Community Immunity: Public Health Reckons with Religious Freedom for New York Control

The age old saying goes, “my rights end where yours begin.” But where is that line drawn? Overlap, misalignment and direct contradiction between rights blur this concept to obscurity. And what about when the rights of entire communities are at stake? As public crises are wont to do, the recent measles outbreak across the United States has brought this question into the spotlight,having dredged up long held beliefs on who has a right to determine vaccination policies. With concentrations of outbreak in communities with low vaccination levels threatening to overflow, governments are turning to strong-arm policies to battle the rising measles case count, which has drawn the ire and the legal action from those who choose immunization exemption for themselves and their children.

New York mayor Bill de Blasio in coordination with the New York Department of Health and Mental Hygiene issued an order on April 9 that all unvaccinated residents of the Williamsburg neighborhood in Brooklyn must receive the MMR (Measles, Mumps, and Rubella) vaccine to counteract the outbreak of measles.[1]Enforcement will be executed through tracing future measles cases for sources of communication. Those who did not comply within a 48 hour grace period following the issue of the order are subject to up to $1000 in fines.[2]

This follows another countermeasure enacted in Rockford County in northern New York. In Rockford, unvaccinated individuals under 18 were banned from entering a public place where an immunocompromised person may encounter them in order to curtail the growing spread of measles. [3] This ban was placed on hold by a New York judge questioning its authority over religious choice, with a hearing scheduled for April 19. Until then, all people are allowed to return to public spaces regardless of immunization status.[4]

Measles, a virus hallmarked by fever, cough, runny nose, and a red rash spreading across the body, is highly contagious, and thus the measles vaccine is vitally important for controlling and preventing outbreaks. Two doses of the vaccine, recommended by the Center for Disease Control to begin in infancy, allow for 97% immunity to the illness.[5] Such high preventative rates are important for establishing herd immunity, wherein a disease is less effectively communicated among people due to their immunity, which prevents spread of the disease and protects immunocompromised community members such as children too young for vaccinations or people living with immunocompromising illnesses such as HIV or cancer.[6]

The New York City Health Department has recorded 228 total measles cases in Williamsburg so far, with 26 new cases reported this week.[2] The outbreak, which began in September of 2018, has rapidly spread within the Orthodox Jewish community in Williamsburg, and with Passover approaching, city health officials fear close contact among families gathered to observe the holiday will only spread the disease further.[7]

The order is supported by New York City Health Code §3.07, wherein residents are prohibited to, “…do or assist in any act which is or may be detrimental to the public health or to the life or health of any individual... or ...shall fail to do any reasonable act or take any necessary precaution to protect human life and health.”[1]

Despite this, propaganda from an anonymous anti-vaccination group known as PEACH has been circulating throughout the Williamsburg area, with articles suggesting unfounded connections between vaccines and autism, claiming vaccines equate to toxic chemicals, and describing horror stories of children experiencing serious illnesses, disabilities, and even death following standard immunizations. [8] These articles contain information and graphics aimed specifically at Jewish audiences and address concerns regarding conflict between vaccines and the Torah.[9] It is through this channel that misinformation is spread, and, when coupled with New York State’s religious exemption policy regarding vaccinations, creates pockets of unvaccinated children and adults, which is now the case in Williamsburg.

The religious exemption policy in New York allows parents to fill out a form citing “sincere and genuine” religious beliefs as the reason for declining vaccinations for their children before enrolling them in schools.[10] New York State does not authorize philosophical exemptions, so those who are morally or scientifically opposed to vaccinations are not legally allowed to claim exemption. According to The Official Website of the City of New York, the Williamsburg requirement overrides religious and medical exemptions, which is significant for the heavily religious communities in questions, as it overrules a previously established right to choice in vaccinations for adults and children alike. [11]

Sample documents published in December 2016 from the New York State Center for School Health addressed the possible impact of an outbreak, such as the one currently occurring, on exemption policies, notifying parents that, “if your child has not had an immunization for the disease that is spreading, your child may be required to not come to school (excluded) as ordered by the local health department.”[10] Thus, the groundwork was already laid for public health exclusion policies long before the measles outbreak began.

Religious exemption policy has been a source of contention in New York State and across the United States, with tensions rising between the freedom of religion and the needs of public health. In light of the current rise in measles cases, several New York State Assembly officials proposed a bill that would prohibit all exemptions to vaccination outside of medically necessary concern in order to prevent a future outbreak of a similar nature.[12] The bill was referred to the Standing Committee On Health on January 22, 2019 and its fate hangs in the balance.[13] The implications, however, are more certain, as bringing this bill into law would likely provoke the outrage of the religious communities whose beliefs oppose vaccine use. Despite the seemingly clear-cut public health necessity of the mandatory requirement, attorney Michael Sussman, who also represents Rockford County residents opposing the public space ban, is working to file a lawsuit against the order, claiming that it is “an overreach of authority.” [14] Legal action would therefore be swift to attempt to bring down any bill that passed ending religious exemption allowances. 

Some religious objections to vaccines include opposition to their non-kosher status and the use of aborted fetal tissue in the original measles vaccine formula in the late 1960s, which has been faded out to near nonexistence in the current formula.[15] With both these qualms and the public health in mind, in November of 2018, the Orthodox Union, America’s largest organization for the Orthodox Jewish faith, released a statement regarding the burgeoning measles outbreak, stating, “The Orthodox Union (OU) and the Rabbinical Council of America (RCA) strongly urge all parents to vaccinate their healthy children on the timetable recommended by their pediatrician.”[16] Rabbis in Williamsburg have been clear in their support and advocacy of this message, but resistance to governmental infringement on faith, as protected by law, remains in the community.[7]

Policy exists to protect religious communities and to protect public health, but the two sets of law cannot coexist without compromise. The threat of a public health crisis competes with the threat of religious denial, which could open the door for future bypassing of religious freedoms, and there is no way to win without someone’s rights being stepped on. In the case of Mayor de Blasio and the New York health authorities, the solution to a lose-lose situation appears to be to sweep aside the balancing act altogether and implement policy to get the health and wellness of the state back on track. Only then, once crisis is averted, can the discussion of how to balance these clearly precarious boundaries to protect the changing needs of modern America.
