Ukraine’s reform activists are under attack

“AUTHORITIES confirm they’ve made progress in an investigation into the finances of anti-corruption activist Vitaliy Shabunin,” drones the anchor of an American television network, News24, in a clip recently shared across Ukrainian social media. There is only one problem: there is no News24, and the anchor is not a journalist but an actor hired through a freelance site, Fiverr.com. “I assumed the video was a prank his friends were playing on him,” says the actor, Michael-John Wolfe.

The “fake news” bulletin was an illustration of the increasingly hostile environment facing anti-corruption activists, journalists and reformist officials in Ukraine. “I cannot escape the feeling that we’re living through a counter-revolution,” writes Yaroslav Hrytsak, a historian at Ukrainian Catholic University. This is partly a backlash against reforms, particularly the new National Anti-Corruption Bureau (NABU). By allowing such measures, the political elite “opened Pandora’s box,” says Yaroslav Yurchyshyn, the executive director of Transparency International Ukraine.

Now they are trying to close it. This spring Ukraine’s parliament passed a law requiring NGOs and their employees to submit asset declarations, drawing stern rebukes from Western embassies. Ukrainian editors are concerned that security services are carrying out surveillance on journalists. (The president, Petro Poroshenko, denies it.) Anti-corruption activists increasingly find themselves derided as “agents of Putin” or grantoedy (“grant-eaters”). In April a mock funeral procession gathered outside the home of Olga Balytska, a reformist Kiev city-council member, carrying a coffin plastered with her photograph. “It’s one thing when people criticise you on Facebook, it’s another when they threaten death,” Ms Balytska says.

One key target is the Anti-Corruption Action Centre (AntAC), an NGO jointly led by Mr Shabunin (pictured). An MP has peddled false accusations that the group embezzled American government funds. Tax police opened an investigation into its finances. When protesters gathered outside Mr Shabunin’s home, investigative journalists revealed that an officer of the Security Service of Ukraine (SBU) oversaw them. (The SBU says he was there by chance.) In mid-August Mr Shabunin punched a video blogger, Vsevolod Filimonenko, whom he accuses of having harassed him and his colleagues for months (Mr Filimonenko says he is simply a journalist who “asks tough questions”). Mr Shabunin now faces a potential three-year sentence; the severity of the response led many to see the case as politicised.

AntAC argues that the “systemic campaign” is meant to discredit NABU and its supporters. This spring the bureau made its first high-level arrests, bringing charges against Roman Nasirov, the former head of Ukraine’s fiscal service, and Mykola Martynenko, a powerful former lawmaker. “The deeper we probe, the more resistance we face,” says Artem Sytnyk, NABU’s director. The next big battle concerns Ukraine’s courts, which Mr Sytnyk accuses of “sabotaging” his bureau by convicting only low-level figures. Even a man who tried to bribe his way into a job at the Anti-Corruption Bureau avoided serving prison time, he notes contemptuously.

The reformers want a new independent anti-corruption court for the anti-corruption prosecutor, named in 2015. In the past the West helped push through such measures by attaching strict conditions to IMF loans and European Union aid. But Ukraine’s economy has stabilised and is less reliant on IMF loans, and the EU has granted Ukraine visa-free travel. “There are now fewer instruments to influence the Ukrainian leadership,” says Volodymyr Fesenko of Penta, a think-tank. And as the presidential election in 2019 approaches, reform will take a back seat to winning.

September 2020 Visa Bulletin: Cut Off Dates Maintain Status Quo

After August 2020’s release of the visa bulletin, there was much anticipation for the September 2020 visa bulletin. Having seen a significant jump in cut-off dates, petitioners in the employment based categories for the immigrant visa were expecting a continuation of the upward trend in the September visa bulletin as well, only to be disappointed.

There has been no significant movement in any of the employment based categories for next month except a couple of weeks in the EB-1 category. Seeing how these numbers may plateau as this fiscal year nears end on September 30, 2020, everyone is going to pin their hopes against the additional green cards made available for the next year.

While the agency established the Employment-based preference’s numerical limitation to 156,253 immigrant visas this year, next year there could be an additional 100,000 green cards available. This is owed to the fact that President Trump signed an executive order preventing any new green card applicants from outside the US from entering the country until December 31, 2020. This has resulted in the slowdown in family-based immigrant visa processing in FY 2020, which is then made available to the employment-based limit in FY 2021.

While most US consulates abroad have resumed in-person operations, local conditions and norms prevent full service resumption. However, the proclamation continues to limit the issuance of immigrant visas abroad.

August 2020 Visa Bulletin

The current cut off numbers for September 2020 Visa Bulletis are as follows:

EB-1: India & China advance by three weeks to March 1, 2018. ROW will remain current in September.

EB-2: No movement for India & China. ROW remains current. 

EB-3 Professional and Skilled Workers: No movement for India & China or the ROW. 

EB-5: India remains current, as do the ROW countries. China’s date moves forward to August 15, 2015.

The last visa bulletin USCIS accepted adjustment applications based on the Final Action dates chart. Until the agency specifically clarifies, the September Dates for Filing cutoff will remain the same as that of August.

August 2020 Visa Bulletin: The Good Streak Continues For Employment Based Categories

In spite of the recent developments in the world of US immigration, the August 2020 visa bulletin brings in a lot of good news for the employment based categories of green card applicants. This visa bulletin has brought in a significant amount of forward movement, especially in the EB-1 and EB-3 categories.

July’s visa bulletin had also seen a positive movement for the EB categories. But not as significant as August. The cutoff dates for issuance of the immigrant visas is most prominent for EB-1 where India advanced by 9 months and settled onto February 8, 2018 while China advanced by 6 months and arrived at the same date. Rest of the countries are already current.

EB-3 saw a major jump for everyone – China up by a year, India up by 4 months and all other countries up by almost a year. The lower demand for EB-3 has pushed it ahead on the curve compared to EB-2. This was anticipated in the past and hopefully, will continue this trend.

For those that had downgraded to EB-3 from EB-2, this is a good phase.

Final Action Dates

It is important to be reminded that due to the President’s Executive Order which was recently extended to December 31, 2020, no new immigrant visas are being issued to applicants in US Consulates abroad.

Similarly, the Dates for Filing in August 2020 has seen some advancement as well. EB-1 India moved up by 11 months and China by 8 months. Dates of Filling for EB-3 all countries except India and China have gone up to a year ahead.

August 2020 Visa Bulletin

One of the biggest parts of getting a green card in the U.S. is waiting for your priority date to be current. For those that have invested the time, effort, and money into an immigrant visa, questions arise such as “How long will it take for my date to be current?” and “Can I speed this process up?”. To help answer these questions, this post will provide regular monthly updates on the most recent visa bulletin, an analysis of the date movements, and what predictions are made about the coming months. This month, we’ll go over the August 2020 visa bulletin.

Important Visa Bulletin Dates

For those that are new to the green card process, there are a few terms that you should learn and keep in mind in order to understand the rest of this August 2020 visa bulletin report. If you have further questions about the process or anything else about your green card, you should consult with your immigration attorney.

Priority Dates

The first term that you’ll hear thrown around here and there is the “priority date“. Each person who files a petition with the USCIS receives a priority date, which is the day that the government obtained your petition. Keep this date handy, since you will need it to compare to the dates found in this bulletin. Remember that your priority date does not move and you cannot change it except under certain circumstances.

Final Action Dates

The dates that you’ll see listed here in this report of the August visa bulletin for 2020 are “final action dates”. These dates are based on both the green card preference level (type of green card) and the chargeability area (your country of origin). The final action dates are constantly changing based on how many people from each chargeability area have petitioned for that particular green card.

If the limit for that green card has not been reached, then the final action date will likely move forward, closer to your priority date. If the limit has been reached, then you will not see any movement from that final action date. If the limit has been passed, you may see the date retrogress, or move backward away from your priority date.

Once the final action date in your green card preference level and chargeability area reaches your priority date, your priority date will be considered “current” and you will be able to adjust your status or go through consular processing to obtain your green card. Some of the dates are already current, which means that you can get your green card as soon as your petition is approved without having to wait for your priority date.

Family-Based Green Cards

The category for family-based immigration is made up of four preference levels that are based on who your sponsoring family member is in relation to you. There are five chargeability areas for this category: China, India, Mexico, the Philippines, and all other countries (the general category).

There are also marriage-based green cards, but by marrying a U.S. citizen, you are considered an immediate relative and all priority dates for immediate relatives are automatically current.

First Preference

This first preference level, the F1 green card, was created for the children and dependents over 21 years old of U.S. citizens.

The dates for the general category, China, and India have moved forward five weeks fro July 8, 2014, to August 15, 2014.

The date for Mexico has moved forward two weeks from December 8, 1997, to December 22, 1997.

The date for the Philippines has moved forward three months from June 1, 2011, to September 1, 2011.

Second Preference

There are two subcategories for the F2:

The F2A is meant for the unmarried children who are under the age of 21 and the spouses of lawful permanent residents (green card holders).

The dates for all chargeability areas remain current. 

The F2B is for the children who are 21 years old or older of lawful permanent residents.

The dates for the general category, China and India have all move forward five weeks from May 1, 2015, to June 8, 2015.

The date for Mexico has moved forward two weeks from March 8, 1999, to March 22, 1999.

The date for the Philippines has moved forward three months from January 1, 2011, to April 1, 2011.

Third Preference

This third preference, or F3 green card, is meant for the married children of U.S. citizens.

The dates for the general category, China, and India have all moved forward three weeks from May 8, 2008, to June 1, 2008.

The date for Mexico has moved forward one week from July 8, 1996, to July 15, 1996.

The date for the Philippines has moved forward three months from August 15, 2001, to November 1, 2001.

Fourth Preference

In this last level, the F4 was created for the siblings (sisters and brothers) of U.S. citizens.

The dates for the general category and China have both moved forward two weeks from August 22, 2006, to September 8, 2006. 

The date for India has moved forward two weeks from February 8, 2005, to February 22, 2005.

The date for Mexico has moved forward two weeks from June 1, 1998, to June 15, 1998.

The date for the Philippines has moved forward three months from June 1, 2001, to September 1, 2001.

Family-Based Final Action Date Chart

Here are the dates for family-based immigrant visas from the August 2020 visa bulletin.

Employment-Based Green Cards

With five different preference levels and seven chargeability areas, the employment-based category is issued through your job or occupation. Here, both your sponsor and your personal qualifications will be taken into account. In some cases, you can even sponsor yourself. The chargeability areas are China, India, Mexico, the Philippines, Central America (Guatemala, Honduras, and El Salvador), Vietnam, and the general category.

First Preference

Created for aliens with extraordinary achievement, outstanding researchers and professors, and the managers and executives of multinational companies, the EB-1 allows holders to petition without a PERM Labor Certification.

The dates for the general category, Central America, Mexico, the Philippines, and Vietnam all remain current.

The date for China has moved forward five months and two weeks from August 22, 2017, to February 8, 2018.

The date for India has moved forward nine months from May 8, 2017, to February 8, 2018.

Second Preference

The EB-2 is meant for advanced degree holders, those that have exceptional ability, and those that are eligible for a National Interest Waiver, which allows holders to self-petition.

The dates for the general category, Central America, Mexico, the Philippines, and Vietnam all remain current.

The date for China has moved forward two months and one week from November 8, 2015, to January 15, 2016.

The date for India has not seen any movement and remains at July 8, 2009.

Third Preference

In this third level is the EB-3, which is for professional workers (or bachelor’s degree holders), skilled workers (those with more than 2 years of relevant experience), and “other workers” (those with fewer than 2 years of experience).

The dates for the general category, Central America, Mexico, the Philippines, and Vietnam have all moved forward eleven months and two weeks from April 15, 2018, to April 1, 2018.

The date for China has moved forward seven months and three weeks from June 22, 2016, to February 15, 2017.

The date for India has moved forward four months from June 1, 2009, to October 1, 2009.

The date for the “other workers” category for China has moved forward one week from July 22, 2008, to August 1, 2008.

Fourth Preference

EB-4 applicants have special jobs that come from a limited list provided by the USCIS.

The dates for the general category, China, India, the Philippines, and Vietnam all remain current.

The date for Central America has moved forward two months from February 1, 2017, to April 1, 2017.

The date for Mexico has not seen any movement and remains at June 15, 2018.

Fifth Preference

Rather than being based on your employment, the EB-5 is based on making a significant financial investment in a U.S. enterprise.

The dates for the general category, Central America, Mexico, India, and the Philippines all remain current.

The date for China has moved forward two weeks from July 22, 2015, to August 8, 2015.

The date for Vietnam has moved forward two months and one week from May 15, 2017, to July 22, 2017.

There has been significant movement in a large portion of the family-based categories as well as some employment-based preference levels such as the EB-3. While we know that this is due to a lower number of applicants for these categories, it remains to be seen if the coronavirus is resulting in lower application numbers. As we approach the end of the 2020 fiscal year, we may start seeing a slowdown of final action date movement followed by a jarring resent in October. 

Additionally, the recent increase in the number of COVID-19 cases seems to have had an effect on the processing times for many green card categories. To learn more, you can visit the consular affairs site.

Can You Shorten Your Waiting Time?

The short answer is: probably not. There are two main cases in which you may be able to shorten your green card processing time which we will explain here.

The first way is if you want to file an I-140 for a green card and chargeability area that has a current priority date. In this case, rather than have to wait the usual six months for your petition to be processed, you can opt to pay an additional fee for premium processing, which will shorten the processing time to 15 calendar days. However, this is only available for certain green cards that use the I-140. It is not available for family- or investment-based immigration and is also not available for the EB-1C or EB-2 NIW.

The second situation involves green card “porting”, or transferring your application from a lower preference level to a higher one to take advantage of the shorter waiting times. This is a bit misleading because you don’t actually port your green card. In reality, you need to start over with a new petition (and a new PERM if necessary). The “porting” aspect only comes in when you indicate that you would like to retain your original priority date.

As attractive as “porting” might seem, it is a very delicate process with particular requirements. It is always a good idea to run decisions like these through your immigration attorney.

Just when the US immigration scene appeared at its bleakest so far, USCIS released July’s visa bulletin and gave some respite to the green card aspirants from India. While all employment based categories benefitted in some forward movement or the other, it was EB-1 India that saw a momentous push forward in all cut off dates.

The Good News

The overall picture for India and China is looking up with advancements in cutoff dates in most employment based visa categories. Although not a grand sweeping march ahead, these forward movements in priority dates was least expected after the recent immigration-related announcements, which is why this was welcome.

May 2020 Visa Bulletin Analysis

We look at the May 2020’s visa bulletin to see how the priority dates have been impacted individually for each visa category and overall in the bigger picture of movement during this Covid-19 lockdown.

With the President Trump declaring a National Emergency due to the Coronavirus spread and the country had gone into complete lockdown mode, all USCIS offices were shut down and all in-person services suspended. There were little expectations in having any progress in priority dates.

Which Countries Are Current?

Except for India and China, the Rest of the World (ROW) stands current under the employment based (EB) visa categories. Particular reference to EB-3 which stayed at January 1, 2017.

Just as announced in April 2020’s visa bulletin, USCIS will be considering Final Action dates for adjustment of status filings in the month of May. 

If an adjustment of status (AOS) is being filed under the EB category, the priority date should be earlier than the date listed below.

The visa bulletin for May 2020 wasn’t released until pretty late in the month US immigrants to speculate whether there will be a visa bulletin at all. Late timing coupled with President Trump’s Executive Order to suspend green card issuance for 60 days, left employment based and family based visa holders with little hope…until the May 2020 visa bulletin was released over the weekend.

The Good News

The overall picture for India and China is looking up with advancements in cutoff dates in most employment based visa categories. Although not a grand sweeping march ahead, these forward movements in priority dates was least expected after the recent immigration-related announcements, which is why this was welcome.

Lastly, May 2020’s visa bulletin sees that the Final Action Dates is finally current for all EB-1 countries worldwide, excluding India and China. This is some reprieve especially since these have become current after several months of retrogression.

May 2020 Visa Bulletin Analysis

A quick review of April’s visa bulletin reminds us that very little movement happened in any of the visa categories. But the good news then was that there weren’t any unexpected retrogressions either. We look at the May 2020’s visa bulletin to see how the priority dates have been impacted individually for each visa category and overall in the bigger picture of movement during this Covid-19 lockdown.

With the President Trump declaring a National Emergency due to the Coronavirus spread and the country had gone into complete lockdown mode, all USCIS offices were shut down and all in-person services suspended. There were little expectations in having any progress in priority dates.

Which Countries Are Current?

Except for India and China, the Rest of the World (ROW) stands current under the employment based (EB) visa categories. Particular reference to EB-3 which stayed at January 1, 2017.

Just as announced in April 2020’s visa bulletin, USCIS will be considering Final Action dates for adjustment of status filings in the month of May. 

If an adjustment of status (AOS) is being filed under the EB category, the priority date should be earlier than the date listed below.

Priority Dates for India

EB-1: Minor forward movement to August 1, 2015.

EB-2: Advanced to June 2, 2009, a small 1-week push.

EB-3: Another forward move to March 1, 2009.  With a month-and-a-half progression, this was positive move in cutoff date advancements after a several visa bulletins.

EB-5: India saw a substantial jump to October 1, 2019, a nine-month advancement for the cut-off dates. 

Priority Dates for China

EB-1: Similar to India’s small advancement, China moves ahead to July 15, 2017

EB-2: Moves up to October 1, 2015.

EB-3: Again, similar to EB-3 India, EB3 China advanced to May 15, 2016.

EB-5: The last advancement in the cutoff dates with a six-week jump to July 1, 2015.

Are Employment Based Visas Turning a New Leaf: March 2020 Visa Bulletin Analyzed

USCIS just released the March 2020 visa bulletin and it looks like the beginning of a (hopefully) positive trend for employment based (EB) visas. EB-1, Eb-2 and EB-5 have all advanced between three days to six months ahead. EB-3, however, retrogressed and like predicted from data in the February 2020 visa bulletin, it is expected to continue in this state of retrogression for the next couple of months without any change. All categories under family and employment based preferences are advised to use the Dates for Filing. See Table below.

EB-3 Worldwide Retrogression

EB-3 has continued to grow in demand. In order to keep the processing schedules in check the cut-off dates for ROW besides India and China has been retrogressed to January 1, 2017 with immediate effect. Adjustment of Status applications will continue unhindered until USCIS says otherwise. EB-3 for India and China have advanced to January 15, 2009 and March 22, 2016 respectively.

EB-5: Big Step Forward

EB-5 China saw the biggest forward movement with an advancement all the way up to May 15, 2015. EB-5 India advanced as well – seven weeks to October 22, 2018. ROW remains current. While EB-5 has a growing demand compare to other employment based visas, it doesn’t always reflect full capacity to meet the total number of visas available in each fiscal year. China is a case in point. Although the current scare of the Coronavirus has affected China as a whole, the number of EB-5 petitions filed continue to rise. However, there aren’t enough applicants to meet the total numbers in each year. By advancing the cut-off dates for EB-5 China, USCIS hopes to create more demand in this category.

Good to Know

To follow the above analysis, please keep in mind that priority date means that the immigrant visas will be available to individuals whose priority date is earlier than the cut-off date for filing.

For employment-based categories, an applicant’s priority date is the date of PERM application or Form I-140 submission, whichever is applicable.

For family-based categories, an applicant’s priority date is the date of the Form I-130 submission.

If priority dates are unavailable in the visa bulletin, applicants cannot apply for a green card in that category.
