RIAA kills youtube-dl

In 1998, Bill Clinton signed the Digital Millennium Copyright Act into law. At the time, most of the attention was on Section 512 - AKA "notice and takedown," which absolves platforms from liability for users' infringement provided they respond quickly to removal demands.
Over the years, this has been horrifically abused, with everyone from post-Soviet dictators to sexual predators to cults and literal Nazis using spurious copyright claims to censor their critics, often without consequence.
But the real ticking time-bomb in the DMCA is Section 1201, the "anti-circumvention" rule, which makes it a felony (punishing by a 5-year prison sentence and a $500k fine) to help people tamper with "access controls" that restrict copyrighted works.
This rule means that if a company designs its products so that you have to remove DRM to use them in legal ways, those uses become felonies. DMCA 1201 is how Apple and John Deere make it a felony for anyone except them to fix their products.
They just design their devices so that after the repair is complete, you need an unlock code to get the system to recognize new parts. Bypassing the unlock code defeats an "access control" and is thus a literal crime.
But there's no copyright infringement here! Swapping a new part into a phone, a tractor or a ventilator is not a copyright infringement. And yet, it is still a (criminal) copyright VIOLATION. DMCA 1201 lets companies felonize ANY conduct that is adverse to their shareholders.
It's "felony contempt of business model" and you can go to prison for it.
Thing is, it would be easy to fix this law. If you thought that DRM deserved its own legal protection, you could get there just by adding "this only applies when copyright infringement takes place."
But from the very first days, it was clear that DMCA1201 was NOT about preventing copyright infringement, it was about enforcing business models. The first users of this law were DVD manufacturers who wanted to stop the public from "de-regionalizing" their DVD players.
The manufacturers and studios had cooked up a racket where they would sell DVDs at different prices in different countries, and they didn't want Americans shopping for cheap DVDs in India.
But going into a store in Mumbai and paying the asking price for a licensed DVD and watching it in NYC is NOT infringement. It is how copyright is supposed to work: a rightsholder names a price, an audience member pays it, then they get to enjoy the work they've bought.
Likewise the early consoles that also took advantage of DMCA 1201. If you own a Sega Dreamcast and I write a game for your Sega Dreamcast and sell it to you, we are doing copyright right: a creator and an audience member exchanging creative works for money.
But Sega - and the App Store businesses it spawned up to and including Apple - used DMCA 1201 to make it a felony for creators to sell their works to audiences without cutting the device manufacturer in for a commission.
Now that everything has software in it, DMCA 1201 can be brought to bear on an ever-widening constellation of devices, from medical implants to kitchen appliances, from printer ink to insulin pumps.

The metastasis of DRM is a gift to monopolists, who can corral customers, independent competitors and toolsmiths into arrangements of their design.
When the Napster Wars began, the RIAA represented the Big Six record labels. Today, it represents the Big THREE labels, as an entire realm of human endeavor stretching back to a time before language itself is now the near-exclusive purview of three giant corporations.
They are tightening the noose. Yesterday, the RIAA sent a DMCA 1201 takedown notice to Github demanding the removal of youtube-dl, a venerable and popular tool for format-shifting Youtube videos.

As Parker Higgins documents in a brilliant, scathing thread, the complaint is a masterwork of legal shenanigans, claiming that because someone COULD infringe an RIAA member's copyright by saving a Youtube video, Github MUST remove tools that permit this.

The RIAA's lawyers don't mention the millions of hours of public domain Youtube videos that archivists have preserved using youtube-dl, nor the Creative Commons licensed videos that are unambiguously lawful to download with youtube-dl.
Nor do they mentions the limitations to copyright that sometimes make it lawful to download ANY video from Youtube.
DMCA 1201 isn't just a charter to transform your commercial desires into legal obligations, it is also a powerful censorship tool.
I started this essay talking about DMCA 512, the "notice and takedown" rule. That says that if you believe your copyright is being infringed, you can fire off a notice to the host and demand its immediate removal. If they comply, you can sue their user, but not them.
In 1998, Congress recognized that this was ripe for abuse, and created a "counternotice": if your material is taken down and you think you are in the right, you can counternotify the host and they can put your stuff back up, again, without being liable if you're wrong.
If the rightsholder complains again, the host either removes the content (the rightsholder and user can go to court), or they can leave it up if they think the complaint is BS. This system has been wildly inadequate at protecting legit speech, but it's better than nothing.
And "nothing" is what you get under 1201. When the RIAA complains about youtube-dl to Github, Github pulls it down, but if the developers counternotify them, Github can't restore the files without facing CRIMINAL liability (5  years/$500k).
Copyright trolls have long figured this out: DMCA 1201 is a superweapon for getting content removed from Google and elsewhere: if you assert that someone who recorded you doing something abusive is violating 1201, that video goes down and STAYS down, with no counternotice.
DMCA 1201 is a goddamned dumpster fire, a surefire recipe for techno-corporate dystopia. EFF is suing to overturn it. That trial can't come fast enough:

Assisted by technology, affordable mobile phones and cheap and reasonably uninterrupted data, the last decade has seen conversation around menstrual health gain a lot of online traction in India. The biggest beneficiaries of this development have been   India’s adolescent children living in its remotest areas, who are using all resources available — from chatting with educator “didis” on WhatsApp groups, putting up Instagram stories and TikTok videos, and using menstrual tracker apps to talk about their period stories.
Grassroots workers, too, are utilising social media tools and available technology to spread information about safe menstrual practices in areas where conversations about sustainable menstrual practices are a matter of privilege.”

Trishneet Arora — Age 25
At the age of 25, Trishneet Arora is an author, a self-described friendly hacker and the founder and CEO of cyber security startup TAC Security Solutions. The India-based company performs Vulnerability Assessment and Penetration Testing for corporates identifying weaknesses in their cyber security. He has received funding from angel investor Vijay Kedia and support from former VP of IBM, William May. In 2017, Arora was listed among the 50 Most Influential Young Indians by GQ Magazine, while August 25, 2017 was proclaimed Trishneet Arora Day, by the Mayor of Santa Fe, New Mexico.
Akash Shukla — Age 30
Akash Shukla is the co founder of Uprise India Foundation, a one of a kind and highly appreciated venture. “Uprise India Foundation provided the platform for women who are trying to achieve their entrepreneurial dreams. Women who will enrol with the program would be getting 360 business training, support & guidance for making their dream career successful. Indian NGO
Since the past few decades many Non-Governmental Organizations in India have come into existence and through their dedicated and selfless work strengthened their position in society. Out of these many NGO in India, a few of them have carved a name for themselves and have impacted society in a positive way.
Types based on use
Co-operative societies
In India, cooperative societies are regarded as instruments to mobilise and aggregate community effort to eliminate layers of middlemen in any product or service supply chain hence resulting in greater benefit sharing for the grassroot farmer, worker or artisans. The Cooperative Credit Societies Act, 1904 enabled formation of cooperatives for supplying to farmers cheap credit and protect them from exploitation in the hands of the moneylenders. The cooperative act 1912 expanded the sphere of cooperation and provided for supervision by central organisation.
Multi-state co-operative societies
The Multi-state Co-operative Societies Act, 2002 which substitutes the earlier statute of 1984, facilitates the incorporation of cooperative societies whose objects and functions spread over to several states. The act provides for formation of both primary (with both individual and institutional members) and federal cooperatives (with only institutional memberships). Any application for the registration of a multi-state cooperative society, of which all the members are individuals, should be signed by at least fifty persons from each of the states concerned. In case of a society of which members are cooperative societies, it should be signed by duly authorised representative of at least five such societies registered in different states.
Trade unions
Trade union means any combination, whether temporary or permanent, formed primarily for the purpose of regulating the relations between workmen and employers or between workmen and workmen or between employers and employers, or for imposing restrictive conditions on the conduct of any trade or business, and includes any federation of two or more Trade Unions.
Religious bodies
Religious bodies are frequently registered as NGOs.
Non-profit laws of India
This article describes the various laws related to non profit organisations in India. A non profit organisations can be registered in India as a Society, under the Registrar of Societies or as a Trust, by making a Trust deed, or as a Section 8 Company, under the Companies Act, 2013.
Whether a trust, society or Section 8 company, the Income Tax Act, 1961 gives all categories equal treatment, in terms of exempting their income and granting 80G certificates, whereby donors to non-profit organisations may claim a rebate against donations made. Foreign contributions to non-profits are governed by FC(R)A regulations and the Home Ministry.
For an organisation to be termed as charity it requires Income tax clearances under 12 A Clause of Income Tax Act. Section 2(15) of the Income Tax Act defines ‘charitable purpose’ to include ‘relief of the poor, education, medical relief and the advancement of any other object of general public utility’. A purpose that relates exclusively to religious teaching or worship is not considered as charitable.

The S API Level M1 Android Emulator is pretty fast. Just like the one we usually run on Intel device machine with Intel® HAXM. And for me the best news is, Chrome is working!! I tried Charles.

In this post, we have seen that is possible to install Android Studio in Macbook Air M1 and use a virtual device even that your M1 doesn’t support VT-x. I recently upgraded from Macbook Air 2017 to Macbook Pro with an M1 chip. My four-year-old Macbook Air was giving up. The performance to run heavy tasks like using the iOS simulator when developing and working on React Native apps was declining. I had long given up using the Android emulator and used an actual Android device for testing. December 2020 was the time I decided its time to upgrade.
I had a long internal discussion with myself for almost a month about whether I should upgrade to M1 or stick with Intel-based chips and spend them bucks. Don't get me wrong here, M1 is not cheap either as I did go for a RAM upgrade to max limits, which is currently 16GB in the base model.
After going through some online reviews and research, the kind of performance I was expecting has been worth it so far (it is fast, no doubt). I received it two weeks back when writing this post, and since then, I have installed all the necessary tools and utilities that help me work on Web development and React Native apps.

iTerm
My favorite terminal app that I have been using for years is iTerm. I am currently using two versions of iTerm on my setup. One with Rosetta 2 enabled and the default one. This way, I can only use the Rosetta 2 emulator when required. There are no performance issues I have found with using iTerm with Rosetta 2 for ARM-based applications.
If you'd like a similar setup, go to the Applications folder in your Macbook and duplicate the iTerm application.
You can rename the duplicated iTerm app. I have renamed it to iTerm_rosetta to differentiate between the two. Right-click the duplicated app and click Get Info. In the General, check the box where it says Open using Rosetta.
Now, if you open the second terminal, it will be using Rosetta 2 emulator by default.
Other iTerm profile settings that I use:
Recently I started using Jetbrains Mono font.
For the overall looks and appearance, I use Dracula Pro Color Presets created by Zen Rocha.

And my last favorite thing is to split the working directory into two more different tabs using Command + D for horizontal panes.
Make sure to have the following setting configured from
General > Working Directory > select Advanced Configuration > click button Edit... > select Reuse previous session's directory under Working Directory for New Split Panes.
For terminal prompt, I use Spaceship ZSH.
Xcode
After installing Git, for me, the next step is to install Xcode app from Apple's App Store.
Then, install 'command line tools'. It is required by many of the formulae in Homebrew.
After installing it, make sure to open it for the first time, from the menu bar, open Xcode > Preferences > Locations and make sure that Command Line Tools point towards the current Xcode app.
Homebrew
On December 1, 2020, the Homebrew team announced on their website about the version release 2.6.0. The most significant changes among others they listed were the support for macOS Big Sur, using brew commands instead of brew cask and beginning to support macOS M1 and Apple Silicon or ARM-based chips.
Using the terminal, you can install the Homebrew by executing the default command:

What is Karabiner-Elements?
When I bought Macbook Air M1, it had function keys (that got me excited), but I don't understand why Apple decided to replace function keys that would allow me to control Keyboard Brightness?! And moreover, replace it with 'Do Not Disturb'.
Why? That got me confused 🤷

Rosetta 2
Update: I am not using the Rosetta environment to install anything on the secondary machine since August 2021. That is the reason I've mentioned it at the end of the post.
Rosetta 2 is the lifeline that allows you to run apps designed for Intel-based chips that use x86 architecture on ARM-based chips (in this case M1). This solution is provided by Apple in the form of an emulator and doesn't come pre-installed. You have to install it manually. Fire up the Terminal application that comes pre-installed on the Big Sur and let your first command to execute be:
If you decide not to put the flag --agree-to-license, you will be prompted by Apple's interactive install, and you will have to agree to their terms and license conditions to use it.

That’s the setup I now use for my JavaScript, Node.js, React and React Native. I think it's a good machine. Hopefully, M1 is just the beginning of a new era of powerful computers for daily work use 🤞
🤔 The only thing left for me is to find a way to transfer all laptop swag/stickers from my Macbook Air 2017 to Pro. I miss having them on this one.

OnePlus Officially Announces Merger with Oppo
After working closely with Oppo for a long time, OnePlus has now made its merger with the Chinese business public. OnePlus opted to “further integrate” its organisation with Oppo “after observing good effect” from the current partnership, according to co-founder and CEO Pete Lau in a forum post.
OnePlus and Oppo, on the other hand, will continue to operate as separate brands, according to the executive. The news comes only days after OnePlus announced the OnePlus Nord CE as its new cheap smartphone in India and other regions.
In a forum post, Lau stated that the tighter integration with Oppo will provide OnePlus with additional resources to deliver “even better products” to customers.
