What If I Already Have a Valid B1/B2 Visitor Visa?
While the ESTA Travel Authorization is completed online with no interview, there are Visas that require a U.S. Embassy interview. The Visa process has separate procedures, which generally require an appointment, travel to a U.S. Embassy, an interview with a Consular Officer, processing time, and the payment of an application fee. Can I Re-Apply for an ESTA Travel Authorization if Denied?
Yes, but you must wait at least 10 days to reapply and your circumstances must have changed. Unless there is a change in a substantive fact, re-application will not change the result. Keep in mind that applying for an ESTA Travel Authorization with false information can cause a foreign national to be permanently barred from ever entering America. The ESTA system is designed to try to prevent individuals from changing and manipulating an ESTA entry until they receive an approval.
What If I am Denied an ESTA Travel Authorization and Have No Changed Circumstances?
There are three types of responses to an ESTA application; approved, pending or travel not authorized (denied). Applicants who receive a "pending" response are advised to check the website 72 hours later. Applicants who are denied will be required to go to a U.S. Embassy to apply for a formal nonimmigrant visa, such as a B1/B2 Visa, which may take months.
Can a Traveler Find Out the Reason Why an ESTA Application was Denied?
The U.S. Dept. of Homeland Security has stated that travelers may contact the DHS Travel Redress Inquiry Program (DHS TRIP at dhs.gov) but there are no guarantees that information about a denial will be divulged. U.S. Embassies and Consulates are not required to provide details about an ESTA denial nor resolve the issue that caused the ESTA denial.
What If I Have a Criminal Record?
Only those qualified to travel under the VWP are eligible to pre-register through ESTA. Persons who have been arrested and/or convicted are generally not eligible for VWP and probably require a formal Visa, such as a B1/B2 Visa, to travel to America. How Long Will the ESTA Application Data be Stored? Who Can Access It?
The ESTA Travel Authorization is valid for two years or until the traveler's passport expires, whichever comes first. The American government will maintain the information for at least 15 years to allow retrieval of the information for law enforcement, national security, or investigatory purposes. Information submitted through ESTA can also be shared with any U.S. government organization.
What Information Does the Airlines Get?
Airlines will receive confirmation of a passenger's ESTA status visa the "Advance Passenger Information System" (APIS) which shows whether the ESTA authorization has been granted for a Visa Waiver Program traveler. The traveler must provide (in English) biographical data including name, birth date, country of citizenship, country of residence, email address, sex, telephone number, passport information, destination address in the U.S., travel information (round trip airline ticket, flight number and city where you are boarding) as well as questions regarding communicable diseases (chancroid, gonorrhea, granuloma inquinale, HIV, leprosy, lymphogranuloma venereum, syphilis [active], tuberculosis [active], and others), physical or mental disorders, drug addiction problems, arrests, convictions, past history of visa cancellation or denial, and prior deportations from the U.S. The traveler will also be asked whether they are seeking work in the U.S., have ever been deported or tried to get a visa by fraud or misrepresentation. The traveler will be asked if they have ever detained a child of a U.S. Citizen granted custody of the child, and whether they have ever asserted immunity from prosecution.
Do I Select "Business" or "Pleasure (Tourist) at the Airport Port of Entry?
After the ESTA Travel Authorization is granted, the foreign traveler will be interviewed by government officers at the first American airport they land. The officer will ask what the foreign traveler will be doing in America and the questioning can take up to four hours in a detained setting called "secondary inspection." The officer may ask the traveler "what else are you doing in America?" repeatedly to try to get "the real" answer. If the traveler is only going to be a tourist, they are not allowed to do any business, including meeting with any attorneys, applying for a bank account, meeting with real estate agents, or other business consulting activities. Even though the traveler is going to conduct just one business meeting while in America, they are required to report it and enter as a business visitor. The business visitor is allowed to participate in tourist activities, but the tourist visitor is not allowed to participate in any business activities. Therefore, if any business might be conducted while in America, it is best to tell the government officers about it at the airport to avoid being accused of lying, put immediately on a plane back to your home country, and barred from America for life.

A White House official has confirmed that the US is set to reopen to foreign nationals from “early November” – but it will only be allowing entry to travellers who have had both Covid-19 vaccines.
Non-citizens visiting the United States will have to show proof of full vaccination as well as a negative Covid test taken within three days of departure, said Jeff Zients, the pandemic response coordinator for the White House.
“This new system allows us to implement strict protocols to prevent the spread of Covid from passengers flying internationally to the United States. Requiring foreign nationals travelling to the United States be fully vaccinated is based on public health,” said Zients at press briefing on Monday. “This is based on individuals rather than a country-based approach.”
According to Zients, the changes will take effect in “early November”, though no formal announcement has been made of an exact date.
Until then, the same travel ban that has been in place for the UK since March 2020 remains.

Who can currently travel to the US?
At present, US citizens and those with right of residence in the US can travel there from any country, along with foreign nationals from all countries outside of a select few barred in a presidential proclamation in January 2021 – as listed below.
On 25 January, President Joe Biden signed legislation banning foreign nationals arriving from several countries, including the UK, South Africa, Brazil, Ireland, and much of Europe, due to variants of concern.
This followed an earlier ban of arrivals from the UK in March 2020, by then-president Donald Trump, meaning the US has been shut off to British travellers for 18 months.

People from these countries with a compassionate reason to travel to the US – or whose presence is held to be “beneficial” to the American nation – may be granted permission.
Despite many other countries having more serious Covid case numbers, the US has remained open to arrivals from more than 100 other countries.
When will more non-resident travellers be able to enter the US?
From early November – exact date to be confirmed – the blanket travel ban will be lifted on fully vaccinated travellers only from the above 36 countries.
This means that foreign nationals from anywhere in the world will be able to visit, provided they can prove their fully vaccinated status.
Double jabbed travellers from these countries will then be able to enter on the normal terms: presenting a visa or an Esta (America’s online entry permit). They will not need to quarantine on arrival.
As well as the proof of vaccination, they will have to show proof of a negative Covid test taken in the three days before arrival, wear a mask for the journey over, and share their email address and phone number for contact tracing purposes.
The Centers for Disease and Control and Prevention is set to unveil a contact tracing order that will require airlines to collect this information on travellers coming into the US, with airlines permitted to hold this information for 30 days, CNN reports.

New citizens promise to bear arms for the U.S. — and most are just fine with it

Rigoberto Osornio has never held a weapon. But he swore to do just that to defend his new homeland from any enemy.
“If it comes to bearing arms to defend this country (the U.S.), it is our duty to do so as citizens," said the 40-year-old originally from Querétaro, Mexico. He’d already lived in the U.S. for 24 years when he saw his American Dream come true on the day last year when he became a U.S. citizen in an emotional ceremony.
"I don't renounce being Mexican. And now I can return home to see my family,” said Osornio. “But I would do anything for this country because it has given me all I have."
According to U.S. Citizenship and Immigration Services, since 2016, more than 35,000 immigrants have taken the Oath of Allegiance to become U.S. citizens in naturalization ceremonies in Dallas.
This tradition goes back 220 years. But since 1950, new citizens recite a paragraph unlike any in the world: the pledge to bear arms and perform noncombatant service in the Armed Forces if required by law.
"It's a military service-based tradition because citizens are supposed to help the country in case of war," said Peter. J. Spiro, immigration law professor at Temple University. "It is rooted in the need of having men available in the absence of military capacity," he added.
Almost every country in the world allows immigrants to become citizens.
Notable exceptions include Saudi Arabia, North Korea, Monaco, Afghanistan, Bhutan, Cuba and Iran, where the right is exclusive to children born to citizens. In the Vatican, only people working for the Pope are eligible for citizenship and they lose it when they quit.
Still, only a score of nations have a form of oath or pledge of allegiance. Among those, a promise to abide by the constitution or the nation's laws is the norm. To be faithful and bear true allegiance to the supreme authorities of the nation, the flag and God are also typically included.
In countries like Jamaica, Canada and the United Kingdom, people pledge allegiance to the Queen Elizabeth II and her heirs.
"Pledging allegiance to a country is more common in Western countries. But in the U.S, the reference to bearing arms stopped being a concern after the Vietnam War, when the draft was rescinded," Spiro said.
"It's more of a symbolic thing."
Few object to the oath
Katherine Moncada is a 38-year-old lawyer from Trujillo, Peru, who started visiting Texas as a tourist when she was 9. She decided to move here under a student visa in 2009.
"All of my family moved here to live. Living in Peru without them was pretty sad," said the woman, who became a naturalized citizen in May and lives in Carrollton. She is about to marry a U.S. citizen.
Like any applicant for U.S. citizenship, Moncada filled out forms, had her fingerprints and photographs taken, and passed an interview where she had to answer about six random questions out of the 100 she had studied with help of a CD and a book.
A statue replica she posed with for pictures, and U.S. flags were part of the sober decorations at the Irving hall where she became a citizen. She learned about the oath she had to take on the same day she got naturalized.
"It feels weird to pledge allegiance to a homeland other than yours because I lived half of my life in Peru," Moncada said.
"It's a very emotional moment, but you can't get certain benefits in life without paying a price. If I have to bear arms for this country, the homeland of my future husband and children, I will. For me, this is a moral obligation now."
It's such a moment of joy and the culmination of so many achievements and fears that the new citizens rarely object to the arms passage.
However, a new federal directive was issued in 2015 allowing some people to opt out of the clause "based on religious training and belief or deeply held moral or ethical code."
Those who object must file a witness statement or an affidavit.
"Out of about 4,000 people whom we have helped apply for citizenship in the past four years, only three have succeeded in objecting reading that passage," said Verónica Serrato, executive director of Citizenship Project, founded in Boston in 2014.
"They were Jehovah's Witnesses. They specifically object, because of their religion, to killing people. But the law requires them to prove membership to a group or church through a pastor or elder of their religious community. That's not easy."
The requirement to take the whole oath may, too, be waived if a medical professional certifies that an immigrant can’t understand its meaning due to a medical condition
An emblematic case reached the Supreme Court in 1946, when the pledge to bear arms was not yet included in the oath, but there was a question about it in the citizenship interview.
James Girouard of Canada answered “no” when asked whether he would bear arms for the U.S. "I'm a Seventh-Day Adventist. I believe in the democratic ideal, but I am an uncompromising pacifist,” he said.
The Supreme Court ruled in his favor and allowed him to become a citizen.
"There are people who tell us they would not bear arms,” said Serrato, who, as the daughter of Mexican immigrants, began to have an interest in citizenship issues after her parents were naturalized. She said conscientious objectors “understand that's a very hypothetical situation based on old laws and that legally it is very difficult to dispute” the oath.
Belma Islamovic, 44, lost both of her arms during the Bosnia-Herzegovina War.
After being exiled, she came with her parents, Salco and Asma, now 67 and 70, to the U.S. She was naturalized in 2009. Her parents were naturalized four years ago.
"With such a bloody past in my country, it really was a bit odd to pledge to do something that I neither moral nor physically could do," Islamovic said from her home in Richardson.
"I don't think we civilians are here to do that. But it is an emotional ceremony, and after 35 years in this country, citizenship is something too big to object."
The benefits to become citizen are not just a few: They gain the right to vote, they can hold public office and compete for federal jobs. They can stay in the U.S. for the rest of their lives, since, as opposed to those with permanent residency status, citizenship never expires. They also can travel freely and help their family members immigrate legally to the U.S.
The new citizen can apply for permanent residency for a spouse, fiance(e), parents, siblings and children.
Carlos Avilés, 19, was born in the U.S., but his Mexican parents immigrated from Querétaro.
He’s been playing soccer since he was 12, and as his passion for the sport grew, he eventually needed to become a citizen — of Mexico.
"I had a tournament with Mexico's national team and I needed a (Mexican) passport," said Avilés, now a player for FC Dallas, who played for his second homeland in a couple of tournaments in China and Korea.
Avilés now has dual citizenship.
Despite solemnly reciting the pledge to the American flag every morning when growing up and going to school at Lee A. McShan Jr. Elementary in Dallas, he always knew he’d become a Mexican citizen one day.
"I didn't know I would have a big opportunity to play with the Mexican national team,” he said. “But because of my parents, their culture is everything for me."
The Mexican Consulate in Dallas said that since 2016, about 5,000 U.S. citizens born to Mexican parents have become Mexican citizens. So far in 2018, almost 2,000 more did — an increase of 90 percent compared to the same period in 2017.
In Avilés' case, his process was simple: He got a naturalization document in the Mexican consulate in Dallas certifying him as a Mexican citizen. No ceremonies, no pledges. Just a picture to keep a memory of it.

"I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen; that I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I will bear arms on behalf of the United States when required by the law; that I will perform noncombatant service in the Armed Forces of the United States when required by the law; that I will perform work of national importance under civilian direction when required by the law; and that I take this obligation freely, without any mental reservation or purpose of evasion; so help me God."
