Under which law am I secured?
Passengers that have been affected by flight delays, flight cancellations or in some instances have been denied boarding, are covered under Regulation (EC) No 261/2004.
What limits my claim?
The amount of flight delay compensation you can claim is dependent on three key elements:
1. The airline, Departing and Destination Airport;
Retrieving flight compensation due to delays or cancellations is determined on the geographical location of departure or destination airport. If you have affected and you have used a European airline, or the flight has flown from or arrived in Europe, you can relax as the regulation protects you.
Also, there are some exceptions and these additional countries are also covered by the Regulation (EC) No 261/2004: Iceland, Liechtenstein, Norway, Switzerland, Guadeloupe, French Guiana, Martinique, Reunion Island, Mayotte as well as Saint-Martin, the Azores, Madeira and the Canary Islands.
Regulation (EC) No 261/2004 does not apply to passengers or flights that have departed from Faeroe Islands, Isle of Man and the Channel Islands & Gibraltar Airport.
2. Cause of Delay;
Flight delay compensation applies when the airline is accountable for the delay, including the following:
- Technical or engineering problems with the aircraft;
- Poor communication between the airline and airport;
- Delays caused by crew members such as the pilots or cabin crew;
- Airline staff strikes.
Should you experience delays as a result of reasons listed below, you are not entitled to flight compensation as they are considered to ‘extraordinary circumstances’:
- Severe weather conditions;
- Political unrest;
- Airport staff taking industrial action (this does not include the airline’s staff);
- High threats or security risks such as terrorism, etc.;
- Air traffic controller slow to provide clearance;
- Any technical faults which are outside of ‘routine’ aircraft maintenance.
3. Flight Distance and Length of Delay.
Flight Claims Online’s website calculator will show you how much you may be entitled to based on the length of delay and the distance of the flight. The regulation stipulated that the ‘delay time’ is how late a flight is when compared to the anticipated landing time at the destination airport.

What else am I entitled to?
If you experience delays and find yourself stuck at your departure airport, you are also entitled to the following:
- Food and drink;
- Any necessary accommodation, along with transportation between there and the airport if you require an overnight stay;
- Communication expenses, e.g. Wi-Fi and phone calls;
- Should you or your party need assistance as a result of reduced mobility/disability.
Generally, the airport will provide these amenities in the form of a voucher. However, you may find that certain airlines will ask you to keep receipts to help validate your claim. Reimbursements will only be made for ‘reasonable purchases.’
Travelling for free or using staff discount tickets?
Unfortunately, you will not be entitled to flight delay compensation if you are traveling free of charge or if you have a specially issued ticket at a reduced price. E.g., staff discounted tickets.
Multi-mode ticket or part of a holiday packages
If you have purchased a multi-mode ticket which combines several methods of transports that may include plane, rail, ferry, etc., or whether you have purchased the flight as part of a holiday package, you are not entitled to claim flight delay compensation.

9 Things You Can Request When You Fly
Are there plane and airport perks that you aren’t currently aware of? 1. Changing seats
It isn’t always possible to get seats next to or near to friends or family while travelling in a group when booking. However, it is possible to change seats once the plane has been boarded. Simply ask a steward or stewardess to accommodate your request. Of course, this is generally only possible when there are spare seats after everyone has been seated. You won’t even have to pay for the change of seating like you would online.
2. Beverages
Depending on their airline you’re flying with, you may get offered a free drink or snack once the flight has taken off. However, when it comes to budget airlines, you will usually be expected to pay for your beverages on-board. Yet with airlines such as British Airlines, you will be able to request a range of non-alcoholic and non-alcoholic beverages.
3. Emergency Kits and Medical Supplies
If you start to feel unwell, which isn’t uncommon on long haul flights, you can enquire what medical supplies are available on the plan. If you find yourself suffering from a migraine or back pain, you may be able to request mild strength painkillers to make your flight more comfortable. Always let a member of staff know if you’re feeling unwell or if you’ve injured yourself.
4. Internet connection (Selected Airlines Only)
If the plane you’re travelling in has Wi-Fi, make sure you take full advantage. Having no access to the internet can often be the biggest cause of complaint during a flight, so always ensure you enquire whether there is free Wi-Fi on-board, so you can pass the time on social media apps or browse the internet. Please note that some airlines may charge for this service.
5. Second Servings
If you’ve had your on board meal and you’re still feeling peckish, why not ask for a second serving? If there are any spare portions left, the chances are that your request will be granted at no extra charge if your meal and beverages were included in the flight price.
6. Childcare
Travelling with children can be difficult, especially when it comes to visiting the bathroom. So, if you’re flying alone with a child, you can always ask a steward or stewardess to look after your child while you’re in the bathroom.
7. Headphones
There’s no good time to forget your headphones, especially if you’re on a long-haul flight. So, if you would like to enjoy the in-flight movie, listen to your own music, or get some sleep you can always request a free pair of headphones which may be available on select airlines.
8. Sleeping Aids
If you want to get some shut-eye, the airline may be able to supply you with free earplugs, a sleeping mask to block the light, blankets or even socks.
9. Visiting the cockpit
If you're tempted to look at the cockpit, why not just ask? Although you will have to wait until the plane has landed and come to a complete stop and the staff will be happy to show it to you.
