Saying 'yes' to troubled borrowers cost lender dear: 3. Thirty days is outer limit for Yes Bank resolution, says Das: March 5,2020: RBI applied to Central Govt. to impose a Moratorium to 'YES Bank', under section 45 of Banking Regulation Act, 1949. Accordingly, on the same day, Central Govt. issued the Order of Moratorium. Total period of Moratorium should not exceed 6 months. Why RBI applied for Moratorium? Financial position of YES Bank has undergone a steady decline. The bank experienced serious governance issues & practices in the recent years- steady decline. Engagement of the bank failed to result into infusion of any capital. Adequate opportunity given to YES Bank by RBI, to draw up a Credible Revival Plan, to bring a bank & market led revival, rather than regulatory restructuring. In the meantime- regular outflow of liquidity was observed. Moratorium: Govt. stays the commencement or continuance of all actions and proceedings against YES Bank in the period of Moratorium Subject to conditions/restrictions imposed on YES Bank. RBI may prepare a Scheme for the reconstruction of a banking company for following reasons in mind: In the public interest. In the interests of depositors. To secure proper management of the banking company. In the interests of banking system of the country as a whole. RBI places the final scheme(prepared after suggestions and objections) before the Central Govt. may sanction the scheme & specifies the scheme, on this behalf. Salient features of Draft 'YES Bank Ltd. Reconstruction Scheme, 2020' Authorised capital and the number of equity shares to be altered. SBI(Investor Bank) shall agree to invest in the equity of the Reconstructed bank to the extent that post-infusion holds 49% shareholding in the Reconstructed bank... SBI shall not reduce its holding below 26% before completion of three years from the date of the infusion of the capital. Four articles of association will stand deleted. The office of the Administrator of YES Bank Ltd. appointed by the Reserve Bank shall stand vacated, and a new Board shall stand constituted, with two directors nominated by SBI. Rights and liabilities of the Reconstructed bank to be as per scheme. All the employees of the Reconstructed bank shall continue in its service with the same remuneration and on the same terms and conditions of service(T&C), including terms of determination of service and retirement,... at least for a period of one year. Board of Directors of the Reconstructed Bank will, however, have the freedom to discontinue the services of the Key Managerial Personnel(KMPs) at any point in time after following the due procedure. The offices and branches of the Reconstructed bank shall continue to function in the same manner and at the same places they were functioning prior to the effective date, without in any way being affected by this Scheme. It will be open to the Reconstructed bank to open new offices and branches or close down existing offices or branches, in accordance with the extant policy of the Reserve Bank and complying with the necessary terms and conditions. The provisions of the Scheme shall have effect notwithstanding anything to the contrary contained in any other law or regulations or directions or agreement, award or another instrument for the time being in force. If any difficulty arises in giving effect to provisions of the scheme, the Central Govt may, in consultant with the Reserve Bank, by order, as occasion arises, do anything not inconsistent with the provisions of the scheme, which appears to it as necessary for the purpose of removing the difficulty. Authorised Capital: Maximum amount of share capital for which shares can be issued by a company can be increased/altered. Paid-up share capital: Amount of money for which shares were issued to the shareholders for which payment was made by the shareholder. Total Regulatory Capital in Bank: Tier-I Capital(Going-concern capital)-> The capital that can absorb losses without triggering the bankruptcy of the bank Common equity Tier-I capital. Additional Tier-I capital. Elements of Additional Tier-1 Capital(Indian Banks) Additional Tier-1 capital will consist of the sum of the following elements. Perpetual Non-Cumulative preference Shares(PNCPS), which comply with the regulatory requirements as specified by RBI; Stock surplus(share premium) resulting from the issue of instruments included in Additional Tier-1 capital; Debt capital instruments eligible for inclusion in Additional Tier-1 capital, which complies with the regulatory requirements as specified by RBI. Any other type of instrument generally notified by the Reserve Bank from time to time for inclusion in Additional Tier-1 capital; While calculating capital adequacy at the consolidated level, Additional Tier-1 instruments issued by consolidated subsidiaries of the bank and held by third parties which meet the criteria for inclusion in Additional Tier-1 capital and Less: Regulatory adjustments/deductions applied in the calculation of Additional Tier-1 capital Elements and Criteria for Additional Tier-1 Capital- Foreign Bank's Branches: Various elements and their criteria for inclusion in the Additional Tier-1 are as follows: Head Office borrowings in foreign currency by foreign banks operating in India for inclusion in Additional Tier-1 capital with comply with the regulatory requirements as specified by RBI. Any other item specifically allowed by the Reserve Bank from time to time for inclusion in Additional Tier-1 capital; and Less: Regulatory adjustments/deductions applied in the calculation of Additional Tier-1 capital 4. Banking on bailouts: Promt draft reconstruction scheme(bailout proposal) is commendable, but raises several questions. Why YES Bank was not earlier placed in prompt corrective action(PCA) Framework of RBI? PCA: If a bank hits the trigger points in three parameters(Capital to Risk-weighted Aspect Ratio(CRAR), net NPA, Return on Assets), then RBI will initiate certain structured & discretionary actions(applicable only to commercial banks) Why SBI was chosen as an investment bank to bailout YES Bank, at a time when public sector banks are currently engaged in merging with weak(Public Sector Banks)? Is it a reflection of a lack of other options for the Govt? GS-1: Effects of Globalization on Indian Society. GS-2: Government policies and interventions for development in various sectors & Effects of policies and politics of developed and developing countries of India's interests. GS-3: Indian Economy and Issues relating to planning, mobilization, of resources, growth, development and employment. 5. Monetory policy can't combat the COVID-19 impact: 6. Had enough forex reserves: Das 7. Oil plunges to lowest since 2017: Monetary Policy: deal with the supply of money and interest rates in an economy. Instruments: Repo, Reverse Repo, CRR, SLR, etc,... Decided by monetary policy committee. Impact of COVID-19:U.S. Federal Reserve has cut its interest rate by 50bps(0.5%) Central banks in Malaysia, Australia also cut their rate. Exert pressure on RBI- bond yields on 10-years G-secs fell by 0.12% NOTE: Bond yield- coupon payment/market price of a bond. Interest rate and bond price are inversly related. Decrease in interest rate: (1)Increase in bond price. (2)Fall in bond yield. The Virus has affected not just the demand side, but also the supply side China: Factory of the world Industries across the world depends on chinese inputs Global supply chain is hit. UN Conference on Trade and Development: Global Merchandise exports could shrink by $50 billion. Rate Cut: Effective on demand side Ineffective on supply side Under pressure, RBI may go for tools like: Operation Twist, & Long-term Repo Operations. Indian industries heavily dependent on chinese inputs will suffer: Pharma, electronics & automobiles -> impact on our export industry-20% of GDP RBI cannot cut rates if it has to attract more investments. Fall in oil import bill- reduce current account deficit and keep forex stable. Opportunity for India: Localise our supply chains - focus on making in India. Global supply chain needs on alternative to china- India has the potential. GS-2: Structure, organization and functioning of the executive and the judiciary- ministries and departments of the govt; pressure groups and formal/informal associations an their role in the policy.& The Role of NGOs 8. Centre can't deem bodies 'political':SC Centre cannot brand organisations 'political': FCRA, 2010 and FC rules, 2011 empower central govt. to brand any organisations as of political nature. Important Provisions: Foreign Contribution(Regulation) Act, 2010. Section-3 of the Act prohibits acceptance of foreign contribution by the following: Candidate for elections; correspondent, columnist, cartoonist, editor, owner, printer or publisher of a registered newspaper; Judge, Govt servant or employee of any corporation or any other body controlled or owned by the Govt; member of any legislature; political party or office-bearer thereof; Organisation of a political nature as may be specified under sub-section(1) of section 5 by the central govt; association or company engaged in the production or broadcast of audio news or audio visual news or current affairs programmes through any electronic mode, or any other electronic form as defined in clause(r) of sub-section(1) of section-2 of the Information Technology Act,2000(21 of 2000) or any other mode of mass communication; Correspondent or columnist, cartoonist, editor, owner of the association or company referred to in clause(g) Section-5(1): Empowers Govt. to brand any Organisation as of political nature. The central govt. may having regard to the activities of the organization or the ideology propagated by the organization or the program of the organization of a political nature not being a political party, referred to in clause(f) of sub-section(1) of section-3: provided that the Central Govt may by rules made by it, frame the guidelines specifying the grounds on which an organization shall be specified as an organization of a political nature. Rule(3) of FC Rules, 2011: Guidelines for declaration of an organization to be of a political nature, not being a political party. Rule(3)(vi): Any organization, by whatever name called which habitually engages itself in or employs common methods of political action like'bandh' or ' hartal', 'rasta roko', 'rail roko', or 'jail bharo' in support of public causes. Section-5(3): Organization can represent its cause to Govt. The organization to whom a notice has been served under sub-section(2), may within a period of thirty days from the date of the notice, make a representation to the central govt. giving reasons for not specifying such an organization as an organization under sub-section(1): provided that the representation after the expiry of the said period that the organization was prevented by sufficient cause from making the representation within thirty days. Section-5(4): Govt. may forward representation to any authority. The central Govt. may if it considers it appropriate, forward the representation referred to in sub-section(3) to any authority to report on such representation. NEWS: Any organisation with no participation in active-politics/party politics can't be declared as 'POLITICAL'. GS-2: Government policies and interventions for development in various sectors & issues arising out of their design and implementation. State has powers to decide on hydrocarbon projects: Centre Environment Impact Assessment Notification, 2006: Two caterories of developmental projects. Category-A Category-B: (1) Category-B1 (2) Category-B2 Category-A Projects: Require prior Environment Clearance(PEC) from Union MoEF & CC, based on the recommendations of a Central Expert Appraisal Committee(EAC). Category-B Projects: Require PEC from State EIA Authority(SEIAA) which shall base its decision on the recommendations of State/UT Level EAC. NEWS: On 16th Jan,2020, the Union MoEF&CC modified the procedure to grant PEC for 'off-shore and on-shore Oil and gas "exploration" Projects' by amending the Schedule to the EIA notification 2006.
