The "religious liberty" angle for overturning the overturning of Dobbs

Frank Wilhoit’s definition of “conservativism” remains a classic:

There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.

Conservativism is, in other words, the opposite of the rule of law, which is the idea that the law applies equally to all. Many of America’s most predictably weird moments live in the tension between the rule of law and the conservative’s demand to be protected — but not bound — by the law.

Think of the Republican women of Florida whose full-throated support for the perfomatively cruel and bigoted policies of Ron Desantis turned to howls of outrage when the governor signed a law “overhauling alimony” (for “overhauling,” read “eliminating”):

This is real leopards-eating-people’s-faces-party stuff, and it’s the only source of mirth in an otherwise grim situation.

But out of the culture-war bullshit backfires, none is so sweet and delicious as the religious liberty self-own. You see, under the rule of law, if some special consideration is owed to a group due to religious liberty, that means all religions. Of course, Wilhoit-drunk conservatives imagine that “religious liberty” is a synonym for Christian liberty, and that other groups will never demand the same carve outs.

Remember when Louisiana decided spend tax dollars to fund “religious” schools under a charter school program, only to discover — to their Islamaphobic horror — that this would allow Muslim schools to get public subsidies, too?

The Satanic Temple has perfected the art of hoisting religious liberty on its own petard. Are you a state lawmaker hoping to put a giant Ten Commandments on the statehouse lawn? And now we come to Dobbs, and the cowardly, illegitimate Supreme Court’s cowardly, illegitimate overturning of Roe v Wade, a move that was immediately followed by “red” states implementing total, or near-total bans on abortion:

These same states are hotbeds of “religious liberty” nonsense. In about a dozen of these states, Jews, Christians, and Satanists are filing “religious liberty” challenges to the abortion ban. In Indiana, the Hoosier Jews For Choice have joined with other religious groups in a class action, to argue that the “religious freedom” law that Mike Pence signed as governor protects their right to an abortion:

Their case builds on precedents from the covid lockdowns, like decisions that said that if secular exceptions to lockdown rules or vaccine mandates existed, then states had to also allow religious exemptions. That opens the door for religious exemptions to abortion bans — if there’s a secular rule that permits abortion in the instance of incest or rape, then faith-based exceptions must be permitted, too.

Some of the challenges to abortion rules seek to carve out religious exemptions, but others seek to overturn the abortion rules altogether, because the lawmakers who passed them explicitly justified them in the name of fusing Christian “values” with secular law, a First Amendment no-no.

As Rabbi James Bennett told Politico’s Alice Ollstein: “They’re entitled to their interpretation of when life begins, but they’re not entitled to have the exclusive one.”

In Florida, a group of Jewish, Buddhist, Episcopalian, Universalists and United Church clerics are challenging the “aiding and abetting” law because it restricts the things they can say from the pulpit — a classic religious liberty gambit.

Kentucky’s challenge comes from three Jewish women whose faith holds that life begins “with the first breath.” Lead plaintiff Lisa Sobel described how Kentucky’s law bars her from seeking IVF treatment, because she could face criminal charges for “discarding non-viable embryos” created during the process.

Then there’s the Satanic Temple, in court in Texas, Idaho and Indiana. The Satanists say that abortion is a religious ritual, and argue that the state can’t limit their access to it.

These challenges all rest on state religious liberty laws. What will happen when some or all of these reach the Supreme Court? It’s a risky gambit. This is the court that upheld Trump’s Muslim ban and the right of a Christian baker to refuse to bake a wedding cake for a same-sex couple. It’s a court that loves Wilhoit’s “in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.”

It’s a court that’s so Wilhoit-drunk, it’s willing to grant religious liberty to bigots who worry about imaginary same-sex couples:

But in the meantime, the bigots and religious maniacs who want to preserve “religious liberty” while banning abortion are walking a fine line. The Becket Fund, which funded the Hobby Lobby case (establishing that religious maniacs can deny health care to their employees if their imaginary friends object), has filed a brief in one case arguing that the religious convictions of people arguing for a right to abortion aren’t really sincere in their beliefs:

This is quite a line for Becket to have crossed — religious liberty trufans hate it when courts demand that people seeking religious exemptions prove that their beliefs are sincerely held.

Not only is Becket throwing its opposition to “sincerely held belief” tests under the bus, they’re doing so for nothing. Jewish religious texts clearly state that life begins at the first breath, and that the life of a pregnant person takes precedence over the life of the fetus in their uterus.

The kicker in Ollstein’s great article comes in the last paragraph, delivered by Columbia Law’s Elizabeth Reiner Platt, who runs the Law, Rights, and Religion Project:

The idea of reproductive rights as a religious liberty issue is absolutely not something that came from lawyers. It’s how faith communities themselves have been talking about their approach to reproductive rights for literally decades.

Hamas strongly condemns the United States' use of its veto power against a UN Security Council resolution calling for a ceasefire in Gaza.

The US veto embodies the American administration's blind bias towards the fascist occupation government and supports its crimes against humanity committed in the Gaza Strip.

We strongly condemn the American administration's defiance of the will of the entire world, as 14 out of 15 Security Council members supported the resolution, while the United States stood alone in opposing it, an arrogant stance that reflects its disregard for international law and its complete rejection of any international efforts to stop the bleeding of Palestinian blood.

The Netherlands announced that it will allow the Ukrainian Air Force to use the 24 F-16 fighters it will receive by donation to be used in attacks against targets within Russian territory.

The Dutch Minister of Defense, Kajsa Ollongren, confirmed that the Netherlands will not impose limitations on the use of F-16 jets. This decision marks a divergence from Belgium's policy, which limits the use of its donated F-16s.

In an interview with the newspaper Politico at the Shangri-La Dialogue in Singapore, Ollongren said: "There is no [a restriction to the Belgian style]. We are putting into practice the same principle that we apply to all other supplies of capacity, that is, once it is delivered to Ukraine, it is theirs to use." She added that the Netherlands only asks Ukraine to comply with international law and the right to self-defense, as established in the United Nations Charter, ensuring that the jets are used to achieve Ukraine's military objectives in self-defense.

Ollongren and U.S. Secretary of Defense Lloyd Austin were among the senior officials who met with the President of Ukraine, Volodymyr Zelenskyy, at the Singapore conference. Denmark also approved Ukraine's use of F-16s provided by Denmark against military targets on Russian soil. Germany has also indicated that Ukraine can use weapons provided by the West for its defense.

Recently, the U.S. authorized Ukraine to attack Russian territory near Kharkiv using U.S.-suplied weapons, confirmed by President Zelensky's spokesman, Serhii Nykyforov, on May 31. However, Washington continues to restrict the use of long-range weapons for deeper attacks within Russia. President Zelensky has expressed interest in using long-range weapons, such as British-made Storm Shadow missiles, but the United Kingdom has not yet fully authorized their use, possibly awaiting a clear position from the White House. The issue has been discussed twice with UK authorities, but remains dependent on a broader international consensus, particularly the US position.

Israeli supporter Dr. Stephen Berk, a professor at the prestigious Schenectady, New York-based Union College, offered a balanced approach in a speech before the Jewish Federation of Northeastern New York.

“Hamas chose its time very, very well. Give the devil the credit that it is due. Hamas looked upon Israel polarized over the issue of judicial reform. Hamas also looked at thousands of reserves who said they would not serve. In the end, as we all know, they did serve,” Berk, 77, told the audience of approximately 150 attendees. “Perception is reality. It’s not really what happened that’s important, it’s what people believe happened. In fact, Hamas saw Israel was vulnerable.”

Berk reminded his audience about Hamas’s goal for the past 35 years.

“In 1988 Hamas was founded and a charter was prepared. That charter said no peace with Israel, no recognition, no compromise, and Israel has to be wiped off the face of the Earth,” Berk said. “The charter also called upon Muslims everywhere to kill the Jews. On October 7, that is exactly what they did. Hamas is a genocidal organization. There should be no illusions about it.”

Berk, who is a Russian and Soviet historian by training, has been considered an expert on Middle East politics and policies. He is currently the Henry and Sally Schaffer Professor of Holocaust and Jewish Studies at the venerable institution. He has taught history for more than 55 years.

When its followers say, “We want a Palestine from the river to the sea,” the river is the Jordan and the sea is the Mediterranean. That means there is no place for the state of Israel. It means that Hamas is hell bent on eliminating close to 10 million people,” Berk concluded.

When established in 1986, Air Europa was the Spanish daughter of the British ILG-Air Europe Group Ltd. which later also formed an Italian subsidiary of the same name. Air Europa's initial corporate design thus also closely matched the British parent's brand, with just the altered last letter of the name and the national flags visibly distinguishing the two.

Almost identical twins, aren't they: G-BNPB flies for parent Air Europe, performing a seasonal inbound charter to the Austrian alps, while its daughter's jet above is about to pick-up local Austrian residents for a break in the warm South of Europe.

The Spanish subsidiary Air Europe initially focussed on the leisure travel market, using a fleet of Boeing 737-300s, later supplemented by the Boeing 757-200 on trunk markets. The British mother however would soon struggling over financial turbulences caused by the entry into the scheduled passenger market, forcing ILG-Air Europe to cease trading in 1991.

The two Mediterranean subsidiaries however escaped the parent's failure and continued trading. While the Italian daughter, since 2000 under the control of former competitor Volare, ultimately also vanished following the new parents failure in 2004 and a fruitless attempt to restart business in 2007/08, the Spanish Air Europa has survived to the present day.

Merger attempts started by IAG International Airline Group that would have led to Air Europa's integration into Spanish flagcarrier Iberia were cancelled twice, and thus Air Europa still trades. However, it is no longer a leisure carrier, but a scheduled airline and member of Star Alliance, serving an extensive intra-European and Latin American network.

Angara Airlines is a Russian domestic air carrier in Eastern Siberia, operating regular passenger flights within the Irkutsk region, the Republic of Buryatia, and the Trans-Baikal Territory. Additionally, it offers charter services to various destinations. The airline was established in 2000, originating from the Irkutsk Aircraft Repair Plant No. 403, and is now a part of the Eastland travel holding.

Angara Airlines provides passenger services to all operational airports in the Irkutsk region. In partnership with the Disaster Medicine Service, it conducts flights for emergency medical assistance. The airline collaborates with the Irkutsk Aviation Forest Protection Base for patrol and monitoring missions, supports search and rescue operations, and delivers cargo, mail, and medicines to remote and hard-to-reach areas. Furthermore, it patrols power lines and oil pipelines, and undertakes construction and installation projects.

The airline’s fleet includes An-24, An-26 aircraft, and Mi-8 helicopters.

Put That Genre Back Where You Found It.

I've grumbled already about "But he just shouldn't have died by their own rules", but I've just remembered someone illustrated that better than me years ago.

They fucked the BDQ!

In One Fine Day In The Middle of the Night by Christopher Brookmyre, a character is discussing the "rules" of action movies. I've put the full text under the cut, but the short version is: films set up how dangerous the action is. You can have films with huge amounts of violence, bullets everywhere but the people rarely get hit. Or you can have the kind of movie where if a gun is fired, someone is getting at least seriously injured. This is the Bullet Deadliness Quotient - low or high.

What you can't do is swap back and forth.

And OFMD swapped back and forth. We've established you can be stabbed in the left side and walk away fine. We've established you can be beaten "to death" by your crew, and be back on your feet through the Power of Hand Holding. They specifically set up adult cartoon levels of violence for the crew - things might get messy, but you'll be up and about in no time.

That's the wrong tone if what you want to give us is the quiet, side-clutching "I don't think I'm making it out of this one, boss".

So even putting aside everything about whether they "should" have killed Izzy, they shouldn't have been able to by the physics of their own story.

Headshot is obviously oot, as is the chest; leg-wound limits mobility, stomach puts you on a dead-withoot-medical-attention timelock, and forearm is just too wimpy. Thus, the upper-arm-to-shoulder area gets it every time, and doesnae affect either the aiming or punching ability of the aformentioned good guy. “Indeed. Then there’s Arnie again in ‘Predator’. Danny Glover in ‘Predator 2’. Danny Glover again in ‘Lethal Weapon’. Carrie Fisher in ‘Return of the Jedi’. The golden era was, of course, your Joel Silver Eighties — I suppose that should be Silver era, shouldn’t it? — but the rules are still bein’ observed today. Nick Cage in ‘Con-Air’, Guy Pearce in ‘LA Confidential’, Robert De Niro in ‘Ronin’.”

“Yes, but it goes back a long way before the Eighties. Before cinema, even. Might I offer Jim Hawkins in ‘Treasure Island’?”

“Of course. Knife through the celluloid sweetspot on the mast of the ‘Hispaniola’. An’ if we’re openin’ it up to books, there’s Frodo Baggins in ‘Lord of the Rings’, with the added discomfort of the blade breakin’ aff an’ giein’ him the Orc equivalent of tetanus for a good two hunner pages. But it’s important to stress that this is a convention we’re talkin’ aboot, not a cliché. Admittedly, there’ an awfy fine line between the two, but good guys gettin’ shot in the shoulder is the right side of it.”

“What would be a cliché, then?”

“Eh, let me think. Aye. Bad guys comin’ back for one last fright. See, your hero gettin’ wounded is part of the mechanics of the story — the baddie comin’ back is just a cheap shock. Fortunately, the ‘Scream’ movies literally put a bullet in the head of that wan.”

Ally was well into his stride. He was feeling buoyed by the experience of having a sensible conversation with Mrs Laurence: it constituted valid, independent confirmation of having achieved grown-up status. Never mind jobs, money, wives or weans: you knew you were a man when you could contradict your former English teacher without her giving you a punishment exercise.

Well, not that sensible a conversation, maybe, but an enjoyable one. Mrs L had surprised him by confessing her devotion to action flicks, unwittingly triggering an onslaught of Ally’s in-depth theses on the genre. This was something that seldom required much provocation, and this time he was really going for it, making the most of that Vader-to-Kenobi moment: “Now I am the master.”

“You know, I never really had you down for a post-structuralist, Alastair,” she said.

Ally laughed, thinking back to all the things Mrs Laurence had called him in his time. That had not been one of them. It seemed he wasn’t the only one pleasantly surprised by their mutual civility.

“Ach, naw,” he told her. “This isnae deconstructionism, it’s pure, anorak-class obsessiveness. Aw the theorisin’ goes right oot the windae when I’m actually watchin’ a film. I want to get carried along for the ride, which is where cliches ruin it, but conventions are part of the structure.”

“Suspension of disbelief.”

“Aye. That kinna thing. I’ll swallow any scenario, as long as the film sticks to its own bullet-deadliness quotient.”

“Its what?”

“An action film establishes its own rules of gunplay. In some, every bullet is potentially lethal — even the old shot to the shoulder can look worryingly near to the upper-chest area. But in others, machine guns can seem the least deadly weapon known to man. To illustrate, at one end of the spectrum there’s your Tarantino movies: reputations aside, there’s not that much gunplay, so when somebody lets off a shot, it’s for real, and it’s usually fatal. High bullet-deadliness quotient. At the other end, there’s your John Woo movies: zillions of rounds goin’ off an’ the only thing they ever hit is glass. Low bullet-deadliness quotient. In a high BDQ film, if the baddie draws a bead on somebody, get ready for ketchup. In a low BDQ film, that’s just a bad day for the janitor. And both types are fine by me, as long as the rules are followed consistently.”

“But you can’t establish a high BDQ and then have a low-BDQ showdown at the end, that’s what you’re saying?”

“That’s what I’m saying. And you cannae establish a low BDQ then have the hero take oot the baddie wi’ wan shot while the air round about him fills up wi’ lead.”

“I agree. So, as you’ve got a term for everything else, what do you call it when that happens?”

“I call it a Renny Harlin film, usually. Worst fuckin’ action director — excuse the swearies —”

“Oh please, Alastair. I’m not your teacher anymore.”

“Fair enough. Worst fuckin’ action director in the world. No idea whatsoever. Just blows a few things up and links it together with badly blocked — and always badly lit — dialogue sequences. And the worst of it is he makes money, so they let him go and do it all over again.”

“I’m not so clued up on the names of the directors — who is he?”

“Renny Harlin. Never to be forgiven for ‘Die Hard 2’. A sequel so unworthy, John McTiernan kidded on it had never happened when he made ‘Die Hard With a Vengeance’ — even came up with a title that got around callin’ it ‘Die Hard 3’. Further Harlin crimes include resurrectin’ Stallone’s career with ‘Cliffhanger’, and the absolute mortal sin of wastin’ a script by Shane Black wi’ ‘The Long Kiss Goodnight’.”

“Oh come on, I thought that one was funny.”

“Aye, it was — that was down to Shane Black, though. As a thriller it was pish — and that was down to Renny Harlin. I mean, Shane Black, that’s precious material. You don’t give it to just anybody. There should be an approved list of directors for his stuff.”
