In a unanimous decision on Saturday, the three-man Appeal Court panel upheld the victory of Otti at the polls, saying that it conformed with the provisions of the Electoral Act. The appellate court ruled that petitions brought by the appellants lacked in merit, as they were like “a comedy skit brought to a democratic setting”. The court said issues of political party membership is a pre-election matter, which also falls within the jurisdiction of the political party. It further said since Otti joined the Labour Party, won its primary election and submitted his name to the Independent National Electoral Commission (INEC), he was qualified to contest. On the issues of Bimodial Voter Accreditation System, BVAS, brought by the PDP and its candidate, the appeal court said the appellants failed to demonstrate or link their documentary evidence to the specific parts of the case. Tribunal: Former Borno deputy gov Dibal testifies for Sanwo-Olu

Former Borno State Deputy Gov. Adamu Shettima Yuguda Dibal, who chaired the last governorship primary election of the All Progressives Congress in Lagos State, on Tuesday testified before Lagos State Election Petition Tribunal. The primary election produced Mr Babajide Sanwo-Olu as the APC Governorship Candidate for the 2023 General Elections. The Peoples Democratic Party and its governorship candidate for the March 18 governorship poll are challenging Sanwo-Olu’s re-election as the state governor. Mr Bode Olanipekun (SAN), counsel to Sanwo-Olu and his Deputy, Dr Obafemi Hamzat, led Dibal in evidence. Dibal told the tribunal headed by Justice Arum Ashom that the Lagos State Chairman of the APC, Mr Cornelius Ojelabi, did not flout any electoral regulation when he notified the Lagos State Office of INEC in writing about the party’s primary election in Lagos State. During cross-examination, Mr Clement Onwuenwunor (SAN), counsel to the PDP Governorship Candidate, Mr Abdulazeez Adediran (a.k.a. Jandor), asked the witness whether Ojelabi was the national chairman of the APC as at May 24, 2022, when he wrote the letter. The witness replied in the negative. The witness told the court that it was APC’s National Working Committee (NWC) that set up state committees that conducted the primary election in all 36 states. While being cross-examined by APC counsel, Mr Babatunde Ogala (SAN), the chieftain, after being shown the said letter which had become an exhibit before the tribunal, said that Ojelabi was only informing the INEC office that the NWC had constituted a five-member committee to conduct the primary election in Lagos State and he was the Chairman. The witness, while replying to INEC’s counsel, Mr Adetunji Oyeyipo (SAN), said that representatives from INEC’s headquarters and its Lagos Office were present during the primary election and signed a report on its conduct. There was no cross-examination by counsel of the Labour Party and its Candidate, Mr Gbadebo Rhodes-Vivour. The tribunal headed by Justice Arum Ashom thereafter discharged the witness and directed the APC to open its defence on July 12. In the petition, Adediran accused the governor of presenting a forged West African School Certificate to INEC – Independent National Electoral Commission. Adediran also accused Hazmat of not including an oath declaration in his INEC Nomination Form EC9. He added that APC did not comply with the Electoral Act when nominating Sanwo-Olu and Hamzat. Falana made this call in an interview on Channels Television’s Sunday Politics. He said, the Independent National Electoral Commission (INEC) failed in its duty to conduct proper elections in the country. He said the votes of Nigerians should not be nullified by the courts because of the supposed negligence of the electoral umpire that shouldn’t have cleared candidates put forward by parties without primaries conducted. He also said thousands of votes should not be invalidated by the court because INEC officials failed to stamp ballot sheets. Falana noted that election matters should be concluded before the inauguration of any administrations. Recall the appellate court sacked three governors that INEC declared as winners in the March 2023 poll. All the three governors sacked by the appellate court are in opposition parties. The court sacked Yusuf of the New Nigerian Peoples Party (NNPP) and declared his All Progressives Congress (APC) counterpart, Nasir Gawuna, as the winner of the poll. In Zamfara, the appellate court sacked Governor Dauda Lawal of the Peoples Democratic Party (PDP) when it declared the poll inconclusive about eight months after. The court ordered INEC to conduct a fresh election in three local government areas of the state. PDP’s Lawal and APC’s Bello Matawalle are the major contenders in the race. On Sunday, the appellate court sacked PDP’s Mutfwang and ordered INEC to issue a Certificate of Return to APC’s Nentawe Goshwe. The court held that the party violated the court order that a valid congress be conducted in the 17 local government areas of that state. But, speaking on the judgements of the appellate court, Falana said INEC failed to perform due diligence before and during the elections. He said all those dissatisfied with the appeal court verdicts can go to the Supreme Court. “If you look at what happened in Lagos is different from what happened in Plateau. You are being told in Plateau that there was a judgement of the high court to the effect that primaries have to be conducted. The judgement, as usual, was dishonoured and disobeyed and the election went on.” He said the political class must learn to comply with the decision of the court. “It is different from Kano where you are being told that voters can be punished. It is a very dangerous judicial policy to sanction voters for the mistake of electoral officers. We are being told that 165,000 votes are wasted, they are invalid because some electoral officers committed an error by not stamping them. On how that affect the validity of election, Falana said, “I do hope that this time around the Supreme Court will resolve these needless controversies surrounding the non-stamping of ballot papers by INEC officials who have not been recommended for any sanction. “This is why these judgements will have to be reviewed.”

2023 Election: G-5 Governors Fall Apart As They Endorse Different Presidential Candidate

The insinuation that the aggrieved governors of the Peoples Democratic Party, PDP, also known as G-5, may unanimously back a Southern presidential candidate has been put to rest. The G-5 comprising Governors Samuel Ortom of Benue State, Okezie Ikpeazu of Abia State, Seyi Makinde of Oyo State, Ifeanyi Ugwuanyi of Enugu State and Nyesom Wike of Rivers State had vowed not to support the PDP presidential candidate, Atiku Abubakar. The governors fell out with the former vice president following the outcome of the party’s primary election which did not favour their leader, Wike. The five governors believed that President Muhammadu Buhari’s successor should emerge from the Southern part of the country as the North has had its eight years. In the South, Mr Peter Obi of the Labour Party and Asiwaju Bola Tinubu of the ruling All Progressives Congress, APC are the major contenders for the nation’s top job. On December 29, 2022, reports emerged that the former Lagos governor met with the G-5 at his London residence where they allegedly struck an endorsement deal. It was subsequently gathered that the aggrieved governors could not settle for a particular candidate during their visit to the United Kingdom. However, it was reported that the governors have opted to support different candidates. According to sources, Governor Wike and his Oyo State counterpart, Makinde have resolved to work for Bola Tinubu of the ruling party. Recall that Tinubu on Tuesday, Feb. 14, met with Wike who was reported to have pitched his tent with the APC candidate for the coming poll. Although he is yet to publicly declare Tinubu as his candidate, Wike had directed all his cabinet members, aides, and local government chairmen in the state to support Tinubu.He gave more indication of his support for Tinubu when he said during the party’s rally on Saturday that: “We have instructed the leaders ward by ward. In our local government, the leaders will tell you what we have decided. If you want me to survive politically, follow the way we are going. “We are going to vote for the unity of Nigeria. We are going to vote for equity fairness and justice. And that is why, I salute the APC Governors who came out to say look, for this country to be united, for this country to move together as a country, as one united country, there is need for power to shift. “They were not greedy; they know that Nigeria is such a country that requires unity. Those who are greedy about power, you can get power and you will not have peace”. Similarly, Tinubu on Wednesday, Feb. 15, visited Governor Makinde in Ibadan, the Oyo State capital, during his campaign rally in the state. Makinde, who is seeking re-election in March, on the platform of PDP, told Tinubu that he would choose unity of the country, equity and fairness over politics. He added that the people of the state would vote for equity and fairness on February 25. Contrary to Wike and Makinde’s move, Governor Ortom on Thursday endorsed the Labour Party candidate, Peter Obi, asking the Benue people to cast their votes for the former Anambra governor on February 25. Ortom who stated this at a town hall meeting in Makurdi, the state capital, said the 2023 election should not be based on party, stating that all the political parties in the country had failed Nigerians. The governor who got a rousing ovation after declaring Obi as his candidate said a new Nigeria that would give its citizens equity, fairness, and justice must emerge via the coming poll. Although the two other governors, Ikpeazu and Ugwuanyi are yet to declare their support for any candidate, there are indications that Ugwanyi has also pitched his tent with Asiwaju, while Ikpeazu may be working for Atiku Abubakar. However, the PDP in Ugwuanyi’s State, Enugu, came with a big surprise during Atiku’s campaign rally in the State, as all the state apparatus was made available for the event. Apart from Ugwuanyi, every other person, including his Deputy, Cecilia Ezeilo, as well as the guber candidate, Peter Mbah, were at the rally. They all asked Enugu people to vote for Atiku. Ikpeazu’s alleged decision to return to Atiku may not be unconnected to the death of the PDP governorship flagbearer in the state, Professor Eleazar Uche Ikonne who was his anointed candidate. According to a member of the PDP in the state, Godwin Igwe: “Ikpeazu’s mind has always been with Atiku. I think he was just dragged into the G-5.” He explained further: “After the death of the governorship candidate, the governor needed upper hands to be able to bring another anointed candidate from his camp and I think he reconciled with Atiku that time.” Similarly, Atiku’s media adviser, Paul Ibe, revealed on Saturday that Ikpeazu “has never left Atiku’. According to him: “He has never left; he was elected under the platform of the PDP and like every other stakeholder, he is working for the party to win. We thank God for what is happening to the G-5, at the end of the day, it will end up to be G-1. At the polling unit which is located at Elizabeth Fowler Primary School, Unit 14, Ward G2, Masha-Surulere, Obi pulled a total of 89 votes to defeat Tinubu who had 59 votes while Atiku polled a total of 5 votes.
