The Supreme Court's ruling, where 3 men decided what "woman" means, puts all women at risk. Male police officers in the UK now have the power to strip search any women they believe to be trans.

It is an offence to enter a single sex bathroom and changing room different from your birth sex, but also to enter one where your presence is "likely to cause offence". This leaves trans men and women with nowhere to go, as well as gender-non conforming cis people.

Non-binary people naturally have zero legal recognition whatsoever, the existence of trans men has been ignored again, and intersex people have been written out of existence.

Trans people are always sent to male prisons regardless of sex. If you don't know the horiffic ramifications of this, Google v-coding.

Gender Recognition Certificates, which were supposed to update your legal sex for all purposes, have been rendered functionally worthless. Trans people are being forced into their assigned sex at birth.

Trans women are banned from rape crisis shelters, domestic abuse protection, and discrimination claims such as equal pay. Trans women have also unsurprisingly been banned from Women's sports.

Trans women are banned from all lesbian groups and organisations, and not just that, cis women are too if they're dating a trans woman. The court ruled that "lesbian" means "AFAB attracted to AFAB", making cis women dating trans women legally straight. The definition also means bi women aren't a thing in UK law now - just a sidenote!

Trans people sent to hospital wards are now always housed according to their assigned sex at birth, regardless of their comfort.

If you're a trans minor, your life is even harder. Puberty blockers and HRT, despite being completely safe and legal for cis people, are banned nation wide for trans youth. The only "help" offered is conversion therapy, which the government calls "exploratory therapy".

And if you're thinking "well, people won't comply" or "My workplace is friendly," then I regret to inform you that this isn't allowed. The UK expects all organisations to update their policies to be trans exclusionary by this summer, and the so-called "Equality and Human Rights Commission" has announced they will persue any organisation which doesn't immediately comply.

By the way, earlier this year the EHRC made the trans panic defense legal. Even kissing someone without disclosing that you're trans is enough to get you convicted with sexual assault. Trans people must always out themselves before any relationship forms or be charged with a sex crime.

Any organisation with bathrooms, changing rooms, rape crisis centres, etc. will be for Ed to exclude trans people. If an organisation lets a trans woman (who in UK law is now legally a man) into a women-only space, they lose the right to operate the single sex space, and can be successfully sued for not letting cis men into it.

The EHRC's recommendation? Trans people use their "powers of advocacy" to request "third spaces" with regards to toilets. THIS IS NOT A JOKE.

You may already be aware but the UK Supreme Court has ruled on the definition of a woman in UK law and it is not in our favour.

"The UK Supreme Court has unanimously decided that the definition of sex under the Equality Act 2010 refers solely to biological sex, and does not include people with a Gender Recognition Certificate."

What this means is that being assigned at birth the biological sex of female means you are legally a woman, regardless, and being assigned the biological sex of male at birth means you can never legally be a woman, regardless.

Trans people still have protection under the law as "gender reassignment or presumed gender reassignment" remains a protected characteristic of the Equality Act 2010. However, trans women do not have the right to sex-based protections anymore, even if that was the reason for discrimination, and can be legally excluded from women-only spaces.

Obviously this is horrifying and disheartening, but it's important that you have all the facts. For anyone who isn't aware, here's a short timeline so yk what happened and who to blame

2018, Scottish Government passed the Gender Representation on Public Boards Act, which happened to include those with Gender Recognition Certificates/ living as women and undergoing transition as women for this purpose

2023, Scottish Government passed the Gender Recognition Reform as an amendment to the Gender Recognition Act. This would have made it easier to legally change gender

January 2023 Rishi Sunak and the Conservative Government used powers given by Section 35 of the Scotland Act (powers that allow UK government to veto Scottish legislation despite their devolved power) to block this.

Despite that particular reform being blocked, the Scottish definition of womanhood remained and this freaked out the group For Women Scotland, who got a case appealed all the way to the Supreme Court to challenge the Scottish Government. Case began November 2023

The group For Women Scotland is significantly funded by J.K. Rowling, who's money will have been a big help to them in their legal fees for this case. There will be other prominent donors

The case is called to interpret the Equality Act and the Gender Recognition Act, and is against the Scottish Ministers. They are being represented by their lawyers rather than appearing in court and have mostly not been commenting.

The Labour Government has been called on for comment and Equalities Minister Bridget Phillipson says the government supports maintaining the sanctity on single sex spaces, and they appreciate clarity in the law

We see the news at about 10.30 and sit in horrified silence for several minutes. Everything I have detailed above - the implications of this news -is immediately clear to both of us, as it likely is to every trans woman in the country as they receive the headlines accompanied by pictures of beaming, grinning transphobes celebrating making our lives worse.

My girlfriend and I go to the local cafe to get out of the house. The owner, who I've known for most of a decade, asks how we're doing and when I tell her the news she is completely at a loss for words. She tells us it will change back again eventually, which makes me think of Section 28. She tells us that her cafe is a safe space, which I've never doubted.

I call with my brother. I don't think he likes to hear me getting angry, which makes it hard sometimes to explain the things they are doing to people like me. I want to tell him that a woman in Colombia was raped and then her arms and legs were broken and she was thrown into the river where passersby watched her drown and didn't help. We talk about America instead, about Hunter Schafer's passport being changed, about other women having their passports seized, about people I know who have loved ones in America can't travel to see them because they could get refused entry, interviewed by ICE, or even detained. I tell him a woman in Florida has been arrested for using the women's bathroom and is being sent to a men's prison. I want to tell him about V-coding, the practice by which prison wardens assign trans women to violent and aggressive male prisoners in a sort of forced marriage to pacify the male prisoner at the cost of the woman being repeatedly beaten and raped, sometimes to death. It won't help the situation to overwhelm my brother with the horrors. He's already asking what he can do. I say he can write to his MP and he can donate to the Good Law Project.

It's rare to see non-US politics getting attention on tumblr, so you may not be aware that trans rights have taken yet another major blow today.

This morning, the UK Supreme Court made a ruling stating that in a legal sense, the term 'woman' refers only to people assigned female at birth. The ruling is briefly explained here. The law pass that lead to this was contested by For Women Scotland (who have received £70,000 worth of donations from JK Rowling - note how providing her with profit in any manner directly harms trans people in the uk) and they have spent the last 5 years working to get legal clarification on who is and isn't a woman (because the law seems incapable of using the term 'female' when referring to sex and 'woman' when referring to gender) so that they could further exclude trans women from female spaces.

This is a ruling that has received resounding support from across the country and politics - Kemi Badenoch (tory leader) has described it as a 'victory', saying that "saying 'trans women are women' was never true in fact, and now isn't true in law either".

Many news outlets are making a point to clarify that this does not mean trans people lose out on the legal protections provided by the Equality Act, but they are failing to recognise the social ramifications of this ruling. It now means that the exclusion of trans women from women's spaces is a lawful and legitimised exclusion. This extends to hospital wards, prisons and sports, to name a few.

What this essentially means is that a GRC does not grant trans women full recognition as a woman, and that a woman's right to enter a women's space depends on others perceiving them as women, as establishments cannot ask to see a GRC. As much as this is an attack on trans women, this also harms cis women who do not meet societies standards of femininity.

There are many news outlets reporting on this so you can find the finer details of the ruling if you wish, I just haven't seen anything about this on tumblr today so I wanted to put it out there for people who aren't aware. the long-term impact of this is yet to be seen, but various people have expressed gratitude at the help this will provide in changing guidance on the treatment of trans people in schools and hospitals. nothing good can come of this for trans people.

HISTORY OF THE US NESARA LAW:

· NESARA was signed into law by President William Jefferson Clinton in 2000, at gunpoint because the Military forced him to sign it. He wasn't going to, and was to be announced by Alan Greenspan on Sept. 11, 2001, at 10:00am.

· This was prevented by the destruction of the World Trade Center by then President George W. Bush, Dick Cheney and others involved with this great deception. They murdered 7,000 innocent Americans that day and stole billions in Gold and Silver from Building 7.

· In early 1993, the U.S. Supreme Court ruled on charges by the Farmer's Union that banks in the U.S. were fraudulently foreclosing on farm mortgages and that the U.S. Government was in collusion with these banks. The testimony and proof brought into court by a retired CIA Agent let to further evidence and proof that Farmer's Union claims were legitimate. It also led to evidence that the 16th Amendment, the Income Tax Amendment, was never properly ratified by the required number of states and therefore, declared that income taxes were unlawful.

· Almost unanimously the U.S. Supreme Court Justices ruled in favor of Farmer's Union. The Justices recognized that overwhelming evidence proved the U.S. Government and the Federal Reserve Banking System were perpetrating FRAUD in many ways upon Americans. The Justices recognized that to remedy this situation, massive reformations would be required. When rulings were made by the U.S. Supreme Court, one or more of the justices are assigned to monitor the process by which rulings are carried out.

· In this case, five of the Justices were assigned to a committee to develop steps to implement the required governmental and banking reformations. As the Justices went about developing the changes, they enlisted the help of experts in Economics, Monetary Systems, Banking, Constitutional Law and other areas. They built coalitions of support and assistance with thousands of people worldwide, working with us to bring NESARA and GESARA to fruition. These people were called the "White Knights". The term "White Knights" was borrowed from the world of big business when a vulnerable company is "rescued" from a hostile takeover.

· Because of the enormously sweeping changes the rulings by the U.S. Supreme Court required, an EXTREMELY STRICT gag order was put in place on everyone involved. The Justices also sealed all records on the case until after the reformations are all accomplished.

· To maintain secrecy, the case details for the docket number assigned to the Farmer's Union case were changed. So, doing a search for this case will fail to reflect the correct information until after the reformations are made public. At every step of the process, anyone directly involved has been required to sign an NDA to keep the process of implementing the required reformations "Secret" or face charges of Treason which are punishable by death.

· To implement the reformations, the five justices spent years negotiating how the reformations would occur in agreements called "accords" with the U.S. Government, with Federal Reserve Bank owners, the IMF, World Bank, and numerous countries including the UK and the EU.

· The reformations required the Federal Reserve Bank system to be absorbed by the U.S. Treasury and all fraudulent banking activities to be stopped, as well as remedies to Americans for past harm due to FRAUD.

· The U.S. Banking reformations will impact the entire world and therefore the IMF, World Bank and other countries involved including the UK and the Vatican City.

· Members of Congress were ordered by U.S. Supreme Court to "DENY" the existence of NESARA / GESARA or face charges of TREASON, punishable by DEATH. Some members of Congress were charged with "Obstruction" and threatened with charges of TREASON. Therefore, all members of U.S. Congress have had to pretend that NESARA has not been passed in order to comply with the Justice's GAG ORDER.

O. SAT. 3 AUGUST 2024 NESARA GESARA REFORMATIONS:

· NESARA / GESARA is the most groundbreaking reformations to sweep the world in the entire history of the world.

· All foreigners will be required to return home in order for them to receive their GESARA Payments.

NESARA DOES THE FOLLOWING: 👇

a. Zero's out all Credit Card, Mortgage and other bank and loan transaction debts.

b. Abolishes the Internal Revenue Service and the Income Tax.

c. IRS employees will be transferred to the US Treasury National Sales Tax area.

d. The Federal Reserve will be absorbed into the US Treasury.

e. Creates a 14% - 17% National Sales Tax, applied to NEW ITEMS only for government revenue. Some of it goes to states, rest to new national government.

f. Used items sold will not be taxed. Food & Medicines will not be taxed.

g. Sets up Restitution Payments for those victimized by Chattel Property Bonds. Those Aged 61 and over will receive a lump sum payment. Those Aged 41 to 60 will receive scheduled payments set time and sign work contract. Those Aged 29-40 will have to sign a Work Contract to receive their funds. Initiates a Universal Basic Income or UBI for those 16-29 years old.

h. An increase for retired Senior Citizens up to 3x current SSN amount up to $5,000.00

i. Dissolves US Inc. and returns the country to 1791 Constitution and Common Law.

Trans Rights in the UK

There is a bit of an alarming thing happening in the UK right now. Recently, five judges in the Supreme Court ruled that the word 'woman' when used in the Equality Act 2010 applies to 'biological sex'.

This led to the Equality and Human Rights Commission (!!!) very quickly releasing some interim guidance that basically excluded trans people from using any single-sex facilities! There was no guidance on how this would be enforced, which was also concerning.

Basically, the UK has introduced a segregation law!

From what I can gather, there are glaring issues with this ruling and the subsequent guidance, both legally and morally. There are lots of law breaches, contradictions, and fairly weak arguments for the judge's ruling.

No trans people, trans organisations, or even specialists from the trans-related medical field or were consulted with. Almost solely anti-trans organisations were represented in court.

In practise, this ruling breaches the Human Rights Act 1998.

In practise, this ruling actually beaches the Equality Act! (The ruling states that for the purposes of the EA, trans people are to be considered their 'biological'/assigned at birth sex. However, possibly owing to the obvious absurdity of having trans men forced to used women's toilets and trans women forced to use men's toilets, the EHRC have said that trans people cannot use toilets either in line with their legal/acquired sex, or with their 'biological'/assigned at birth sex.)

It's in breach of the Law of Goodwin.

It's in breach of the Gender Recognition Act 2004.

The word 'woman' in the Equality Act did include trans women - it was specified that the word 'woman' included trans women who have a Gender Recognition Certificate. So it's unclear why this is being ignored and the word (within the Act) being redefined.

The word 'biological' when used in the ruling is not a scientific or legal term. There are only two legally recognised sexes/genders, yet there was also no regard for the fact intersex people exist (or how this might impact on them).

Many of the reasons they gave for why a trans woman can't be discriminated against for being a woman are things that also apply to many cis women (not all cis woman are able to conceive, for example).

The fact trans people have gender reassignment as a protected characteristic was used to support the idea that trans women don't also need to be protected from sex-based discrimination. However, people can have multiple protected characteristics.

The Good Law Project has decided to challenge this decision, but they need help funding the legal costs.

Removing rights from a marginalised group that has such a devastating and quite disgusting impact is wrong. It's also terrifying. If they get away with this, whose rights will they remove next?

The Good Law Project states:

We believe that the Supreme Court – which disgracefully refused to hear from trans people before handing down a decision with the profoundest possible consequences for trans lives – has placed or revealed the United Kingdom in breach of its obligations under the Human Rights Act. In a 2002 case called “Goodwin”, the European Court of Human Rights said: “A conflict between social reality and the law arises which places [a trans person] in an anomalous position, in which he or she may experience feelings of vulnerability, humiliation and anxiety” and found the UK in breach. Following that case, the UK introduced the Gender Recognition Act to make us compliant. The Minister introducing the Act said it was intended to alter the definition of man and woman in equalities legislation but the Supreme Court, because it refused to hear from any trans people, appears to have been oblivious to this critical fact and decided references to men and women were to “biological” sex. [...] The Nazis forced the LGBT+ community to identity themselves as “degenerates” by wearing pink triangles. Labour’s policy means that for trans people to move through the public sphere they will need, similarly, to identify themselves as trans in an increasingly violent and transphobic world. We believe the UK is now in breach of its obligations under the Human Rights Act and the European Convention of Human Rights and we plan to ask the High Court for a declaration of incompatibility. We believe the legal arguments are strong – but we must also point out that the Supreme Court has revealed a readiness on the part of our courts to disapply, in the case of trans people, normal legal and procedural safeguards. We have put together a legal team involving several KCs and at least one trans barrister. The legal team will be supported by heavyweight policy specialists in equalities law and will be informed by the lived experiences of trans people. We will publish the legal documents in the case as they become available and as the law permits. This is no small undertaking – but, for the trans community in Britain, it is literally existential. We would be grateful for your help. 

This might not be directly related to what this blog is about, but I'm aware that there are a lot of trans Autistics. I'm also aware that many cisgender Autistic people might present as gender non-conforming in some way, and therefore might also be at increased risk of prejudice from the transphobes empowered by this ruling.

Besides, regardless of whether this might also impact the Autistic community, if we don't stand up for other minorities now, it will just bolster bigots to continue trying to take us back in time. Marginalised communities deserve to have rights, and to be properly protected instead of having to rely on the benevolence of service providers, educators, employers, society.

Please, please, let's not let Britain become the kind of country that demonises minorities and legalises their segregation, exclusion, and abuse of their rights.

If you can't donate towards the legal fund, please do support them in whatever way you can (share their articles, videos, posts etc.) and take whatever direct action you can:

Write to your local MP.

Write to the PM.

Complain to the Supreme Court.

Complain to the EHRC.

Join any protests or sign any petitions that you can to make it clear that this isn't acceptable.

Always fight for your rights and fight for other people's. Let's not make it easy for the bigots. If people try to dictate what toilet you/someone else can use, insist that they are violating your/their human rights. If your employer has a segregated toilet they expect trans people to use, insist that they are violating your/their human rights. If you're in hospital and you are, see or hear a trans person having personal info disclosed or being segregated or made to use the incorrect facilities, insist that they are violating your/their human rights. Make a fuss, be a nuisance, make this difficult for them to enforce. Make formal complaints whenever these things occur. Take up their time and resources with paperwork and investigations. Take legal action whenever possible. Don't make it easy for them by complying.

Okay who’s interested in hearing about the school au I thought up in the shower

Keep in mind that all following information is based on my experience in British education, I have no clue how American schools run different

First we have the kids - James and Henri are both kids from the foster system, James has been adopted by Moses, whilst Henri is still technically a foster (ik ik not Franklin but maybe they’re neighbours). Henri is definitely the class clown whilst James is ambitious, but not too sure how to achieve his academic goals. Sarah is an exchange student from the UK living with Franklin, who is either a relative in this au or a family friend like in canon. She and James initially don’t get along but over time through the newspaper club and sharing most classes they grow closer. Sarah is an A+ student and she tutors James and Henri after school.

Most historical figures are teachers or general staff, except for named foot-soldiers like Joseph Plum Martin or other young historical figures like Sybil Ludington, who would be fellow students

Franklin - the kids’ (or at least James and Sarah’s) tutor (I think Americans call it home room?). He teaches science, and it’s his love of teaching that’s kept him from retiring (though he probably should have years ago). He runs the school newspaper (which James and Sarah are both a part of)

Moses - I can see him as a member of the site team or subject technician of some kind (basically helps to prepare stuff like experiments and maintain the school, but more responsibilities than a janitor). He’s also doing an online university course to get his teaching degree (he’d most likely go into either engineering/dt). The adopted Father for James and foster parent to Henri. Has known Franklin for years and the two are next door neighbours

Lafayette - French. Obviously. He’s a younger teacher popular with the students. His class is the only one Henri doesn’t goof around in, and the two are very close (spoilers: he may end up adopting him). Constantly asking the finance department to let him take a class trip to France. If anyone acts up enough to make him mad the class all turns on that one person (based on my mother’s experience (coincidentally she was also a languages teacher lol)). Often gossips and speaks with Hamilton in French.

Adams - idk if they teach law or politics in American high schools but if not then he’s probably an English teacher. His students live in terror or presenting essays or debates because no one can beat the man. You either love him or hate him, there’s no in between with his classes. Probably head of the department

Hamilton - probably either English or history (though maths is also a contender because he was treasury secretary). Also a younger teacher popular with the students. Has almost gotten into a fight with other teachers. And students. Definitely runs the debate club. Expects assignments in a week before the deadline. Is one of the leaders in staff room gossip.

Washington - I know most people make him the head teacher but I’m not a huge fan of that. He’ll probably end up as the head eventually for this au, but for most of it I imagine him is a department head. I can see him teaching either history, maths or geography (he was a surveyor after all, I could see him being a really good geography teacher). He’s that teacher that looks intimidating but is actually very nice. Believes way more in practical than theory and WILL drag his class outside in any and all weather to do a study. He also looks after any of the animals the school owns. Sometimes brings his dog to class. Is DEFINITELY involved in staff room gossip

Abigail Adams - I can see her as either the school nurse or some sort of creative arts teacher

Phillis Wheatley - definitely either an English teacher (damn we got a lot of those) and if not then some sort of creative arts teacher who also runs a poetry club. If anyone acts up in her class the other students ensure the body is never found.

Please suggest what subjects and the sort other historical figures would teach or any other ideas you have relating to this! ^^ Idk if I’ll draw anything based on this but it’s fun to brainstorm!
