In 1967, the Walt Disney Company and the Florida State Legislature created the special tax district of Reedy Creek Improvement District, which granted the corporation the authority to oversee its own building codes, permit distribution, bond issuance, and tax collection. (Reedy Creek Improvement District) With special tax districts totaling over 1,000, including the prominent Daytona Beach Racing and Recreational Facilities District, the mechanism of utilizing special tax districts in Florida is common, as the districts generate revenue through specialized taxation, allow greater autonomy for communities, and provide efficient governance. (Sampson)
In 1968, the State of Florida sued the Reedy Creek Improvement District on the grounds that the district lacked the power to plan for drainage of its own waterlogged terrain and to issue revenue bonds for financing of the drainage endeavor. The Supreme Court of Florida rendered a verdict deeming that the appellant's contention that the project predominantly catered to Disney's interests was "untenable" because the primary objective is a valid public purpose given that the project would "improve sanitation and pest control conditions while aiding in the conservation of natural resources." The Supreme Court of Florida also deduced that as "long as specific constitutional provisions are not offended," a special improvement district can be located within "more than one county and possess multi-purpose powers essential to the realization of a valid public purpose." The Supreme Court of Florida held that the legislation establishing the Reedy Creek Improvement District did not conflict with Article III Section 20 of the Constitution of the State of Florida because the Court previously held that it is permissible for the Florida Legislature "to impose state and county" officials with administrative duties "as an incident to the formation of a taxing district for governmental purposes in order to effectuate the purposes of the district." Ultimately, the Court concluded that the legislation establishing the Reedy Creek Improvement District conferred the district with the control to "issue general obligation bonds, revenue bonds, or any other bonds to pay all or part of the cost of construction," and that the Board of the Reedy Creek Improvement District "was reasonable" and "accordingly not arbitrary, unfair, or inequitable" in its imposition of fees. Therefore, the Supreme Court of Florida ruled in favor of the Reedy Creek Improvement District and solidified a case precedent that granted the Walt Disney Company with more than 5 decades of safeguarded authority. In April 2022, Florida Governor Ron DeSantis signed Senate Bill 4-C, which stipulated that any "independent special district" promulgated "prior to November 5, 1968" that "was not reestablished, re-ratified, or otherwise reconstituted by a special act" will be "dissolved effective June 1, 2023." The Florida Senate bill conspicuously directed its focus towards the dissolution of the Walt Disney Company’s special district, which could cause the special district to be absorbed into Osceola and Orange counties. Jerry Demings, mayor of Orange County, declared that assuming responsibility for "the first response" and ensuring the public safety of Reedy Creek would be "catastrophic for the county's budget" and "would be an undue burden on the rest of the taxpayers in Orange County." (Sampson) Governor Ron DeSantis, the Walt Disney Company, and the mayors of Orange and Osceola counties must collaboratively formulate a resolution to rectify the imminent fiscal upheaval that is poised to confront Osceola and Orange counties.

FAA certifies S-70M Black Hawk helicopter for the civilian market

The Federal Aviation Administration (FAA) has completed its certification of the S-70M Black Hawk helicopter - a new type designation - by issuing to Sikorsky, a Lockheed Martin company, a Special Restricted Category Airworthiness Certificate, allowing delivery to the commercial/civil market.
FAA certification and the establishment of a pilot type qualification are expected to expand the market for military project helicopters, allowing civilian and commercial operators in the United States to purchase new Black Hawk aircraft directly from the factory.
“With type certification, the new S-70M Black Hawk helicopters of production in the latest configuration are available to the U.S. commercial/civil market for the first time,” said Jason Lambert, vice president of Sikorsky Global Commercial & Military Systems. “Internationally, where the FAA restricted category is not widely accepted, we can now discuss with other civil aviation authorities the potential to validate the aircraft to challenge civilian operations in the airspace of their countries.”
“We thank the FAA for its rigorous evaluation of the first S-70M aircraft and FlightSafety International for its partnership to upgrade an S-70i flight simulator and S-70M training curriculum to FAA standards,” he said. “We also congratulate and welcome our first S-70M customer, San Diego Gas & Electric, who requires the robust design and lifting capacity of the Black Hawk helicopter to carry out the demanding air firefighting mission.”
California's San Diego Gas & Electric (SDG & E) public service received the first restricted-class S-70M aircraft on November 18 at the Sikorsky Training Academy in Stuart, Florida. SDG & E will modify the aircraft to the Firehawk configuration at United Rotorcraft, a division of Air Methods in Colorado. By 2023, the aircraft will be ready to release water into forest fires with high precision from its 3,785-liter external tank (1,000 gallons).
FlightSafety was instrumental in the certification effort.
"As an authorized training partner of Sikorsky's S-70 Black Hawk, FlightSafety sees the importance of the S-70M model for the global helicopter market," said David Harper, central manager of the FlightSafety Learning Center in West Palm Beach, Florida. “We invested heavily to develop an all-new S-70M pilot training curriculum with advanced courses and upgrade our flight simulator to a full-movement D-level capability. Work is underway with the FAA to obtain the approval of Part 142 for our training course. FlightSafety is excited that pilots who need initial S-70M type qualification or an air transport pilot upgrade will soon be able to obtain these ratings at our West Palm Beach facility.”
Sikorsky received a type certificate for the FAA S-70M aircraft in February 2019 and produced the first aircraft of its kind a year later. During 2020-21, Sikorsky proved that the aircraft complied with the type design and helped the FAA establish the new type rating.
The FAA certified the S-70M aircraft in accordance with Part 21 of the U.S. Code of Federal Regulations in the Restricted Category, basing its certification on the UH-60M Black Hawk helicopter of the U.S. Army. Although capable of several special purpose operations in the restricted category, Sikorsky requested approval for three: Agricultural operations; External cargo, which allows the use of the external lifting load hook of the 4,082 kg (9,000 lbs.) aircraft; and Forest and Wildlife Conservation, which includes the distribution of liquids in forest fires.
PZL Mielec, a Lockheed Martin company, will build S-70M aircraft in accordance with FAA's Special Restricted Category Airworthiness Certificate in Poland. Like the S-70i aircraft, the S-70M is a third-generation Black Hawk helicopter with digital cabin, GE 701D engines and wide-rope rotor blades for high levels of safety, performance, maneuverability and situational awareness.
