Amid the corporate events pervading New York’s “Climate Week,” an international people’s tribunal held an emotional hearing that spotlighted the ecosystems and people living in the shadow of fossil fuel projects. 

Representatives from communities around the world, scientists and advocates told stories of human and nonhuman forced displacement, degraded heath, ruined economies and lost histories to the International Tribunal on the Rights of Nature on Sunday. 

In India, coal mines are degrading the habitat of endangered elephants sacred to Adivasi Indigenous people. In Louisiana, petrochemical facilities are being built on sacred grave sites. In East Africa, construction of a new oil pipeline is displacing communities and slicing through the homes of giraffes, lions and hippopotamuses. And in Peru, communities that have endured decades of crude oil production and more than 1,000 oil spills are facing down installation of a new refinery and expanding operations.

The testimonies, sweeping in both their global reach and in the harms alleged, were gathered to create a repository of evidence linking the “fossil fuel era” to violations of humans’ and nature’s rights. 

The tribunal, now in its sixth session since 2014, is designed to probe alleged violations of the 2010 Universal Declaration on the Rights of Mother Earth, which recognizes nature as a living being with inherent rights, including the rights to exist and evolve.  

“Just as human beings have human rights, all other beings also have rights which are specific to their species,” the nonbinding declaration says. The declaration was written during a 2010 people’s conference in Cochabamba, Bolivia, following a disappointing United Nations climate summit in Copenhagen a year earlier.

The tribunal is part of the growing “rights of nature” movement, which since 2006 has also created binding laws and judicial precedent recognizing nature’s rights. Today, more than a dozen countries have such laws on the books, including Ecuador, Panama, Spain, New Zealand, Brazil, Colombia and Uganda. But few countries have taken steps to enforce the laws. 

The advocacy group Global Alliance for the Rights of Nature created the tribunal to showcase how a legal system recognizing nature’s rights might work. Past hearings have taken on cases like the Deepwater Horizon Oil Spill, lithium mining in Chile’s Atacama Desert and the impact of free trade agreements on the environment. In each case, “defendant” companies and governments are invited to participate but generally decline to do so. Though the rulings are nonbinding, the tribunal’s website says its work pressures governments by drawing international attention to issues.

In 1916, Midgley began working at General Motors. In December 1921, while working under the direction of Charles Kettering at Dayton Research Laboratories, a subsidiary of General Motors, he discovered (after discarding tellurium due to the difficult-to-eradicate smell) that the addition of tetraethyllead (TEL) to gasoline prevented knocking in internal combustion engines.[4] The company named the substance "Ethyl", avoiding all mention of lead in reports and advertising. Oil companies and automobile manufacturers (especially General Motors, which owned the patent jointly filed by Kettering and Midgley) promoted the TEL additive as an inexpensive alternative superior to ethanol or ethanol-blended fuels, on which they could make very little profit.[5][6][7] In December 1922, the American Chemical Society awarded Midgley the 1923 Nichols Medal for the "Use of Anti-Knock Compounds in Motor Fuels".[8] This was the first of several major awards he earned during his career.[2]

In 1923, Midgley took a long vacation in Miami to cure himself of lead poisoning. He said, "I find that my lungs have been affected and that it is necessary to drop all work and get a large supply of fresh air."[9] That year, General Motors created the General Motors Chemical Company (GMCC) to supervise the production of TEL by the DuPont company. Kettering was elected as president with Midgley as vice president. However, after two deaths and several cases of lead poisoning at the TEL prototype plant in Dayton, Ohio, the staff at Dayton was said in 1924 to be "depressed to the point of considering giving up the whole tetraethyl lead program".[6] Over the course of the next year, eight more people died at DuPont's plant in Deepwater, New Jersey.[9] In 1924, dissatisfied with the speed of DuPont's TEL production using the "bromide process", General Motors and the Standard Oil Company of New Jersey (now known as ExxonMobil) created the Ethyl Gasoline Corporation to produce and market TEL. Ethyl Corporation built a new chemical plant using a high-temperature ethyl chloride process at the Bayway Refinery in New Jersey.[9] However, within the first two months of its operation, the new plant was plagued by more cases of lead poisoning, hallucinations, insanity, and five deaths.[7]

The risks associated with exposure to lead have been known at least since 2000 BC,[10] while efforts to limit lead's use date back to at least the 16th century.[11][10][12] Midgley experienced lead poisoning himself, and was warned about the risk of lead poisoning from TEL as early as 1922.[13] Midgley well knew the hazards of lead. He investigated whether the risks, both in production and use, could be managed. Testing on the exhaust was completed, which he used to support the idea that 1 part tetraethyl lead per 1300 of gasoline could safely be used.[14] After the initial worker exposures, controls were developed to allow the process to operate safely. Leaded gasoline use grew exponentially. The chronic impacts of environmental lead were grossly underestimated.

On October 30, 1924, Midgley participated in a press conference to demonstrate the apparent safety of TEL, in which he poured TEL over his hands, placed a bottle of the chemical under his nose, and inhaled its vapor for 60 seconds, declaring that he could do this every day without succumbing to any problems.[7][15] However, the State of New Jersey ordered the Bayway plant to be closed a few days later, and Jersey Standard was forbidden to manufacture TEL again without state permission. Production was restarted in 1926 after intervention by the federal government. High-octane fuel, enabled by lead, was important to the military. Midgley later took a leave of absence from work after being diagnosed with lead poisoning.

In the late 1920s, air conditioning and refrigeration systems employed compounds such as ammonia (NH3), chloromethane (CH3Cl), propane, methyl formate (C2H4O2), and sulfur dioxide (SO2) as refrigerants. Though effective, these were toxic, flammable or explosive. The Frigidaire division of General Motors, at that time a leading manufacturer of such systems, sought a non-toxic, non-flammable alternative to these refrigerants.[17]

Midgley, working with Albert Leon Henne, soon narrowed his focus to alkyl halides (the combination of carbon chains and halogens), which were known to be highly volatile (a requirement for a refrigerant) and also chemically inert. They eventually settled on the concept of incorporating fluorine into a hydrocarbon. They rejected the assumption that such compounds would be toxic, believing that the stability of the carbon–fluorine bond would be sufficient to prevent the release of hydrogen fluoride or other potential breakdown products.[17] The team eventually synthesized dichlorodifluoromethane,[18] the first chlorofluorocarbon (CFC), which they named "Freon".

Brazil's Petrobras to keep stake in Colombia's deepwater block Tayrona

Brazil's state-controlled oil company Petrobras PETR4.SA has abandoned a plan to sell its 44% stake in a promising offshore gas project it shares with Colombia's Ecopetrol ECO.CN in the Andean country, a Petrobras executive said at a Houston energy conference on Monday.

Petrobras and Ecopetrol last year announced a natural gas discovery at the Uchuva-1 deepwater well in the Tayrona block, 32 kilometers off Colombia's coast. The Brazilian company two years earlier had offered its stake for sale following poor exploration results at a previous well, Orca-1.

Petrobras operates the Tayrona block, which is expected to deliver Colombia's first gas production from deep waters fields in 2026 by connecting to nearby infrastructure, according to Ecopetrol's projections.

"Not anymore," said Carlos Travassos, Petrobras' chief production development officer, when asked about plans to sell the company's stake in Tayrona. "We have seen the relevance of this," he said on the sidelines of the Offshore Technology Conference.

Italian oil major ENI, currently in the news with regards to its major offshore gas projects Zohr and Noor, was awarded sector 11 East of Siwa, while sector 2 went to the General Petroleum Company, sector 4 to Neptune Energy, and sector 5 North Beni Suef to Merlon International.

With regards to the Egyptian gas prospects, American oil giant ExxonMobil, which hasn’t been very active in Egypt for years, reentered the North African country by winning the north of Amreya Marine Company concession area.

The North Sidi Gaber, as well as North El Fanar areas, went to Shell and Petronas. The North West Sherbin concession has been awarded to British oil major BP and Eni.

The re-emergence of major IOC interest should be not underestimated. Egypt’s former rough period, especially during and after the Arabic Spring and the rule of Muslim Brotherhood president Mursi and the military coup shortly after, has had a very negative impact on upstream projects.

Most IOCs and independents working in Egypt at the time, were affected by security threats and delayed payments, resulting in a major slowdown in operations.

The current success of ENI, and the improving political and security situation seems to have changed the sentiment.

Shell and ExxonMobil’s Cairo’s dreams about becoming an energy hub, and supplying European markets, are once again alive and kicking. Shell’s Egypt Chairman Gasser Hanter reiterated this.

Hanter stated at EGYPS2019 that "Egypt's Idku and Damietta LNG export plants are likely to remain the low-cost option for East Mediterranean gas producers looking to export”.

He expects that, soon, it will become very clear to the other participants in the East Med that the Egyptian option has the best commercial and strategic factors. The Shell official is very optimistic with regard to the willingness of Israel and Cyprus to consider the Egyptian option. Some developments are expected around the East Mediterranean Gas Forum meeting in March in Cairo.

At present, provisional agreements have been signed between Cyprus and Egypt to pipe gas from Cyprus’ field Aphrodite to Egypt. Israel has already a gas export deal with Egypt. The deal was set up by Egypt's Dolphinus Holdings, which expects to import 64 Bcm/year of gas from Israel over a 10-year period.

Noble Energy and Israel’s Delek, two prominent producers in the Tamar and Leviathan fields, have agreed to buy a stake in the idled East Mediterranean Gas pipeline.

Shell reiterated at EGYPS2019 that the economics of Egypt's export plants remained compelling, suggesting any other future liquefaction projects in the region may struggle. The underlying economics are clear, as the LNG liquefaction plants in Idku and Damietta already exist, removing the possible multibillion investments needed if choosing other options.

In addition to the IOCs interest, Arab oil & gas company Dana Gas also stated to expect major new discoveries. Dana’s CEO Patrick Allman-Ward stated at EGYPS2019 that his company will start drilling in 2019 in an area it says could become Egypt’s next giant Mediterranean gas field, after seismic data pointed to reserves as large as 20 trillion cubic feet.

First drilling operations will be conducted in an area that is expected to hold 406 Tcf. The targeted area is part of the North Arish field, which is located in the East Med.

The year 2019 could become the Red Sea Year, as Egyptian sources indicate that the Egyptian company Ganoub El Wadi Petroleum Company (Ganope) is expected soon to launch its delayed bid round for offshore Red Sea.

The last days rumors have been floating around, especially after that Egypt’s minister of energy Tarek El Molla indicated a bid round on the 12th of February at EGYPS2019. El Molla stated bluntly that 2019 will be the Red Sea Year. This was also stated by Abed Ezz El Regal, CEO of EGPC.

The bid round was expected earlier, but was delayed at the end of 2018 by Ganope. The Red Sea has become a major focus area for EGPC and others, after that Cairo was able to reach a maritime demarcation agreement with Saudi Arabia.

Ganope’s CEO Mohamed Abdul Azim stated that his company is expected to drill nine new wells.

Based on the Red Sea geophysical data, which has been acquired lately by a 2D, 10,000 square kilometer survey by Schlumberger, a bid round is expected to be announced within the next days.

The prospectivity of the Red Sea is expected to be very interesting, as already shown by several projects on the other side of the sea in Saudi Arabia.

A possible combined effort between Saudi Arabia and Egypt is still in the offing, as some projects could be combined. For sure, Egyptian and Saudi drilling operations could be combined, taking advantage of the growing offshore drilling JVs of bother countries.

The ongoing Saudi Aramco-Rowan JV (ARO) at the International Maritime Industries (IMI) Ras Al Khair Shipyard projects, also could be combined with Egyptian parties. Some new builds or upgrades for the Red Sea arena would be feasible to be done in Egyptian shipyards too.

Mile 22

These days, it’s never any good to be part of an elite. UNLESS it’s an elite member of an elite squad of intelligence operatives and trained killers working under the radar of official scrutiny to protect our most vital yadda yadda yadda. Then it’s good!

Mark Wahlberg plays just such a soul, one James “Jimmy” Silva, in “Mile 22,” the new film once again teaming Wahlberg with director Peter “Join the army, motherfu—er” Berg. Messrs. Wahlberg and Berg have made some hella manly films together, all of them up until now based on true stories: “Lone Survivor,” “Deepwater Horizon,” “Patriots Day.” “Mile 22,” written by Lea Carpenter from a story she concocted with Graham Roland, is an entirely fictional work, but if you think it doesn’t have something to say about the here and now that we’re living in you’re…well, it’s complicated. Also kind of dumb. Maybe not worth getting into so much.

The movie opens with a scene in a bucolic suburban cul-de-sac that demonstrates the sophistication of Jimmy’s crew. He’s in a backyard with a sniper’s rifle, while his colleagues are at the front door of a tasteful colonial house pretending to be lost. Inside the house are a bunch of Russians up to no good. They, and we, know this because a remote crew, headed by John Malkovich as “Mother” (the agents on the ground are called “Child 1,” “Child 2,” and so on) has the house surveilled by drones. They’ve also got Jimmy and the crew’s vitals monitored. Slick. Still, the operation doesn’t go quite as planned. There’s some missing dirty bomb material they don’t retrieve, and a suspiciously young asset from whom Jimmy extracts the ultimate price. Hmm.

A credit sequence establishes Wahlberg’s character as a kind of Jack Ryan on speed. He was a child prodigy! With anger issues! Who lost his family at a young age! His CIA agent status is actually his cover, and he has to resign from the agency every time he works with Malkovich and company! Subsequent scenes reveals he curses a lot, as does his closest colleague Alice (Lauren Cowan), who saves most of her profanity for her ex-husband Luke (played by Berg in a coy cameo). Jimmy is actively unpleasant when he’s mission-focused; his motormouth raps at underlings show that he’s both crazy like a fox and crazy like an outhouse rat. On the trail of the dirty bomb material, Jimmy and Alice butt heads with a Southeast Asian source who has the location of the stuff, but won’t give it up until he’s on a plane to America, where he wants asylum.

The title refers to the number of miles between the U.S. Embassy and the airstrip where that plane will leave from. The local corrupt government is going to do everything in its power to keep Jimmy, Alice, and their crew from getting the source, Li Noor, on that plane.

Noor is played by Iko Uwais, the Indonesian action star who’s best known here for his kicking and punching in the “The Raid” movies; he was also in “Star Wars: The Force Awakens.” So obviously he gets to do a lot of action stuff here, and it’s impressive; fighting back against two fake medicos who want to assassinate him while he’s handcuffed to a hospital bed, that kind of thing. There’s a more than satisfactory amount of boom boom in the movie’s trim running time—at 95 minutes, this is the shortest picture in the Berg/Wahlberg oeuvre.

The action is intercut with shots of Wahlberg in a suit and tie, speaking in a conference room, talking about “chaos” and how none of you know what the word “collusion” really needs. It seems that in the aftermath of this mission, Jimmy decided to try and compete with Jordan Peterson’s YouTube videos. No, that’s not it.

These scenes are him briefing his higher ups, shadowy figures of Maybe The Deep State, or Maybe Not, about the mission we see being enacted before us. Which is another one that doesn’t go as planned, and leaves a ton of dead bodies and munitions residue in its wake. The movie has a peculiar political undercurrent. It’s very pro secret missions, but only because it subscribes to the ideology of There Are Bad People Out There Who Want To Do Bad Things To Us. When “Mother” and his crew set up their high tech equipment on a mission, they lay out bobblehead dolls of U.S. Presidents past and present; the one wearing the “Make America Great Again” baseball cap is placed next to one of Obama, and the shot of the two together reads like a cheeky dare of sorts from Berg and Wahlberg. Also interesting is that Malkovich is compelled to trot out an old H.L. Mencken quote about raising the black flag and slitting throats, which is also the motto of well-known pseudonymous right-wing blogger. And I don’t think either Berg or Wahlberg are big H.L. Mencken readers.

So the movie often felt to me like “The Gauntlet” as rewritten by a Breitbart News bot. Now I’m not saying that’s a bad thing. But what if I were? I guess I’d hear about it in comments. To which I’d have only one response: Join the army.

CSX’s Rockport Terminals are deep-water port facilities on Tampa Bay used for exporting phosphate from Central Florida’s Bone Valley mining region. These facilities are located on more than 300 acres with over 25 miles of track, warehousing, and state-of-the-art loading systems.

Deepwater Horizon accident analysis - case study 01

Recommendation with analysis:

1.     Lack of vigilance.When carrying out the negative pressure test to determine if they should continue with the operation or not, crew on board accepted the result of 0 pressure in kill line as indication to pass the test without questioning the disparity between pressure in the drill pipe and the kill line, which should be the same.

Consequence:if investigated earlier, they would’ve discovered annular preventer’s failure to seal, calling off the operation ASAP, without having to wait until hydrocarbon coming all the way up the rise to know it.

Prevention:Improved training. Higher qualifications required for supervisors. Modify social hierarchy to encourage workers to look to their supervisors for the correct course of action.

2.     Failsafe design causes a negative chain reaction.5/7 ways of closing off the well relies on the functioning of annular preventer, leaving blind shear ram to be the only option to cap the well to prevent the oil spill even in the event of platform drifting off

Consequence:closing off the well became impossible when blind shear ram failed to work either

Prevention:Defence in depth rather than breadth. Redesign the system to reduce failsafe components’ interdependency on each other. If last resort fails to work, automated component will be triggered to close off the well (was included in the design but failed to work, see point below).

3.     Inadequate testing.Blind shear ram couldn’t cut anything bigger than a drill pipe, which failed the purpose in the event of an emergency. Automated activation failed. Link to activate the blowout preventer lost.

Prevention:More rigorous, regular testing in conjunction of replacement in time to make sure operation is carried out after all components are checked

4.     Unfamiliarity with emergency procedure.When trying to close off the well, casing shear ram could be used except no one tried to activate it.

Prevention:Improved emergency plans, protocols that regulate people’s responsibilities during the crisis, external dedicated crisis staff, more escape options

5.     Lax enforcement of regulation.Didn’t install all centralisers to prevent cement from flowing into larger space to ensure the formation can be properly sealed with the cement. Ordered more spacer than needed, then forcibly used it for it to be allowed to get discharged into the ocean. No standard negative pressure testing for platform to stick with.

Prevention:Edit the regulation to include financial penalties that outweigh the benefits of skipping the procedures, making sure the laws are deterrent to similar incidents. Third party audit and assess the enforcement and safety measures, with higher authority watching over the third party to prevent corruption (watchmen higher on the hierarchy have greater responsibility and should be penalised the most if negligence occurred). Stricter approval procedure on use of materials, such as spacer. Industry conference held regularly to push forward standardised testing.

6.     Ignorance of underwater situation.Cement unit pressure detects three abnormalities in water pressure inside the drill pipe that indicated that the well was flowing, but this information was not captured by the driller unit and was overlooked/not captured by crew on board.

Consequence:By the time people on board noticed the abnormality, it was too late to close blowout preventer, and gas is already leaked on board.

Prevention:More comprehensive underwater detection with sensors that allow people on board/on shore to monitor functioning of each component closely. Third party watching over the rig remotely, have the right to directly activate certain component when connection between platform and underwater components is lost.

Anadarko also has a handful of overseas ventures, including a major liquefied natural gas project in Mozambique that Chevron said would help bolster one of Chevron’s major global businesses. “This transaction builds strength on strength for Chevron,” said Chevron Chief Executive Mike Wirth. “The combination of Anadarko’s premier, high-quality assets with our advantaged portfolio strengthens our leading position in the Permian, builds on our deepwater Gulf of Mexico capabilities and will grow our LNG business.” READ ALSO: No Need For Panic Buying, Over 1bn Litres Of Petrol In Stock – NNPC For Chevron, the second-biggest US oil company after Exxon Mobil, the takeover of Anadarko marks its biggest deal since its purchase of Texaco, which closed in 2001. In another transaction, Chevron in 2005 bought Unocal for $18.3 billion after raising the price during a high-profile bidding war with China’s CNOOC that drew interest from lawmakers in Washington. The acquisition is composed of 75 per cent stock and 25 per cent cash, with Anadarko shareholders receiving 0.39 shares of Chevron and $16.25 in cash for each Anadarko share held. By combining the companies, Chevron expects to cull $1 billion in costs. The oil giant will also “high grade” its portfolio and sell off some $15 billion to $20 billion of assets. In 2018, Chevron had $42.4 billion in revenues and pumped 3.1 million barrels oil equivalent per day, above the level of most members of the Organization of the Petroleum Exporting Countries. Anadarko had $13.4 billion in revenues last year and pumped 666,000 barrels of oil equivalent per day. Anadarko is perhaps best known for being a minority partner on BP’s ill-fated Macondo project in Gulf of Mexico, the site of the worst offshore oil spill in US history in 2010, following a well explosion that killed 11 people. Anadarko in October 2011 transferred its interest in Macondo to BP as part of a settlement that resolved claims between the two companies. Anadarko shares surged 32.1 per cent in pre-market trading to $61.80, while Chevron fell 3.1 per cent to $122.10.
