As a person who had to study copyright law in design school, I can tell you that this is 100% copyright infringement. An artist has a copyright on their work upon creation, and while a work has to be registered with the U.S. Copyright Office to allow the artist to bring a lawsuit against someone who is infringing on that copyright either by copying some/all of the work or creating a derivative work, there still has been a violation. The work above is clearly derivative, if not an outright copy. More importantly though, it’s a dick move. Artists pour their hearts into not just the technical creation of the work, but the concept. Taking an idea and making it your own through your own characters and concepts, cool. Copying someone else’s and passing it off as your own, not cool.

For further reference, from EGPD Business Law: “There is actually no percentage by which you must change an image to avoid copyright infringement. While some say that you have to change 10-30% of a copyrighted work to avoid infringement, that has been proven to be a myth. The standard is whether the artworks are “substantially similar,” or a “substantial part” has been changed, which of course is subjective. The court will look at the circumstances and what exactly has been copied. While copying a small part of an image might seem insignificant, it might be deemed “substantial” if it defines or is the essence of the piece. The court will likely say that if a reasonable person would see the pieces as similar and point out which is the copy, an infringement has occurred.”

Yesterday I discovered that an artist had traced my art and was planning to make pins out of them. Art theft is bad enough, but stealing art for commercial use? Big yikes. I confronted her and while she did apologize and delete the posts, she only admitted to referencing my work rather than straight up tracing it. And she is deleting all comments calling her out on it.

I was going to leave it alone, but then I found out she has done this to multiple other artists in the past. While she does make some adjustments to the designs, it’s obvious enough that I could directly tell what the original image was. And she has never credited the original artist for any of these.

I never make public call outs like this, but since she is actually profiting and making these for commercial use I feel it is justified in this case. This person has been confronted by others in the past yet she continues to steal, so clearly she hasn’t learned anything (i talked to an artist who confronted her as recently as last month).

She is called @guillmon9005 on Instagram, and her shop account is called @Chenxira - she also has a Patreon account.

I don’t want any harassment to be sent her way, I just want this information to be public. I don’t think it’s okay that she has been able to continue for this long without ever addressing the situation. Perhaps you disagree with me and don’t consider this theft, which is ok! But even so, it’s shady to be so heavily inspired by someone else and not even giving them credit for it.

GM family.... I know we all have issues, challenges and triumphs. I hope me being transparent with mine inspires someone else to be transparent with theirs. We are each other's keeper. I don't do drama, but I do truth. And if in the process I can help somebody along the way, it makes the purpose of my journey all the more effective and fulfilling.

Things (4 things in particular) on my mind this morning.....

(1) I've come a long way when dealing with female relationships because the old Sonia would have cursed them out and never looked back.

(2) Family and being the best mom to my kids supersedes everything. I am the epitome of a mama bear ready to pounce.....from when my granddaughter's mother is acting crazy to helping my incarcerated/innocent child stay sain. It is my responsibility. And I boldly show up for them at all cost.

(3) Restaining Orders don't protect Black people. I hate to make things about RACE.....but white folks have gotten away with some petty ass shit and never get penalized for it. Show me where a black person with a restraining order against a white person was really protected. EGPD ain't shit for having a black Lt call me this morning to offer his personal assistance. And when I called him out on the hypocrisy, he told me I was being confrontational....code word for angry, loud, disrespectful. So I hung up in his face, not willing to give him that kind of power.

(4) I have connections to some really life altering events when it comes to police brutality and murder.....I marched in 1992 to shut down the Bay Bridge after the Rodney King verdict. My brother-in-law's brother was MURDERED by SacPD almost 20 years ago in the Meadowview area. Another one of my brother-in-law's is/was best friends with Joseph Mann. My uncle is married to the grandmother of Stephon Clark.

When we all sit down and think about the collective trauma that everyone, but especially black folks have experienced and suffered through, we have to pause, reflect and seek clarity. Healing is important but it can't happen if we sweep it under the rug. It can't happen if so called progressive people don't challenge the systems that were designed to marginalize. It can't happen if we don't use the system against itself. It can't happen if we are not ABOLITIONIST. It can't happen if we aren't vocal and RADICAL and pissed the f*ck off. It won't happen if we don't channel this pain at the source. It won't happen if we don't unite. It won't happen if YOU ARE NOT FED UP AND HAVE NEVER REACHED YOUR BREAKING POINT.

What will it take for you to stand up and say you aren't going to live like this anymore.....internalizing the further enslavement of the slave, the lashes, the death of Emmitt Till and Trayvon Martin and Tamir Rice and Stephon Clark. We have to be conduits for each other, intentionally re-routing the pain. It has been 15 weeks since Stephon's murder and every system directly connected to Sacramento have turned a BLINDS EYE.....stagnant to the fact of his family's pain, this community's trauma and historical genocide. So when a cop tells me they and the department they work for don't have policies and practices that uphold racism and white supremacy, I say you are blind and ignorant to the culture and history of policing in Amerikkka.
