Wip Wednesday: Insult to Injury - Chapter VII
a/n: Chapter VII is very close to being done, hope to get there by the end of the month!
The broad man kept one hand in his coat pocket, in Safin’s line of sight. “Do you have the time?”
“James Bond,” said Safin. “Universal Exports.” The man wasn’t as amicable as he had been a moment ago. No doubt he was used to leading the conversations on the back of charisma alone. “You still work for the English?”
“For Queen and country. Beats a desk job.” 007 studied him. “Zahov, isn it?”
Safin exhaled in a plume of steam. “Our business was settled.”
“We were never formally introduced,” 007 said. “I thought this would be prudent.”

I honestly do not care that Paapa Essiedu is the new Snape; I did not like the first movies with Alan Rickman (and I usually love Alan Rickman, but not even he could make me like those movies), I don't plan on watching the new show simply because I don't want to contribute to JKR's anti-trans campaign but I don't resent any of the cast or crew for their role in it. We all have to do what we do to put food on the table, I'm not going to judge. I've got no horse in this race. Paapa Essiedu is a new Snape for a new generation, everything changes and everything must change, and I am unbothered by the continuing march of time or my own inevitable impending old age and death. What I am bothered by is some of the racist things I've been seeing.
So, I recently saw a racist post deriding Paapa Essiedu's casting as Snape as "DEI." This post, like so many Trump-Toe-Sucking Conservative thought-pieces on DEI, clearly has no idea what DEI is. So, let me explain!
First off, I am an American. Secondly, I am an American from the Deep South, specifically in an area where the population is about 60% African American, 30% white, and 10% Asian, Native, and mixed, and yet the majority of our government, school board administration, managers, etc etc are white. Now, logic states that if everyone has the same equal opportunities and 60% of our population is African American then 60% of leadership positions should be filled by Africans Americans! Except this is an area where the Good Ol' Boy system is alive and well in the year of our Lord 2025. DEI is very important for areas of the US where I'm from.
For those who don't know, DEI stands for "Diversity, Equity, and Inclusion" and sort of arose from Affirmative Action that began in the 70s. Now, let's have an example of what DEI is that I can actually pull from my own experiences: if, say, you have a business where about 50% of your employees are black women and your HR department consists of nothing but white men, there are going to be some problems simply because these white men are not going to know or understand some of the difficulties that their black female employees are going through. And I'm not even referring just to the racism, sexism, and micro-aggressions (like only asking the women to wash your coffee cups, ERIC) they have to put up (though that as well), I'm also talking about the health of your employees that may affect their jobs, like sickle cell anemia and the higher rate of maternal death in childbirth for black women. They're going to need to be supported when they're symptoms flare up or when they get pregnant. Doesn't it make sense to hire a black woman on the HR department to help bridge the gap between management and a significant portion (half!) of your employees? And just because an HR department might have a preference for hiring a black woman in this case does not mean she would be any less qualified than a white man who applies. Qualifications always come first, regardless. If she got hired, she got hired because she was qualified for the job.
The times I saw where this was not the case and the person was unqualified? Either management just didn't have any clue what they were doing and hardly anybody was qualified, regardless of race, gender, sexual orientation, whatever, OR they were hired specifically because they were unqualified so that management could fire them and go, "See! See! DEI didn't work, now I can hire a white man." Kind of like how major companies only hire a woman CEO when they company is on the brink of disaster.
None of this applies to actors because the nature of the business is so directly tied to looks. In fact, Disney can get away with dictating the way their employees look more than any other company because they don't call them employees; they are cast members. The fact that HBO hired Paapa Essiedu means that they wanted to hire him, not because they were forced to by some shadowy leftist conspiracy of pink-haired lesbian feminists forcing "DEI" on them, or whatever conservatives think DEI is. It is their production company, they have the freedom and right to hire whoever they want.

Reaper is the protagonist and one of the main characters of Souls of Black (on AO3 now! :D)

₪【 - BIOGRAPHY - 】₪
Reaper is an untrusting soul, taking the route of the dangerous travel through stormbursts and between Biomes due to not feeling at home quite anywhere, especially not in The Dark Forest with its higher monster rates and raider crew attacks. She's made somewhat of a hobby out of the thrill of crossing stormbursts, studying the Biomes and monsters of the world she was Awakened in, and stealing from passing towns and villages. However, she is not entirely heartless, and has done small acts of kindness for those in need of help in the past. However, it usually ends with her leaving shortly after, and her help only comes if she can afford to survive it.
Social Status: Drifter; a person who is socially unattached to civilization and traverses the world.
Beliefs: Reaper isn't a religious person, and holds the beliefs that The Black isn't something to be worshipped, and The Paradigms are just things people have always used to justify their terrible actions, scoffing at anyone who even mentions them. She personally sees religion as a farce, and a way for those in power to control and manipulate the masses. And thus, she wants no part in it.

Reaper is an odd sight for a thief, mainly due to her golden coat that sparkles in any light. Despite it, though, she manages to hide usually well. Reaper typically gives off a dangerous yet in control vibe to others, due to her sharp coat, put-together rugged outfit, and mysterious black bandana. However, her unkempt hair and sarcastic attitude typically shows off her sense of recklessness and unpredictability.
₪【 - PERSONALITY - 】₪
As stated before, Reaper doesn't typically trust anybody, going at the world alone with only herself for comfort. Despite it and her knowledge of how trust leads to demise, she finds herself aching to help those less fortunate and in immediate need, unable to walk away. She is partially annoyed by it, but rationalizes that it's the only thing keeping her from being heartless like everyone else.
Reaper also has a soft spot for scholarship, journaling and sketching in a notebook her studies and finds of the Biomes she's visited, and the world's creatures and elements. She often finds herself wishing to take notes or share them, when it would not be a wise time to do so.
Reaper prides herself on her fighting skills, owning an iron saber prioritized for hacking and slashing through opponents. Her fighting style is often a fluid one, rarely stopping as she moves from one opponent to the next. Coupled with it is her odd Sense ability, active since the day she Awakened, which shows her threats seconds before they strike her, allowing her to parry or dodge them before becoming injured.

Reaper's least favorite monsters are spiders. They make her skin crawl, being three feet tall and four feet wide.
Reaper knows three languages from her travels:
₪ Her main language is Dridonic, the continental language, and she speaks it fluently.
₪ She knows a little bit of Everian, the language of the Plains Biome, mainly numbers alongside a few words. Reaper also knows important hand-signs in Everian, mostly ones for monsters, but also ones such as 'attack', 'kill', and 'run'.
₪ Reaper has also learned a bit of Hiborish, the language of the Taiga Biome.
Reaper instinctively knows where the cardinal directions are at all times.

Brief notes, and how things are going.
So from yesterday’s 20k I made it to 23.5k in like a few hours after I got to finally sit down in front of my computer. I also pumped out like two sketches, but I don’t know how comfortable I feel posting them just yet. Maybe I will with like heavy heavy watermarks because I get so nervous about posting. Regardless, I have altered a couple of designs. So far I’ve drawn most of the main(ish) cast many of them are shit doodles but I’m having fun throwing in all of my headcanons.
Back onto the actual topic though, updates may become less frequent the closer I get to finals week, but right after that I’m going all in. And I want to keep you lovely people aware of what’s going on.
These are questions I’ve gotten from friends. (as soon as I get questions in my inbox I’m answering those)
Questions and Answers!
If Sonic doesn’t reciprocate Amy’s feelings, why would he be a driving force in the narrative?
Without giving the whole story away. In my interpretation, I feel that Sonic is a very friendship oriented person. Affectionate with friends, he cares for them very very deeply, but that’s where it stops. He knows Amy likes him, but he doesn’t want to hurt her feelings and mess up the relationship they have. She’s a great friend and a good person, he’s just unaware of the struggles she experiences having this one sided affection. It’s more so his impact than his actions themselves. He’s well meaning.
You mentioned Knuxouge, are they in an established relationship?
Technically yes, but no one talks about it, it’s more of a known fact. Literally no one has to ask. (They’re practically already married guys /j)
How many people get a POV? Is it just a select few? Or does it depend on what you need.
Mainly we have Amy and Shadow, their POVs are the most important, sometimes I think it’s better not to know the exact internal thoughts of the other party. With Amy being an emotional thinker and Shadow being more of an observant thinker, they both look at the same situation differently.On the other hand, I think it’s important to see the two of them from an outside perspective where you can view them entirely differently.
For example, I wasn’t expecting Tails to have that big of a role in my narrative, but he shows up a lot. I gave him a POV as well, and I think it works! I just finished writing a section from Sonic’s POV as well, and there are things he simply doesn’t notice that others might. It all depends on my needs.
Is this your first fanfiction? Are you a big writer?
While no it’s not my first fanfiction, the only other fanfics I’ve written were like 3 on wattpad and those were super short 2000-3000 word oneshots. This is the first fanfiction I’ve written in years. It’s pretty simple. I have a vivid imagination so I try not to harp on details that could derail the momentum of my fic
Is Shadamy your favorite ship?
Oh ABSOLUTELY! But it’s not the only one I like. I’m a multi shipper and think everyone’s opinions are valid on if they like these two or not. I think they’d be healthy.
What would the age rating be?
For what it’s worth, I don’t plan on writing anything explicit, it’s for sure meant for an older 13+ audience, but that’s mostly for Rouge being suggestive in dialogue. Nothing crazy, I don’t typically write the spicier stuff.

PROCESSING QAF POST 3/?
To me, season 4 was totally bearable, because I understood what the writers were aiming for, and simply squinted while I watched and revised in real time. Season 5 was beyond the pale.
An English professor once advised letting current emotion into writing even if it’s not related to the story, that passion can bleed through and you might be able to use it. Speaking ENTIRELY as an armchair psychologist here, I think this season was written with some real…displeasure on the part of the writers, and that was felt by the audience instead of being edited in a more constructive way.
I have done some googling, and this could be true and they were angry at the audience and/or cast and/or state of the world. Or, fans from 20 years ago were just coping like I am today.
However! Please allow me to present some ideas for what they could have done with their plotlines instead of (what I feel like) was repeating plotlines and throwing things at the wall. Angrily. Plenty of these ideas honor what the writers already created or even kinda got at during S5 itself.
This is very Britin oriented, because thinking about The Girls or Em truly sends me into a tizzy from which I cannot articulate useful ideas.
These ideas are rooted in my belief that S5 dropped the thematic ball that they had been steadily building, mostly with Brian, as referenced HERE.
These are pretty broad strokes, will maybe do a more structured/detailed rewriter vision later, with textual evidence.
First big point is if B/J stay together. Honestly, them splitting is a good move on the producers/advertisers side, because shows lose ratings when the main couple  stays together. However, advertising means nothing to the story quality. Let’s discuss both!
Either way, I wouldn’t want any of this to be about monogamy. Like I’ve said, I always thought monogamy was just the stand-in issue in Brian’s life for his deeper inner issues. 
If they break up:
Maybe the dust-up is Justin comes back from Hollywood and Brian is like live with me and let me pay for school again and Justin is like I’m a man now I have to figure this (living situation, no job and no education) out on my own I love you but I need to grow up.
Idk. Not married to that at all.
Then Brian is so hurt that Justin didn’t move in he blows up at the gang at a party and they cold shoulder him. Again, spitballing. Not attached to the idea for the inciting incident! 
For Justin:
Honestly have put less thought into tangible actions and motivations for Justin. That analysis requires more effort because the writers treated him as a plotpoint and mouthpiece instead of a character in S5 so I would need to give some deep thought to how to fix him, and I have only given that to Brian so far. But here’s what I think off the top of my head!
After this start of season dust-up, Justin is living on his own and he’s really processing all of the failed illusions of being an artist. We saw PIFA not go well for Justin. We saw Justin fired from Vangaurd. We saw Ethan have to sell out to be a successful artist. We see the Rage project being shut down for staying true to the source.
All of these are different disappointments with the reality of being a working creative that Justin could’ve been processing as a disillusionment of his love with art. And throughout the season, as he’s determined to make it on his own for the first time, we could see him being sort of resigned to a fate of having a typical day job. Being lucky if it’s in graphic design and maybe doing art as a hobby on the side.
And then I think the Jennifer and Tucker storyline could be really, really integrated into this. I think she could be the one to pull him out of this and say “When I was your age, I loved art but I got married to your father, started having children, and gave my passions up for a safe life. And now I’m a single mom, living on my own dating a hot younger man, and it’s scary and it’s hard and I get judged for it, but I’m finally living the life that I always wanted. I encourage you to do this dangerous thing of being an artist and yes, it’s going to keep being hard but you can do it.” 
And we see this rebirth of Justin as someone who is still incredibly optimistic - he just now has a more mature framework for that trait.
I could see this happening if there’s no B/J breakup to start the season as well, and he’s simply not letting Brian pay for things within their relationship, or something to that effect. Which!! I hope to later discuss their gendered roles and Brian’s internalized homophobia and patriarchal ideals 
For Brian:
Meanwhile, I think Brian line for season five it was actually really well set up for the writers. They just didn’t follow-through! We see in season three just Brian loses one of his most treasured assests: his wealth and career, but he still has his friends. In season four he loses his other most treasured status :His virility, but he still has his loved ones.
I would like season five to have him still be vivacious and for Kinnetik to be as successful as possible, but he no longer has his loved ones around him because of whatever happened at the start of the season (if we go with the breakup).
Brian realizes that his career and his body are not as important to him as his relationships. Or at least is forced to admit the three are equal. And we see him start to really evaluate why he is the way he is. I would love for him to dive deep into his childhood, confront his demons, and end the series by making some decisions for his adult self and not based on childhood trauma..
And then he reflects, reevaluates, and reintegrates everyone into his life through a new lens. This is really about him admitting to accepting and embracing the fact that the people around him deeply matter. Accept Debbie as a mother, Michael as a brother Gus as his son, Lindsay and Mel as dear friends and coparent, etc.
I fully acknowledge these were touched on – but he was still mostly given Justin/monogamy plotlines and emotions which I disagree with
SPECICALLY this could look like
Letting him throw down with Debbie? Because Debbie was his pseudo mom, but she always put Michael first. Which isn’t wrong, he was her actual son, but I could see Brian maybe projecting on her, or maybe pushing her away, or maybe just really re-integrating his role in her life and vice versa. That could have had some drama (for the ratings) since she’s such a fiery character. This could also be the inciting incident if B/J don’t break up.
If his second nephew came out as gay and ran away from Claire to be with his Uncle Brian, that could have mirrored season 1 with Justin, and show how he’s grown and learned since then, and forced him to confront his family history and baggage, stop generational trauma, and allow him to prevail over the ghosts of his upbringing, giving him and the audience a sense of positive closure.
And if it was the first nephew, the same nephew who falsely accused him of molestation, that could be some serious tension, and it could further the Justin S1 mirror by also showing a better version of Chris Hobbs –  a sort of what if Chris Hobbs had admitted he was gay and tried to atone instead of turning violent? 
Lots of full circles!
AND that could have sparked a fight between Brian and Michael as they disagree over dealing with their troublesome teenage runaways, if the writers wanted B/M drama. This could be wrapped into the Debbie drama?
I think having the nephew come, his own demons from his past, him fight with Debbie, then the nephew arc closes out and with this encouragement from his mentor trial period, (and having processed and moved on from his childhood abuse),  he realizes that he wants to be more involved with Gus. He then tries and fails and eventually figures out what kind of father he wants to be, and what kind of co-parent he and Mel/Linds are (God what I would do to have more Brian and Mel scenes), he and Debbie reconcile, and he has an active friendship with Ted, would have been beautiful relationships, excellent tying up, none of it focused on romance and all of it not promoting the nuclear family. I say that because the writers said they wanted to not focus on happy romantic endings, but also focused their show on Britin…so….
I also think this is where you could integrate some of attempting to be monogamous plot lines from the end of season five. Again, I wrote about what I think about that in another post, but without reflecting on that, let’s just use these elements that the writers came up with and obviously wanted.
I think he could’ve been the stereotypical father to Gus when he starts to be a part of his life. He’s teaching him to play ball. He’s starting to be strict with rules. It’s just kind of funny scenes. Likewise, he does the same with Ted - he embraces the fact that Ted is his friend, and he starts being kind and sympathetic, and not a bitch to him.
And in all of these situations he would hear from Lindsey and Ted to just be who he is. They love him. They just want him around. He doesn’t have to be a textbook Father and Friend. And I think that would greatly heal his inner child wound which again is something I’ve talked about elsewhere and as I think the big issue with Brian. But if he is able to accept his life and accept him the way he is, I think that could be a lot of his plot for this season.
I just don’t get why they didn’t allow exploration in his already pre-existing, non-traditional, non-romantic relationships. Good for his character, closure for the audience, gives plenty of conflict, allegedly what the writers wanted to get across with the ending…
 
Being separated from Justin or not, this could work.
And then, at the end of the season,
The two of them have separately reached their thesis statements of who they are. They can face each other, and these will be two characters who saw the potential in one another from the beginning when no one else did, pushed each other to potential throughout the show, and they have themselves embraced that for their own sakes, and they can choose each other for the next chapter of their lives.
Even, dare I say, (and this would be a controversial!) but I think viewers would be more open to them having a thank you for making me who I am, goodbye forever talk if we got that whole season of seeing them make that final big push in their maturation arcs. 
Or it could still be Justin going to New York, but instead of it feeling like this bittersweet hopefully they stay together, instead it’s they’ve reaffirmed their love to one another and are very confidently moving into this next chapter. I think this would change the tone of the ending to be, all these seasons have been the bildungsroman and now we are at a place to really takeoff into the future because our foundation is now so secure.
We could even have another “rules” discussion - but this time it’s like “you won’t pay for anything for me for the next three years.” “You’ll tell me when you start to fall in love for the one millionth time for some out of work actor” “you will say when you’re angry instead of ignoring my calls. You don’t have to say anything else.just don’t ignore me. Tell me. “
Shit like that. Because those were their real problems - not monogamy. Not married to that idea either - it could be way too much telling now showing or it could be a good throwback to their first rules agreement.

I May Be a Guild Receptionist But I'll Solo Any Boss to Clock Out on Time

Era: 2020s
Rating: C
Plot: Alina Clover is the receptionist for the local adventurer's guild, mostly because it's a steady job with good benefits. However, because heroes aren't often the smartest or nicest in the bunch and take a long time to beat bosses, that leads to a lot of unpaid overtime to process all the paperwork. That's when she becomes The Executioner, a powerful character that solos bosses and allow some peace and quiet in her dayjob, but doing it secretly because she is not allowed to have other jobs.
Length: 12 episodes
Thoughts: Well, don't know about bosses, but the title really beat my formatting. A fun concept, very videogame coded and a very late pick for this season, it ended up being a somewhat disappointing watch. It's pretty bad how often I hit around half of the battle-focused parts of episodes and I'm wishing it ends because the ED is catchy and more amusing that whatever is on screen. I'm hardly a big fantasy fan, regardless of medium, and it needs something to hook me in - something like Frieren has the "well, what happens now" post endgame vibe, Sleepy Princess in the Demon Castle has a gremlin of a main character, this would have the idea the main character is actually hiding as an NPC that only exists to give quests to heroes, and she can pretty much wipe the floor with all of them, but prefers the stability of her job, and that would be perfect if only those heroes didn't leave so much paperwork behind and suck so much at their job.
While the action isn't bad and it avoids dragging fights for too long, I've found the show loses a lot of charm when it becomes less of "office clerk pissed at having to do unpaid overtime so she goes beast mode on the enemies because the heroes suck" (that's more or less the name of the show already) and more "boss fight". I don't think it can be both, and ditching the whole "secret job" with "well she's too useful so let's keep it under wraps because there's some bad stuff brewing" so soon was kinda boring and closed down avenues to what could make it really good, as the show is at it's best and more unique with the characters hunched over stacks of unfinished documents. Or, even forgetting the ruse, it proves it can do that; episode 9, where Alina sneaks in the new receptionist orientation because it's being given by a legend of her field, and she hopes she can hear from her the secret to not do overtime (which is becoming a fully dedicated workaholic, to her dismay), and her activities as the Executioner as just a small part of the story, and the episode feels fuller this way. It does that every so often, but other times (like when Alina finally gets to experience the festival), still needs to pack another top level boss at the end and heeeeeeh boring. Overall, it's a more unique show when there's less Dark Gods and more troublesome heroes who can't clear the new quest dungeon and poor Alina has to stay past closing time processing documents until she snaps and very reluctantly decides to do it herself.
It's not a bad time, but I feel it's one of those shows I take nothing from, and I'll forget everything about it by next month because of how generic it turned out. If you aren't that confident in the concept, just what's the point of it, then? Another "save the world" fantasy adventure with gaming references? Disappointing.
Recommended to: fantasy fans.
Plus:
It looks fairly decent, either in action or slice of life modes.
Fun concept...
Minus:
...almost immediately discarded in favour of being BIG FANTASY SHONEN ADVENTURE.

Less than a year after the Biden administration proposed forgiving up to $10,000 in federal student loan debt for most borrowers, the Supreme Court ruled the policy unconstitutional. At the core of the case was whether the HEROES Act of 2003 granted the Secretary of Education the authority to “waive or modify” federal student loan terms, up to and including forgiving those loans. The Court ruled in a 6-3 decision that broad forgiveness was beyond the scope of what Congress intended when passing the HEROES Act, further arguing in the majority decision that policies with such a large economic and political impact should be decided through Congress, and not executive action.
In the wake of that decision, the Biden administration has shifted policy toward improving the borrowing process as well as the repayment process. Political attention has focused on repayment (from the Biden administration’s attempts at loan forgiveness to Republican-sponsored legislation proposing new repayment structures) but must also turn to reforming how students decide whether and how much to borrow to ensure future students do not face unmanageable student loan debt.
Short-term policies around loan repayment
With widespread student loan forgiveness struck down by the Supreme Court, the Department of Education (ED) is moving forward on two repayment-oriented efforts. First, the Department has been implementing targeted student loan forgiveness under existing programs. In one recent move, ED announced they had reviewed old income-driven repayment accounts to ensure borrowers received accurate credit for prior monthly payments — as a result about 800,000 borrowers had the rest of their loans forgiven.
The Department is also working to expand student loan forgiveness for students who attended fraudulent universities. In some cases, the administration has automatically forgiven loans for students attending colleges that misrepresented its graduates’ employment rates or that lied about their program accreditation when recruiting prospective students. The administration is also launching a “borrowers defense” application on July 30 where borrowers can make claims against their colleges engaging in misbehavior and request loan forgiveness.
Second, the Biden administration announced the details of their new income-driven repayment plan, with some elements going into effect prior to when student loan repayments restart later this year. The new Saving on a Valuable Education (‘SAVE”) plan will replace REPAYE (an existing income-driven repayment plan) and will automatically transfer borrowers on REPAYE to the new SAVE terms.
The key short-term changes include exempting a higher threshold of income and limiting interest accrual. Borrowers’ monthly payment is calculated off their discretionary income, which has to-date been any income above 150% of the poverty line. Under SAVE, that will be any income above 225% of the poverty line. For a household of four, that means an additional $22,500 of income is protected against consideration when calculating monthly payments. Further, starting this summer if borrowers’ payments don’t cover the interest accrued that month, that interest won’t be charged. Interest accumulation has been a key driver of why some borrowers owe more on their loans four years after graduation than their original balance. While other elements of the plan, such as reducing the years borrowers have to pay before forgiveness, won’t go into effect until next summer, many have argued the new repayment plan is so generous it amounts to a new loan forgiveness program.
Pre-pandemic, the Congressional Budget Office estimated that ED loses 16.9 cents on the dollar for loans in income-driven repayment plans (as opposed to the 12.8 cents on the dollar they gain from loans repaid in standard plans). In its initial review of the Biden administration’s proposed income-driven repayment plan, CBO estimated the program would cost about $230 billion over the next decade, though will update that estimate as the details of the program get finalized.
Challenges restarting payments
Millions of borrowers have had their student loan payments on pause since March 2020, but a provision in recent debt ceiling negotiations stipulated that the pause must end this year and payments will resume this fall. One analysis estimates about 16% of borrowers could be unprepared to make their student loan payment, recommending ED double-down on enrolling borrowers in existing income-driven repayment plans and calls on states and employers to provide assistance navigating loan repayment.
At the federal level, the Biden administration announced that borrowers would not face any negative credit consequence of non-payment until September 30, 2024 during a repayment “on ramp” period. While this action will help borrowers avoid default, it is incumbent on the administration to clearly communicate to borrowers that interest will still accumulate on their loans, so borrowers aren’t surprised by increasing debt balances.
Widespread loan forgiveness: Negotiated rulemaking
The administration has not stopped pursuing widespread student loan forgiveness. But these actions must be taken through the authority granted to the Secretary of Education under the Higher Education Act (HEA). The administration now turns to a long, complicated process called “negotiated rulemaking,” (commonly abbreviated as “neg reg” or “reg neg”) to advance student loan forgiveness.
This Brookings explainer details the negotiated rulemaking process from 2021 when ED convened a committee around student loan forgiveness rulemaking. At a high level, ED must craft a negotiating committee, which will hold hearings and vote on proposed actions, and then ED will propose rules based on committee consensus. These phases can take a long time — but ED is moving quickly and the 2023-24 negotiated rulemaking process is already underway.
There are two key timing considerations for implementation. ED must propose rules by November 1 for them to go into effect by the following July — meaning the Department will likely announce final rules on student loan forgiveness just days before the November 2024 presidential election, raising the stakes on implementation. A new presidential administration could potentially pause implementation and move to formally rescind a federal rule, as former Secretary of Education Betsy DeVos did in 2019 when she rescinded a “gainful employment” rule regulating career programs’ eligibility for federal financial aid that had been passed under the Obama administration.
There’s another date to consider — the end of 2025. Most types of student loan forgiveness are subject to taxation, but the American Rescue Plan has a provision that federal student loan discharges are not subject to federal taxation through December 31, 2025 (and most, though not all, states have followed suit). This deadline makes it even more pressing for borrowers that neg-reg rules get submitted by November 2024 so they can be implemented in the second half of 2025 before the tax exemption expires.
Legal challenges ahead?
Federal rulemaking is subject to judicial review, and whatever rules emerge from the current neg-reg process will almost certainly face legal challenge. However, based on the Administrative Procedural Act, those challenges will be unlikely to come until late 2024 once there has been “final agency action” (e.g., when the final rule is posted). Of course, a legal challenge to one rule does not preclude another attempt from an agency. When the Obama administration was crafting gainful employment regulations, their first proposal was struck down, after which they changed the metrics they would use to evaluate colleges and proposed a new rule that was upheld against legal challenges. This may be the first of multiple rulemaking processes around student loan forgiveness and how to best structure loan repayment.
