How to screw up a whistleblower law
Tumblr media
I'm touring my new, nationally bestselling novel The Bezzle! Catch me THIS WEDNESDAY (Apr 17) in CHICAGO, then Torino (Apr 21) Marin County (Apr 27), Winnipeg (May 2), Calgary (May 3), Vancouver (May 4), and beyond!
Tumblr media
Corporate crime is notoriously underpoliced and underprosecuted. Mostly, that's because we just choose not to do anything about it. American corporations commit crimes at 20X the rate of real humans, and their crimes are far worse than any crime committed by a human, but they are almost never prosecuted:
https://pluralistic.net/2021/10/12/no-criminals-no-crimes/#get-out-of-jail-free-card
We can't even bear to utter the words "corporate crime": instead, we deploy a whole raft of euphemisms like "risk and compliance," and that ole fave, the trusty "white-collar crime":
https://pluralistic.net/2021/12/07/solar-panel-for-a-sex-machine/#a-single-proposition
The Biden DOJ promised it would be different, and they weren't kidding. The DOJ's antitrust division is kicking ass, doing more than the division has done in generations, really swinging for the fences:
https://pluralistic.net/2024/03/22/reality-distortion-field/#three-trillion-here-three-trillion-there-pretty-soon-youre-talking-real-money
Main Justice – the rest of the DOJ – promised that it would do the same. Deputy AG Lisa Monaco promised an end to those bullshit "deferred prosecution agreements" that let corporate America literally get away with murder. She promised to prosecute companies and individual executives. She promised a lot:
https://pluralistic.net/2024/03/22/reality-distortion-field/#three-trillion-here-three-trillion-there-pretty-soon-youre-talking-real-money
Was she serious? Well, it's not looking good. Monaco's number two gnuy, Benjamin Mizer, has a storied career – working for giant corporations, getting them off the hook when they commit eye-watering crimes:
https://prospect.org/justice/2024-04-09-reform-groups-lack-of-corporate-prosecutions-doj/
Biden's DOJ is arguably more tolerant of corporate crime than even Trump's Main Justice. In 2021, the DOJ brought just 90 cases – the worst year in a quarter-century. 2022's number was 99, and 2023 saw 119. Trump's DOJ did better than any of those numbers in two out of four years. And back in 2000, Justice was bringing more than 300 corporate criminal prosecutions.
Deputy AG Monaco just announced a new whistleblower bounty program: cash money for ratting out your crooked asshole co-worker or boss. Whistleblower bounties are among the most effective and cheapest way to bring criminal prosecutions against corporations. If you're a terrified underling who can't afford to lose your job after narcing out your boss, the bounty can outweigh the risk of industry-wide blacklisting. And if you're a crooked co-conspirator thinking about turning rat on your fellow criminal, the bounty can tempt you into solving the Prisoner's Dilemma in a way that sees the crime prosecuted.
So a new whistleblower bounty program is good. We like 'em. What's not to like?
Sorry, folks, I've got some bad news:
https://www.corporatecrimereporter.com/news/200/stephen-kohn-on-the-justice-department-plan-to-offer-whistleblower-awards/
As the whistleblower lawyer Stephen Kohn points out to Russell Mokhiber of Corporate Crime Reporter, Monaco's whistleblower bounty program has a glaring defect: it excludes "individuals who were involved with the crime." That means that the long-suffering secretary who printed the boss's crime memo and put it in the mail is shit out of luck – as is the CFO who's finally had enough of the CEO's dirty poker.
This is not how other whistleblower reward programs work: the SEC and CFTC whistleblower programs do not exclude people involved with the crime, and for good reason. They want to catch kingpins, not footsoldiers – and the best way to do that is to reward the whistleblower who turns on the boss.
This isn't a new idea! It's in the venerable False Claims Act, an act that signed into law by President Abraham Lincoln. As Kohn says, making "accomplices" eligible to participate in whistleblower rewards is how you get people like his client, who relayed a bribe on behalf of his boss, to come forward. As Lincoln said in 1863, the purpose of a whistleblower law is to entice conspirators to turn on one another. Like Honest Abe said, "it takes a rogue to catch a rogue."
And – as Kohn says – we've designed these programs so that masterminds can't throw their minor lickspittles under the buss and collect a reward: "I know of no case where the person who planned or initiated the fraud under any of the reward laws ever got a dime."
Kohn points out that under Monaco, the DOJ just ignores the rule that afford anonymity to whistleblowers. That's a big omission – the SEC got 18,000 confidential claims in 2023. Those are claims that the DOJ can't afford to miss, given their abysmal, sub-Trump track record on corporate crime prosecutions.

How Does Bank of America Compare to Other Major Banks?
Tumblr media
Bank of America is one of the largest banks in the U.S. They have a strong network of branches. You can find them in many places. This makes them very convenient. If you need to deposit cash or talk to someone, it’s easy. Many people like this. Other big banks like Chase and Wells Fargo also have many branches. But Bank of America stands out for its easy access. Their customer service is also good. However, some say they prefer smaller banks for a more personal touch.
Bank of America has many services. They offer checking, savings, and credit cards. You can also get loans and mortgages. Their mobile app is simple to use. It lets you check your balance, pay bills, and send money. Many users love this app. They say it makes banking easy. Other big banks also have apps. For example, Chase’s app is popular too. But Bank of America’s app has a strong reputation. It’s reliable and fast.
When it comes to fees, Bank of America is similar to other big banks. They have fees for overdrafts, monthly maintenance, and out-of-network ATMs. But you can avoid some fees. For example, by keeping a minimum balance. Some people find these fees high. They compare them to online banks like Ally, which have lower fees. Still, Bank of America offers good benefits. Their rewards programs on credit cards are popular. Overall, Bank of America is a solid choice. They compete well with other big banks.

The Verge: Pushy checkout screens are helping ‘tipflation’
Tipping is an age-old American debate. How much do you pay and when? Is it a choice or an obligation? Generally, tech has at least made it easier over the years. Smartphones made it a breeze for friends to whip out a calculator to figure out tip and split the bill. And now, checkout screens everywhere, from in-person stores to delivery apps, have added buttons designed to make it easier for you to tip.
That’s convenient, until it’s not. According to a new Pew Research Center report, tipping culture in America has seen a shift in recent years. Seventy-two percent of Americans say tipping is expected in more places than five years ago. Not all of that is tech-related, but it’s hard to deny the role checkout screens have in tipflation. Even the Pew Research report notes the practice of tipping “is undergoing significant structural and technological changes,” including “the expansion of digital payment platforms and devices that encourage tipping.”
On days I go to the office, I occasionally treat myself to a latte at a local coffee shop. It’s all good, until I’m paying. A part of me dies at the fact a small latte is now around $9 in Manhattan. The anxiety seeps in when, after I’ve tapped my card against the terminal, it asks me how much I want to tip — 20 percent, 25 percent, and a higher number that I’ve blocked from my memory. There’s an option to not tip or to enter a custom tip, but those are smaller, and pressing those buttons fills me with anxiety that I’m a bad person.
Most recently, a finance bro behind me sighed because I was taking too long to figure out the custom tip interface. I ended up pressing the 25 percent button in a social anxiety-induced panic. Or $11.25. At that price, I regretted the latte, and in my head, I heard Suze Orman’s specter haranguing me for having my millennial treat.
Self-service kiosks occasionally ask me if I want to tip, too. The audacity to even ask is staggering. And even if most people pick “no tip” in that scenario, muscle memory and social programming may mean someone accidentally does tip.
How much of these tip prompts actually goes to the people you intended to tip?
Screens make all this easy partly because it cuts out the math. You just press a button that automatically adds on a percentage or, sometimes, a dollar amount. It’s all built into the regular flow of checking out, and you don’t have to rummage through your wallet to add to the tip jar. The thinking — whether it’s about how much you can afford or how it affects your total — is meant to go out the window. It’s similar to online or in-app shopping — just press the button and move on.
It’s common knowledge that service workers generally prefer direct tips — either handed to them or sent via Venmo. But where does that fit now that cashless payment options and checkout tip prompts are more commonplace? It’s very easy for a business to add these checkout screens to their systems and to set the lowest “easy” option at a price that may be higher than you want to give. They also often make it harder for you to choose an alternative to the preset options. On these screens, the “no tip” or custom options are either smaller or lower down on the menu. And while no one is forcing you to do anything, there’s a gentle persuasion happening that doesn’t always feel right. With DoorDash, if you don’t pre-tip, you now get a warning that your food may be delayed. That makes sense if you view tipping to be an obligation rather than a choice — but for those who view tipping as a reward for good service, it can feel like extortion, too.
Wherever possible, I still try to tip in cash. At my local ice cream shop, it warmed my heart this past summer to stick my dollar in a jar labeled “Help me fund my study abroad to Italy.” It felt a lot better than a digital prompt.

Magic 30th Anniversary Failed
Tumblr media
“The 30th Anniversary Edition sale has concluded, and the product is currently unavailable for purchase. Thanks to everyone who joined us today!”
@wizards_magic
While most people ignored WotC’s biggest cash grab in 30 years, the remaining curious parts of the community were rewarded with what has to be one of the biggest conspiracy theory:
Did Wizards of the Coast purposely cut the release window of Magic 30th Anniversary to save face? Much less create more artificial scarcity to an already artificial product?
In my mind, they absolutely did. Totally and without any remorse.
Not just for customer “goodwill” for the brand, but also to save the “collectable” aspect of their printed products. WotC has more to lose if Magic 30th Anniversary “sold out” in a few day than a few hours. Since the vast majority of orders occurred within the first few minutes of the product’s launch window (as do all their products online); WotC most likely saw next to little actual activity after the first 10 minutes. Sure, there were probably a few hundred bots set up to mess with cart and waiting queues, but nothing catastrophic like a DDOS attack.
You have to remember folks, Wizards of the Coast is under a lot of pressure after Bank of America gave a scathing evaluation of Hasbro’s stock. Not just for funny business for cooking their books, but the fact that WotC is sitting on millions and millions of dollars of unsold inventory of cards/merchandise. It’s not like these cards can be shipped and sold to down to other lesser chain stores, like ROSS or Five Below. Magic 30th Anniversary was their Hail Mary for quarter 4 earnings. It was suppose to stabilize what was already considered a bad year for Magic the Gathering.
So what happens now?
It really is up to you, the player base. You already have WotC employees telling every single customer to not buy every product to avoid burn out. To be more selective of what products you engage with. Obviously, very poorly worded in business to accuse your customers to be so dumb that they keep buying everything...
Which doesn’t surprise me how they’ve been focusing so hard to market their products to mentally ill/challenged parts of the community. It’s not even an open secret anymore that a lot of video games and mobile services solely focus sales to whales and/or create an ecosystem of their products to be addictive as possible. A lifestyle some would say in corporate pitch meetings. This is why Secret Lairs have been so successful. Not just by the fear of missing out in small windows of availability, but also the elite status of being a MTG mega fan! The sunk cost of your commander/EDH alone is nothing compared to another $40 upgrade of foils next paycheck...
For me, I hate to say it, but I’ve been done with the game since Modern Horizons 2. I used to love playing Modern/Legacy, where old cards can find new life after rotation. Where you didn’t have to constantly spend money every set just to stay relevant. Who doesn’t like owning a deck and keep in their closet for a few months or years, knowing they can just dust it off to a big Magic event or some old friends dropping by?
Instead, these old non-rotating formats did get rotated and through blunt force of power-creep no less. You can’t really have the same experiences like you did when cards are created solely to sell you new boxes/cases of cards. It was not like this before in non-rotating formats; good cards trickled in the format, not by power creeping everything around it. It’s really insulting to downright malicious towards it’s own customers when these boxes/cases are almost quadruple than their old counterparts.
I don’t really see Wizards of the Coast or Hasbro correcting any courses... maybe adjust lower print runs and make actual collector products collectable again... without artificially pricing them at stupid prices. One thing is for sure though. We won’t be seeing anymore blatant cash grabs of $1,000 official proxies anytime soon.

What Are the Benefits of a Bank of America Credit Card?
Tumblr media
Bank of America credit cards offer many perks. One big benefit is cashback. For example, their Cash Rewards card gives 3% back on chosen categories. I know someone who uses this card for groceries. She gets 2% back on all her shopping. Over a year, she saved enough to cover holiday gifts. Simple rewards like this can make a big difference. If you like cashback, Bank of America might be a good choice.
Another benefit is low-interest rates. Many Bank of America cards come with 0% APR for the first year. I had a friend who needed to buy a laptop for work. She used her card to buy it. She paid it off with no interest over 12 months. This saved her money. If you plan to make a big purchase, a card like this could help you avoid interest. Plus, they offer balance transfers with low fees.
Bank of America also has a great mobile app. With the app, you can track spending. You can also set up alerts. My cousin used the app to control his budget. He set alerts to know when he was close to his limit. This helped him avoid fees. The app is simple to use and helpful. For those who like to manage money on the go, the app is a great tool.
Bank of America credit cards come with many perks. Cashback, low rates, and a handy app are just a few. Many people find these benefits helpful. They make life easier and help save money. If you’re thinking about a new card, Bank of America has good options.

Can You Save More with Bank of America’s Rewards Program?
Bank of America’s Rewards Program can help you save more. It offers different perks based on your account balances. The more you have saved or invested, the better the rewards. For example, customers with a higher balance can earn bonuses on credit card rewards. This means you get more cash back or points on every purchase. If you regularly use your Bank of America credit card, these extra rewards add up quickly. Over time, you could save a significant amount by earning more on your everyday spending.
The program is designed to benefit those who use multiple Bank of America products. If you have a checking account, savings account, and an investment account, you can combine your balances to qualify for better rewards. This can lead to discounts on banking services, higher interest rates on savings, and reduced fees. For instance, if you reach the Platinum tier, you might earn a 50% bonus on credit card rewards and enjoy no fees on wire transfers. These savings make a difference, especially if you often use these services.
Another way to save with the Rewards Program is through reduced loan and mortgage rates. If you qualify for the higher tiers, you can get lower rates on loans, helping you save on interest. This is particularly useful for big expenses like buying a home or car. For example, a Platinum Honors member could get a lower interest rate on a mortgage, saving thousands over the life of the loan. By taking advantage of these rewards, you not only save on daily banking but also on long-term financial goals. This makes the Bank of America Rewards Program a valuable tool for maximizing your savings.
