So I keep seeing people play the "Harris is a Cop, so I'm not voting for her because ACAB" card, and not even pointing out that she was a DA/Prosecutor rather than an actual cop seems to change their minds - as far as they're concerned, working with cops in any capacity makes you a cop. Do you happen to have anything that'd make for a good counterpoint to this argument (or, at the very least, something to make those of us who still plan on voting for her despite our dim views on Law Enforcement not feel so bad about it)?

First of all: these are laughably, incredibly unbelievably unserious people, and frankly, my first advice would be NOT to bother trying to engage with them at all, because there is nothing whatsoever they will ever accept in the way of logical proof to change their minds. First it was "you can't ask me to vote for Biden specifically because of [insert issue here.]" This changed a lot, from Roe getting overturned by the corrupt SCOTUS, to the train strike (hey anyone remember that?) to student loan forgiveness and then had settled firmly on Gaza. So now, lo and behold, they're given exactly what they asked for: a new younger candidate who is not Biden and explicitly more progressive on the Gaza issue (Harris was the first member of the administration to openly call for a ceasefire). So they turn their noses up, rush to their favorite 2020 disinformation founts that were first spouted when they were trying to sabotage her in favor of Bernie (who endorsed Biden pretty strongly before he dropped out), flirt with Jill "Actual Agent of Putin" Stein, and other equally expected and equally bullshit maneuvers. Lololololololol online leftists. Never change, or something.
That said: because their minds are so set that they will never vote for any Democrat ever, you can't really give them any logical information to separate them from this conclusion. I don't have the links on hand, but etc Google and Wikipedia are free: Harris's tenure as district attorney and California AG was progressive even by modern standards, and it was happening in the early 2000s: she refused to prosecute for low-level weed offenses, pushed for harder sentences for assault weapons, performed gay marriages LONG before it was legal even in San Freaking Francisco, refused to seek the death penalty, worked with restorative justice programs, etc. This was after she was a first-generation American child of brown immigrants who took advantage of equal-opportunity education programs to go to law school, and her parents were already high-achieving academics (one a cancer researcher from India and one an economics professor from Jamaica). Sure sure, she definitely seems exactly like Derek Chauvin to me. Critical thinking is great! #VoteJillStein! A literal puppet of Putin and unabashed Assad fangirl is definitely the pro-peace morally correct option here!*
In other words, the morons do not give a single shit about factual reflections of Kamala's record. They do not care about whether her time as a district attorney was progressive (it was) and whether she was actually a cop (she wasn't). They're so wedded at the hip to their braindead disinformation propaganda that now we're going to see the excuses change at lightspeed from why they can't vote for Biden specifically to why they can't vote for Harris specifically. None of it will be remotely tethered to reality and all of it will be in extreme and obvious bad faith. As I said, there are plenty of persuadable voters elsewhere who HAVE been energized by her elevation to candidacy. If you are indeed interested in winning voters to her side (as opposed to having to find reasons to justify yourself to the All Voting Is Evil crowd who will never listen to or believe you anyway), I suspect your time would be better spent elsewhere, and outside the echo-chamber leftist social media space in general.
Aside from that, I have gotten a few hand-wringy asks about Kamala and the election overall, and I gotta say, I am not going to waste my time and effort replying to them. We have about 100 days to win this election or become a fascist dictatorship. We are already in uncharted territory, but the replacement of Biden with Harris went UNIMAGINABLY smoothly, far, far more than anyone (including me) ever expected. It reminds me of the presto-chango that the French center, left, and center-left parties pulled off to replace candidates, IN FIVE DAYS, to better position themselves to defeat the fascists. Compared to that, three and a half months is a cakewalk, but we still absolutely do not, DO NOT, have time to sit around worrying and hand-wringing about this or that hypothetical Bad Thing. It deeply unsurprises me to hear that US Online Leftists are still throwing snits and pitching their toys out of the pram rather than getting on board, but the rest of us don't have any time to waste and need to apply our energy to where it will be best put to use. So yes.

Do We Have an Amy Coney Barrett Problem?

Was putting Justice Amy Coney Barrett on the Supreme Court a mistake? It wouldn’t be the first. John Roberts was a blunder. David Souter was another, the late Ted Kennedy and John Kerry tried to smear Souter as a right-wing nut. We used to call her Notorious ACB—the anti-Ruth Bader Ginsburg: conservative and Catholic. Liberals melted down when Donald Trump pushed her through in 2020.
Now, she’s been one to hand us some brutal defeats on serious constitutional questions, like allowing district courts to paralyze the executive. Jeff wrote about the Supreme Court compelling the Trump administration to unfreeze the aid which was placed under a 90-day moratorium by the president: 
The Supreme Court has rejected the Trump administration’s request to vacate a lower court order requiring it to release about $2 billion in foreign aid that it had previously frozen. The dispute centered on whether the district court possessed the authority to override President Donald Trump’s pause on the disbursement of foreign aid. The court let the ruling stand by a slim majority.  The debate over the matter began when President Trump decided to halt foreign aid disbursements. The U.S. District Court for the District of Columbia issued a temporary restraining order on February 13 preventing the administration from making this move. The same court issued an order on February 25 compelling the White House to release the $2 billion payments for services that had already been rendered.  The White House appealed the ruling to the Supreme Court, arguing that the district court lacked the authority to issue the ruling.
This ruling initially stayed a district court’s overreach on the subject. Justice Samuel Alito torched his colleagues.

The 5-4 ruling forced the president-elect to face the music before Inauguration Day. Who sided with the court’s three liberals to make it happen? Barrett, alongside Chief Justice John Roberts. The conservative bloc—Thomas, Alito, Gorsuch—dissented, seeing the move for what it was: a partisan jab at Trump. Barrett’s vote didn’t just green-light a political hit job; it undermined the man who put her on the bench. That’s not loyalty to the Constitution—that’s a nod to the left’s lawfare playbook.  Then there’s the January 6 cases. In Fischer v. United States (2024), the court narrowed the scope of an obstruction law used against Capitol riot defendants. Barrett dissented again, siding with the liberals to keep prosecutors’ tools intact. She argued the majority’s reading was too restrictive—fair enough if you’re a law professor, but this was a real-world win for the DOJ’s witch hunt against Trump supporters. Contrast that with her concurrence in Trump v. Anderson (2024), where she refused to join the majority’s full reasoning on keeping Trump off Colorado’s ballot, aligning partly with the liberals’ narrower take. She scolded both sides for turning up the “national temperature,” but her waffling diluted a clear conservative victory.
And some are theorizing that when angry left-wing mobs targeted the justices, Barrett might have been shaken up by the assassination threats. We’ll see about that, but Robert and Barrett’s stock is dropping.

… Trump is now a convicted felon as he was adjudicated guilty today at his sentencing hearing before Judge Merchan. He did not receive any other sanctions besides the conviction and court costs, as a result of his election as the 47th president.
… This sentencing was only possible since Amy Coney-Barrett and John Roberts decided they would do the right thing and side with the sane members of the court against Thomas, Alito, Kavanaugh and Gorsuch. Many SCOTUS analysts believe that Judge Merchan taking the unusual step of stating ahead of time that he was going to enter an unconditional discharge is the only reason Coney-Barrett and Roberts joined the others. No way of knowing if that is the case, but it certainly made it a lot easier for them knowing that ahead of time.
… Dan Bongino melted down on his show after the decision: “Amy Coney Barrett has been a total failure! She has been a total failure. Whoever recommended her - I believe it was the Federalist Society. Coney Barrett is John Roberts, Junior. We DON’T have a 6-3 Court. Roberts is a hard core leftist! Coney Barrett has been a disastrous pick! Trump should haul in every single person who recommended her, and demand an explanation why.”

Prosecutor Joshua Steinglass spoke first: “Instead of preserving and defending our Constitution, the defendant, the once and future president, has engaged in a coordinated campaign to undermine his legitimacy. The defendant has not shown remorse, and instead has shown disdain for our institutions and the rule of law, all for his own ends. Trump has said, ‘Corrupt, rigged, a witch hunt, and a sham’ too many times to count, and his rhetoric has only ratcheted up since the verdict.”
… More Steinglass: “Trump's actions constitute a direct attack on the rule of law. Moreover, the defendant has publicly threatened to retaliate against the prosecution. These threats are designed to have a chilling effect, to intimidate those who have the responsibility to enforce our laws in the hopes that they will ignore the defendant’s transgressions because they fear he is too powerful to be subjected to rule of law like the rest of us. This defendant has caused enduring damage to public perception of the criminal justice system.”
… Trump’s lawyer Todd Blanche was up next, and he complained again that the whole trial was a sham and they will win on appeal: “It's a sad day for Donald Trump and his family, and in his view (odd he would add that) a sad day for this country. This was a case, without a doubt, that was brought by a DA who promised to go after Trump if elected. And that's sad. And Trump shares his view that this will never happen again in this country.”
… Trump then gave a rambling shambolic statement: “Thank you, your Honor. This has been a terrible experience and setback for NY and the NY court system. This was a case Bragg did not want to bring. It was inappropriately handled. A gentleman from a law firm came in and acted as a DA, and he was criminal or almost criminal. The records were put down by accountants. They're called a legal expense and for this I got indicted. It's incredible actually.”
… More incoherent whining from Genghis Con: “The top legal experts, highly respected people, virtually every one I know of, these people are not exactly friends of mine, all said this case should not have been brought - Jonathan Turley, Judge Rifkin, Elie Honig, Alan Dershowitz. I got indicted for business records. It’s a witch hunt. I wasn't allowed to use the lawyer-client privilege, or use discrediting info against Michael Cohen - he's a man who has no standing and was disbarred. He was allowed to talk as though he's George Washington, but he's not George Washington!"

With all of the wars and horrible things going on, I got indicted for calling a legal expense a legal expense. I’ve been treated very unfairly.”

… Merchan then made it clear that the only reason why Trump wasn’t going to prison is because he won the election: “While one can argue the trial was somewhat ordinary, same cannot be said about sentencing because of the office you once occupied and will soon occupy once again. It is because of the legal protection afforded to the office. Protections afforded to the executive is a factor that overrides all others. This Court has determined that the only lawful sentence that permits entry of judgment and conviction without encroaching on the highest office in the land is that of unconditional discharge.”
NOTE:  MERCHAN WAS A COWARD!!! HE SHOULD HAVE SENTENCED HIM AND SENT HIM TO PRISON IN SEPTEMBER WHEN HE WAS ORIGINALLY GOING TO SENTENCE HIM!  THE BASTARD ONLY RAN FOR OFFICE TO AVOID JAIL, AND MERCHAN PLAYED RIGHT INTO IT!!!!
… Republicans weren’t happy after court about Trump becoming a convicted felon. Rep. Clay Higgins: “We the People hereby sentence the elitist oppressor Juan Merchan to a life of shame. Where this man is encountered in public, Patriots shall turn our back to his visage.” I think Merchan would be fine with that last part.
… Charlie Kirk: “The people who went after Trump should be investigated and charged. All of them. Justice is coming.”
… Lindsey Graham: “They have singled out Trump for prosecution for offenses that either never existed before or were cobbled together to get a result and make him a felon. The judge in this case rushed to sentencing so that he could tell the world, ‘I made Trump a convicted felon!’ I am sure he will be in great demand on the Manhattan party circuit.”

… Alan Dershowitz: “I will never call Trump a convicted felon. He is a convicted, innocent man! A convicted, framed up man. Nobody should call him a convicted felon!”

… A new jobs report was released this morning which showed another robust month of growth. The economy added more than 256,000 jobs in December, and unemployment dipped from 4.2% to 4.1%. The economy added more than 2.2 million jobs in 2024. Economists expected the unemployment rate to stay at 4.2% and for the economy to add about 153,000 new jobs, but both expectations were surpassed substantially.
… Just like 2017, Cantaloupe Caligula inherits a strong economy from his Democratic predecessor. Strong economic growth, stock market setting records, low inflation, and low unemployment. It is 2017 all over again for Trump as he takes office - somewhat similar to how he entered life - born on 3rd base while claiming he made a triple.
… Hopefully, Trump will not hand off another disaster to his (hopefully Democratic) successor in 2029 like he did in 2021, but I’m not optimistic based on his track record and plans.
… Mark Zuckerberg went on Joe Rogan’s podcast and made it clear why he has gotten into bed with Trump like so many others in his industry. He thinks that the US should put tariffs on the EU because of how many times the EU has fined US big tech companies for violations: “This is an EU policy for how they want to deal with American tech. It’s almost like a tariff. And the US government gets to decide how they want to deal with that. It’s one of the reasons I’m optimistic with President Trump. I think he just wants America to win.”
… He then complained about how he was treated by the Biden Admin: “They pushed us super hard to take down things that were true about vaccines - like that they have side effects. These people from the Biden Admin would call up our team and scream at them and curse. They wanted us to take down memes - humor and satire. And then Biden said, ‘these guys are killing people.’ And then there was all these investigations of our company. It was brutal.”

… Rudy Giuliani was found in contempt of court today for continuing to violate court orders while also refusing to participate in discovery. Rudy during a break while waiting for the judge’s ruling: “Judge Beryl Howell is so bloodthirsty. This decision was already obvious from her earlier opinion and her overall pathological hatred of all things Trump. The hearing was a hypocritical waste of time and a disgusting example of Biden lawfare. Soon I will reveal my real feelings about this systematic destruction of the American system of justice.”

… Per Politico, after finding him in contempt, Judge Howell then told Rudy “it is outrageous and shameful that Mr. Giuliani suggests that he is the one being treated unfairly” given the fact that Ruby Freeman and Shaye Moss lost their jobs, received many credible death threats, and were forced to move. “This takes real chutzpah, Mr. Giuliani.”
… The judge then ordered Rudy to sign a declaration acknowledging he was provided an opportunity to cross examine witnesses in deposition and at trial, that he's reviewed all trial evidence and sworn testimony, and that no testimony or government report has ever contradicted Moss or Freeman.” Judge Howell said if he violates this order by publicly stating anything to to contrary from this point forward, she will put him in jail.

So now the expectation is, because he won again and got 78 million votes we've all got to be civil to Donald Trump!”

I was hoping that after Congress recessed we were going to get a little break on the manic news cycle. That is what normally happens. But we are back entering another four years of Trump, where there will be no breaks because the madness never ends.

Hi! I do have a question about politics and Biden/Harris. I want to preface this by saying that I am not American and all I know about the elections is from the internet & Philip DeFranco. I recently started following a youtuber who, when Bernie dropped off the race (i lov him sm), she told everyone to STILL VOTE GREEN in the elections in november, that she couldn't respect people who voted for Biden because they thought he was the lesser of two evils (1/?)
she said that if you were from a swing state and you voted for Biden, that you didn't really care about people, that you just wanted to get Trump out of office, and that it'd be better if you voted green. I felt like this was a little... harsh? extreme? because of course you (i was about to say we as if my voice counted LMAO) want to get Trump out of office. is that not the point? I really am trying to understand, I swear. I know Biden/Harris are not great, but definitely better than Trump (2/?)
and i feel like ultimately, any votes that don't go to Biden right now, are going to Trump. I don't know. I'm sorry, I'm mexican and I don't know much, but... it does worry me that, for example the last elections, the people who voted for Harambe or third party ultimately helped get Trump elected. EVERYONE would have to agree to vote third party to not get Biden or Trump elected. right? she has a pretty big following and it scares me a little that she could be influencing them. (3/3)
Ahhh yes this is such a good question!!! Thank you for asking!!! And honestly your thoughts here are really the root of the struggle with this election (at least in my opinion). I totally don’t speak for everyone so I want to make sure that’s said. I also wanna say I 1000% understand why American voters are feeling disenfranchised and not wanting to vote at all so I want to make sure I approach this with empathy because so many people’s lives are going to be affected negatively no matter who wins. My answer might be all over the place because it totally is a complex and really nuanced issue so if anything is confusing at all please lmk!! 
In terms of a Biden vote meaning you don’t care about people, I think for most rational Americans, and those of us who are leftist/socialist (at least those of of us who, at the minimum would have voted for Bernie and even to a lesser extent, Warren), the point is to get Trump out of office but many people who don’t want to vote for either aren’t voting because they truly don’t feel that Biden is the better option. For a lot of people who aren’t wanting to vote at all, it’s because they feel they’re voting for just sliding scales of morality and both Trump’s and Biden’s morals (and therefore the policies they’ll choose to support) are corrupt. Trump is the obvious and outspoken fascist, but Biden is just wrapped in a veneer of progressivism because he doesn’t explicitly say he wants to disenfranchise voters, he’ll just do it by picking a VP that has a long and icky history of turning Black people into felons and therefore excising them of their right to vote ever again. (For what it’s worth, people with a felony record in CA where Kamala Harris was DA and senator can vote with some qualifiers, unlike many other states). For a lot of people, especially BIPOC, their lives are threatened under both candidates so why vote for either if neither will make them feel safe or care about their basic human rights?
It’s hard too because we do know what a Trump 2nd term will bring and it’s fascism and the removal of everyone’s rights/healthcare/access/etc. as much as he possibly can manage. With Biden those particular risks are just not at the same level. The way he is damaging is in different ways and people are unfortunately being forced to choose whether he as a president will be more harmful or less harmful than Trump, so it’s really about what each individual person is willing to sacrifice and “put up with” because clearly all of us are going to sacrifice in very painful ways (to put it lightly) no matter which candidate is picked. I do think part of it too is playing into Republican hands to make Biden look as bad as Trump, which I feel is what they did in 2016, as well, and it worked. If we’re talking about the basic, will Biden put children in cages, will he build a border wall, will he refuse to leave office if he gets elected and loses re-election, will he xyz - no, I personally do not feel he will. And if that, for me, is the bar I’m voting at, then he’s getting my vote, if that makes sense. (For me personally, it just doesn’t track that the right can get a spray-tanned used sock into power and all unite behind him in unison, but the moderate to liberal left can’t unite behind one fucking person to keep a fascist from exercising his dictator inclinations.)
One of the other big things people feel is that centrism is the death of progressivism. Malcolm X and MLK both talked a lot about this with respect to being Black and in general, a person of colour, and I’m REALLY going paraphrase it here but basically, lots of people feel that voting for Biden will make Democrats/centrists/liberals complacent. The republicans and conservative party are getting more and more extreme and far-right with every new candidate so the fear is that to be a “moderate” democrat and to be successful, you have to bend to the will of Republicans to even casually get both sides to agree, which inches each “moderate” Democrat further from being left-leaning and more toward being right-leaning because the demands of the GOP are such fucking thinly veiled fascist demands at this point, if that makes sense.
With respect to the idea of not voting for Biden meaning a vote goes to Trump, it’s sort of true and not true at the same time (in my opinion). If someone doesn’t vote for Biden, it’s not *literally* a vote for Trump because you *literally* voted for a third party candidate, but in the nuance of how electoral politics work, the American two-party and electoral system does feel like it turns it into “if you don’t vote for one of the major candidates, your vote won’t count at all.” It’s easy to say “well if everyone voted for the Green Party then they’d win”, but as we saw in 2016, the person who wins the most votes doesn’t necessarily win the presidency, so even if most of us did vote for a third party candidate, we’d all have to do so in EVERY state enough to outvote not only Biden but Trump as well. And it ABSOLUTELY would mean the states with a lot of electoral votes (in particular Florida because historically whoever wins FL’s electoral votes generally wins the presidency) would have to go toward the Green Party candidate.
I do feel that telling people if they don’t vote for a third party candidate that they don’t really care about people is harsh because a vote for Biden isn’t just a vote for the president, it’s a vote for a supreme court judge (who rules for their ENTIRE life or until they actively choose to step down - this person WILL be as disgusting as Kavanaugh under a Trump 2nd term at best and at worst, a 2nd Trump presidency will get to choose two more SCOTUS judges), it’s a vote for hundreds and hundreds of political offices approved by the President and confirmed by the Senate, it’s a vote to kick DeVos and Barr the fuck out, it’s a vote for climate change and for abortion access and LGBTQ+ healthcare, it’s a vote for someone who won’t tweet his presidency (the bar is so low), it’s a vote for representatives of the US who won’t act like fools in front of foreign powers, etc. etc. Lots of people are being forced to vote for him even when they don’t want to (like me) the same way lots of people are feeling forced to note vote at all because both of them feel dangerous to themselves in different ways. 
For me, it feels like a MASSIVE gamble to say I’m not gonna vote for either because I think that we as a country need a revolution. I said this on Twitter but feeling like the revolution needs to happen before you’ll vote hinges a lot on that revolution actually happening and if we’re gonna be honest, I don’t think it will happen. Will I be a part of it? Yes. Will I attempt to dismantle the system we have? Without a doubt. But I’m also going to vote for the candidate that will keep my rights to be able to do that even if I think he’s kind of a sentient sock puppet.

Brentwood, N.H. man purchases four military M67 fragmentation grenades with inoperable fuzes from undercover FBI agents. District court: To be a grenade, a device must contain not only explosive material but also a means of detonating that explosive material. Inoperable fuzes mean the man didn't buy grenades. First Circuit: Reversed. The grenades were explosive; they just needed new fuzes. Congress can't have meant for agents only to use fully functioning "weapons of war" in their sting operations.
Nineteen-year-old (or perhaps he's 20) impregnates 14-year-old in 2009, is sentenced to 16 years of probation. He seeks parental visitation rights; she tries to stop that from happening. Suit 1: State court won't stop it. Suit 2: Federal court won't stop it. Suit 3: State court won't stop it; he's been ordered to pay child support, and Massachusetts family courts were (at that time, anyway) authorized to adjudicate the parental rights of a parent convicted of statutory rape. Plus, the kid should be getting financial support from both parents. Suit 4: Federal district court won't stop it. First Circuit: Subject to exceptions that don't apply here, losing parties in state court don't get to re-litigate in federal trial courts.
Hoke County, N.C. officer knocks on door of home, threatens to break it down unless it's opened. It's opened. A voluntary knock-and-talk or a coercive, warrantless entry? Fourth Circuit: Other than threatening to knock down the door, the officer and federal agents were casual and nonhostile. No need to suppress the evidence.
A man is shot dead at a Wilson County, N.C. convenience store in 1976. Three alibis place Charles Ray Finch at a poker game when the shooting occurred, but a witness places Finch at the shooting and picks him out of a lineup. Finch is convicted. Fourth Circuit: We've now learned that the witness had cognitive and short-term-memory problems, that the lineup was unduly suggestive, that another witness was coerced, and that a host of forensic conclusions were wrong, so Finch's habeas claim—ordinarily time-barred—can go forward.
Two people crawl through a Goldsboro, N.C. McDonald's drive-thru window, demand money at gun point, throw cash drawers at employees, hit the manager with the gun, and make off with $1k. One perpetrator pleads guilty to robbery and the additional, distinct crime of using a firearm in connection with a crime of violence. Fourth Circuit (en banc, splitting 8–7): Alas, the statutory definition of "crime of violence" is unconstitutionally vague, given the Supreme Court's treatment of materially identical laws. Dissent: Courts should look to the underlying facts of the crime, rather than just the statutory language in a hypothetical case, to determine whether a crime is one of violence. Pistol whipping during a robbery clearly is. (Circuit-split watch: The Fourth joins the Fifth, Tenth, and D.C. Circuits but departs from the Eleventh Circuit in this holding. Moreover: SCOTUS will hear the Fifth Circuit case.)
Galveston, Tex. police get warrant to search drug suspect's house, seize any "ledgers" they might find. They seize a cell phone. Is a cell phone a ledger? Close enough, says the Fifth Circuit, so no need to suppress evidence from the phone (which helped convict him of pimping minors).
Texas inmate threatens guard, has his stuff taken away, gets put in solitary. Or maybe—as inmate alleges—guard was lying, retaliating against inmate. Inmate brings a hodgepodge of claims (to get out of solitary, over loss of his stuff, and more). Fifth Circuit: Almost none of which can go forward. But if the guard really took away the inmate's Bible (and books by mega-pastors like Joel Osteen), there needed to be a valid reason. The inmate's First Amendment claim should not have been dismissed.
"Sexed cow semen" is bull semen containing only X- or Y-chromosome-bearing sperm. It allows dairy farmers using artificial insemination to ensure they breed only female—and thus milk-bearing—cows. It's valuable stuff, and, until recently, the U.S. market was controlled by a monopolist whose technology worked by identifying sperm cells, electrically charging them, and then sorting them with magnets. But when an upstart hired one of the monopolist's ex-employees, she shared the monopolist's trade secrets. The upstart then began using a different, potentially faster method: individually vaporizing the unwanted sperm cells with a laser millions of times per second. The ensuing antitrust/patent infringement/breach of contract suit, culminating in a two-week trial, gave wins and losses to both sides. On appeal, the Seventh Circuit affirmed some of the monopolist's wins but also—in a complicated discussion of patent law featuring set theory, subscripted variables, and LSAT-esque diagrams—gave the upstart a second chance at invalidating the seminal patent claims.
Federal law prohibits any "unlawful user" of marijuana from possessing a firearm. "Unlawful user" is unconstitutionally vague, says criminal defendant who admits to smoking daily for the past decade. Perhaps in some hypothetical scenarios, says Seventh Circuit, but your conduct "undoubtedly falls within the obvious core" of the statute. As a consolation prize, however, the court "commend[s] everyone involved in the briefing and arguing of this case" (along with the district-court judges) for a job well done.
San Francisco requires that advertisements for "sugar-sweetened beverages" contain a warning, taking up 20 percent of the advertising space, that sugary drinks contribute to obesity, diabetes, and tooth decay. Unconstitutional compelled speech? The en banc Ninth Circuit unanimously agrees that it is, though they disagree vociferously as to why.
Pizza chain's website and app are incompatible with screen reading software, so blind man can't order online. A violation of the Americans with Disabilities Act? District court: No, the Act doesn't mention the internet, and the feds have failed to provide formal guidance on how it applies—despite promising to do so. Ninth Circuit: Reversed. The feds have said that websites must comply; there's no need for the gov't to produce a blueprint detailing how to do it.
Douglas County, Colo. officer tases man who has a rifle muzzle in his mouth and his thumb on the trigger. The gun goes off; the man dies. Can the man's parents sue the officer? No, they filed suit 27 days too late, says the Tenth Circuit; the deadline started running on the date they asked the coroner to reconsider her report, not when the amended report was released (over a year later).
There are a number of federal crimes—from fraud to robbery—that apply only to banks that are FDIC insured at the time of the crime. Inexplicably, and despite repeated warnings from federal courts, prosecutors routinely fail to produce direct evidence that a bank was FDIC insured at the time of the crime—the testimony of a single witness would do—and instead rely on circumstantial evidence that it was insured at some point before or after. Is enough finally enough? Eleventh Circuit (over a dissent): Although prosecutors are "cruisin' for a bruisin'," we won't bruise them today.
After seven years' imprisonment for rape, man is released after tests confirm that his DNA was not on the victim. Chatham County, Ga. DA declines to re-prosecute. Trial court dismisses indictment. And state lawmaker introduces bill to compensate the man $1.6 million for the wrongful conviction. But wait! The DA opposes the bill and (allegedly) falsely states that the man remains under indictment. Bill fails; man sues. Eleventh Circuit: The DA's defamation absolutely amounted to unconstitutional retaliation. But even so, qualified immunity. Concurrence: "My only comfort with this result is knowing that if another official in this circuit henceforth engages in conduct similar to [the DA's], he or she will not be entitled to hide behind the doctrine of qualified immunity."
And in en banc news, the Eleventh Circuit will reconsider its holding that an Alabama law enacting a statewide minimum wage of $7.25 that preempts a Birmingham minimum wage of $10.10 might violate equal protection. The now-vacated opinion declared: "Today, racism is no longer pledged from the portico of the capitol or exclaimed from the floor of the constitutional convention; it hides, abashed, cloaked beneath ostensibly neutral laws and legitimate bases, steering government power toward no less invidious ends."
Officials in Yorktown, Indiana want to bulldoze a small neighborhood with many long-time, elderly residents and replace it with: a tech firm, other businesses, and new residences. To bypass the state's eminent domain law, which bars seizing property for private projects, officials have strategically placed some public amenities in the plan. Sneaky! Sharon and Jerry Puckett's home, for instance, is scheduled to be replaced by "courtyard/games" and part of a new restaurant. The kicker: The town already owns enough property to build the development just 500 feet away. IJ has helped gather over 105,000 signatures on a petition opposing the plan, and in January residents presented the Town Council with the petition. But the project is still rolling along, so please do sign the petition if you're of a mind.

I’ve been commenting on it the past few weeks. Like Heather- a girl who was murdered last year- right after going to CCPD and telling them ‘he’s going to murder me’. She was killed. Ok- obviously the family thought the cops were not doing their job [whether true or not- I don’t know- but you could understand the feeling coming from the family]. So- the other day I read an article in the Caller Times- they have been doing a good job on covering the problem of domestic violence in Corpus Christ. But- I read the headline- and it seemed strange- I looked for the link- as of now can’t find it. Why strange? It had the sister of the latest victim- saying something like ‘the law and CCPD are doing a good job [Hmm?] but the system needs time to work’. Then they said the sister of the victim said this. I read the actual article [small print as we say- which most people don’t read- they usually form their opinion from the headline]. And this quote- according to the actual article- WAS NOT FROM THE SISTER- But the cop in charge of the domestic violence unit. I’ll give the benefit of the doubt to the Caller Times- and attribute it to a simple mistake- but the national media do indeed do this type of stuff- all the time. [ I just found the article- right before I post- in my news paper collection here at the house- I’ll post the actual pictures on facebook right now- I hope the caller times makes a correction because if the family does not feel this way- it victimizes them again]. NEW NOTES ON SAMUEL 4- [news links and commentary below] The people of God go to battle against the enemy- at a place called Ebenezer [means rock of help- a picture of Christ]. So- they think God is on their side- and the enemy wins! They go back to Shiloh- the place where the Ark [box] was- and they think if they bring the box with them- this time they will win. The Ark was a God given thing- but inside of it were the 10 commandments- which the people did not keep anymore. The Philistines hear that the box is now with the army- and they fear. Yet- they say ‘be strong- be courageous- let’s fight to the death anyway’. This is a God given principle- courage- but the Philistines worshipped false Gods [they had bad doctrine about God]. So- they engage in battle with God’s people [right doctrine- but not right obedience] and sure enough- the enemy wins- and captures the Ark! The 2 sons of Eli are killed- fulfilling the first prophecy God gave Samuel and Eli hears what happened- and falls back off his chair and dies. Bible teachers ‘warn’ not to confuse the Ebenezer of chapter 4 with that of chapter 7. Why? Because in chapter 7 the Ebenezer is an actual stone monument that represents victory for God’s people. And the Ebenezer of chapter 4 seems to not be a picture of Christ- the Rock of help. Jesus said that whoever ‘this rock’ falls on- it will grind him to powder- but whoever falls on it- will be broken. Jesus was speaking of himself- saying ‘if you repent- and ‘fall’ down before me’- yes- it is a type of judgment- but necessary. But- if you reject me- the rock comes in judgment. I believe the Ebenezer of chapter 4 was a type of Christ too. Because God allowed the defeat- so the people would realize it’s not good enough to just have ‘the box’ which is an outward expression of religion- but you need a change of heart. When you receive the Ebenezer of chapter 4- then you get the Ebenezer of chapter 7- and the Philistines get ‘ground to dust’. See? VERSES- 1Samuel 4:1 And the word of Samuel came to all Israel. Now Israel went out against the Philistines to battle, and pitched beside Ebenezer: and the Philistines pitched in Aphek. 1Samuel 4:2 And the Philistines put themselves in array against Israel: and when they joined battle, Israel was smitten before the Philistines: and they slew of the army in the field about four thousand men. 1Samuel 4:3 And when the people were come into the camp, the elders of Israel said, Wherefore hath the LORD smitten us to day before the Philistines? Let us fetch the ark of the covenant of the LORD out of Shiloh unto us, that, when it cometh among us, it may save us out of the hand of our enemies. 1Samuel 4:4 So the people sent to Shiloh, that they might bring from thence the ark of the covenant of the LORD of hosts, which dwelleth between the cherubims: and the two sons of Eli, Hophni and Phinehas, were there with the ark of the covenant of God. 1Samuel 4:5 And when the ark of the covenant of the LORD came into the camp, all Israel shouted with a great shout, so that the earth rang again. 1Samuel 4:6 And when the Philistines heard the noise of the shout, they said, What meaneth the noise of this great shout in the camp of the Hebrews? HILLARY’S RESPONSE- ‘They are just attacking my campaign’- sad- The report showed us that one of the reasons we did not send our men help- was the Obama administration debated if they needed ‘approval’ from Libya- I mean our own men were under attack. Besides the fact that Hillary lied- and said the attack was because of a video- she even lied to the family members of the dead. The investigation was NOT INTENDED to find who was at fault- if it were- then yes- it would be Hillary’s state dept. But the media says ‘no wrong doing found’ but that’s not what they were looking for- in the sense that our guys asked for help- and didn’t get it- yes- that is wrong doing. PAGE 30 [of the report] security assessment 9 months before attack- state dept. witness said ‘people will die in Benghazi’ because we have inadequate security. Now- Hillary’s state dept. knew this- why did she not provide adequate security? HOW THIS WOMAN CAN RUN FOR PRESIDENT IS BEYOND ME.
