT), to which the Philippines acceded in 2002, defines "communication to the public".
Jurisprudence: The Court distinguished this case from previous rulings like Anrey (radio-over-loudspeakers in a restaurant as public performance) and Home Cable (cabcasting karaoke channels as communication to the public), noting that those involved public reception or exhibition, unlike the individual access in Wolfpac's case.
Application:
Not Public Performance/Communication to the Public:
The pre-listening function is primarily a pre-selling feature or promotional tool to entice consumers to download ringback tones, not a public exhibition for enjoyment or exploitation.
Consumers access the 20-second samples individually, at a time and place of their own choosing, making it a private act of informing a purchase, not a public performance intended for a general audience.
The samples are too insubstantial (20 seconds) to be considered an enjoyment of the entire musical work. Their purpose is merely to aid the purchasing decision.
While the MOA allowed Wolfpac to convert musical works into ringtones and sell them, the Court found that the pre-listening function was a distinct activity, but one that did not fall under unauthorized exploitation.
Fair Use Applies:
Purpose and Character: The use is promotional and non-commercial (the 20-second sample itself is free), making it transformative. It does not directly generate revenue from the sample itself.
Nature of Copyrighted Work: While musical compositions are creative works, their use as a sample for promotion is considered transformative.
Amount and Substantiality: The 20-second clip is a minimal portion of the whole song and does not constitute the "heart" of the work.
Effect on Potential Market: The use of samples is likely to increase sales of the full ringtone, thus not harming, but potentially benefiting, the market value of the copyrighted work.
Conclusion: The pre-listening service is a legitimate marketing tool that does not infringe on copyrights, falling under fair use due to its promotional, non-commercial, and insubstantial nature, and its positive effect on the market.
Doctrine:
The pre-listening function of musical works, which allows prospective consumers to listen to a short portion (e.g., 20 seconds) of a song before downloading the full ringback tone, is considered a promotional or pre-selling tool. Such a function does not constitute "public performance" or "communication to the public" because its primary purpose is not public enjoyment or direct exploitation of the work, but rather to facilitate an individual purchase decision. This use of a short, non-revenue-generating sample for promotional purposes falls squarely under the fair use doctrine, as it is transformative (from full work to promotional sample), non-commercial (no direct revenue from the sample), insubstantial in amount, and does not negatively impact the market for the copyrighted work; instead, it tends to increase sales of the full work.
RATIO:
The Supreme Court's decision hinges on a crucial distinction between acts intended for public reception or enjoyment of a copyrighted work and those serving an individual, promotional, or pre-selling purpose.
Differentiating from Public Performance/Communication to the Public: The Court reasoned that "public performance" or "communication to the public" implies an act where the copyrighted work is rendered or made available for appreciation by a general audience, often in a public setting or through broad transmission. Wolfpac's pre-listening service, conversely, allowed users to individually access a short sample at a time and place of their choosing. This individualized access, coupled with the promotional nature of the 20-second clip, means it was not intended for "performance" or "communication" in the sense of delivering the full artistic experience for public consumption, but rather as an informative step in a commercial transaction. The Court effectively drew a line between consumption of a work and sampling for purchase.
Applying Fair Use: The Court found that all four factors of fair use weighed in favor of Wolfpac:
Purpose and Character of Use (Transformative): The primary purpose was to facilitate the sale of ringtones, not to directly exploit the copyrighted work for independent commercial gain from the sample itself. The short duration transformed the sample into an advertisement or a preview, rather than a full performance, thus adding a new purpose.
Nature of Copyrighted Work: While musical works are creative, their use in a promotional context can still be fair use, especially when it is transformative.
Amount and Substantiality of the Portion Used: The 20-second snippet was deemed insubstantial; it was not the "heart" or the most significant part of the entire musical composition. This limited exposure prevents it from substituting the full work.
Effect of the Use Upon the Potential Market: Crucially, the Court concluded that the pre-listening function benefited, rather than harmed, the market for the ringtones. By allowing users to sample, it encouraged actual purchases of the full ringtone, thereby increasing royalties for composers.
Some concurring and dissenting opinions provided additional nuance to the interpretation of "public performance" and "communication to the public". For example, Justice Lazaro-Javier and Justice Singh opined that a 20-second pre-listening clip could constitute "public performance" or "communication to the public" if it provided "listening pleasure". However, even those who found it to be a form of communication ultimately concurred with the dismissal, often on the grounds that consent was implied by the MOA (in Justice Lazaro-Javier's case) or that the use was still justified under the fair use doctrine (in Justice Singh's and Zalameda's cases). This highlights a broader judicial consensus on the outcome, even with differing interpretations of what constitutes "public performance" or "communication to the public" in the context of modern digital technologies, ultimately emphasizing the flexibility of the fair use doctrine to adapt to new commercial realities.

PAMPLONA, NEGROS ORIENTAL -- The newest local radio station in Negros Oriental, far distancing as discovered from Pamplona town to Dumaguete City in the same radio frequency. Christian Music Power Incorporated (CMPi) recently launched this year with Big 107.9mhz FM under the Big FM Network.
The said station is owned and managed by 'Grace Glory C. Agabon', along with assistant station manager 'Antonio T. Baldoza' and it operates daily from 5:30am to 10pm (Pamplona local time). Local listeners say that a set of radio commercials about Bioherb products is distributed by Master Herbs Marketing (MHM).
In principle, they might be operating without radio broadcasting license both from the National Telecommunications Commission (NTC) and Filipino Society of Composers, Authors and Publishers (FILSCAP) in lease time marketing agreement.
As of right now, there is no callsign of Big 107.9 FM in this said town. The flagship station of Big FM Network is located in 'Santo Tomas, Batangas' over Big 101.5 FM; and in 'Casiguran, Sorsogon' over Big 107.5 FM as an affiliate radio station of the Big FM Network.
Allegations of operating without a license on free local radio have not stopped Big 107.9 FM from having a presence in Pamplona and parts of Dumaguete City, where people use portable radios to listen. Despite the lack of legal confirmation, the station carries on with its daily broadcasts. The Negrosanon community is wondering how far it might be heard on various radio frequencies.

Young blood.
Those were the stars that shined brightly amidst the rainy night in Makati wherein some of the youngest songwriters in the country competed in the first Pioneer Insurance #MoveOnLang Songwriting Competition.
  The 10 finalists where chosen from 150 entries from colleges and universities all over the country at the Preliminary Judging conducted by FiLSCAP.
After hearing the 10 songs performed live, mostly by the composers, I am pretty much sure that the OPM will be in good hands in the future, if the likes and caliber of these young songwriters will be leading the way.
For the purpose of the contest, there are only three top winners. But certainly, each song is a winner in its right.

The first and second runners-up won Php 50,000 and Php 30,000 respectively.

To recognize their songwriting prowess, Pioneer awarded the remaining seven finalists with Php 10,000 each. Julia Dichoso’s song ”Hand In Hand” received 44.96% of online votes and was crowned as Online Favorite.
Pioneer also gave a Special Recognition Award to Drei Chua of San Beda College Alabang for his song entry “Bangon,” an exceptional composition that perfectly describes Pioneer’s promise to its clients.
Aside from the cash prize, all winners received Php 100,000 worth of insurance coverage from Pioneer.
Pioneer launched the #MoveOnLang Songwriting Competition in partnership with FILSCAP and One Music PH to encourage the youth to pursue artistic endeavors and to celebrate the Filipino trait of resiliency.
Applicants were challenged to write a song expressing their take on resiliency in 3 minutes or less.

“Time” by Patricia Monsod of University of the Philippines Diliman Attended by guests from the Filipino Society of Composers, Authors and Publishers (FILSCAP), ABS-CBN’s One Music PH, and Pioneer’s Professional Sales Agency, Finals Night marked the end of the contest, as the judges proclaimed the Grand Winner, who received a prize of Php 100,000. The first and second runners-up won Php 50,000 and Php 30,000 respectively.
To recognize their songwriting prowess, Pioneer awarded the remaining seven finalists with Php 10,000 each. Julia Dichoso’s song ”Hand In Hand” received 44.96% of online votes and was crowned as Online Favorite
