PLUSH BOOKS COPYRIGHT INFRINGEMENT

I received several comments this morning informing me that one of my fanfictions has been stolen and published for money by a company called "Plush Books". A group of saints on twitter have been helping fic authors who's fics have been stolen, and have been providing information on what to do if you are affected. Please reblog this so that fanfic authors can check if they have been plagarised and learn what to do if they have.

Plush Books have been using FicLabs to download entire fics then upload them and sell them as e-books and paperbacks on multiple different sites including Amazon, Barnes and Noble, Abe Books and others.

Twitter user KokomRoily has been calling for help with contacting affected authors and a spread sheet in Google Docs of contacted authors has been made here. You can find the full list of works published by Plush Books here.

KokomRoily provides a good template to use with the Amazon DMCA takedown form (X, text version), which has limited characters, however, you will also need to search other sites too. Other sites have different legal requirements, and I'm copying the template I used here. A good way to find most of the places you need to contact is to look on Good Reads, which lists lots of the marketplaces selling the book.

Make sure you add an author note on the original story stating that this company do not have the rights to publish your fic. I strongly suggest sending this email from the email address that your fic account is registered to, in case you need to provide further evidence. Here is an email template that I put together based on the one above and modified according to the legal demands required on Barnes and Noble's takedown help page:

To whom it may concern,

I affirm under penalty of perjury that I am [YOUR AUTHOR NAME ON YOUR FIC], the author of the work "[YOUR FIC NAME]" posted at [LINK] (entire work) as a free-to-read story. My work has been stolen and published and you are currently listing the work as for sale at the following location [LINK ON MARKETPLACE] as "[BOOK NAME]" by Plush Books.

Under statute 17 USC 512, [MARKETPLACE] has a legal obligation to take down Plush Books' "[BOOK NAME]" in response to a valid DMCA takedown notice by the author. According to this statute, if "[BOOK NAME]" is not taken down, you are making [MARKETPLACE] liable to be sued. Please check with a manager to verify.

I will not be filling in my contact information such as home number and address and I am not required to do so in order for my claim to be valid. I have written in the author's note section of my story that I have not given Plush Books permission to use my work, which is proof enough that Plush Books has stolen the work from someone. If you would like more proof, I can email you screenshots of comments/kudos I've received from my readers from [DATE], the original date of publication, that are still in my inbox.

I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. The information in the notification is accurate, and I swear, under penalty of perjury, that I am the owner of an exclusive right that is allegedly infringed.

Please take ""[BOOK NAME]"" down.

One of the most unexpectedly and unintentionally amusing interactions I've seen on reddit was while browsing through the comments of a very predominantly female community. Not being specifically LGBT-focused, it was also naturally predominantly cishet just because that's how population statistics work. There was a conversation there about how men just don't understand how dangerous life can be as a woman, they've never had to play russian roulette with going out on dates and hoping they'll have a great night instead of ending up on a missing persons list.

Someone lamented how draining and exhausting it can be, starting a new relationship always means having to explain to another guy about why she needs to know where the security cameras are in places where she'll have to go alone at times when there aren't any other people there, and sometimes they just refuse to get it, because the only part of "sometimes men assault people" they hear is "men", and they'll immediately start defending themselves, that he personally would never assault anyone.

Then someone suggested to her, has she tried dating trans guys? Plenty of them are straight, have about the same range of personalities and interests as cis men do, and depending on her preferences essentially the only difference is that they get it. The original person hadn't considered that, and thanked for the suggestion.

And I know none of this is funny in any way, but it was so hilariously unexpectedly neutral. Neither fetishising nor invalidating, just a casual "have you tried this other type of dude", like someone had lamented how they want a dog but wouldn't want dog hair everywhere, and someone else suggesting dog breeds that don't shed.

Healthcare Travel

I’m sitting through a webinar for Point32 (the merged company made from Harvard Pilgrim Health Care and Tufts Healthcare) and they brought up healthcare travel due to the new state specific limitations in female reproductive care after Roe v. Wade was overturned. In a wbur article, it states, “Tufts Health Plan and Harvard Pilgrim Health Care said they will cover airfare, rental cars, and hotel stays for people who can’t get abortions where they live. This follows a similar move from Blue Cross Blue Shield of Massachusetts.”  https://www.wbur.org/news/2022/07/18/massachusetts-health-plans-abortion-travel-expenses

What does this mean for you?

If you live in a state which has limited your reproductive rights, it will be up to your health insurance carrier whether or not they provide this. So if your company’s situs state is Massachusetts (this is likely available in other progressive states, but the majority of my clients are in the NE) and it uses one of the major regional carriers (Tufts, HPHC, or BCBS MA... still waiting for an update from Allways) you will have travel covered for necessary reproductive medical care that isn’t allowed in your state. (Note: There are Blue Cross Blue Shield carriers across the country, and they are not the same, so don’t expect BCBS TX to cover this.) It’s possible Cigna, UHC, and Aetna will offer this dependent on the situs state of the employer, so stay tuned if you are on a national carrier.

Maybe the questions are “are mass shootings killing humans” and “should we get realistic gun control and background checks in place to stop the killing of humans under the guise of individual liberties”.

Would anyone in the NRA be willing to forever give up the ability to have a gun and gun license if it would save frozen embryos? 

How about “does renal kidney failure kill humans” and “should people be allowed not to become living organ donors on account of convenience”?

Are all healthy adults going to be forced to give blood monthly to save lives?

What’s the line of where we’ll allow the government to make decisions for our bodies?

What a lot of people get wrong about the abortion debate is this- they want to argue "abortion is good/bad/ok but in whatever circumstances/etc".

But that isn't the question at all. The question is "is this the government's business?" And "are strangers entitled to make this choice for you?" "Legally, who gets final say on your pregnancy/medical choices?"

And regardless of how you feel about abortion, I can't imagine anyone wanting their govenor/senator/president getting to decide that.
