How to Report Stolen Art on Twitter, Instagram, and TikTok (2022 Updated)

🌸 DMCA and You 🌸

If you're reading this, you may be the victim of reposted or traced artwork. It can feel demoralizing and sad when other people take credit for your work, but know that you have rights! As the original artist, you own the rights to art that you create.

Under the Digital Millennium Copyright Act (DMCA), online platforms like Twitter, Instagram, and TikTok will issue "takedown notices" to users who infringe on copyright. These notices are only valid if you have a good faith belief that the infringer is not protected by fair use. More on DMCA for artists here.

What is "fair use"?

Essentially, that the new work is transformative in purpose and character. Examples include research, parody, journalism, and critique. Repost accounts exist to gain followers, and do not fall under fair use. Tracing another artist's work or "photo-bashing" without permission are not fair use either (see end for examples).

🌸 Where to File 🌸

To file, you will need at minimum a name, a physical address, and an email address*. I've organized this list roughly by my success rate with getting reposts removed, along with # of reports submitted. Turnaround refers to how quickly I received a response to my report.

(@laine-o adds: I have had some success with filing DMCAs without including my full name/complete personal info as that can deter artists from filing DMCAs.)

I. Instagram:

Turnaround: 2 minutes - 8 hours

Success rate: 96% (n=33, 2 pending)

While the repost community is huge on this platform, admins are quick and efficient with responding to reports

II. Twitter:

Form: https://help.twitter.com/en/forms/ipi/dmca/copyright-owner/redirect

Turnaround: 2 days

Success rate: 100% (n=1)

Twt has a robust art community that lambasts reposters, so it's rare that I've had to submit one

III. Meta (f.k.a. Facebook):

Form: https://www.facebook.com/help/contact/1758255661104383

Turnaround: 24h

Success rate: 100%

I haven't personally used this platform but @laine-o reports success :)

IV. Pinterest:

Form: https://www.pinterest.com/about/copyright/dmca-pin/

Turnaround: ?6 months

Success rate: 100% (n=4)

I've never received an email response to my reports, but all four posts I reported were taken down. Make sure you are reporting fresh uploads of your work and not pinned "links" to twt.

V. TikTok:

Form: https://www.tiktok.com/legal/report/Copyright?lang=en

Turnaround: ??

Success rate: 0% (n=2 / pending)

I'm sorry little one, this is... the Sunken Place. TikTok's DMCA form requires you to provide "a certificate, license agreement, and/or other materials" to prove you are the copyright owner. I've tried submitting a letter, and if it works, I will upload a template. Anecdotally, I don't know of any small artists who have successfully had their work removed through DMCA reports.

🌸 Tips & Tricks 🌸

Asking your followers to report a repost won't work. You, the copyright owner, must file the request.

Watermark your art so your handle is visible on reposts

If you find yourself frequently reposted (prayers 4 tenartist), set up autofill on Chrome and save the repost URLs to report in bulk.

Reverse Google Image your work to find reposts on various sites.

And my #1 tip:

⭐️🌟File the DMCA report before you contact the reposter.🌟⭐️ Until you've had the experience of an online user DMing you a college thesis on why you should feel honored that they stole your art for their shitty curated repost page only for IG to approve your report and their account to be deleted mid-rant due to too many DMCA strikes... you have not experienced true schadenfreude, my friend.

🌸🌸🌸🌸 Ch 17 Excerpt: 🌸🌸🌸🌸 The metal walls of the mineshaft zipped past as she free-fell into the depths of the Earth. Blindly, she scrambled against the grooves of the metal plates, her fingers and soles heating with friction.

When she found purchase, she stopped to catch her breath. The air underground was warm and gritty, with the unpleasant scent of old eggs in someone’s forgotten lunch. Overhead, the bright sky was but a distant star in a pitch black night; below, the bottom of the mineshaft was a small square, haloed in a green glow.

How far down did this mine go?

Not too far, she hoped. She had to clamber back up with Riku in tow. As Sakura descended, the metal trembled under her hands, and every so often, the whole shaft reverberated with a low, ominous groan. At the end of the shaft, Sakura pushed chakra into the walls, trying to sketch a map of the mine in her mind, and…

It was useless.

The stony heart of the mountain pulsed like living flesh, and the mine below the great belly of the beast. In her mind’s eye, the crystal gem embedded in the soil burned as bright as fire, too blinding to discern from other signals.

It could be Riku or an entire army down there.

Hanging from the ceiling, Sakura crawled out of the mineshaft.

A vast cavern opened below her, nearly as wide across as the excavation pit above. Construction must have progressed since Sasuke visited with Higa. The smooth ceiling sloped against support beams, and steel tram carts rested on double-wooden rails that split into a network of dark tunnels. Singular lightbulbs hung from the ceiling, but their glow was dimmed by lurid veins of yellow-green threading the walls, coalescing at a tangle so bright it was nearly blinding.

Sakura’s eyes adjusted to the cavern’s single occupant at the center: lithe frame, black hair, and sharp eyes narrowing over a gas mask—

“You should’ve run while you had the chance.”
