INDIANAPOLIS (AP) — Indiana’s Republican attorney general on Wednesday asked the state medical licensing board to discipline an Indianapolis doctor who has spoken publicly about providing an abortion to a 10-year-old rape victim who traveled from Ohio after its more-restrictive abortion law took effect.
The complaint alleges Dr. Caitlin Bernard violated state law by not reporting the girl’s child abuse to Indiana authorities and violated patient privacy laws by telling a newspaper reporter about the girl’s treatment.
That account sparked a national political uproar in the weeks after the U.S. Supreme Court overturned Roe v. Wade in June, with some news outlets and Republican politicians falsely suggesting Bernard fabricated the story and President Joe Biden nearly shouting his outrage over the case during a White House event.
Bernard and her lawyers maintain the girl’s abuse had already been reported to Ohio police and child protective services officials before the doctor ever saw the child. A 27-year-old man has been charged in Columbus, Ohio, with raping the girl.
Bernard’s lawyers argue Indiana Attorney General Todd Rokita, who is stridently anti-abortion, has been spreading false or misleading information about the doctor with his investigation allegations for several months.
The attorney general’s complaint asked the licensing board to impose “appropriate disciplinary action” but doesn’t specify a requested penalty.
“Dr. Bernard violated the law, her patient’s trust, and the standards for the medical profession when she disclosed her patient’s abuse, medical issues, and medical treatment to a reporter at an abortion rights rally to further her political agenda,” the office said in a statement. “Simply concealing the patient’s name falls far short of her legal and ethical duties here.”
Bernard’s lawyers didn’t immediately reply to a request for comment on the licensing complaint.
The attorney general’s office filed the action as an Indianapolis judge considers whether to block the attorney general’s office from trying to obtain patient medical records for its investigation. The judge’s ruling is expected later this week.
Bernard treated the girl in Indianapolis in late June, as she said doctors determined the girl was unable to have an abortion in neighboring Ohio. That’s because Ohio’s “fetal heartbeat” law took effect with the Supreme Court’s June 24 decision. Such laws ban abortions from the time cardiac activity can be detected in an embryo, which is typically around the sixth week of pregnancy, before many realize they are pregnant.
Deputy Attorney General Caryn Nieman-Szyper said during a court hearing last week that Bernard wouldn’t be under investigation if she had not disclosed the girl’s rape to a reporter to advance her own advocacy of abortion rights. Nieman-Szyper said Bernard had not shown she had permission from the girl’s family to discuss her care in public, exposing the child to national attention.
Bernard testified that she spoke with an Indianapolis Star reporter about the girl’s impending abortion at an event protesting the Supreme Court’s abortion decision.
After the newspaper cited that case in a July 1 article about patients heading to Indiana for abortions because of more restrictive laws elsewhere, Rokita told Fox News that he would investigate Bernard’s actions, calling her an “abortion activist acting as a doctor.”
Rokita has kept the investigation going even after rape charges were filed in Ohio and public records obtained by The Associated Press show Bernard met Indiana’s required three-day reporting period for an abortion performed on a girl younger than 16.

CIRCLEVILLE, Ohio (AP) — As Jadarrius Rose drove his 18-wheeler through rural Ohio, a simple missing mudflap caught the highway patrol’s eye. The trip ended with a police dog’s powerful jaws clamping down on Rose even as he tried to surrender.As he stood with his hands up beside the highway on July 4, at least six law enforcement officers surrounded him at a distance, one calling forcefully to the K-9 handler: “Do not release the dog," highway patrol video shows.Nevertheless, a Belgian Malinois is seen on the video either breaking free or being set loose. At first, the animal seems confused, racing past Rose toward officers at the far end of the truck, then turning back and running for Rose, then 23.By then the trucker is on his knees, hands still high, as an officer shouts, “Get the dog off of him!”That day, Rose joined a long list of Black Americans attacked by police dogs, a history well documented by journalists, academics and filmmakers. Investigations into such cases have been launched regularly in recent years. For some, the scenes harken back to the Civil Rights Movement, when authorities often turned dogs and firehoses on peaceful Black protesters marching for equality.The Associated Press captured one such attack in a photograph from Birmingham, Alabama, taken in the spring of 1963. It shows two police officers setting a pair of K-9s on 15-year-old Walter Gadsden. One of the dogs lunges straight for the teenager’s belly as the other strains against his leash, panting.Over the past five years, controversial police K-9 attacks have made headlines across the U.S.Records reviewed by the AP in 2018 showed the Ohio State Highway Patrol used drug dogs in 28% of its stops involving Black motorists from 2013 through 2017, although the Black population accounts for only about 11.5% of people old enough to have a driver’s permit or license in the state.The Salt Lake City police department suspended its dog apprehension program in 2020 after a Black man was bitten and an audit found 27 dog bite cases during the previous two years.The FBI opened an investigation into the police department in Woodson Terrace, Missouri, in 2021 after cellphone video showed three officers allowing a dog to repeatedly bite a Black man. And in 2020, a Black man in Lafayette, Indiana, was placed in a medically induced coma after police dogs mauled him as he was arrested in a battery case.A TROUBLED HISTORYCircleville, located about 25 miles (40 km) south of Columbus, Ohio, resembles many rural towns across the country. The city's downtown is filled with restaurants, law offices and a bakery. Flags honoring fallen servicemen and women hang from lampposts lining Main Street.While the picture may be idyllic to some of the town’s 14,000 residents, the Rev. Derrick Holmes, longtime leader of the Second Baptist Church, said Black and white residents describe their lives very differently.“Everyone doesn’t have the same experience, even though they’re all in the same town,” Holmes said. “And I think those divisions exist around the realities of bigotry, the realities of racism.”At church services the day after the video of Rose’s arrest aired, Holmes said the congregation was appalled, but not entirely surprised.“People were horrified by it,” he said. “Angered by it. Frustrated by it. And also there was a feeling of, ‘Well, here we go again.’”This isn’t the first time Circleville police have grappled with uncomfortable questions about how they train and use police dogs. Nearly 20 years ago, a founder of the K-9 unit sued the department after he was fired for insubordination. Officer David Haynes had publicly opposed cutting training hours for dogs and their handlers to 172 hours annually from 500 hours, according to court documents.Haynes warned in a 2003 memo that “words like ‘deliberate indifference,’ ‘negligence’ and ‘failure to train’ will someday be brought up.”Today, Circleville’s K-9s train 16 hours per month, or 192 hours a year, according to the department.

Circleville Police were there to assist.What happened next can be pieced together from law enforcement video and the incident report.Rose initially didn't stop as police pursued him. When he did, he saw officers with their guns drawn and took off again. At some point, he called 911 and told a dispatcher he feared the officers were “trying to kill” him. After pulling over a second time, he delayed getting out of the truck and did not immediately get on the ground as instructed.He initially was charged with a felony for failing to comply with officers, but prosecutors dropped the case. Online court documents show Rose was charged Sept. 26 with a misdemeanor version of the offense and there is an active warrant for his arrest.Neither Rose nor his attorney responded to repeated messages seeking comment.It’s not clear why a K-9 unit was at the scene that day. Michael Gould, a former New York City police officer and founding member of the NYPD’s K-9 unit, said officers appeared to have control once they surrounded Rose with their guns drawn. And then there’s the image of Rose with his hands up.“He was compliant and not a threat to anyone,” Gould said.Rose required hospital care for the bites he suffered. Whether he sustained lasting injury is unclear.The dog’s police handler, Officer Ryan Speakman, was fired, but the Ohio Patrolman’s Benevolent Association filed a grievance on his behalf arguing the officer was fired without just cause.Circleville City Councilwoman Caryn Koch-Esterline said police have yet to account for what happened.“I’m just waiting for all the information to come out,” she said in a brief interview with the AP three months after Rose’s arrest.For those working to improve race relations in Ohio, the roadside attack was a reminder of all that is still left to do.“If it were a white man and a dog was unleashed on that individual, what would that community be saying? With ambition and anticipation, Summit Motorsports Park in Norwalk, Ohio staged its Inaugural Ken Ganley Chrysler Dodge Jeep Ram World of Mopar presented by Arrington Performance, Sept. 22-24, 2023 and by all accounts, it was an extraordinary event. Produced and presented by Summit Motorsports Park with Mopar enthusiasts in mind, it featured three days of racing, a Fun Field Car Show, swap meet, car corral, manufacturers’ midway, concert by Trainwreck Country Band and fireworks. “We couldn’t be happier with our Inaugural Ken Ganley Chrysler Dodge Jeep Ram World of Mopar presented by Arrington Performance,” said Bill Bader Jr., president of Summit Motorsports Park. “Our team spent several months organizing this event, and we all wanted it to be successful, and we are all very grateful that it was. We had a tremendous turnout, and we look forward to an even bigger event next year. The planning starts now.” On Friday, Sept. 22, 2023, the final round of eliminations in Indy Cylinder Head No Box saw Ron Hicks of Leo, Indiana, rip off a .001 reaction time and race to a 12.45 to defeat Cory Blackford of Toledo, Ohio, who stopped the clocks at 9.89. In Box, Randy Chestnut recorded a .007 on the tree and took the win with a 6.13 over Keith Meador, who went through the traps at 6.16. On Saturday, Sept. 23, 2023, the final round of eliminations in Koffel’s Place Super Pro put the spotlight on Gene Nagy of Pittsburgh, Pennsylvania and Cliff Motes of Logan, West Virginia. They inched into the beams before blasting off, and Nagy came out on top with a 4.70 to Motes’ 6.59. In CRT Transmissions Pro, Marcus King of Republic, Ohio and Mike Walwood of Parma, Ohio motored up to the starting line, and King secured the win with a 9.60 elapsed time to Walwood’s 9.85. AA Transmission Hemi Super Stock saw Bob Marshall of Columbus, Ohio and Ron Gallagher of Whitby, Ontario, turn on their red lights, and Marshall won as his light was a bit less red than Gallagher’s. In Mancini Racing Nostalgia Super Stock, Doug Wright of Waterford, Michigan and Mike DeChicco of Ostrander, Ohio put dial-ins on their classic cars before Wright wrapped up the win with a 9.43 to DeChicco’s 11.46. Dan Trainer of Orient, Ohio and Dan Brewer of West Milton, Ohio took the stage for the TTI Exhaust Sportsman final round of eliminations, and Trainer wrapped up the win when Brewer illuminated the red light, with a mere -.005, at the hit. On Sunday, Sept. 24, 2023, the final round of eliminations in FireCore 50 Top Gun Full-Bodied saw Jeff Goebel of Stratford, Ontario, flat-foot the pedal on his Duster to a 4.39 for the win over Chris Wheatcraft of Jamestown, Ohio, who clocked a 4.84 in his Demon. In FireCore 50 Top Gun Open-Bodied, Bryan Keller cruised to a 3.70 to earn his trip to the Summit Motorsports Park Winner’s Circle over Keith McLennan, who was .004 at the hit but had to get out of the throttle. Unfortunately, a continuous mist on Sunday evening caused the remaining rounds for other categories to be cancelled.  As an added element to the event, Manufacturers’ Choice Car Show Awards were given during a ceremony on the starting line.
