about the copyright stuff.. do you think if someone gave complete legal consent for approval of use in an episode (with legal documents giving them permission/ ownership of the material) do you think they could use fanfic/au ideas then? wouldn’t that work around the copyright protections or is that not possible because even then if the person tried to sue or wanted to they couldn’t since it would be in their ownership (rcg) technically.
I don't know enough about the intricacies of copyright and intellectual property law to really say I'm giving you a professional answer, but if a contract was involved relinquishing ownership and/or claims, I'm pretty sure, yes.
In all honestly, I would go as so far as to say just a blanket statement that you relinquish all your right, title, and interest to any original plot, ideas, and/or dialogue in your story would do it. Similar to how some studios or writers have had contests or promotional things fans can submit their fan works to, if you tick a box and say you read and agree to the terms and conditions (normally being you relinquish your right to any monetary claims if they use your work), that's all there is to it. So yeah, if RCG wanted to do some kind of "fan written" or fan-contributed episode they absolutely could.
Just to restate: the refusal of creators and writers engaging with fanfiction due to copyright issues is really when it's put upon them: a fan hands them something or DMs them. That, they basically straight up know/are trained to refuse and not to engage with. When it comes to something more organic, like imagining a creator looking through Ao3 or ff.net, the extremely low likelihood that they are going to do that is because they know it is a very murky area they can easily dupe or hurt themselves walking into. They're supposed to actively avoid it, and most do, but if you want to think (or even strongly believe) your guy is browsing fics when he's bored as hell flying back and forth from LA to Wales multiple times a month, slap a little release on your work, if you want (Sometimes you see release disclaimers on other people's fanfiction. Though a lot of the time it's just a rejection of ownership because people are paranoid they can get in trouble for publishing fanfiction...lmfao).

Cory Doctorow: I think of enshittification as a theory about what happens when you have power without consequence. We have increased the power available to large firms for a long time by reducing our antitrust enforcement, allowing mergers, predatory pricing, all the conduct that allows firms to get very big. That’s been across the board, not just with tech. Nightcap: What does that look like, in real life? Doctorow: There’s a law, the Digital Millennium Copyright Act, that makes it illegal to break digital rights management. So for example, if Audible (which is owned by Amazon) sells you one of my audiobooks, they require that it have digital rights management that locks it to Audible’s platform forever — you can’t unlock it, quit Audible and take your books with you. And if I give you a tool to jailbreak the audiobook so you can go somewhere else, I commit a felony punishable by a five-year prison sentence and a $500,000 fine. So even though I am the rights holder to that work, Amazon, the intermediary who sold you the work, has more intellectual-property rights to that work than I do. This is a law that is oriented around allowing these large firms to wield regulation against competitors, against their own workforce and against their users so that they can maintain power. It’s a collapse of discipline — they don’t have to worry about their workers, they don’t have to worry about regulators. And they bought all their competitors.

I think people delude themselves about how effective intellectual property is. In the pure world of intellectual property you can patent a discovery and sell it for all the value it adds, or use it to make that much profit, but in reality the value of intellectual property corresponds very loosely to how much value it adds.
It's relatively easy to read a few books and write a pop history book about a topic which makes ten times as much money as what the academic history books made, even though those books may each have taken 10 times as long by more skilled workers, and amount to the vast majority of the work that went into your book. The incentive structure is clearly wrong if you want books like your pop history book to be made about more topics.
If you do basic research that leads to an important new drug being developed 20 years down the line, you will get nothing- the organisation that actually gets the patent is the one that does the last step. And many kinds of valuable research don't lead in any immediate way to a marketable product in the first place.
The reason the neoliberal argument fails here is because people are getting patents intellectual property that doesn't just capture the value they added, but all the work others put into the idea before them, which no intellectual property was awarded for. So there is a huge incentivise to focus on the last mile, the marketable part, to the neglect of everything else, even though that's most likely to be the part that anyone could have done.
The neoliberal might reply that this is actually a problem of incomplete property rights- the neoliberal's model works if the basic research was patentable too, so that the person who brings it to market pays for the basic research, gets paid the value of the market product, and pockets the difference- the value they added. But the reason that isn't done is that a world like that would be unlivable. It would be impossible to get any research done because the web of how ideas feed into each other isn't simple, and the negotiation of how much to pay for each idea would be arduous. This is why patents cannot work in the 'ideal' way they do in economic models, and why they will inevitably have this serious flaw in the real world.
The neoliberal might argue that this is a problem solved by universities- universities can do the basic research, which becomes commons, and the researchers are paid salaries because paying them based on their value added would be impossible, and the applied research is done by businesses, who are paid their value added, because it's close enough to the market that that is possible. Aside from neoliberals cutting universities, the problem with this is that it allows private companies to capture the value of research done by universities if there are only a few ways to apply that research effectively. If a company uses X basic research to make Y product, and there are no profitable alternative ways to apply X to make a competitor product, the company hasn't just been given a monopoly on Y, they've been given a monopoly on X- they have captured a piece of the commons, created by a university researcher for the good of everyone, and they're extracting rent from it. This also creates a strong incentive for reinventing the wheel, because if you can turn X into Y in a way different enough to fall outside of that patent, you get half of that economic rent.
Additionally there is no clear delineation between basic and applied research, so there is a balance that must be struck between not letting things too basic be patented, as that would be devastating to all the research that might build on it, while allowing applied research to be patented. But it is difficult to tell early on how far an idea could be taken, and patent assessors are generally not well placed to do that, so it is easy for them to hamstring any attempts to build upon a crucial idea for the duration of the patent- 20 years in the UK. Potentially this creates an incentive to veer away from more basic lines of inquiry.
And there is no such thing as a terminal creation, that there is no point in trying to improve, so counting research as applied and giving a patent is still cutting off the possibility of future improvements being made for 20 years, except by people at that company. This is particularly devastating with arts and writing, where works want to iterate on each other rapidly. Maybe someone made some important discovery, but they're a bad writer, so you want to rewrite their article so that people will actually read it, but you can't do so because that would undermine the incentive to read the original article, the copyright of which is owned by the publisher, so it's illegal- and has to be for the intellectual property regime to function, stifling the spread of ideas.
This capturing of value added by others isn't the only problem. Monopolies are an inefficient way for industries to be organised, leading to higher prices, so less sales, meaning less people are able to actually make use of the innovations, both applied and basic. The number of people who can access a drug is slashed to make sure the value from those who do access the drug can be captured by the market. But even when there are several variations of a product, patented by different companies, this creates the same problem, because of fixed costs- the companies have to charge above the marginal cost to make back their investment, reducing the number of people who can access the product. And this is a drastic effect when the marginal cost is often near zero.
This of course exacerbates inequality, and means that there is a strong incentive to create innovations that are aimed at the affluent, not the poor. Invent Ozempic, not a cure for malaria.
And finally there's the problem of the institutional structure actual people are innovating under. In theory everyone is a lone inventor-entrepreneur who chooses what they research and gets paid by their results, and aims to maximise profit. But really people are employed by a corporation, and when they discover something the shareholders capture most of the value, not them, so after this elaborate, expensive, destructive system to create a financial incentive for innovation, a tiny fraction of it gets passed on to the actual innovators, in the form of increased chance of a promotion or pay rise. And yet the innovations still get made, so clearly this is enough, or people are motivated by the desire to make the world a better place, not just money. Either way the patent system we have is patently excessive.
And if you aren't a researcher at an existing company and you want to get any money at all for your discovery, you're going to have to found a company yourself to extract the surplus- an arduous task, and one that you might not be any good at, and that in any case will take you away from making further discoveries. To be rewarded as an engineer you must remake yourself as an entrepreneur, or accept that someone else is going to take most of your reward. And it may be half your lifetime before you get that reward.
There are additional problems with access to educational resources, incentives for black/grey markets, deadweight loss from litigation, etc. but this is more than enough to show intellectual property is very inefficient at incentivising innovation. So when alternative models are also criticised for being flawed, economically inefficient that shouldn't kill those alternatives- because it would take a lot for them to be as flawed as the existing system.
A panel of experts awarding a payment for a discovery might get its value drastically wrong- but so might investors buying a start up, so might an unwilling, untalented entrepreneur failing to price their product correctly and losing money from their creation. And at least they can go on inventing/writing/innovating instead of changing careers, and the valuation will be based on opinions of people who know what they're talking about, and based on the value of their innovation to everyone, not just the wealthy. There might be political pressure to reduce the value of payments, but there's also political pressure to cut university funding- at least it would mean there is some connection between output and compensation for university researchers, and there isn't an incentive gradient driving people out of basic research and into applied research, and at least all of the value of the payment would be going to the actual innovator.

I personally feel like Harry Potter is one of those franchises that's been practically corrupted by its fandom.
The fandom should respect the author, but doesn’t.
The fandom has people in it who say:
"I don't trust JKR with her own Intellectual Property."
"She doesn't know anything about the Marauders. The world and characters belong to us now."
"She would just make all the Marauders straight, white, and cis." (Not everything has to be gay? Wtf)
It's HER story. None of you children (or adults with immature minds) have any right to say that she doesn't know her characters. If she hadn't written them in the first place, you'd have nothing to do, would you? There would be no wolfstar or jegulus or marauders era to begin with.
And you guys do understand that Regulus is fucking dead, right? James and Lily got married. Remus and Tonks had Teddy. Sirius was too focused on the delusion that he thought he got his best friend back (through Harry) to give a shit about Remus. Evan Rosier was never important to the plot. Lily is actually an important character. "Pandora" Lovegood doesn't exist in the books (her name is never mentioned except on Pottermore), and, no, she isn't Evan's twin so stfu. Marlene McKinnon is mentioned once (and it's implied that she married a man). Y'all can't even get Dorcas Meadowes's name correct.
The amount of canon-divergence absurdity in fanon culture is appalling.

(And just because headcanons are what "you believe/think about a character" doesn't mean they don't have to be logical and actually fit into the canon story, so I don’t wanna hear it.) 🙄
And before you tell me "if you don't like it then don't read it"— I don't "read it." I don't read ATYD or Crimson Rivers or Art Heist or whatever other fics are out there that you've decided is canon now. I read the real story, y'know, the seven, very much canon, books. And I was gonna read ATYD, but once I found out how y'all treat it as the Holy Grail of the 1970s Wizarding World, I decided it wasn't my cup of tea because I want to read a fic that is canon-compliant, that doesn't push every hot character into a gay relationship, that doesn't have explicit sex involving minors, that doesn't have self-inserts..

if i missed something, or got something wrong, yell at me in the comments. there are a few other analysis on my page, if you wanna check them out :3 hope u enjoy!!
“ratio” can be traced back to the ancient greek logos. early translators rendered this into Latin as ratio (“reason;” as in the word "rational"). a more modern interpretation of Euclid's meaning is more akin to computation or reckoning.
in Latin, ratio has several meanings, including "reason, ration, calculation," etc
in Roman mythology, Veritas, meaning "truth," is the Goddess of Truth.
there's a lot of owl symbols on ratio, and owls symbolize wisdom, mystery, intelligence and protection.
there's a lot of greek symbolism, esp in his outfit and the way the fabric is tied and the laurel leaves in his hair (in Ancient Rome, it was worn on the head as a symbol of triumph) and the owl motif, the symbol of Athena goddess of wisdom.
dr. ratio's plaster head besides being an obvious reference to ancient greek's herma (symbol of protection, warding off unwanted intrusion or evil spirits), but it is also a reference to, euler, who famously went blind towards the end of his life. his productivity only increased after his blindness, and he was reported to having said, "now I will have fewer distractions," after going blind in both eyes.
dr ratio's eidolons are all based off multiple philosophical concepts and proverbs;
eidolon one: "pride comes before fall" comes from the 'book of proverbs' in the bible.
eidolon two: "the divine is in the detail" explores the relationships in aisha khalid (a visual artist)'s work amongst geometry and precision with respect to the spiritual. the exhibition title is a play on the commonly heard phrase ‘the devil is in the detail’, in other words, the difficulties or problematics of specificity.
eidolon three: "know thyself" is a philosophical maxim which was inscribed upon the Temple of Apollo in the ancient Greek precinct of Delphi. initially, it meant "know your limits," then it was re-interpreted by Plato who understood it to mean "know your soul." then it was re-interpreted again by christian, jewish and muslim scholars used "know thyself" as a command to study the physical properties of the human body.
eidolon four: "ignorance is blight." i couldn't find much for it, but ignorance (lack of knowledge) is blight (a thing that spoils or damages something), which could be the opposite of a quote by poet Thomas Gray "ignorance is bliss."
eidolon five: "sic itur ad astra" literally means 'thus, one goes to the stars'. the phrase is most famously attributed to the Roman poet Virgil in the Aeneid. the phrase can be interpreted as a motivational statement. it suggests that greatness and high achievements are attainable if one follows the right path or method. it also implies that the journey to greatness involves effort and perseverance. it's not just about the destination (the stars) but also about the path one takes to get there.
eidolon six: "vincit omnia veritas" means "truth conquers all things." similar to the Latin phrase "amor vincit omnia," meaning "love conquers all things." this phrase emphasizes the idea that truth is powerful and ultimately prevails over falsehood or deceit.

"mind is might:" the idea behind this phrase is that through the power of the mind, individuals can solve complex problems, innovate, lead effectively, and make decisions that have far-reaching positive impacts. it underscores the value of mental prowess in various aspects of life, from personal development to societal progress.
"intellectual midwifery:" intellectual midwifery is a metaphorical concept that describes the role of a person or a process in helping someone else develop their ideas and thoughts. it's like how a midwife helps in childbirth by supporting and assisting, but instead of a baby, it's about helping ideas or intellectual creations come into being. this can involve guiding someone through the process of thinking critically, asking questions, and providing support so they can articulate and develop their ideas effectively.
"syllogistic paradox" is a situation where a series of logical steps leads to a conclusion that seems contradictory or unexpected. in simple terms, it's like following a set of rules or ideas that seem logical individually, but when put together, they create confusion or a surprising result. these paradoxes often highlight flaws in reasoning or assumptions that we might not initially notice.
"cogito, ergo sum" is a Latin phrase that means "i think, therefore i am." it was famously stated by the philosopher René Descartes. it expresses the idea that the act of thinking proves that a person exists. Descartes used this statement to assert that even if everything else could be doubted or uncertain, the fact that he was thinking was undeniable proof of his own existence as a thinking being.
"mold of idolatry" refers to the different shapes and forms that idol worship or excessive devotion can take. it includes worshiping statues or images as gods, being overly focused on material possessions, or putting anything above the rightful place of worshiping the true divine or ultimate reality. essentially, it describes the various ways people might stray from focusing on what truly matters spiritually.

The snow was coming down on this quiet afternoon. You were bundled up in Andy’s hoodie, a pair of leggings and warm fuzzy socks. A blanket was draped over your legs and the book you were reading was captivating. Andy was currently making chili to warm you both up on this cold day.
When you first met Andy he was quiet and kept to himself. He had lost his wife and son in an accident. Between losing his family and job Andy was a lost soul wandering through the world.
Then life gave him an opportunity and he decided to work for a nonprofit organization that helps people who are falsely accused of murder. It just so happens you work for the same organization and team up on cases with him every now and then. What started as coworkers evolved into you becoming best friends for several years now.
Andy had moved in with you over two years ago and became your roommate to help you both save money. You would have thought being best friends with someone who is your coworker and roommate would have failed from the start. Being around someone that much could drive people crazy, but not you and Andy. It was the total opposite.
You both loved spending time together and hanging out. With Andy everything seemed right in the world and now your current problem was you developed feelings for him. How could you stupidly fall for your best friend? There was the fact he was handsome and he had the best personality. He was encouraging, loyal, kind, caring, respectful, and thoughtful. He had many other attributes about him you could list but you would be here forever listing them.
Andy was 6’1, with ocean-like eyes that you could swim in all day long. His body you have felt thanks to cuddling is muscular and firm. Though you have seen him shirtless many times and you thanked the lord for the view.
Then there was you, a woman who refuses to date thanks to a break up you had prior to meeting Andy. It was a bad breakup that found you questioning your self worth. But thanks to Andy you feel confident and comfortable in your own skin. No longer were you questioning yourself. Now you were a strong female who knew what you wanted. But could you tell him the truth about how you felt?
So here you both have been snowed in since yesterday. Thankfully you both have enough food to last this storm and stay safe indoors. You were several chapters into your book when you felt a pair of hands start to rub your neck. Strong hands were gently massaging you and your eyes closed from the feeling. You couldn’t help the groan that left your mouth when he moved into your shoulders.
”For someone who has been reading all morning your shoulders are tense. Is everything okay? ” Andy spoke gently as his hands continued to rub your shoulders. “Also is this my hoodie?”
“Yeah, I’m fine. I didn’t sleep well last night. Tossed and turned most of the night. Nothing a nap after lunch won’t fix. The hoodie used to be yours but I commandeered it.” You tilted your head back and warmly smiled up at him. After a few more rubs of your neck, he patted you on the shoulder.
“Commandeered it my butt. You stole it months ago and I haven't seen it since. Let’s go eat some lunch. It will warm you up in no time.” He smiled at you as you stretched on the couch and got up.
Both of you walked into the spacious kitchen and grabbed a bowl. You put a couple of spoonfuls of chili in your bowl and made your way to the dining room table. As you sat down Andy had made his way to the table, sitting across from you.
As you made small talk with him your eyes wandered across his face from his eyes to his beard to his lips. You licked your lips absentmindedly and went back to eating. The thoughts of him being yours made your heart race. Would being honest ruin what you already have? You had the best roommate and best friend in the world. The thought of losing him made you tense again. Maybe you should keep your feelings to yourself.
You let out a sigh and that had Andy reaching his hand across the table and gently taking your hand. You looked up and your eyes locked onto his soft blue ones. He offered a friendly smile before he took your hand and pressed a kiss to it.
“Sweetheart, something is telling me that you want to talk about something but you’re nervous. You know you can talk to me about anything. I won’t judge you at all.”
Feeling nervous you look away from him and pull your hand back. You weren’t sure how to start this conversation but you knew Andy was going to be persistent about this.
You stood from the table and grabbed your empty bowl. Putting it on the counter you wrapped your arms around yourself and tried to figure out how to just come out with it.
Andy followed you into the kitchen and set his bowl next to yours. He watched as you bit your lip and stared at him with sadness in your eyes.
“Sweetheart, come here.” He stretched his arms open and waited for you to come to him. Slowly you walked to him and wrapped your arms around him.
Your head was against his chest as Andy held you close to him. You felt him kiss your forehead and breathe in your scent.
“You know I will never judge you for what you have to share with me. You mean everything to me.” Andy reassured you and gave you a big hug.
Pulling away from him reluctantly you grabbed his hand and walked over to the couch. As you sat down Andy slowly sat next to you.
Andy wouldn’t be lying if he said he wasn’t nervous. Something in your expression has changed this morning and he was worried about losing you. He couldn’t help himself with developing feelings for you. If you wanted him to move out he would be crushed because he was in love with you.
You stared at him for a minute before you took a deep breath and spoke. “I have feelings for you Andy. I have for some time now. I’m in love with you and I can’t keep pretending that I’m not.”
Andy’s eyes go wide with shock. He couldn’t believe what he heard. After all this time of being coworkers, roommates, and best friends who knew you had the same feelings as him. Andy couldn’t help but smile and let out a chuckle.
You looked at him confused. Why did he just chuckle? Did he think it was a joke to him?
Grabbing your hand Andy intertwined his fingers with yours. Lifting both hands to his face Andy kissed the back of your hand.
“I promise I’m not laughing at you. It’s just that I have feelings for you too. I didn’t know how to approach you about it cause I didn’t want to ruin what we already had between us. You mean everything to me and make me feel like myself again. Since losing my wife and son years ago I didn’t think I deserved happiness again. But you made me believe in second chances.”
Tears welled up in your eyes as you shook your head. “Andy, I promise this is for real. I was so afraid of losing you that I kept it to myself this whole time thinking you only saw me as a friend. But knowing you feel the same makes me so happy.”
Andy pulls you into his lap and starts kissing you from your forehead to your cheeks. His beard tickles you and you let out some giggles from the affection he is showing you.
“You’re adorable when you giggle. You’re always so adorable. Everything you do drives me wild.” Andy says affectionately as he kisses you all over your face making you giggle more.
He stops his silly kisses and lightly cups your face then leans in for a kiss on your lips. The kiss is soft and slow. Both of you are testing the waters and grabbing at each other to pull the other closer. This is what you have been waiting for and a soft moan pulls from your lips as you separate.
Andy smiles warmly at you and caresses your cheek. “I want you to know you can always count on me to treat you like the queen you are. You’re the most precious thing ever. I will protect you with everything I have. You will never have to worry about being alone cause I will always be here for you.”
You pull him close again and kiss him on the lips. “I don’t know what I would do without you.”
“Let’s not find out,” Andy whispers to you as he holds you tight.
You thank the universe for allowing you two to finally express your feelings. You feel that this is going to be the beginning of forever with him.

In a product demo last week, OpenAI showcased a synthetic but expressive voice for ChatGPT called “Sky” that reminded many viewers of the flirty AI girlfriend Samantha played by Scarlett Johansson in the 2013 film Her. One of those viewers was Johansson herself, who promptly hired legal counsel and sent letters to OpenAI demanding an explanation, according to a statement released later. In response, the company on Sunday halted use of Sky and published a blog post insisting that it “is not an imitation of Scarlett Johansson but belongs to a different professional actress using her own natural speaking voice.”
Johansson’s statement, released Monday, said she was “shocked, angered, and in disbelief” by OpenAI’s demo using a voice she called “so eerily similar to mine that my closest friends and news outlets could not tell the difference.” Johansson revealed that she had turned down a request last year from the company’s CEO, Sam Altman, to voice ChatGPT and that he had reached out again two days before last week’s demo in an attempt to change her mind.
It’s unclear if Johansson plans to take additional legal action against OpenAI. Her counsel on the dispute with OpenAI is John Berlinski, a partner at Los Angeles law firm Bird Marella, who represented her in a lawsuit against Disney claiming breach of contract, settled in 2021. (OpenAI’s outside counsel working on this matter is Wilson Sonsini Goodrich & Rosati partner David Kramer, who is based in Silicon Valley and has defended Google and YouTube on copyright infringement cases.) If Johansson does pursue a claim against OpenAI, some intellectual property experts suspect it could focus on “right of publicity” laws, which protect people from having their name or likeness used without authorization.
James Grimmelmann, a professor of digital and internet law at Cornell University, believes Johansson could have a good case. “You can't imitate someone else's distinctive voice to sell stuff,” he says. OpenAI declined to comment for this story, but yesterday released a statement from Altman claiming Sky “was never intended to resemble” the star, adding, “We are sorry to Ms. Johansson that we didn’t communicate better.”
Johansson’s dispute with OpenAI drew notice in part because the company is embroiled in a number of lawsuits brought by artists and writers. They allege that the company breached copyright by using creative work to train AI models without first obtaining permission. But copyright law would be unlikely to play a role for Johansson, as one cannot copyright a voice. “It would be right of publicity,” says Brian L. Frye, a professor at the University of Kentucky’s College of Law focusing on intellectual property. “She’d have no other claims.”
Several lawyers WIRED spoke with said a case Bette Midler brought against Ford Motor Company and its advertising agency Young & Rubicam in the late 1980s provides a legal precedent. After turning down the ad agency’s offers to perform one of her songs in a car commercial, Midler sued when the company hired one of her backup singers to impersonate her sound. “Ford was basically trying to profit from using her voice,” says Jennifer E. Rothman, a law professor at the University of Pennsylvania, who wrote a 2018 book called The Right of Publicity: Privacy Reimagined for a Public World. “Even though they didn't literally use her voice, they were instructing someone to sing in a confusingly similar manner to Midler.”
It doesn’t matter whether a person’s actual voice is used in an imitation or not, Rothman says, only whether that audio confuses listeners. In the legal system, there is a big difference between imitation and simply recording something “in the style” of someone else. “No one owns a style,” she says.
Other legal experts don’t see what OpenAI did as a clear-cut impersonation. “I think that any potential ‘right of publicity’ claim from Scarlett Johansson against OpenAI would be fairly weak given the only superficial similarity between the ‘Sky’ actress' voice and Johansson, under the relevant case law,” Colorado law professor Harry Surden wrote on X on Tuesday. Frye, too, has doubts. “OpenAI didn’t say or even imply it was offering the real Scarlett Johansson, only a simulation. If it used her name or image to advertise its product, that would be a right-of-publicity problem. But merely cloning the sound of her voice probably isn’t,” he says.
But that doesn’t mean OpenAI is necessarily in the clear. “Juries are unpredictable,” Surden added.
Frye is also uncertain how any case might play out, because he says right of publicity is a fairly “esoteric” area of law. There are no federal right-of-publicity laws in the United States, only a patchwork of state statutes. “It’s a mess,” he says, although Johansson could bring a suit in California, which has fairly robust right-of-publicity laws.
OpenAI’s chances of defending a right-of-publicity suit could be weakened by a one-word post on X—“her”—from Sam Altman on the day of last week’s demo. It was widely interpreted as a reference to Her and Johansson’s performance. “It feels like AI from the movies,” Altman wrote in a blog post that day.
To Grimmelmann at Cornell, those references weaken any potential defense OpenAI might mount claiming the situation is all a big coincidence. “They intentionally invited the public to make the identification between Sky and Samantha. That's not a good look,” Grimmelmann says. “I wonder whether a lawyer reviewed Altman's ‘her’ tweet.” Combined with Johansson’s revelations that the company had indeed attempted to get her to provide a voice for its chatbots—twice over—OpenAI’s insistence that Sky is not meant to resemble Samantha is difficult for some to believe.
“It was a boneheaded move,” says David Herlihy, a copyright lawyer and music industry professor at Northeastern University. “A miscalculation.”
Other lawyers see OpenAI’s behavior as so manifestly goofy they suspect the whole scandal might be a deliberate stunt—that OpenAI judged that it could trigger controversy by going forward with a sound-alike after Johansson declined to participate but that the attention it would receive from seemed to outweigh any consequences. “What’s the point? I say it’s publicity,” says Purvi Patel Albers, a partner at the law firm Haynes Boone who often takes intellectual property cases. “The only compelling reason—maybe I’m giving them too much credit—is that everyone’s talking about them now, aren’t they?”

hi! I just wanted to ask what do you mean you don't believe in copyright? I'm genuinely interested, I had never heard that take before
It's a bit of hyperbole, but it's three (edit: four) things basically:
Copyright is used to enforce the property (literally intellectual property) "rights" of capitalists. Most, if not all, cases of copyright infringement are solved in favor of capitalist companies instead of those who really created those ideas
I think art should be as free as possible. At most I support rights for individuals to be held until death, and then it should be passed to the public domain. I don't think the descendants or a company can profit from an idea they simply didn't came up with!
(this might apply to pop culture like say, Spider Man, but also patents and such, I don't think there should be patents at all, all knowlege should be completely free)
Being from the third world, I already live in a post-copyright world. To me it's just a pretense, a silly thing the yanquis made up. I can download a book, a movie, a song, and copy it ten thousand times. My own professors constantly 'pirate' papers and books. Copyright laws and the whole idea of the "right" to "copy", when copying and sharing something is completely trivial in the era of digital media and the internet are completely obsolete, the first world hasn't realized yet.

It took me 14 months to write my fic, but it only took 2 months to turn it into this:

That’s right, y’all. I learned the art of bookbinding. This is the dark path fic writing can lead you down. I wanted a copy of my 220K-word monstrosity on my shelf, but paying to have it bound is illegal. (Damn you, intellectual property law!) When I learned I’d have to make it myself, I was like, are you fucking kidding me? No way. That is insane. Then 24 hours later I was like, okay, I guess I’m learning bookbinding? ¯\_(ツ)_/¯
Then I started to enjoy it! Rejecting a life of crime gave me a new hobby. And it does look nice sitting on the shelf next to the Scholomance series that inspired it.

It really is gorgeous to me, mostly because I created the whole thing from concept to hardcase. I wrote the story, created the typeset, designed the cover, and bound it—all by myself! I feel a bit like Gwen Higgins creating that healing patch for El: tilling the soil, planting the linen seeds, spinning it into thread, and then weaving it into a patch. (Okay, I didn’t make the paper or the ink or the heat transfer vinyl, but we have to set boundaries somewhere.)

It was rather exhausting though. I feel like I’ve completed a never-ending quest full of side missions that each required a different set of skills and required me to obtain a wide variety of obscure supplies. I also spent a bunch of money that I don’t really have, which makes this the most expensive book I’ve ever owned BY FAR, which is ridiculous because all the flaws in its construction undoubtedly decrease its value. It cost so much that I feel obligated to bind a whole bunch of more books to bring down the average cost per project. That, or I’ll have to eat all the supplies instead of buying groceries next month.

I plan on writing a series of posts about how I made this thing, including all my trips to the hardware store, the fraudster on Amazon who sent me weird paper, and my newfound love for craft knives and bone folders. When I do, I’ll post the links down below.

YOU'VE ACTIVATED MY TRAP CARD [excuse to talk]
Everyone strap in because while I talk about a lot of queer issues this is actually my biggest beefiest thing that I am personally passionate about.
I. Copyright Abolishment: An Introduction
Copyright is widely believed to be a system designed to protect artists, writers, and creators. In practice, however, its origins and current implementations tell a very different story. Rather than being a tool for empowering individuals, copyright was historically created to control the dissemination of information, and today, it overwhelmingly serves the interests of large corporations. As technology evolves and culture becomes increasingly collaborative, the case for abolishing copyright grows stronger. I'm going to explore the historical roots of copyright, its economic implications, its role in stifling creativity, and the potential for alternative systems that better serve both creators and the public.
II. The Origins of Copyright: A Tool for Control
Copyright law did not begin as a way to protect the individual rights of creators, artists, or anyone who matters. The earliest example of copyright-like regulations is the Licensing Act of 1662 in England, which empowered the Stationers' Company, a guild of printers, to control all printed material. The primary goal of this law was not to reward creativity, but to prevent the spread of subversive or unapproved information. This act effectively granted the Stationers' Company a monopoly on publishing, which served both commercial and political purposes.
In 1710, the British Parliament passed the Statute of Anne, often considered the first modern copyright law. While it ostensibly granted rights to authors, it was still heavily influenced by the interests of publishers. Authors typically sold their rights to publishing houses, who then controlled the reproduction and sale of the work. Far from empowering creators, the Statute of Anne solidified the dominance of publishers in the literary and artistic marketplace.
Thus, from its inception, copyright was not designed to uplift the individual artist or protect their labor, it was a tool to control and profit from art. That legacy continues today.
III. Who Benefits from Copyright?
In the contemporary world, copyright law continues to primarily benefit corporations rather than individual creators. In industries such as music, film, and literature, artists often sign contracts that transfer their copyright to corporations in exchange for limited upfront payments. Record labels, publishing houses, and film studios then enjoy decades of control over these works, profiting far more than the creators themselves.
The extension of copyright terms, from the original 14 years to the current 70 years after the death of the author in many jurisdictions, serves to keep works out of the public domain for as long as possible. This benefits the estates and corporate owners of intellectual properties like Disney and my deeply beloathed much hated Nintendo, rather than fostering a thriving cultural commons. The prolonged duration of copyright effectively locks away knowledge and art from public use, especially in the educational, archival, and creative sectors.
And remember, Copyright doesn't protect small artists, we've seen time and time again small artists be bulldozed by people and corporations who have the money to use copyright as a weapon to bully. By abolishing copyright, we remove these weapons from the hands of our artistic oppressors. Abolishing copyright won't hurt the average artist in a meaningful way, but it WILL kneecap corporations.
IV. Copyright is an Innovation Stifler
Copyright is often defended as a means of encouraging innovation, but many economists argue the opposite. Michele Boldrin and David K. Levine, in their book "Against Intellectual Monopoly," demonstrate how copyright and patent laws actually suppress innovation by limiting competition and the free exchange of ideas. By preventing others from building on existing work, copyright laws hinder the iterative process that is central to artistic advancement.
For example, consider the realm of fan fiction, remix culture, or parody, areas where creators produce transformative works based on existing properties. Under strict copyright regimes, these acts are often treated as infringement rather than legitimate creative expression. This not only silences many voices but also narrows the diversity of cultural output available to the public.
V. The Digital Age Dilemma
The rise of digital technology and the internet has dramatically altered the landscape of content creation and consumption. In a world where information can be copied and shared at virtually no cost, the traditional copyright model becomes increasingly untenable. Enforcing copyright online often involves draconian measures, such as mass takedown notices, algorithmic content flagging, and lawsuits against individuals for minor infringements.
Moreover, the digital age has brought about new forms of creative labor, memes, mashups, TikTok edits, and more, that often blur the lines of authorship and originality. Attempts to police this kind of expression through old copyright frameworks fail to account for how culture is now co-created in participatory and decentralized ways.
Instead of adapting, copyright law became more punitive, targeting individuals with outrageous lawsuits (remember the $222,000 fine for sharing 24 songs? What about that old man who went to prison for modding nintendo software? What about Palworld being nuked into the ground by Nintendo for daring to compete with them?). Meanwhile, corporations like YouTube and Spotify struck deals to monetize user-generated content, profiting off of the same people they once threatened with legal action.
VI. Or, 'How I learned to Embrace The Public Domain'
The public domain is the collective cultural heritage of humanity, works that are freely available for anyone to use, adapt, and build upon. Abolishing copyright would rapidly expand this commons, encouraging creativity, collaboration, and accessibility. Artists could draw from a much wider range of influences without fear of litigation. Educators, archivists, and historians would gain unfettered access to materials that are currently locked behind paywalls or legal barriers.
We already see the benefits of a rich public domain in projects like Wikipedia, Project Gutenberg, and community-created media platforms. These repositories of knowledge and art flourish when content is not monopolized but shared. Far from diminishing creativity, a robust public domain supports it by removing artificial scarcity.
Abolishing copyright would return culture to the people. The public domain is the lifeblood of creative evolution. Think about how many beloved works came from reusing old stories: West Side Story (Romeo and Juliet), The Lion King (Hamlet), Clueless (Emma). Shakespeare himself borrowed heavily from older plays and historical texts, because he could!
Imagine a world where musicians could freely sample anything, where indie filmmakers could use old movie clips freely, where children could remix books and stories without worrying about lawsuits. The creativity unleashed would be immense.
Moreover, access to information is a human right. Students often can't afford academic textbooks or journal articles because they’re locked behind copyright paywalls. Libraries are sued for digitizing books. Even dead authors’ works are sometimes kept under lock and key by estate holders who contribute nothing to the creative process.
Art and knowledge should not be commodities controlled by a few.
II. Alternative Models for Supporting Creators
Opponents of copyright abolition often ask, “How will artists make money?” There are, in fact, many viable alternatives to copyright-based revenue models:
Patronage Systems: Platforms like Patreon enable creators to receive direct support from their audiences. This model fosters a more personal and sustainable relationship between artists and fans.
Crowdfunding: Services such as Kickstarter or GoFundMe allow creators to secure funding before completing a project, ensuring both creator autonomy and audience investment.
Public Funding: Governments can support the arts through grants, subsidies, and public commissions, recognizing the societal value of culture without tying it to market dynamics.
Merchandising and Experiences: Many creators make money through live performances, merchandise, commissions, and events, forms of income not reliant on intellectual property control at all.
These models not only exist but are already in wide use. They offer a more ethical and artistically free way of compensating artists than corporate-mediated copyright monopolies. In short, you don’t need copyright to get paid. You need visibility, community, and infrastructure that values your work.
VIII. Conclusion
Copyright has long been misconstrued as a system that champions creators. In reality, it has served as a mechanism for control, first by the state, then by publishers, and now by global media conglomerates. It restricts access to culture, hampers innovation, and disproportionately benefits those with the resources to enforce it.
Abolishing copyright would not end creativity, it would liberate it. With robust public support systems, direct audience engagement, and the vast potential of a truly open cultural commons, we could build a more equitable and vibrant creative world. It is time to imagine a future beyond copyright, one where culture is free, accessible, and shared by all.
Frankly? We are long past the age when copyright was even arguably helpful. Today, it’s a tool of enclosure, turning shared culture into corporate real estate. It limits access, stifles remix, criminalizes creativity, and prioritizes profit over people and Art.
Abolishing copyright doesn’t mean creators won’t get paid, it means we will have to build better systems that support artists directly, without requiring them to control every instance of how their work is used.
It’s time we stop clinging to an outdated system that was never designed for artists, and start building one that actually supports them.

A taxonomy of corporate bullshit

There are six lies that corporations have told since time immemorial, and Nick Hanauer, Joan Walsh and Donald Cohen's new book Corporate Bullsht: Exposing the Lies and Half-Truths That Protect Profit, Power, and Wealth in America* provides an essential taxonomy of this dirty six:

I. Pure denial
As far back as the slave trade, corporate apologists and mouthpieces have led by asserting that true things are false, and vice-versa. In 1837, John Calhoun asserted that "Never before has the black race of Central Africa, from the dawn of history to the present day, attained a condition so civilized and so improved, not only physically, but morally and intellectually." George Fitzhugh called enslaved Africans in America "the freest people in the world."
This tactic never went away. Children sent to work in factories are "perfectly happy." Polluted water is "purer than the water that came from the river before we used it." Poor families "don't really exist." Pesticides don't lead to "illness or death." Climate change is "beneficial." Lead "helps guard your health."
II. Markets can solve problems, governments can't
Alan Greenspan made a career out of blithely asserting that markets self-correct. It was only after the world economy imploded in 2008 that he admitted that his doctrine had a "flaw":

No matter how serious a problem is, the market will fix it. In 1973, the US Chamber of Commerce railed against safety regulations, because "safety is good business," and could be left to the market. If unsafe products persist in the market, it's because consumers choose to trade safety off "for a lower price tag" (Chamber spox Laurence Kraus). Racism can't be corrected with anti-discrimination laws. It's only when "the market" realizes that racism is bad for business that it will finally be abolished.
III. Consumers and workers are to blame
In 1946, the National Coal Association blamed rampant deaths and maimings in the country's coal-mines on "carelessness on the part of men." In 2003, the National Restaurant Association sang the same tune, condemning nutritional labels because "there are not good or bad foods. There are good and bad diets." Reagan's interior secretary Donald Hodel counseled personal responsibility to address a thinning ozone layer: "people who don’t stand out in the sun—it doesn’t affect them."
IV. Government cures are always worse than the disease
Lee Iacocca called 1970's Clean Air Act "a threat to the entire American economy and to every person in America." Every labor and consumer protection before and since has been damned as a plague on American jobs and prosperity. The incentive to work can't survive Social Security, welfare or unemployment insurance. Minimum wages kill jobs, etc etc.
V. Helping people only hurts them
Medicare will "destroy private initiative for our aged to protect themselves with insurance" (Republican Senator Milward Simpson, 1965). Covid relief is unfair to people that are currently in the workforce" (Republican Governor Brian Kemp, 2021). Welfare produces "learned helplessness."
VI. Everyone who disagrees with me is a socialist
Grover Cleveland's 2% on top incomes is "communistic warfare against rights of property" (NY Tribune, 1895). "Socialized medicine" will leave "our children and our children’s children [asking] what it once was like in America when men were free" (Reagan, 1961).
Everything is "socialism": anti-child labor laws, Social Security, minimum wages, family and medical leave. Even fascism is socialism! In 1938, the National Association of Manufacturers called labor rights "communism, bolshevism, fascism, and Nazism."
As Dayen says, it's refreshing to see how the right hasn't had an original idea in 150 years, and simply relies on repeating the same nonsense with minor updates. Right wing ideological innovation consists of finding new ways to say, "actually, your boss is right."
The left's great curse is object permanence: the ability to remember things, like the fact that it used to be possible for a worker to support a family of five on a single income, or that the economy once experienced decades of growth with a 90%+ top rate of income tax (other things the left manages to remember: the "intelligence community" are sociopathic monsters, not Trump-slaying heroes).
When the business lobby rails against long-overdue antitrust action against Amazon and Google, object permanence puts it all in perspective. The talking points about this being job-destroying socialism are the same warmed-over nonsense used to defend rail-barons and Rockefeller. "If you don't like it, shop elsewhere," has been the corporate apologist's line since slavery times.
As Dayen says, Corporate Bullshit is a "reference book for conservative debating points, in an attempt to rob them of their rhetorical power." It will be out on Halloween:

Sometimes I wonder how intellectual property law works in The Vampire Chronicles. Like, when Lestat wrote his own book Daniel was obviously too…preoccupied…to care. But these were best sellers in universe, right? There were publishers involved, presumably with their own rights and legal teams, and as far as the world was concerned they were works of fiction. How were there not lawsuits over copyright infringement?
Maybe all of the later books could have been submitted for publication “through” Daniel. But not The Vampire Lestat! It is very funny to me that TECHNICALLY, Anne Rice made Lestat himself Interview with the Vampire’s biggest Fanfiction author.

You had seen more than one child run around with a Resistance fighter helmet, and not an original, but a plastic toy one. Infuriatingly enough likely made by the same companies that sold First Order toys to indoctrinate kids back in the day. Little X-Wing models, too, you had seen people have collections of.

It was really decent of them, considering nothing in the Resistance was ever made intellectual property and my name isn’t even copyrighted. But I said they could go ahead for free, we don’t need any of that attention or compensation.”
“I see. Wish you’d told me!”
“They were having materiel sourcing issues! I didn’t wanna tell you if it wasn’t going to exist, and besides, I didn’t know you liked that kind of stuff.”
“I didn’t really, but…” You shook your head and sat on the edge of Poe’s desk to unbox it.

“…” Poe said.
“You’re what?” He asked, sure he must’ve had the translator in his aid acting weird again.
“He,” you held up the figurine, rotating him back and forth a little. “Is going in the jar.”
“You don’t mean—”
“I do.” You said with an all too satisfied nod.
The red in his cheeks could’ve made paint.

“You married me knowing this.”
He sighed.

It’s been a week since you both decided to start over again. Building trust was important to both of you and being honest, whether one wanted to hear the truth or not, was just as important. You and Steve were able to start this unconventional relationship by talking about anything and everything.
Of course, Steve wanted to talk about your future and what you both wanted or saw in the next five years. His answer was simple: he wanted to be married and have kids. He wanted everything he had ever dreamt of and he saw that future with you.
Yours you hesitated on at first. Yes, you wanted to get married in a small intimate wedding and eventually wanted to start a family. You also desired a little freedom to be able to do all of this one day as you wanted to shed the rocky start you both had. It was important to also be able to get your super soldier strength back as you wanted to feel normal again and not this frail human being he reduced you to. Steve told you he would think about that one and that you needed to earn it.
The sex was also amazing between the two of you. It was as if you were a newly married couple on their honeymoon as many times as you did it throughout the day. The pleasure you would pull out of one another drove the cravings to new heights. This had to be the highlight of your days spent with him. However, you did worry about the lack of birth control not being used.
Though as amazing as that was, a part of you deep down inside still felt trapped and wanted to escape. The other part argued that you have one of the best setups in your life and you could finally be with the one man you always had feelings for. You had the house you wanted, the man you wanted, and this could be the life you always dreamt of. Maybe it didn’t start like you thought but you deserved to have this dream come true even if Steve was still controlling and watching you like a hawk at every moment.
Your days seem to become repetitive as well and that starts weighing you down. Something was missing in your life and you knew just what it was, friends. You missed hanging out with Natasha. You missed the gossip, the laughs, and especially the training with her. Is this something that Steve would allow you to have again? This was a conversation you will need to have with him.
For now, you stayed curled up on the couch reading your favorite book while Steve was on the phone with Tony just outside the door. He watched you with curious eyes, making sure you didn’t run like you had in the past. Though he told himself this was a new start and he had to learn to trust you to do the right thing. The call wasn’t long and it was mainly catching up. Steve also placed an order for food and supplies they would need for the month. Steve was sure to give a list of things you asked for that would make your stay comfortable. When he was done he hung up the phone and walked into the house.
You looked up from your book and met his deep blue eyes. You couldn’t help but smile at the man you loved. Patting the seat on the couch next to you, Steve took the hint and sat down. Your hand held his momentarily as he got comfy next to you. Taking a breath you worked up the courage to ask him a question.
“Steve, what would you say to me reaching out to Natasha? I mean she was my best friend after all and I miss her dearly. I miss the talks with her and the support she gave me. I need to have someone to talk with besides you.”
You bit your lower lip and worried maybe you stepped over the line. But Steve gave you a reassuring smile as his hand tightened around yours.
“I think we can work that out. I know Nat has been bugging me since you came here. She really misses you as well. Just know she won’t try to help you escape. She will just be your friend only.”
Steve stared at you as he watched his words sink in. You nodded your head in agreement knowing full well that Nat wouldn’t help you since Steve had hinted at that before. You had a feeling that all the Avengers were in on this which broke your heart initially. Little did you know that they each were out for a partner to call their own? For now, you continued to make the best of your situation despite all your mixed feelings.
Steve was a man of his word and Natasha came to visit you both a week later. He was outside talking to her while you waited patiently in the living room. You wondered what Steve was saying to her. Was he placing down rules for the visit or having a friendly chat? Your nerves were starting to get the best of you until you heard the door open and shut. Looking over your shoulder you saw Nat and Steve walking into the room smiling. Nat practically ran to you as you stood up from the couch. Her arms wrapped around you and you smiled hugging her back.
“I’ve missed you so much,” Nat whispered into your ear.
Tears formed in your eyes as you whispered the same thing to her. “I’ve missed you too.”
Steve watched as you both embraced and he could see the smiles on both of your faces. If this is what you needed to make you more comfortable and trusting around him, then that needed to be. Steve cleared his throat to get both of their attention.
“I hope you two have a wonderful time catching up. If you need me I will be outside.”
As he turned on his heel to leave you called out for him, “Steve?”
He turned to look at you.
“Thank you for this. I appreciate it.”
Steve nodded and headed outside to get some work done.
When you both were alone you sat on the couch facing each other. Nat smiled at you as she took in your appearance. She was good at always reading you.
“So how are you doing? This is me asking as your friend, not Steve’s spy.”
“I’m doing well. I mean what’s there really to say? I was forced here by Steve, the man I have loved for years, to become some housewife or sex object to him. Don’t get me wrong I enjoy the sex now but everything started so badly between us.”

Nat looked at you up and down taking in your features. A soft smile played on her lips. “When was the last time you had your cycle?”
You started to think of the last time you had it. “I think the last time was before Steve brought me here. You don’t think I’m pregnant do you?”

It was at the moment your stomach felt ill again. “I-we have it daily. Like several times a day.”
Nat grinned at you. “I have to say you’re glowing. I just so happened to bring some tests with me as Steve asked me to. Here let me get you one.”
Nat walked over to the dining room table and opened a bag she had with her. Taking the test she handed it to you. “Go and take it. I will wait for you here.”

The test felt like it was taking forever to give you results. You were thinking how you just told Steve over a week ago that you wanted to wait. What would you do if this came back positive? A knock on the door had you panicking as you looked down to see the result was indeed positive. A gasp left your mouth as another knock and Nat’s voice filled the air. You opened the door with tears streaming down your face. Nat looked at you and hugged you instantly knowing what the result was.
“I’m not ready Nat. Not now while we are working through everything.”

Steve stood there shocked by what his friend was saying. He did it. He finally did what he set out to accomplish. This child was going to bind them together forever. Now he just needed to get married to her to make it official.
“I-I’m going to be a dad?” Tears filled his eyes as he watched you flush the toilet and sit up against the wall.
