SHCP deberá informar sobre los recursos públicos aportados al Fondo de Servicio Universal Eléctrico

El caso

Una particular solicitó a la Secretaría de Hacienda y Crédito Público (SHCP) conocer el monto de los recursos que ha ingresado al Fondo de Servicio Universal Eléctrico desde su creación, desglosado por año, fuente de ingreso y monto. La Secretaría formuló un requerimiento de información adicional a la particular para que precisara qué documento solicitó y aclaró que los Fondos son sujetos obligados en materia de transparencia, por lo que le sugirió dirigir su petición al propio Fondo o a la Secretaría de Energía. La particular consideró que su solicitud de información fue clara.

La Secretaría respondió ser incompetente para conocer lo requerido y sugirió dirigir la solicitud al Fondo de Servicio Universal Eléctrico o a la Secretaría de Energía. Inconforme, el particular impugnó que el sujeto obligado le negó la información. Debido a que el recurrente no expresó claramente su impugnación y en aplicación de la suplencia de la queja a favor de la hoy recurrente, esta ponencia considera que la inconformidad se debió a la incompetencia declarada por la Secretaría de Hacienda, misma que reiteró en alegatos agregando que si los fideicomisos y fondos públicos no cuentan con estructura orgánica para cumplir sus obligaciones de transparencia, la responsabilidad es de las unidades administrativas que coordinan su operación, en este caso, la Secretaría de Energía. Por último, señaló que en los Informes sobre la Situación Económica, Finanzas Públicas y Deuda Pública se puede consultar información relativa los recursos del Fondo en cuestión y proporcionó la ruta de acceso.

En análisis

Al analizar el caso, esta ponencia identificó que la Secretaría de Hacienda actuó como fideicomitente del Fondo de Servicio Universal Eléctrico, es decir, destinó los bienes y derechos necesarios para su constitución y administración por parte de la Secretaría de Energía, la cual, debe reportarle trimestralmente sobre el estado del Fondo. Por lo tanto, sí tiene atribuciones para conocer de la información solicitada. En consecuencia, esta ponencia determina fundado el agravio del particular.

Posicionamiento

Elegí este recurso para su discusión pública porque nos permite hablar de un servicio público indispensable para mejorar el nivel de vida de las personas: la energía eléctrica. Como señala la Organización de las Naciones Unidas en la iniciativa Energía Sostenible para Todos (SEforAll), el acceso a la energía eléctrica no sólo es insumo para tareas domésticas, sino para que funcionen hospitales, escuelas, el transporte público e, incluso, algunas industrias.[1] Es preocupante que en la segunda década del siglo XXI, en México hay personas que no tienen suministro de energía eléctrica.

Relevancia del caso

Según datos de la Comisión Federal de Electricidad, la institución encargada de dirigir el sistema nacional de generación, transmisión y distribución de energía eléctrica en el país, hay poco más de 192 mil poblaciones, de las cuales 41 mil 697 no tiene servicio eléctrico y en las que habitan aproximadamente 1.8 millones de personas. Entre los estados que presentan mayor rezago en electrificación son: Oaxaca, Guerrero, Chiapas, San Luis Potosí, Durango, Chihuahua y Nayarit.[2]

Es por esto que, como parte de la reforma energética, el ejecutivo federal creó el Fondo de Servicio Universal Eléctrico en noviembre de 2016, cuyo objetivo principal es la electrificación de poblaciones rurales y zonas urbanas marginadas y el suministro básico a usuarios finales en condiciones de marginación. Se estima que el Fondo genere recursos por 12 mil millones de pesos para que sean invertidos en electrificación y así, para finales de 2018, se alcance una cobertura del 99% de la población, que incluya el 100% de las zonas urbanas marginadas.[3]

De llegar a ese rango de cobertura, México estaría cumpliendo con la meta que planteó la ONU en la iniciativa Energía Sostenible para Todos, la cual dio forma a uno de los objetivos de la Agenda 2030 para el Desarrollo Sostenible: que todos los habitantes del planeta reciban energía eléctrica. Es decir, se busca que todas las personas tengan acceso a fuentes de energía fiables que les permitan llevar una vida segura, saludable y productiva.[4]

Para construir un México justo, es decir, para combatir la desigualdad, contar con suministro de energía eléctrica no debe ser un privilegio, es una necesidad básica que debe ser satisfecha para tener una vida digna. El acceso a la información pública permitirá que la ciudadanía conozca los avances que las autoridades competentes llevan a cabo para administrar adecuadamente el Fondo de Servicio Universal Eléctrico, así como los avances en el cumplimiento de sus metas.

Propuesta

Por lo anterior, esta ponencia propone REVOCAR la respuesta de la Secretaría de Hacienda e instruirle realizar una nueva búsqueda de la información en todas las unidades administrativas competentes y remitir la documentación localizada a la particular.
