Auch für die Höhe einer finanziellen Entschädigung sieht das Gesetz keine Regelung vor. Das heißt, Abfindungszahlungen durch den Arbeitgeber sind freiwillig und nicht jede Kündigung zieht zwangsläufig eine Abfindung nach sich. Für die Höhe der Abfindung kann zur Orientierung allerdings eine allgemeine Faustformel herangezogen werden, die zur Berechnung u.a. bei betriebsbedingter Kündigung genutzt wird. Der Regelsatz der finanziellen Entschädigung ergibt sich dabei aus der Betriebszugehörigkeit und dem Monatsgehalt. Für jedes Jahr, das der Arbeitnehmer im Unternehmen tätig war, gibt es ein halbes Brutto-Monatsgehalt als Abfindung. Hat der Mitarbeiter zehn Jahre lang 4.000 Euro monatlich erhalten, könnte sich die finanzielle Entschädigung somit auf 20.000 Euro belaufen.
Mit der Abfindung Steuern sparen: Ist eine Abfindung auch steuerfrei möglich?
Bis zum Jahr 2003 war eine Abfindung steuerfrei. Nach einer Übergangsregelung mit Freibeträgen und Ausnahmen für kleinere Summen verlangt das Finanzamt seit dem 1. Januar 2006 auf alle Abfindungen Einkommensteuer. Denn auch einmalig erhaltene Zahlungen zählen seitdem laut Arbeitsrecht in vollem Umfang zum steuerpflichtigen Arbeitslohn. Für die Abführung der Einkommensteuer ist auch hier der Arbeitgeber zuständig. Damit diese außerordentlichen Einkünfte, die das zu versteuernde Einkommen im jeweiligen Jahr schlagartig erhöhen können, den Arbeitnehmer nicht in die steuerliche Bredouille bringen, sieht das Steuergesetz eine Sonderregelung für Abfindungen vor. Denn mit einem höheren Einkommen unterläge der Arbeitnehmer auch einem höheren Steuersatz. Der Gesetzgeber erkennt Abfindungen als außerordentliche Einkünfte (§34 EStG) und Ausnahmefall an. Zum Ausgleich einer möglichen unverhältnismäßigen Steuerlast im Jahr der Abfindung wird die sogenannte Fünftelregelung bereit gestellt. SO PROFITIEREN SIE VON DER FÜNFTELREGELUNG Bei der Anwendung der Fünftelregelung wird der Abfindungsbetrag zunächst durch fünf geteilt. Ein Fünftel wird zum aktuellen Jahreseinkommen hinzugerechnet. Von diesem Gesamteinkommen berechnet das Finanzamt die Lohnsteuer, die abgeführt werden muss. Diesen Steuerbetrag vergleicht der Finanzbeamte mit der Summe, die ohne Abfindungsbetrag fällig wäre. Die Differenz dieser beiden Beträge ergibt die sogenannte steuerliche Mehrbelastung, die zu zahlen wäre, hätte der Arbeitnehmer nur ein Fünftel der Abfindungssumme erhalten. Die steuerliche Mehrbelastung wird wiederum mit fünf multipliziert und damit die günstigere Besteuerung auf die komplette Abfindung angewendet. Ein Beispiel ausgehend von einem ledigen, kinderlosen Arbeitnehmer verdeutlicht die Vorgehensweise: Er wird von seiner Firma betriebsbedingt gekündigt und erhält bei einem Jahreseinkommen von 26.000 Euro brutto eine Abfindung in Höhe von 10.000 Euro. Der Einfachheit halber werden Kirchensteuer und Solidaritätszuschlag nicht berücksichtigt. 1. Schritt: Ein Fünftel der Abfindung wird zum Jahreseinkommen addiert und die Steuer errechnet. 2. Schritt: Berechnung der Einkünfte eines Jahres ohne Abfindung 3. Schritt: Die Differenz beider Steuerbeträge wird gebildet und das Ergebnis verfünffacht In diesem Beispiel beträgt die Einkommensteuer auf die Jahreseinnahmen 4.143 Euro plus 2.965 Euro auf die Abfindung, insgesamt beläuft sich die Einkommensteuer also auf 7.108 Euro. Wird die Fünftelregelung nicht angewendet und die 36.000 Euro werden komplett besteuert, beliefe sich die Steuerlast im Jahr 2018 auf 7.288 Euro. Aufgrund der Fünftelregelung reduziert sich die Steuer also um 180 Euro. Bei höheren Einkommen und Abfindungen kann die Steuerersparnis natürlich größer sein. Von der Fünftelregelung profitieren allerdings vor allem Arbeitnehmer, die durch Ihre lange Betriebszugehörigkeit mit einer hohen Abfindung rechnen können, selbst aber kein allzu hohes Gehalt erwirtschaften. Wird Ihr finanzieller Verdienst hingegen bereits mit einer Besteuerung im Bereich des Spitzensteuersatzes belegt, spielt die Fünftelregelung kaum eine Rolle. Da sich auch durch eine Abfindung an Ihrem Steuersatz nichts ändert. ABFINDUNG VERSTEUERN: VORAUSSETZUNGEN FÜR DIE FÜNFTELREGELUNG Auch wenn Sie nicht zu den Spitzenverdienern gehören, kann nicht bei jeder Abfindung auch die Fünftelregelung angewendet werden. Der ermäßigte Steuersatz unterliegt bestimmten Voraussetzungen wie einer “Zusammenballung von Einkünften”. Dies ist gegeben, wenn der Steuerpflichtige durch die Abfindung infolge seiner Kündigung mehr Einkommen im jeweiligen Kalenderjahr hat, als es durch die Fortsetzung des Arbeitsverhältnisses der Fall gewesen wäre. Dann kann es auch geboten sein, sich diese außerordentlichen Einkünfte erst im folgenden Jahr auszahlen zu lassen. Auch wenn Sie Ihre Abfindung in Teilauszahlungen bekommen, kann die Fünftelregelung nur in Ausnahmefällen durch die Steuererklärung geltend gemacht werden. Dies ist keine Steuerberatung.
