Berlin deportiert auch ohne AfD

Strafgesetzbuch (StGB) vs Aufenthaltsgesetz (AufenthG)

Als juristischer Laie geht man davon aus, dass die Gesetze eine einheitliche Ordnung bilden, die in sich widerspruchsfrei sei. Zum anderen nimmt man an, dass das Nichtbefolgen von Gesetzen im üblichen Fall ein Verfahren nach sich zieht, das mit einem Urteil endet. Erst dann kann eine Strafe oder Beschränkung von Freiheitsrechten aufgrund anderer Vorschriften folgen.

In Berlin zeigt der Umgang mit Demonstranten an der FU Berlin, dass einzelne Gesetze aus sich selbst heraus zu wirken scheinen. Zwar gibt es gegen vier Ausländer:innen, die an den teilweise "gegen Sachen gewalttätigen Demos in der Freien Universität" zum Krieg Israel-Palästina teilgenommen hatten Ermittlungen der Staatsanwaltschaft Berlin (nach StGB) aber noch keine juristischen Verfahren.

Trotzdem haben alle Vier, darunter 3 EU- und ein US-Bürger von der Ausländerbehörde Aufforderungen zum Verlassen der BRD erhalten. Bei den EU-Bürgern handelt es sich Verfahren nach dem EU-Freizügigkeitsgesetz (FreizügG/EU) auf der Grundlage der Freizügigkeitsrichtlinie (2004/38/EG) und bei dem US-Bürger nach dem Aufenthaltsgesetz (AufenthG).

Damit verlieren erstmals(?) EU-Bürger:innen ohne ein Strafverfahren die Freizügigkeit innerhalb der EU. Franz C. Mayer, Professor für Verfassungs- und Europarecht an der Uni Bielefeld bezeichnet laut lto.de das Vorgehen als "Skandal" und "offensichtlich unionsrechtswidrig" ... "Es besteht schwerer Trumpismusverdacht", schrieb Mayer auf X.

Gegen das Vorgehen der Behörden gibt es heute von 8-12 Uhr eine Protestaktion/Mahnwache vor dem Berliner Abgeordnetenhaus (AG Frieden: Drohende Abschiebungen wg. Palästina-Solidarität).

Die Gewerkschaftliche Linke schreibt in dem Aufruf zum Protest: Stoppt die Abschiebung der Berlin 4 Der Berliner Senat will 4 Jugendliche ohne Gerichtsurteil abschieben, darunter 3 EU-Bürger, weil sie sich an Palästina-Demonstrationen beteiligten. Damit wird ein gefährlicher Präzedenzfall geschaffen, der alle Migranten und eingewanderten Kollegen bedroht, die die Regierung kritisieren und ihr Versammlungsrecht wahrnehmen. Wir fordern ein sofortiges Ende dieser politischen Verfolgung, denn wir haben schon einmal gesehen, wo das hinführt! Ungezügelte Polizeigewalt geht Hand in Hand mit Einschränkungen von Meinungs- und Wissenschaftsfreiheit und der repressiven Anwendung von Einwanderungsgesetzen. Diese Abschiebungen werden genutzt, um Demonstrationen und unliebsame politische Aktivitäten generell zu behindern sowie Ausländer:innen und Migrant:innen einzuschüchtern!

While the surface of Mars looks relatively unchanging now, it wasn’t always so. The tallest mountain in the Solar System is Olympus Mons, a giant shield volcano on Mars that reaches 21.9 km (13.6 miles) high, 2.5 times higher than Mount Everest here on Earth. Ancient lava flows surround the volcanic caldera, evidence of an active time. New images from ESA’s Mars Express show how these lava flows created extremely sharp cliffs, as high as 7 km (4.3 miles) in some areas, which suddenly collapsed in mind-boggling landslides. One of these landslides occurred several 100 million years ago when a chunk of the volcano broke off and spread across the surrounding plains. If we could look back in time and see as it happened, it was certainly a very dramatic and turbulent epoch on Mars. The images, from Mars Express’ High Resolution Stereo Camera (HRSC), show a crumpled feature named Lycus Sulci, on the edges of the aureole; the volcano itself is located out of frame to the bottom left in the image above — (south-east), many hundreds of km away, but visible in the images below. Combining the new images with data with topographical data from NASA’s Mars Orbiter Laser Altimeter helps tell the ancient story of how Olympus Mons’s lower flanks catastrophically collapsed several 100 million years ago. ESA scientists say that large amounts of lava once flowed down the volcano, triggering landslides that tumbled down its flanks to meet bedrock – in this case, bedrock containing ice and water. This image of shows the wrinkled surroundings of Olympus Mons and a feature named Lycus Sulci, on the raised aureole surrounding the volcano. Credit: NASA/MGS/MOLA Science Team The steaming hot lava caused the ice to melt and become unstable; as a result, the rocky rim of Olympus Mons broke off and partially slid away. This collapse came in the form of huge rockfalls and landslides, which slipped downwards and spread widely across the surrounding plains. As the landslides traveled across the landscape, they crumpled and pulled apart, created a wrinkly-looking surface. Later, fierce Martian winds whipped across the hardened lava flows and sculpted them into the softened wrinkles we see today in Lycus Sulci. Comparable but smaller landslides can be seen around the volcanic islands of Hawaii and the Canary Islands, which have seen large rockfalls in the past.
