The proposed Chat Control contravenes Articles 7 and 8 of the Charter of Fundamental Rights of the European Union, which guarantee the right to respect for private and family life and the protection of personal data. The indiscriminate surveillance of private messages without specific suspicion or cause directly violates these fundamental rights. The General Data Protection Regulation (GDPR) sets out stringent rules for the processing of personal data. The proposed indiscriminate surveillance and scanning of private messages before end-to-end encryption is fundamentally incompatible with the principles of data minimization and purpose limitation enshrined in the GDPR. Specifically, Articles 5 and 6 of the GDPR, which govern the lawfulness and principles of data processing, would be violated by the introduction of such measures. The implementation of Client-Side Scanning (CSS) on devices means that all messages and files are scanned on the user's device before being encrypted and sent. Moreover, the technical capability to scan such content could be exploited by malicious actors to circumvent or manipulate surveillance mechanisms. The knowledge that their private messages are being scanned and monitored could significantly restrict individuals' willingness to freely express themselves. Additionally, trust in digital communication platforms would be severely undermined. I urge you to take a strong stance against this disproportionate and unlawful measure. The privacy and digital rights of EU citizens must be safeguarded. It is imperative that we protect our fundamental rights and ensure transparency in the decision-making processes of our leaders. BAD CALIFORNIAN INTERNET BILLS

While it is good that KOSA is now dead in the House (for now) I would like to ask for people's attention on AB1949 and SB976, which could push for Age verification by showing your ID.

There was a third bill named AB3080 that had similar goals, but luckily it received revisions so it is no longer a threat or require ID verification to access websites. So it would be possible to get AB1949 and SB976 to be revised so they aren't dangerous anymore.

AB1949 doesn't explicitly ask for ID verification anymore, as it used to, due to a revision, but there is a provision stating if they deem a website "willfully disregards" the age of the user they will be deemed to have actual knowledge of the user's age.

This broad part could be left to abuse, which is why it needs to be revised before passing, in order to confirm ID verification is not required. FIND YOUR REPS HERE!

For AB1949, you can find your Senate representative with the link above as I said, and check to see if they're a member of the CA Senate Appropriations Committee. Then call them to tell them you oppose this bill. Try to add reasons you think this bill would negatively affect California financially because that's what this committee focuses on.

As for SB976, which you can read here

Its goal is to "keep kids off social medias and addictive feeds" But the concerning part is that "it would make it unlawful for the operator of an addictive internet-based service or application, as defined, to provide an addictive feed to a user, unless the operator does not have actual knowledge that the user is a minor; commencing January 1, 2027, has reasonably determined that the user is not a minor; or has obtained verifiable parental consent to provide an addictive feed to the user who is a minor."

How are you supposed to know that you have "verifiable parental consent" without ID and age verification of both parents and child?Even then, holding the ID of a minor feels pretty illegal given how sensitive how an info this is, in case of a data breach (which will happen) this would endanger kids even more, and no one in general want to give their ID to access a website or an app.

The bill would also make it unlawful for a website or app to send notifications to a minor according to a certain timeframe.

For SB976, find your Assembly representative using the link below and check to see if they're a member of the CA Assembly Appropriations Committee. Then call them to tell them you oppose this bill. https://apro.assembly.ca.gov/members

🚨🚨🚨 KOSA being voted on in Senate THIS THURSDAY 7/25/2024

Basically it is a mass censorship and surveillance bill being disguised as "child safety". Grassroots organizers have been fighting against this bill for two years, and now it's come to the point where it will likely pass the Senate unless we make a LOT of noise RN.

The best way to stop this bill is to go to https://www.stopkosa.com/ and use their call script to call your Senators and tell them to vote NO. After this, it goes to the House, and we need to show as much pushback as we can rn asap.

If KOSA passes, this will enable a possible future Trump presidency to go after any and every LGBT content online under the guise of "protecting kids from harm" exactly like they did with book bans. Except, it will be much, much worse.

If you don't know what Chat Control is, this post sums it up well, as well as to why its a bad idea, but in a nutshell, European citizens will be forced to accept having their private messages/photos to be scanned by AI Or else they can't send images, texts, videos or links anymore. The council vote has been delayed a few days ago, but it has been put back on the agenda according to this tweet

Activists Win Big Reprieve, Don't Let Up

EU Council has withdrawn the vote on Chat Control

Lack of majority thanks to severe pushback puts the proposal on hold.

The EU Council and its participants have decided to withdraw the vote on the contentious Chat Control plan proposed by Belgium, the current EU President. According to Netzpolitik (German), “The EU Council did not make a decision on chat control today, as the agenda item was removed due to the lack of a majority, confirmed by Council and member state spokespersons”. Belgium’s draft law, which was supposed to be adopted as the Council’s negotiating position, was instead postponed indefinitely. Although the Committee of Permanent Representatives meets weekly, Belgium cannot currently present a proposal that would gain a majority. In July, the Council Presidency will transfer from Belgium to Hungary, which has stated its intention to advance negotiations on chat control as part of its work program.

UPDATE: The Chat Control (AKA: CSAR) vote has been postponed for now! 🎉 This is great news! But the fight isn't over yet as it is expected that the Hungarian presidency will bring it up again. HELP US STOP CHAT CONTROL!

If you live in the EU, you absolutely need to pay attention to what's to come. What is Chat Control, you may ask? In a (failed) attempt to combat child abuse online the EU made Chat Control, Chat Control will result in getting your private messages and emails to be scanned by artificial intelligence aka AI to search for CSAM pictures or discussion that might have grooming in there. And on top of having your private conversations handed to AI or the police to snoop in, like your family pictures, selfies, or more sensitive pics, like the medical kind, only meant to be seen by your doctors, or the "flirtatious" kind you send to your partner, you either have to ACCEPT to be scanned...or else you will be forbidden from sending pictures, videos, or even links, as said here.

Kids should absolutely be protected online, without question, but the things that Chat Control gets wrong is that this is a blatant violation of privacy, without even considering the fact that AI WILL create tons of false positives, this is not a theory, this is a fact. And for all the false positives that will be detected, all of them will be sent to the police, which will just flood their system with useless junk instead of efficiently putting resources to actual protect kids from predators.

It also does not help that politicians, police officers, soldiers etc will be exempt from Chat Control if it passes. If it's for the sake of protection, shouldn't everyone get the same treatment? Which further prove that Chat Control would NOT keep your data of private life safe. Plus, bad actors will simply stop using messenger apps as soon as they know they're being tracked, using more obscure means, meanwhile innocent people will be punished by using those services On top of this, the EU also plans on reintroducing Data retention called "EU Going Dark". Both Chat Control and EU Going Dark are clear violation of the GDPR, and even if they shouldn't stand a chance in court, its not going to prevent politicians from trying to ram these through as an excuse to mass surveil European citizens, using kids as a shield. Even teenagers sending pictures to each other won't be exempt, which entirely goes against the purpose of protecting kids by retaining their private photos instead. Furthermore, once messaging apps are forced to comply with Chat Control, the president of Signal, a secured messaging app with encryption, have confirmed that they will be forced to leave the EU if this is enforced against them.

If Chat Control also ends up targeting any websites with the option of private messages, you better expect Europe to be geo-blocked by any websites offering such function. I would also like to add that EU citizens were very vocal in the fight against KOSA, an equally bad internet bill from the US-- and it showed! Which is why we heavily need the help of our fellow US peers to fight against Chat Control too, so please, because we all know if it passes, the US government will take a look at this and conclude "Ooh, a way to force mass surveillance on citizens even more than before? don't mind if I do!" It's always a snowball effect.

KEEP IN MIND THE EUROPE COUNCIL WILL LIKELY VOTE ON CHAT CONTROL THIS 19 JUNE OF NEXT WEEK TO SEE IF IT WILL ENTER TRILOGIES OR NOT. Even if it does enter Trilogues, the fight will only be beginning. Absentees may not count as a no, so it is crucial that you contact your MEPs HERE, as well as HERE, and you can also show your support for Edri's campaign against Chat Control HERE.
