Der Bundesverband Erotik Handel e.V. hat nach zahlreichen Strafanzeigen gegen die Betreiber von frei zugänglichen Internetseiten mit pornografischen Inhalten nunmehr die Bundesministerin für Familie, Senioren, Frauen und Jugend Dr. Katarina Barley sowie Bundesjustizminister Heiko Maas aufgefordert, effektive Maßnahmen gegen die jugendgefährdende Verbreitung pornografischer Inhalte im Internet zu ergreifen. Zensur / Geschloßen / Kriminell / Illegal Nach Einschätzung des Bundesverbandes Erotik Handel e.V. ist vielfach nicht bekannt, dass ohne Altersverifikation zugängliche pornografische Seiten auch aus Sicht der Staatsanwaltschaft in Deutschland eindeutig strafrechtlich relevante Inhalte aufweisen und gegen §§ 184 Abs. 1 Nr. 1, 184d Abs. 1 StGB verstoßen (Verbreitung pornografischer Schriften, bis zu einem Jahr Freiheitsstrafe). Außerdem stellen diese frei zugänglichen Angebote u. E. massive Verstöße gegen § 4 Ab.s 2 Nr. des Jugendmedienschutz-Staatsvertrag (JMSdV) dar. Die Staatsanwaltschaft sieht sich bisher allerdings aufgrund von Länderschranken außerstande, gegen Betreiber/Server vorzugehen (z. B.: rund 50 Ermittlungsverfahren der Staatsanwaltschaft Hamburg aus 2016 und 2006 zu den Aktenzeichen 7452 UJs 43/16 sowie 7102 Js 340/06 bis 7102 Js 397/06). Der Bundesverband Erotik Handel e.V. hatte zahlreiche Strafanzeigen bei der Staatsanwaltschaft Hamburg gegen Internet-Seiten bzw. gegen die dahinterstehenden Betreiber erstattet. Die Staatsanwaltschaft hat jetzt allerdings erneut mitgeteilt, dass das zuletzt eingeleitete Verfahren eingestellt worden sei, da Täter nicht ermittelt werden konnten. Diese hätten ihren Sitz im Ausland, überwiegend in den USA, Großbritannien und den Niederlanden. Dort würden Anfragen des Bundeskriminalamtes üblicherweise allerdings nicht oder nur unbefriedigend beantwortet werden. Dieses Ergebnis ist aus Sicht des Verbandes auch unter Berücksichtigung der Interessen des Jugendschutzes nicht hinnehmbar, da die Staatsanwaltschaft bereits vor Jahren in Einstellungsbescheiden mitgeteilt hatte, dass die Internet-Seiten in Deutschland eindeutig strafrechtlich relevante Inhalte haben und damit massiv gegen geltendes Recht verstoßen. Mit anderen Worten: Trotz massiver Verstöße gegen Jugendschutz und Strafrecht hat sich in den vergangenen Jahren nichts geändert. Parallel hatte der Bundesverband sich auch an die Kommission für Jugendmedienschutz als Arbeitsgemeinschaft der Landesmedienanstalten gewandt. Die neue Vorsitzende, Frau Cornelia Holsten, hat allerdings mit Schreiben vom 11.04.2017 nunmehr mitgeteilt, dass sie ein Einschreiten mittels Sperrverfügungen oder ähnlichem nicht vornehmen werde. Auch diese grundsätzliche Einstellung der zuständigen Kommission ist vor dem Hintergrund der eindeutigen Rechtslage in Deutschland aus Sicht des Verbandes nicht hinnehmbar. Selbst der Bundesgerichtshof hatte in zwei Entscheidungen 2015 entschieden, dass Telekommunikationsunternehmen verboten werden kann, rechtswidrige Inhalte zur Verfügung zu stellen (BGH Urteile vom 25.11.2015, I ZR 174/14 sowie I ZR 3/14). Die vom Verband hierzu aufgeforderte Kommission weigert sich aber konsequent, diese Vorgaben umzusetzen. Parallel hat der Bundesverband Erotik Handel e. V. nunmehr auch die Telekom Deutschland GmbH als großen Provider unter Fristsetzung aufgefordert, ihren Kunden keinen freien Zugang -ohne Altersverifikation- zu Internetseiten mit pornografischen Inhalten mehr zu gewähren. Der Bundesverband fordert auch die angeschriebenen Minister, Politiker sowie zuständige staatliche Stellen auf, effektive Maßnahme zu ergreifen. I love being skeptical about some newbie, then halfway thru the video, I'm like, 'so then wait, why am I still listening/viewing?' It's DOPE! The trio, James Davis is a band n' not just one person. NMT 5/19 - Jennifer

I am relatively new to NMT, having only discovered it via Becs approximately 6 weeks ago, give or take. I know what I like, and I’m open to more artists of what I like than I am to music from genres I’m not into.

Thus, NMT is 70% skip, 30% gems for me….usually.

This week’s NMT was 99% skipped.

I’ll echo Becca in the heavy 80s influence the upcoming electronic music is taking. I find most times it doesn’t work for me, at least not since Tegan and Sara’s Heartthrob. That album was magical.

NMT was such a bust this week that I had to stop a third of the way through the playlist to listen to music I actually like to remind myself what it is to like music. I had a mini-existential crisis, y’all. I thought, This is it. This is where I turn into my grandmother, grumbling “Back in my day, music was…”

I think the biggest problem with this playlist was how biased it was toward two genres: rap and EDM. I skipped 4-6 songs in a row that sounded similar to one another, and you do that a few times and damn, there’s your entire playlist.

Brandon Flowers surprised me with ‘Between Me & You’. I generally like Flowers, though if I’m honest it’s by default because The Killers were early millennium indie alt rock gold. Previous two singles were just okay to me, and I expected this one to sound identical because that’s kind of Flowers’ schtick. ‘Between Me & You’ was a nice companion, and I think the lyrics really sold this one for me.

Of Monsters and Men has one of my most-anticipated albums of 2015. I absolutely loved ‘Crystals’ and ‘I of the Storm’–with the latter being on repeat at least a handful of times d-a-i-l-y. So good. ‘Empire’, however, ran a little lukewarm for me. If this is the weakest song on the album, I’ll still be thrilled. I can’t quite pinpoint it…maybe it’s the instant quick pace with his naturally slower-rhythm voice that throws me off. When Nanna comes in to the bridge, I’m back on board, happily singing along to the chorus. OMM do this very well. Catchy bridge that unsuspectingly grabs your attention, and a chorus that grabs you by the soul.

Mariah Carey…I just have to throw her name in here as an honor to her. She’s trying so hard, and it comes across in her music now more than ever.

Now let’s talk about the unsuspecting accidental gem that is James Davis.

James Davis got SHAFTED on NMT! I cannot believe they did not put ‘Better than You Are’ on this week’s playlist. It is hypnotic. Y’all, they��re going to be big. There’s so much talent and variety in their debut EP; soaring melodies and acoustics, beats and rhythm that are so smooth and speak to their family dynamic. They are a collaborative force. Each one of the trio has a a distinct and raw voice in their music, and they make it work impeccably. This is the only one Becs and I can wholeheartedly mutually agree on. Check out their mesmerizing live performance of ‘Better than You Are’. Fucking hypnotic.

Next week, I hope they put a hipster back in charge of NMT.
