Pattern Notes

This pattern is worked in the round from the top down with increases for upper skirt shaping.

Dc rounds are started with a modified turning chain, a single crochet is worked without a ch-1 turning chain, followed by 2 chains to create the height needed for dc. When working the next round the top of the ch-2 is worked as the top of a regular dc st.

To make the skirt longer add rounds without increases between the increase rounds (for a shorter skirt, subtract rounds without increases between the increase rounds. The last round of the upper skirt needs to have a number of stitches divisible by 14 for the lace pattern set-up.

Contexto legal del ejercicio de la profesión farmacéutica en el territorio nacional

El marco legal

En Argentina, la ley 17565 es la referencia para el ejercicio de la farmacia. Esta Ley data desde 1967 y posee un decreto reglamentario, el 7123, además tiene capítulos sobre herboristería y droguerías.

La herboristería se caracteriza por la venta exclusiva de hierbas de origen natural que tienen PA y/o acción terapéutica.

Para la Provincia de Buenos Aires aplica la ley 10606 y el decreto 3521; en estas legislaciones se describe la base del ejercicio de la farmacia, qué se puede hacer y qué no, las limitaciones, los registros que se deben tener, el modo de operar, etc.

¿Qué es una farmacia según la ley?

Una farmacia es un lugar físico del territorio nacional en el que se realiza la preparación, el despacho y la venta al público de drogas, medicamentos y especialidades farmacéuticas. Se la considera como un servicio público y es el único lugar permitido legalmente para la venta de medicamentos, incluso los de venta libre.

Es por ello que si se vendiese fuera de la misma se lo considera un ejercicio ilegal de la farmacia, lo cual es penable por el código penal en el artículo 208.

En cuanto a los requisitos que debe cumplir una farmacia se encuentran los siguientes:

La habilitación: tiene que ser habilitada por el Ministerio de Salud y por el municipio del lugar donde se encuentre, cumpliendo con los requerimientos fiscales como cualquier otro comercio.

El cumplimiento: la farmacia debe cumplir ediliciamente con ciertas áreas específicas y cierto metraje para ser habilitadas, además de cumplir con cuestiones de seguridad, higiene, luminosidad, ventilación, dispuestas en la resolución 192/1998.

La ambientación: debe tener un ambiente para la atención al público, para preparaciones oficinales/magistrales, heladera, etc.

El laboratorio: si realizan preparaciones homeopáticas estas tienen que hacerse en un laboratorio separado y destinado a tal fin.

Los insumos: las farmacias que apliquen inyectables/vacunas deben tener un espacio destinado a ello, separado de los demás y con camilla, pileta y material descartable.

El personal: las farmacias tienen que tener personal autorizado para la aplicación de inyecciones y, si se preparan inyectables, debe tener una zona para ese fin y su fraccionamiento.

En las farmacias sólo se pueden aplicar inyecciones IM y SC con receta médica; está prohibida la aplicación de IV.

¿Qué se puede hacer allí y qué no?

Las farmacias pueden vender diferentes productos por el decreto reglamentario, como productos higiénicos o destinados a la estética, productos con propiedades profilácticas, desinfectantes e insecticidas que se encuentren autorizados por la salud pública.

Entre lo que NO se puede hacer se encuentra:

vender cosas diferentes a lo que habilita la ley

tener medicamentos que hayan sido retirados de la venta por las autoridades de salud

vender mercadería que no cumpla con los requerimientos de trazabilidad

modificar la razón social o modalidad de prestaciones sin comunicarlo (una vez que está habilitada la farmacia)

cerrar más de 30 días corridos

haber una óptica en el establecimiento

Se deben guardar las facturas de compra; registrar las ventas usando los libros de farmacia y los mismos deben estar habilitados para su uso; debe estar habilitada por el rubro de comercio de farmacia y por el municipio; todo debe estar rotulado e identificado; debe disponer siempre de los libros de farmacia de registro y ser completados a diario de acuerdo a la ley.

Formas de expendio legales existentes

Venta libre: la cantidad es ilimitada y puede dispensarse sin prescripción aunque se recomienda el asesoramiento del farmacéutico.

Venta bajo receta: se debe respetar la droga y la cantidad indicada por el médico; requiere que la prescripción sea acorde a las leyes vigentes y la misma tiene un mes de duración.

Venta bajo receta archivada: debe respetar la droga y la cantidad indicada por el médico. Las recetas se deben archivar y completarse en el dorso, además de ser selladas (por la farmacia), numeradas y anotadas en el libro recetario.

Las muestras médicas

Las muestras médicas no son comercializables, no se permiten muestras médicas de psicotrópicos o estupefacientes, sólo de productos bajo venta libre y para mayores de 18 años.

El personal presente y sus responsabilidades

Toda farmacia para ser habilitada requiere de un farmacéutico, denominado director técnico (DT) que posee su título bloqueado.

puede haber (o no) más farmacéuticos que tengan el cargo de farmacéutico auxiliar y poseen la mitad de su título bloqueado

puede haber farmacéuticos que no sean DT ni auxiliares ni tengan su título bloqueado;

hay asistentes de farmacia que atienden al público

hay cadetes

hay vendedores de perfumería

hay cajeros

hay personal administrativo

Todos son responsables de la tarea en conjunto aunque, desde el punto de vista legal, el profesional es la autoridad mayormente comprometida.

Tipos de farmacia

Para cada tipo de farmacia existe un listado de medicamentos de urgencia y materiales de curación que debe poseer, especificados en la ley.

Farmacias hospitalarias: son las que se hallan en los hospitales y las clínicas, destinadas a la atención de sus pacientes internos.

Farmacias:

solo homeopáticas

solo alopáticas, sin preparación de magistrales

alopáticas con preparación de magistrales

homeopáticas y alopáticas

sociales o mutuales

Formas terapéuticas homeopáticas y alopáticas

Homeopáticas

Son preparaciones realizadas en una farmacia con componentes particulares y recetados por un médico, en cantidades muy pequeñas. Ejemplo, si la persona tiene fiebre se le da un medicamento que suba la fiebre en concentraciones milésimas ya que se sostiene que lo similar cura lo similar.

Alopáticas

Todas las especialidades medicinales son formas alopáticas, es decir que curan por lo opuesto. Ejemplo, si la persona tiene hipertensión se le da un medicamento que haga lo opuesto (provoque la hipotensión hasta llegar a un punto estable).

Los turnos de la farmacia

Los turnos son establecidos por el Colegio de Farmacéuticos de cada localidad o partido. Al momento de presentar la documentación para la habilitación hay que asentar si cumplirá turnos voluntarios y/o horarios extendidos de 24 horas.

La autoridad sanitaria podrá eximir del cumplimiento del mismo a las farmacias que así lo soliciten por hallarse a menos de mil metros de distancia de otra que funcione 24 hs.

El NO cumplimiento de los turnos es una falta grave que puede sancionarse.

Otros puntos de la Ley 17565

En las OF deben hallarse los siguientes libros habilitados por la autoridad sanitaria:

el libro recetario en el que anotan diariamente y por orden numérico las recetas despachadas, copiándolas íntegramente y haciendo constar el nombre del profesional que las firma;

el libro contralor de estupefacientes;

el libro de inspecciones;

el libro para anotar las ventas de sacarina;

el libro para anotar la venta de sustancias venenosas y corrosivas.

Estos libros deben ser foliados y encuadernados por la autoridad sanitaria, además tienen que llevarse en forma legible y sin dejar espacios en blanco, sin alterar el orden de los asientos de las recetas despachadas y sin enmiendas ni raspaduras.

La autoridad sanitaria puede autorizar otro sistema copiador de recetas siempre que el mismo asegure la inalterabilidad de los asientos.

Por otra parte se encuentran los siguientes puntos a tener en cuenta:

la autoridad sanitaria debe autorizar previamente toda propaganda sobre drogas, medicamentos o agentes de diagnóstico que se realice en las farmacias

una farmacéutico NO puede ser DT en más de una OF (sí puede ser DT de una y trabajar en otra a la vez). Está obligado a la atención personal y efectiva del local y a vigilar la preparación y expendio de los medicamentos, firmando diariamente el libro recetario al final de la última receta despachada.

el DT de una OF debe hacer lo siguiente en la misma:

exhibir su título profesional

tener un ejemplar de la Farmacopea Nacional

tener un ejemplar de la presente ley y su reglamentación

tener un plano del local autorizado por la autoridad sanitaria y las constancias de la habilitación del establecimiento

prever que en el frente del local, en los rótulos, prospectos, sellos e impresos en general figure su nombre y su título, además de la entidad propietaria de la farmacia y su domicilio

conservar la documentación de la existencia y procedencia de todas las drogas y medicamentos con el fin de poder individualizar a sus proveedores

cumplimentar lo dispuesto por la ley vigente en todo caso comprobado de intoxicación habitual por estupefacientes.

4. queda prohibido para los farmacéuticos:

anunciar, tener existencia y expender medicamentos de composición misteriosa

anunciar y expender agentes terapéuticos atribuyéndoles efectos extraordinarios o que ofrezcan curar radicalmente cualquier enfermedad

aplicar en su práctica privada procedimientos que no estén aprobados en los centros universitarios/científicos reconocidos en el país

anunciar, por cualquier medio, medicamentos o especialidades NO reconocidas por la autoridad sanitaria

ejercer la profesión mientras padezcan enfermedades infecto-contagiosas

inducir a los clientes a proveerse de determinados medicamentos

participar en honorarios con médicos y odontólogos

recibir participación de honorarios en los laboratorios de análisis clínicos

delegar en el personal auxiliar facultades inherentes o privativas de su profesión.

El Sistema Nacional de Trazabilidad (SNT)

El SNT de medicamentos es un sistema de información destinado a identificar en forma individual y unívoca cada una de las especialidades medicinales a ser comercializadas y para efectuar su seguimiento a través de toda la cadena de distribución.

De esta manera mediante la implementación de la trazabilidad se puede:

controlar la distribución de medicamentos de manera eficiente, conociendo en tiempo real el destino de cada especialidad medicinal liberada al mercado;

verificar el origen de los medicamentos;

registrar el historial de localizaciones y traslados a lo largo de toda la cadena de distribución y despensa, asegurando su legitimidad.

El SNT se creó con el fin de evitar la falsificación y adulteración de los medicamentos, auditando su recorrido y mejorando la seguridad de los pacientes.

El sistema permite detectar las anomalías que puedan generarse en el circuito de provisión legal y garantizar al paciente la calidad y seguridad para su salud en los tratamientos a lo que se expone.

Psicotrópicos y estupefacientes

Psicotrópico: (psyche: mente / tropein: tornar) es un agente o sustancia química que actúa de forma directa sobre el SNC. Esto trae como consecuencia cambios temporales en la percepción, el ánimo, estado de conciencia y comportamiento ya que actúa excitando o deprimiendo el SNC.

Estupefacientes: es toda sustancia psicotrópica con un potencial de producir una conducta abusiva o dependencia psíquico-física.

La Ley Nacional 17818 (ley de estupefacientes/Normas para su comercialización) y la Ley 23737 (tenencia y tráfico de estupefacientes) determinan los estupefacientes con comercialización permitida. De acuerdo a la ley 17818, es requisito que las farmacias presenten un vale oficial para adquirir determinados grupos de medicamentos (tramitados por la farmacia y entregado a las droguerías) y dispensar el producto contra receta oficial (la que tramita y entrega el médico al paciente).

Los psicotrópicos y estupefacientes se clasifican, cada uno, en cuatro listas.

Psicotrópicos

En el libro recetario deben anotarse todos los medicamentos de venta bajo receta; los psicotrópicos de la lista II deben volcarse en el libro de psicotrópicos mientras que los estupefacientes de la lista I y II deben asentarse en el libro de estupefacientes.

Las drogas psicotrópicas y estupefacientes NO pueden descartarse como residuo una vez vencidas sino que, para poder hacerlo, se requiere autorización del Ministerio de Salud quienes van a auditar la situación o envían una notificación por escrito autorizando la destrucción de: X producto, lote y vencimiento; cantidad de unidades, detallando cada unidad con sus datos.

Marco legal

La farmacia está regida por la Ley 17565/69, de alcance nacional, y su decreto reglamentario es el 7123, el mismo cuenta con aclaraciones/complementos a la ley original.

No se reglamentan todos los artículos de una ley sólo los que necesitan una aclaración o comentario para su interpretación.

En la Provincia de Buenos Aires rige la Ley 10606 y su decreto 3521.

¿Qué es una farmacia?

De acuerdo a la ley, una farmacia es el lugar físico en el que se prepara, despacha y se vende al público drogas, medicamentos y especialidades farmacéuticas.

Se considera a la farmacia como un comercio y un centro de salud.

Tipos de farmacia

La farmacia hospitalaria atiende y dispensa a los pacientes de un hospital, ya sean ambulatorios o internados;

la oficina de farmacia puede ser alopática, homeopática o ambas al mismo tiempo.

¿Qué se puede hacer?

se pueden vender productos para la higiene o la estética;

aplicar inyecciones IM y SC;

vender productos con propiedades profilácticas, desinfectantes, insecticidas que se encuentren autorizados por la salud pública.

¿Qué no se puede hacer?

vender cosas diferentes a lo que habilita la ley;

tener medicamentos que hayan sido retirados de la venta por la autoridad de salud. Es responsabilidad de la farmacia ver las notificaciones de la ANMAT sobre el retiro de ciertos lotes de medicamentos y quitar esos productos del stock;

vender mercadería que NO cumpla con los requisitos y seguimientos de trazabilidad;

no se puede cambiar la razón social de la farmacia sin notificarlo;

no se puede cerrar más de 30 días seguidos;

sólo aplicar inyecciones subcutáneas e intramusculares, con receta y por personas habilitadas por la ley 17132;

no puede haber una óptica en la farmacia.

¿Qué se debe hacer?

guardar las facturas de compra para justificar cada producto, de dónde vino, para evitar falsificaciones y adulteraciones;

estar habilitadas como un comercio, contar con habilitación municipal;

registrar las ventas usando los libros de farmacia;

todos los envases tienen que estar rotulados e identificados;

disponer de los libros de farmacia de registro que dicta la ley;

cumplir con los turnos: es un turno semanal a cubrir en la noche o un feriado. Se puede eximir del turno si hay alguna farmacia de 24 horas a menos de mil metros de distancia.

Formas de expendio

Venta libre: son productos que se pueden vender sin límite de cantidad y sin presentar una receta, como los elementos de parafarmacia y medicamentos de tipo OTC/venta libre.

Venta bajo receta: el cliente tiene que presentar la receta pero no está la obligación de retenerla sino que se le puede devolver al paciente.

Venta bajo receta archivada/expendio restringido/con receta oficial: para los medicamentos controlados como psicotrópicos, estupefacientes o medicamentos magistrales.

Cargos y funciones

En toda OF tiene que haber sí o sí u DT farmacéutico con título bloqueado, lo cual significa que sólo puede ser DT de una farmacia.

También hay farmacéuticos auxiliares (con y sin bloqueo de título), hay asistentes de farmacia, cadetes, vendedores de perfumería, cajeros y personal administrativo.

Los libros de registro

Son exigidos por ley para volcar los movimientos de la farmacia:

libro recetario

libro de estupefacientes

libro de inspecciones

libro de venta de sacarina

libro para anotar la venta de sustancias venenosas y corrosivas

Lo que debe hacer un DT en la OF

exhibir su título profesional

tener un ejemplar de la Farmacopea Nacional

tener un ejemplar de la Ley 17565 y su regla

tener un plano del local autorizado por la autoridad sanitaria y las constancias de habilitación del establecimiento

prever que en el frente del local, rótulos, sellos, etc, figure su nombre y su título

conservar la documentación de la existencia y procedencia de todas las drogas y medicamentos

Lo que está prohibido

anunciar, tener y expender medicamentos de composición secreta o misteriosa

anunciar, tener y expender agentes terapéuticos atribuyéndoles efectos extraordinarios

aplicar en su práctica técnicas o procedimientos que no hayan sido aprobados científicamente (técnicas ilegales)

anunciar medicamentos o especialidades NO reconocidas por la autoridad sanitaria

inducir a los clientes a proveerse de determinados medicamentos

participar en honorarios con médicos, odontólogos o laboratorios de análisis clínicos

delegar a los auxiliares facultades o funciones que le son propias.

El SNT: Sistema Nacional de Trazabilidad

Es un sistema de información que nos permite identificar desde la fabricación hasta el uso del medicamento, siguiendo cada uno de los pasos. Generalmente se trazan los medicamentos oncológicos, los de alto costo o alto riesgo.

El Estado podría conocer dónde está o ubicar el medicamento.

Los psicotrópicos

Son agentes químicos que actúan directamente sobre el SNC, exaltándolo o deprimiéndolo. Tienen por consecuencia cambios temporales en la percepción, ánimo, estado de conciencia y comportamiento

Los estupefacientes

Son sustancias psicotrópicas con alto potencial para producir una conducta abusiva y/o dependencia psíquico física.

Los estupefacientes son todos psicotrópicos pero NO todos los psicotrópicos son estupefacientes.

Ambos se encuentran listados de acuerdo al tipo de expendio que tienen esos medicamentos, cómo será a adquisición de la OF y cuál será la receta que haga el profesional médico.

Mais duas vias municipais serão atendidas pelo Programa de Mutirão. As ruas Francisco Wuerges Sênior, no bairro Do Salto e Gaúcha, no Passo Manso, tiveram a ordem de serviço assinada pelo prefeito Mario Hildebrandt, na última quarta-feira, dia 17, autorizando o inicio das obras. Somente neste ano, outras 19 ruas de Blumenau foram ou estão sendo pavimentadas pelo sistema de mutirão. “É pela união de esforços entre Prefeitura e comunidade que conseguimos ter o fôlego para expandir o programa e atender a necessidade das vias que ainda aguardam pela pavimentação em frente as suas casas”, reforça o prefeito Mário Hildebrandt.
