Doug Klain: How to open NATO’s door for Ukraine

Despite more than two-thirds of NATO members supporting a path for Ukraine into the alliance, Ukraine got a flat no. The alliance’s decision at the 2023 Vilnius summit was both unsurprising and a disappointment. Opposition primarily from Washington and Berlin dashed any hopes of a clear invite for Ukraine, with only a pledge that Ukraine would join “when members agree and conditions are met.”
The good news is that Ukraine and its friends have one year until the next summit to persuade U.S. President Joe Biden that Ukraine belongs in NATO. Berlin will follow suit. Ukraine’s friends should spend the next period making the growing consensus on Ukrainian membership ironclad.
Above all, that means working to change Biden’s calculus and addressing the White House’s biggest objections, particularly the pervasive fear of Russian escalation, which continues to shade every major U.S. decision.

It goes without saying that Ukraine in NATO is the single best way to safeguard the peace – both for their country and for all of Europe – that Ukrainians are fighting and dying for. They are resolutely united in seeking membership in the alliance, with 86% in favor of joining as of 2023, a serious increase from past years.
It’s also promising that this shift in Ukrainian public opinion is matched by a shift in NATO opinion. Though Berlin was unwilling to break directly from Washington and call for an invitation for Ukraine at the Vilnius Summit, more members signaled that they supported such a move. France was a notable example, given that they were a chief obstacle to Ukrainian and Georgian membership at the 2008 Bucharest NATO Summit.
While the most pressing issue for Ukraine and its partners is to support Ukrainian troops with all the tools they need to liberate more territory and succeed in the counteroffensive, it’s time to start laying the groundwork to ensure that NATO members have no excuse to sidestep inviting Ukraine at the Washington summit next year.
Americans and Europeans see Ukrainians as courageous partners – it’s time to take that a step further and show that they would be even better as allies. One way to formalize this is for Western voters to elect officials in their own countries who support Ukraine in NATO.

While Ukraine’s friends work to bolster consensus on membership and lay the groundwork for an invitation, Ukraine’s government and civil society can get to work at home as well. The big three items on the Biden administration’s list are more decisive action against corruption, judicial reform, and de-monopolization.
The West and Ukrainians alike favor anti-corruption efforts and judicial reforms. Ukraine’s government is showing meaningful attempts to stamp out corruption, with President Volodymyr Zelensky recently reiterating that corruption is tantamount to treason and that “Ukraine has no more time for that.”
After a high-profile food procurement scandal at the Defense Ministry earlier this year, Zelensky moved quickly under public pressure to get rid of numerous deputy ministers and regional governors while directing Ukraine’s Security Service (SBU) to conduct dozens of raids on allegedly corrupt officials, former Interior Minister Arsen Avakov, and oligarch Ihor Kolomoisky.
It’s also promising to see the Verkhovna Rada speaker urging MPs to resume asset declarations for government officials, which have been suspended under martial law. Requiring government servants to be transparent about their finances would be a strong signal of accountability, and the EU ambassador to Ukraine calls it a good test case for whether or not Ukraine is serious about the anti-corruption efforts needed to join the EU.

Recent reports that the SBU thwarted criminal groups – including those led by Russian agents – trying to steal Western weapons to sell on the black market are another cause for hope. Rather than trying to hide these types of cases, publicizing anti-corruption efforts and accountability are a good way to spotlight the good work of watchdogs and contribute to a broader culture shift away from graft.
Every country has those who will try to secure ill-gotten gains – Ukraine can show the world it’s one of the countries where those people are caught and held accountable. But there’s still more work to do to show that the incredible progress Ukraine has made is irreversible.
Another milestone was passed in June, when members of the High Qualification Commission for judicial appointments were finally appointed. However, Mykhailo Zhernakov, head of judicial watchdog DeJure Foundation, points out that two members of the commission do not meet standards of integrity and remain marked by scandals, while more qualified candidates were passed over.
The reform is a partial victory that is vital to build on. The commission, its members, and their decisions require strict scrutiny, and the West should hold its feet to the fire while supporting Ukrainian victory.

Ukraine’s post-Revolution of Dignity anti-corruption agencies have yet to bring any serious charges against high-ranking corrupt officials or oligarchs, though they did detain Supreme Court President Vsevolod Kniaziev as part of a massive bribery inquiry in May. Pursuing accountability at the highest levels is the sign of a vibrant, healthy democracy – especially during wartime.
Zelensky’s government has also made decent progress in de-oligarchization, though implementation of the “anti-oligarch law” has been delayed as it tries to resolve conflicts with the EU over how best to address the issue. Working closely with the EU and the Venice Commission to future-proof Ukraine from the corrosive influence of oligarchs will be a major step for Ukraine to join both the EU and NATO.
While some fairly point out that Ukraine is being asked to meet standards that even some NATO members may not meet, the reality is that welcoming a new member into the alliance is a political decision. The best thing for Ukraine to do is make that political decision an easy one.
Officials accused of using war as pretext for hiding ill-gotten wealth
As Ukrainian soldiers are defending their homeland on the front line, officials in the rear are accused of using the war as a pretext for hiding their wealth. They are able to do so because one of Ukraine’s main anti-corruption tools, the asset declaration system, has been effectively eliminated.

There are strong arguments for inviting Ukraine to be the 33rd NATO ally. The best way to preserve peace in Europe is by adding Ukraine’s world-class fighting force to the alliance.
After Ukraine defeats Russia, the best way to preserve that peace is through NATO. Further integration into Western structures like NATO and the EU are also excellent ways to consolidate the democracy that Ukrainians are fighting for.
There’s just under a year until the Washington summit. Both Ukraine and its friends have their work cut out for them. Time to get to work.

Ukraine on Wednesday announced searches of government buildings and the homes of high-profile ministers and oligarchs as part of a clampdown on corruption. The move comes ahead of a gathering of European leaders in Kyiv to discuss Ukraine’s path towards EU membership.
Among those targeted by coordinated searches on Wednesday were residences linked to influential billionaire Igor Kolomoisky and former interior minister Arsen Avakov. Law enforcement also raided tax offices in the capital and senior customs officials were fired, said the head of Zelensky's party David Arakhamia.
These are the latest in a string of high-profile efforts to tackle corruption in recent weeks.
In the midst of war with Russia, Ukrainian President Volodymyr Zelensky has upped the ante in an internal fight against corruption, pledging to make as many personnel changes “as necessary” even at the highest levels of office.
"People in the government who do not meet the basic requirements of the state and society should not occupy their seats," he said in a video address on Tuesday.
Zelensky was elected in 2019 on an anti-establishment and anti-corruption platform. Yet efforts to ongoing efforts to stamp out misconduct have been overshadowed by the Russian invasion almost a year ago.
Ukraine currently ranks a low 116 out of the 180 countries listed for perceived corruption, according to anti-corruption group Transparency International.
Multi-million-dollar fraud
Investigators from the Ukraine’s security service SBU released images of a search from the home of Kolomoisky, who was barred from entering the United States over allegations of corruption and undermining democracy.
Prior to the Russian invasion, Kolomoisky was one of the country's richest men, with holdings in a slew of industries, including media, aviation and energy.
The security service said the search had been launched over an investigation into the embezzlement of 40 billion hryvnia (about $1.1 billion) from energy holdings.
Last week Ukrainian authorities fired around a dozen senior figures, including defence officials and a top aide to the president's office.
One such official was former deputy defence minister Vyacheslav Shapovalov, who worked on logistical support for the army. The ministry has been accused of signing food contracts at prices up to three times the market rates.
The SBU also said it had uncovered a scheme by the head of the Kyiv tax office involving "multimillion-dollar" fraud schemes. They accuse the official of having abused a position of authority.
Additionally, the government has also seized stakes in the energy companies – oil producer Ukrnafta and refiner Ukrtatnafta – as part of moves to consolidate the war effort.
More dismissals are possible. The State Bureau of Investigation and the Prosecutor General's Office said Wednesday they had informed several senior officials they were under investigation for crimes including misappropriation of state funds and misuse of state property.
"Every criminal who has the audacity to harm Ukraine, especially in the conditions of war, must clearly understand that we will put handcuffs on him,” said Vasyl Maliuk, the head of the SBU, on Wednesday.
Speed vs integrity
Renewed efforts to tacks corruption are thought to be aimed at appeasing EU leaders who arrived in Kyiv on Thursday for a summit to discuss Ukraine’s bid to join the EU.
Ukraine currently has EU “candidate status", with Brussels saying strengthening the judiciary, fighting corruption and curbing the clout of powerful oligarchs are key conditions for joining.
“Ukraine wants to show it can present a stable government that can deliver at the negotiating table, that can demonstrate the value systems and the commitment to transparency that are needed to be able to be part of the EU,” says Dr Melanie Garson, associate professor of international security and conflict resolution at University College London, UK.
Yet, among EU member states, there are widely divergent views on how fast the process will go. Ukraine's strongest cheerleaders – including Poland and the Baltic states – insist Kyiv is making big strides against corruption and progress could come quicker than expected.
But others insist that while making Ukraine a candidate sent the right symbolic message of support in light of the war, working through the nitty-gritty of the major reforms needed would be long and arduous.
“The EU needs to strike a balance between speed and integrity,” says Joel Reland, research associate at UK in a Changing Europe. “It clearly wants Ukraine to be given fast-track membership but, at the same time, it can’t totally compromise on its principles of membership, which define the integrity of the EU.”
Even so, French President Emmanuel Macron warned last May it could take "decades" before Ukraine meets the criteria and achieves full membership.
The upper hand
In the meantime, demonstrating values such as transparency is not just a question of values.
In 2016, then US vice president Joe Biden withheld loan guarantees from Ukraine until the country’s prosecutor general, Viktor Shokin was dismissed as part of a push for anti-corruption reforms developed at the State Department and coordinated with the European Union and the International Monetary Fund.
In 2023, countries providing crucial military and financial aid to Ukraine still have “the upper hand to force their position”, says Garson, associate professor of international security and conflict resolution. “Zelensky is very aware of this and is trying to reiterate increased bipartisan support across the world.”
Although the public dismissal of figures – including a high-level defence official – in the midst of war may seem like a risk, not tacking corruption during wartime can have even more serious long-term consequences.
Funding for reconstruction and recovery efforts can be “drastically undermined by wrongdoers pocketing funds, both during the war and after”, said Transparency International in its 2023 report.
“The visibility that the work has been done to make this a place where donors don't feel their funds are going into the pockets of oligarchs is really important,” adds Garson. “There needs to be confidence in government funds coming in and from external investors – it’s critical to long-term strategic rebuilding.”

This decision provoked the anger of Ukrainian nationalists. The judges considered that the accused "Kulikovtsy" did not take part and did not organize riots in Odessa on May 2, 2014. At the same time, the court immediately arrested two of the acquitted defendants -- Ukrainian Sergey Dolzhenkov and Russian Evgeny Mefyodov -- for 60 days on another charge. They were charged under Article 110 of the Criminal Code of Ukraine, accused of separatism.
Alexey Albu, a former deputy of the Odessa Regional Council and survivor the attack on the House of Trade Unions on May 2, 2014, said:
“In my opinion, there is a political will to keep these people behind bars in any case. The court vindicates them on the one hand, and on the other -- they are jailed again under another article. I think that it is in the interests of the top people of the state: Poroshenko, Turchinov, Avakov, Parubiy and all those who were involved in the organization of this massacre. “It also seems to me that the court decision may be linked to the fact that now a great destabilization campaign brewing in Odessa. It’s connected with a fire at the Victoria Children's Camp, which resulted in the deaths of several children. This is a terrible tragedy which the nationalists tried to use today to overthrow the mayor of Odessa, demanding that he resign. And not only nationalists, but a number of politicians, like Saakashvili, like Hurwitz, want to do this, and one of Odessa's leading businessmen Adnan Kivan is interested in this. Today they want to remove the mayor of Odessa with the help of the nationalists. On September 20 at Duma Square near City Hall, large protest actions are scheduled. And in order to shift attention to another problem, the question of May 2 was raised. A positive decision was taken that triggered a confrontation and shifted public attention from Victoria Children’s Camp to May 2.”

Regarding the ‘ideal or worst result’ and the ‘deoccupation of the territories seized by Russia’:
‘For me, there cannot be any new changes to Ukraine’s borders made after the 24th of February.’
About neutral status: ‘NATO doesn’t want us. We can have neutral status. But we can be like Israel – remember, they are also a neutral country. We need to be neutral but also strong.’
About ‘demilitarization’: ‘No one will agree on limiting the military to 50 thousand soldiers. Not the army, not the people, no one. The president does not have such a mandate. It is meaningless.’
About the ‘post-2014 occupied territories, Crimea and L/DPR’: The question of these territories is the question of the standoff against Russia as a monkey with an atomic stick. This question can only be settled when the question of the standoff with Putin’s Russia is settled. В июле 2019 года, глава МВД Арсен Аваков публично заявил, что не будет давать от МВД справку в ЦВК, что Шарий не проживает в Украине последние 5 лет (условие для участия в выборах), а потому не может балотироваться нар��дным депутатом Украины. В июле 2019 г. Аваков отправил такую справку в ЦВК на Клюева, что он не может регистрироваться в ЦВК, на прямой вопрос: "а почему на Шария не отправили?", Аваков ответил, что это "не компетенция МВД". Почему по Клюеву компетенция, а по Шарию нет? Интересно... Шарий покинул Украину в 2011 году, а в 2012 году был обьявлен в розыск Соломенским РОВД г. Киева - структурой МВД.Аваков демонстративно подписывался на ресурсы Шария и респостил его публикации в Твиттере, Шарий для Авакова очень близкий друг, Шарий всегда тщательно избегал критики Авакова и даже хвалил его как "лучшего министра". В свою очередь Аваков всеми силами помогал Шарию интегрироваться в Верховную Раду Украины, путем умышленного не предоставления информации о юридической невозможности его участия. Шарий долгие годы систематически накручивал жителей РФ и стран Европы, что в Украине якобы "одни нацисты и бандеровцы", тщательно оправдывал все преступления РФ и клеветал на Украину. Аваков это все одобрял. Теперь Шарий оправдывает зверские убийства РФ жителей Бучи. Помогая России и сформировать общественное мнение, мол Россия ни в чем не виновата. Чтобы он смогла продолжить геноцид.

We shouldn't forget that Ukraine has been a trailblazer, having elected the guy who played President in a sitcom as their IRL President last year. Arguably, Ukraine has been living in 2020 for about 40 years, it's the smug hipster of polities.
