Probably all the house owners face the same thing at least once in their entire lifespan. Before 1996, there were no rules or regulations to solve such disputes smoothly without harming the relationship with a neighbor or an adjoining owner. Walls or structures that are shared by two adjoining properties or developed on the boundary line are accepted as “Party Walls”.

Party Wall Disputes between neighbours get raised when one party plans to take on building works till fences or walls of buildings which falls common or remains in close vicinity of their neighbour's property. The Party Wall Act was formed to restrict such types of disputes between neighbours by ensuring that the property owners send each other the notice before undertaking any such type of building works.

A lot of the Party wall disputes arise due to the lack of clear understanding of the Party Wall Act. As per the act, not all party wall notices are consented to, and if explained properly a lot of the unnecessary party wall disputes can be avoided...

In this surveying blog post, I will be discussing the role that a Third Surveyor plays in Party Wall Surveying process and I will be established when they are required.
For every Party Wall Dispute that has two separate Surveyors appointed on behalf of both the Building Owner and Adjoining Owner, a third Surveyor will also be in place.
As per the wording of the Party Wall etc. Act 1996 S10(1)(b):, Each party shall appoint a surveyor and the two surveyors so appointed shall forthwith select a third surveyor (all of whom are in this section referred to as “the three surveyors”)
The Third Surveyor’s duties are to make determinations and resolve any dispute deferred to them by either of the two Surveyors or either of the respective owners.
