The US Copyright Office frees the McFlurry

I'll be in TUCSON, AZ from November 8-10: I'm the GUEST OF HONOR at the TUSCON SCIENCE FICTION CONVENTION.
I have spent a quarter century obsessed with the weirdest corner of the weirdest section of the worst internet law on the US statute books: Section 1201 of the Digital Millennium Copyright Act, the 1998 law that makes it a felony to help someone change how their own computer works so it serves them, rather than a distant corporation.
Under DMCA 1201, giving someone a tool to "bypass an access control for a copyrighted work" is a felony punishable by a 5-year prison sentence and a $500k fine – for a first offense. This law can refer to access controls for traditional copyrighted works, like movies. Under DMCA 1201, if you help someone with photosensitive epilepsy add a plug-in to the Netflix player in their browser that blocks strobing pictures that can trigger seizures, you're a felon:

But software is a copyrighted work, and everything from printer cartridges to car-engine parts have software in them. If the manufacturer puts an "access control" on that software, they can send their customers (and competitors) to prison for passing around tools to help them fix their cars or use third-party ink.
Now, even though the DMCA is a copyright law (that's what the "C" in DMCA stands for, after all); and even though blocking video strobes, using third party ink, and fixing your car are not copyright violations, the DMCA can still send you to prison, for a long-ass time for doing these things, provided the manufacturer designs their product so that using it the way that suits you best involves getting around an "access control."
As you might expect, this is quite a tempting proposition for any manufacturer hoping to enshittify their products, because they know you can't legally disenshittify them. These access controls have metastasized into every kind of device imaginable.

DMCA 1201 is the brainchild of Bruce Lehmann, Bill Clinton's Copyright Czar, who was repeatedly warned that cancerous proliferation this was the foreseeable, inevitable outcome of his pet policy. As a sop to his critics, Lehman added a largely ornamental safety valve to his law, ordering the US Copyright Office to invite submissions every three years petitioning for "use exemptions" to the blanket ban on circumventing access-controls.
I call this "ornamental" because if the Copyright Office thinks that, say, it should be legal for you to bypass an access control to use third-party ink in your printer, or a third-party app store in your phone, all they can do under DMCA 1201 is grant you the right to use a circumvention tool. But they can't give you the right to acquire that tool.
I know that sounds confusing, but that's only because it's very, very stupid. How stupid? Well, in 2001, the US Trade Representative arm-twisted the EU into adopting its own version of this law (Article 6 of the EUCD), and in 2003, Norway added the law to its lawbooks. On the eve of that addition, I traveled to Oslo to debate the minister involved:

The minister praised his law, explaining that it gave blind people the right to bypass access controls on ebooks so that they could feed them to screen readers, Braille printers, and other assistive tools. OK, I said, but how do they get the software that jailbreaks their ebooks so they can make use of this exemption? Am I allowed to give them that tool?
No, the minister said, you're not allowed to do that, that would be a crime.
Is the Norwegian government allowed to give them that tool? No. How about a blind rights advocacy group? No, not them either. A university computer science department? Nope. A commercial vendor? Certainly not.
No, the minister explained, under his law, a blind person would be expected to personally reverse engineer a program like Adobe E-Reader, in hopes of discovering a defect that they could exploit by writing a program to extract the ebook text.
Oh, I said. But if a blind person did manage to do this, could they supply that tool to other blind people?
Well, no, the minister said. Each and every blind person must personally – without any help from anyone else – figure out how to reverse-engineer the ebook program, and then individually author their own alternative reader program that worked with the text of their ebooks.
That is what is meant by a use exemption without a tools exemption. It's useless. A sick joke, even.
The US Copyright Office has been valiantly holding exemptions proceedings every three years since the start of this century, and they've granted many sensible exemptions, including ones to benefit people with disabilities, or to let you jailbreak your phone, or let media professors extract video clips from DVDs, and so on. Tens of thousands of person-hours have been flushed into this pointless exercise, generating a long list of things you are now technically allowed to do, but only if you are a reverse-engineering specialist type of computer programmer who can manage the process from beginning to end in total isolation and secrecy.
But there is one kind of use exception the Copyright Office can grant that is potentially game-changing: an exemption for decoding diagnostic codes.
You see, DMCA 1201 has been a critical weapon for the corporate anti-repair movement. By scrambling error codes in cars, tractors, appliances, insulin pumps, phones and other devices, manufacturers can wage war on independent repair, depriving third-party technicians of the diagnostic information they need to figure out how to fix your stuff and keep it going.
This is bad enough in normal times, but during the acute phase of the covid pandemic, hospitals found themselves unable to maintain their ventilators because of access controls. Nearly all ventilators come from a single med-tech monopolist, Medtronic, which charges hospitals hundreds of dollars to dispatch their own repair technicians to fix its products. But when covid ended nearly all travel, Medtronic could no longer provide on-site calls. Thankfully, an anonymous hacker started building homemade (illegal) circumvention devices to let hospital technicians fix the ventilators themselves, improvising housings for them from old clock radios, guitar pedals and whatever else was to hand, then mailing them anonymously to hospitals:

Once a manufacturer monopolizes repair in this way, they can force you to use their official service depots, charging you as much as they'd like; requiring you to use their official, expensive replacement parts; and dictating when your gadget is "too broken to fix," forcing you to buy a new one. That's bad enough when we're talking about refusing to fix a phone so you buy a new one – but imagine having a spinal injury and relying on a $100,000 exoskeleton to get from place to place and prevent muscle wasting, clots, and other immobility-related conditions, only to have the manufacturer decide that the gadget is too old to fix and refusing to give you the technical assistance to replace a watch battery so that you can get around again:

When the US Copyright Office grants a use exemption for extracting diagnostic codes from a busted device, they empower repair advocates to put that gadget up on a workbench and torture it into giving up those codes. The codes can then be integrated into an unofficial diagnostic tool, one that can make sense of the scrambled, obfuscated error codes that a device sends when it breaks – without having to unscramble them. In other words, only the company that makes the diagnostic tool has to bypass an access control, but the people who use that tool later do not violate DMCA 1201.
This is all relevant this month because the US Copyright Office just released the latest batch of 1201 exemptions, and among them is the right to circumvent access controls "allowing for repair of retail-level food preparation equipment":

While this covers all kinds of food prep gear, the exemption request – filed by Public Knowledge and Ifixit – was inspired by the bizarre war over the tragically fragile McFlurry machine. These machines – which extrude soft-serve frozen desserts – are notoriously failure-prone, with 5-16% of them broken at any given time. Taylor, the giant kitchen tech company that makes the machines, charges franchisees a fortune to repair them, producing a steady stream of profits for the company.
This sleazy business prompted some ice-cream hackers to found a startup called Kytch, a high-powered automation and diagnostic tool that was hugely popular with McDonald's franchisees (the gadget was partially designed by the legendary hardware hacker Andrew "bunnie" Huang!).
In response, Taylor played dirty, making a less-capable clone of the Kytch, trying to buy Kytch out, and teaming up with McDonald's corporate to bombard franchisees with legal scare-stories about the dangers of using a Kytch to keep their soft-serve flowing, thanks to DMCA 1201:

Kytch isn't the only beneficiary of the new exemption: all kinds of industrial kitchen equipment is covered. In upholding the Right to Repair, the Copyright Office overruled objections of some of its closest historical allies, the Entertainment Software Association, Motion Picture Association, and Recording Industry Association of America, who all sided with Taylor and McDonald's and opposed the exemption:

This is literally the only useful kind of DMCA 1201 exemption the Copyright Office can grant, and the fact that they granted it (along with a similar exemption for medical devices) is a welcome bright spot. But make no mistake, the fact that we finally found a narrow way in which DMCA 1201 can be made slightly less stupid does not redeem this outrageous law. It should still be repealed and condemned to the scrapheap of history.

Yanında gelenler kocası ve kaynanasıymış kocası işsiz üniversite mezunu biriydi İsmi Haşmet ti . Birkaç yer ile görüştüm onay aldım iş görüşmesine gönderdim Fatma çıkarken elime bir kağıt parçası sıkıştırdı . Onlar gider gitmez kağıdı açıp okudum yarın beni 11 den sonra ara numaram bu yazmıştı. O gece sabaha kadar Fatma yı düşünerek 31 çekmiştim. Ertesi gün saat 11 de telefon numarasını çevirdim Fatma açtı efendim Nazlı dedi bende ses çıkarmadan kapattım demek ki müsait değildi 11 35 te telefonum çaldı arayan Fatma ydı açtım konuştuk 4 yıl önce evlenmiş kocasının ne yatakta ne de başka bir yerde hiçbir işe yaramadığını söyledi. Daha önce bahsettiğim milletvekili ile görüştüm Fatma yı devlet Hastanesine işe aldırdım 2 hafta sonra işe başladı . Bu süreçte her gün telefon da konuştuk 4 yıl içinde 4 kez seks yapmadık dedi bende sen zaten seks yapmasını sevmezsin ne güzel işte dedim. Yok aslında çok seviyordum da kızlığımı elimden alırsın sonra evlendiğimde kocama ne derim diye düşündüğüm için sevmiyormuş gibi yapıyordum dedi. Cuma akşamı olmuş eve gittim hazırlandım belki erken boşalırım diye hap bile aldım, saat 21 gibi hastaneye gittim ortalık sakin herşey yolundaydı odasına gittim yanında 2 hemşire ve q hasta bakıcı vardı elime yine bir kağıt parçası sıkıştırdı 5 kat 507 numara yazıyordu , hemen odaya çıktım stor perdeleri kapattım 10 dakika sonra geldi kapıyı kilitledi öpüşmeye başladık öpüşürken soyunarak okşuyorduk birbirimizi, yatağa uzandı 69 pozisyonuna geçtik o kadar güzel kokuyordu ki o da kendini bana hazırlamıştı belki 1 saate yakın amını götünü yaladım o da bana sakso çekti kendi kendime işte aynı annem gibi bir kadın elimin altında ve ben bu kadına gerçek anlamda sahip değilim ama altındaydı. Ben ilaç aldığım için boşalmıyordum Fatma enaz 4 kez boşalmıştı altımdan kalktı sikimin üstüne çıkıp oturdu zıplamaya başladı birlikte patladık ama ne patlama zevkten kendimizi kaybetmiştik. Giyinip odadan çıktı gitti bende biraz TV izledim belki 30 belki 45 dakika sonra geldi soyunup amını ağzıma verdi sikimi ağzına aldı sikim kazık gibi olmuştu yatağa yatırıp bacak arasına girip sikimi amına soktum pompalamaya başladım ben her girip çıkmamda zevkten inliyordu bu sefer ağzıma boşal döllerini yutmak istiyorum sonrakini götüme boşalmanı aynı okuldaki gibi beni sikmeni istiyorum dedi. Dediğini harfiyen yerine getirdim . Her orgazmdan sonra işinin başına geçti sonra tekrar benim koynuma geldi .
Korona başlamıştı ilk ben korona oldum benden de Fatma ya bulaştı ben hayattayım ama Fatma 03. 05. 2020 de hayata gözlerini yumdu. Nurlar içinde yatsın kocası ile şimdi çok iyi bir arkadaşız yeniden evlendi ikna ettim karısını bana kendi elleriyle siktirecek karısı bilmiyor ama kocası benim altıma yatıyor bana canım ne zaman isterse sakso çekiyor. Joker Out Masterpost for new fans
New fan of Joker Out? Say no more!
Getting to know a new artist you’ve found can be intimidating if it’s all in another language, so we’ve compiled some of our favourite interviews, articles and lore here! You’ve arrived in a wonderful fanbase, welcome from all of us here at JokerOutSubs!

How did the band form?
Joker Out was formed from two bands, Apokalipsa and Buržuazija.
Apokalipsa included Bojan Cvjetićanin (vocals), Martin Jurkovič (bass) and Matic Kovačič (drums)
They gained some traction with young people around Slovenia, particularly with their song 'Mogoče' ('Maybe'), which you can watch on YouTube here.
They came to the attention of Kris Guštin, who was inspired to start learning guitar! He discusses the details in this video (at 9:40).
Kris then met Jan Peteh, another student of his guitar teacher, and at their teachers advice, they formed the band Buržuazija.
Bojan attended their second ever gig in 2016, and decided these two excellent guitarists were exactly what had been missing from Apokalipsa, as he wasn’t happy with their current guitarists. He asked them to join, and they accepted
The new lineup (Bojan, Jan, Kris, Martin and Matic) decided to rename themselves Joker Out. The name means nothing, but they thought it sounded good and was the ‘least horrible’ of all the ideas they could think of.
So, in 2016, Joker Out was officially formed!
November 2016, Kot srce ki kri poganja:
Joker Out’s first music video was for their song ‘Kot srce ki kri poganja’ ('Like a heart that pumps blood'), filmed in Jan’s hometown of Vrhnika! We eventually got this song on Spotify on their 2023 album Live from Arena Stožice!

June 2017, Špil Liga:
One of the earliest performances for Joker Out was at Špil Liga, a competition for young bands in Slovenia. They won, and recorded their winning song, Omamljeno telo (intoxicated body) in November as part of the prize.

c.2017/18, Bojan’s attempt at going solo:
The band took a hiatus c.2017/18, and Bojan considered going solo at that time, even working with a few producers. He eventually realised that he belonged with the band! Hear him tell the story:

2019, A change up for the band:
The band began working with their current producer, Žare Pak, and their videographer Mark Pirc, in 2019 - both of whom have been referred to as the sixth member of the band. This led to a change in their sound and production quality, which culminated in ‘Gola’ ('Naked'), the first of their songs to be a big hit!

Zlata piščal ('Golden Flute') - Best New Artist 2019:
Joker Out won their first Zlata piščal award in 2019, for best new artist (one of many they’d go on to win!) This is a kind of Slovenian Grammy! Covid interrupted the proceedings, but you can see their interview for it here (3m 59s)-

Umazane misli, and a new member:
During the Covid times, the band began recording their first studio album, 'Umazane misli' ('Dirty thoughts'), which was originally going to be released in March 2020 but was repeatedly delayed until October 2021. The first half was recorded with drummer Matic Kovačič, but the band felt they needed something extra and brought in Jure Maček to help write the arrangements. They loved him so much, he never left!

COVID times, and Cvetličarna:
The band had arranged to do two concerts at Cvetličarna, a very important venue in Slovenia and a big break for them. This was delayed several times due to Covid, but eventually managed to go ahead in October 2021 for the release of their first album.

Umazane misli album launch:
'Umazane misli' was extremely well received! The band would go on to win two more Zlata piščal awards, Newcomers of the Year in 2020 and Artist of the Year in 2021.

An acting career for Bojan?
Around the same time as 'Umazane misli' was released, Bojan began considering an acting career. He acted in two episodes of the series ‘Gospod Professor’ and in another series, which was eventually reworked as a film called ‘Kaj pa Ester’ and released in December 2023. He decided music was his passion though, and he wanted to fully focus on that.

September 2022, Križanke:
The band got straight to work writing their second album, 'Demoni' ('Demons'), and decided to present it in September 2022 at Križanke, another hugely important venue in Slovenia. This whole concert wasn’t recorded, but we have an interesting advertisement they did for it, an interview and a clip of one song live from Križanke!

Another new member!
After Križanke at the end of 2022, Martin Jurkovič, one of the founding members of the band, made the decision to leave to focus on his studies.

2023, Eurovision:
Joker Out were then internally selected to go to Eurovision 2023, and began recording their Eurovision song, 'Carpe Diem', in Hamburg in December 2022. To learn more, you can watch the Carpe Diem series, a documentary series which followed their entire journey.

Luckily, the best was still to come for Joker Out! The rest of 2023 was spent on an extremely successful European tour, and they also released their first English single, 'Sunny Side of London', in September.

6th of October 2023, Stožice:
All of this, however, was building up to Stožice. This is the biggest closed venue in Slovenia and Joker Out managed to sell out their October show there - an extremely important milestone for Slovenian artists.

Joker Out spent the beginning of 2024 in London, where they wrote new music, did live cooking shows on Instagram and met the incredibly talented photographer, Damon Baker, who did a beautiful series of photoshoots with them. They also released their next English single, 'Everybody’s Waiting', in February.

what’s with the kadian 16:23?
we have a couple of number combinations that have meaning to the fandom and this one is making the rounds lately. primarily because xzs have been posting material related to this album at this time. i understand 10:00 and 10:05, even 10:30, 11, 12, 13:00 but for some reason the 16:23 has been very consistent and too specific. the conversation around it and digging up times related to it became louder because of how xzs featured this specific time on their video from friday. personally, 16 to me is yibo’s number and 23 is ofcourse love zhan. so putting that together in a bjyx-kadian-biased way made sense to me.

maybe it’s as simple as someone from xzs team asking gege if there is a specific posting time he wants and he said 16:23.
if we are going by that assumption, then these may be some reasons why it’s important…
1. I’m seeing some throw in the explanation that this may be a substitute to 18:23. It may be too sus to use this repeatedly when everyone knows what it means lol. So 16:23 may be a safer choice, those who know that 16 is yibo’s number will understand. and not many are aware of this fact. He also allegedly has a fake account called ASAP16
2. XZ has used 1623 license plate before which i understand is stalker information and more likely than not out of their control. I’m just putting it out there.
3. Back in 2020, WYB bday post was a shoe. This was back when he was a Nike boy. But the posting of 16:23 is unique and why would he choose that for a special day.

4. This is more of the number 16, there was a LRLG rumor where it appears they are talking about this pig doll with a 16 on it. I really think that this kadian is directed more towards the 16 to represent Yibo.

🟢: "It's getting cold. I'm afraid his head will freeze. Doesn't this hat look pretty?"
🔴: "Well, you're pretty good at taking care of yourself."
Wang laoshi then just locked the phone and refused to reply? Hahahahahaha. It was a little piggy doll wearing a hat with the number "16" on it. Very cute
5. There are other times that XZS posted at this time and one if for the new year and GG’s bday. I’d like to think that this has always been a favorite but it’s more in our face with the album promotion.


compared to other kadian, this is one that may need more time to be fully realized. i find it significant that out all the songs, Lighthouse got the 16:23 written all over it. if you believe that it’s a song for yibo, then maybe the 16:23 is really what we think it is. 🫶🏼
lastly, another cpn connected to this is how xzs skipped to post anything on GRA weekend. but to me this was more of professional courtesy to this important event. xz and his team most likely didn’t want to be mistaken as trying to overshadow anyone. there are other times where i think their studios are coordinated in order to not clash — for example this tuesday, the main release time for XZ materials is 10:00 and WYB’s magazine release is 12 onwards — but this incidence ( at least to me ) is not one of those.

The CFPB is genuinely making America better, and they're going HARD

On June 20, I'm keynoting the LOCUS AWARDS in OAKLAND.
Let's take a sec here and notice something genuinely great happening in the US government: the Consumer Finance Protection Bureau's stunning, unbroken streak of major, muscular victories over the forces of corporate corruption, with the backing of the Supreme Court (yes, that Supreme Court), and which is only speeding up!
A little background. The CFPB was created in 2010. It was Elizabeth Warren's brainchild, an institution that was supposed to regulate finance from the perspective of the American public, not the American finance sector. Rather than fighting to "stabilize" the financial sector (the mission that led to Obama taking his advisor Timothy Geithner's advice to permit the foreclosure crisis to continue in order to "foam the runways" for the banks), the Bureau would fight to defend us from bankers.
The CFPB got off to a rocky start, with challenges to the unique system of long-term leadership appointments meant to depoliticize the office, as well as the sudden resignation of its inaugural boss, who broke his promise to see his term through in order to launch an unsuccessful bid for political office.
But after the 2020 election, the Bureau came into its own, when Biden poached Rohit Chopra from the FTC and put him in charge. Chopra went on a tear, taking on landlords who violated the covid eviction moratorium:

Then he banned comparison shopping sites where you go to find the best bank accounts and credit cards from accepting bribes and putting more expensive options at the top of the list. Instead, he's requiring banks to send the CFPB regular, accurate lists of all their charges, and standing up a federal operated comparison shopping site that gives only accurate and honest rankings. Finally, he's made an interoperability rule requiring banks to let you transfer to another institution with one click, just like you change phone carriers. That means you can search an honest site to find the best deal on your banking, and then, with a single click, transfer your accounts, your account history, your payees, and all your other banking data to that new bank:

Somewhere in there, big business got scared. They cooked up a legal theory declaring the CFPB's funding mechanism to be unconstitutional and got the case fast-tracked to the Supreme Court, in a bid to put Chopra and the CFPB permanently out of business. Instead, the Supremes – these Supremes! – upheld the CFPB's funding mechanism in a 7-2 ruling:

As Kuttner writes, the common thread running through all these orders is that they ban deceptive practices – they make it illegal for companies to steal from us by lying to us. Especially in these dying days of class action suits – rapidly becoming obsolete thanks to "mandatory arbitration waivers" that make you sign away your right to join a class action – agencies like the CFPB are our only hope of punishing companies that lie to us to steal from us.
There's a lot of bad stuff going on in the world right now, and much of it – including an active genocide – is coming from the Biden White House.
But there are people in the Biden Administration who care about the American people and who are effective and committed fighters who have our back. What's more, they're winning. That doesn't make all the bad news go away, but sometimes it feels good to take a moment and take the W.

Not sure if this is the right time to ask this but how old are the prisoners now? We know what their age was going into Milgram, but what is it now? Since Mahiru was just short of her birthday
Star and I have been looking for the post where I list the characters ages and birth years though neither of us can find it at the moment I'll link it again if one of us do.
Sakurai, Haruka
Age when brought to Milgram: 17 (said he was this age but didn't really care too much about his own age. So, he wasn't sure. Actively lied about his age is one of the oldest young adult prisoners here. He is older than Mahiru, Futa, and Kotoko.)
Turned: 18 (said he was seventeen in his first voice drama meaning he would have turned eighteen the first year he was in Milgram if this were true. It's not it's fiction he made it up.) Haruka Sakurai was 22 when brought into Milgram and turned 23 during his first two months of incarceration within Milgram.
Birthdate: 06-22-2001 Lying dead bastard- 06-22-1997
Age at demise: would have been 23 (this is based on a lie and inaccurate) 27 or 28 if he passed away after June 22, 2025
Kashiki, Yuno
Age when brought to Milgram: 18
Turned: 19 her first four to five months of incarceration in 2020
Birthdate: 09-02-2001
Current Age: 23 turning 24 on September 02, 2025 (if she lives to see it)
Kajiyama, Futa
The specialist birthday boy. Had his birthday right before being taken to Milgram. His character description on the website says he's twenty. His birthday is on April 19 the first video for Milgram the MILGRAM / Teaser Movie released on April 27, 2020 after Futa's birthday.
So for him to be twenty when he was brought there means the prisoners must have awoken or been brought to Milgram on either the day the MILGRAM -ミルグラム- / PV video came out April 27, 2020 or when the MILGRAM / Jackalope’s “This is the MILGRAM” video came out on May 1, 2020.
Futa's age gives us a big hint for when the prisoners arrived within the prison in that sense.
I believe it was the former since the video released on April 27, 2020 is when we hear Es and all the prisoners for the first time. This also aligns with the beginning of the timelines as well.

Current Age: 19 going on 20 whenever their birthday is. So literally Futa's age when he did what Es/the audience found him guilty for driving someone to suicide and or instigating someone's death but not killing them directly. Man it would be awkward if they did the exact same thing at the exact same age now wouldn't it- Luckily we don't live in that timeline.
My apologies that this took a bit to answer. I had @apatchworkstar check over it to make sure I was doing the math right before posting just in case I messed up and I did with Mahiru. Now no one will ever know how. Yay always have someone check over your work when you suck at mental math and are greatly out of practice with the subject and art of it.
Hope this is helpful to you and others in some way. Honestly more art of the prisoners at the irl time ages would be great. So maybe this may lead to that or nothing but just more knowledge being out there.
