in theory, ambivalent bc i simply haven't read tim's pride special or tdr (basically if it's rebirth and kon isn't heavily featured you can guarantee i haven't read it yet), and i try very hard not to let fanon turn me off a character or ship i haven't actually read yet. in practice... blacklisted because i swear to god one more "kon is so jealous of bernard!!!"/timkon vs timber ship war!!!!/"omg kon's entire character is just being tim's love interest right???" post and that's it im turning into the joker :/ ig i don't have any strong feelings about the ship but the [loudest minority of the] shippers. as a kon blog... they vex me

you have any nico headcanons where he’s ftm trans but then realizes he’s also nonbinary (he/they/she)? just struggling with gender identity lately ig.
Alright, anon, I hope these help you some, my gender has been rather ~~~ lately, if that makes any sense... I would also like to remind everyone to bind safely and if you need resources on how to safely bind without a binder feel free to reach out to me:
Nico always just knew he was a boy, dresses were a no-go, couldn't stand to wear anything that wasn't undeniably boys clothes
In the beginning Maria thought maybe it was just a texture problem, but when Nico was three she came home to see him cutting all of his hair off she knew it was deeper
This is why they ended up moving to America eventually, Maria decided that if they started over then Nico would be able to be himself
Bianca named him on the way over, she liked the name because they were "winning" by leaving Italy
Nothing really signifigant happens in regards to Nico and his gender through this point, he is able to play freely with other boys, and he goes to school with them and such
The same in the Lotus Hotel, nothing signifigant
When he and Bianca go to Westover Nico is kind of scared the whole time, because he is worried about being "caught", changing for afterschool soccer games and having communal shower spaces at the school is difficult for him to feel comfortable
He usually tries to shower late at night or early in the morning when nobody is around, and that works out okay for him
His chest starts developing around this point and he freaks out, he has no clue how to hide it or how to deal with the new stress
He ends up trying to find Bianca one day, and they do all sorts of crazy stuff to see if they can help, eventually they figure out how to use a piece of cloth they sew together
When Nico ends up at camp alone without Bianca, there's the problem once again of communal showers and they're rarely ever empty
This is how he befriends the Stolls
At some point the pair of them notice Nico is weirdly panicky about the bathrooms so they go stand outside and keep people out when Nico's in there... It's honestly how they perfect their pranking techniques
When Nico runs away from camp upset, just the day before his binder had quit fitting and he had been upset by that because he had to make a binder again
Although his sister dying pushed all other thoughts out of his head, the emotions from previous events were still leftover
This is why he buys his jacket TM, because the layers help hide his chest more and the weight is comfortable
At some point during the Labrynth he ends up binding with ace bandages (AN: Don't do this)
He also starts his period at some time around this point and kind of freaks out "oh no" and it's not entirely that his period bothers him, but more so that he just doesn't know how he's supposed to hide it
He also realizes at some point around here that he likes Percy, which makes him feel odd and more freaked out
He's struggling because "boys are supposed to like girls" and also he's struggling because if most boys oon't have periods and he does... why doesn't his bother him?
Despite Nico himself being trans, he doesn't have the vocabulary to describe anything he's going through, and he doesn't know there's other trans people, or even queer people of any sort
So he sort of begins to question "am I really a boy?" but there's so much going on in the world and he's got so much to do, so he can't really devote much time to thinking about it
Everything continues about canonically until he's in the jar after Tartarus
During a fight with a monster or something he was knocked over, and combine this with the fact that Nico was binding with ace bandages, he definitly breaks a rib
Which makes breathing with little air a lot harder
Eventually he's saved and through ambrosia and nectar Nico manages to heal his ribs a little
He isn't able to bind that whole time though, so he does his best to keep away from The Seven
After Cupid outs him to Jason, Jason asks a few days later if he wants to talk about it, at first Nico is like "no go away I don't like you don't talk to me"
But eventually he opens up to Jason, because Jason was like "I'm sorry you had to do that I promise I won’t tell anyone and if you want to talk we can talk"
Anyhow eventually Nico kind of just breaks down and he's like "I don't know if I'm a boy or a girl? I think I used to be a girl, but now I am a boy and I don't really remember how it happened” or something similar
It takes Jason a moment but eventually he’s like “Oh you’re trans?”
And Nico;s like “heh? What’s that?
And so him and Jason talk, but Jason is only kind of well versed in this topic, so he only covers “basic” MtF and FtM transition because he doesn’t really know enough about other genders to feel comfortable explaining it
And Nico’s like “there’s people? Out there?? Like me??” and he’s just Happy Nico ™
Nico is like “and there are people like me who like boys?”
And Jason is like “Yeah totally!” but internally he’s like (I think so??)
Anyhow Nico feels a little better, but he doesn’t feel perfect, he’s still struggling a little bit internally to recognize that there’s other people like him and he’s not wrong for being him
Anyhow, Jason doesn’t know enough about this stuff to know binders exist, Jason just has a little bit of secondhand information from tv shows and from being from California… He promises he’ll look into various things more when he’s back at camp or has decent access to internet
On Nico’s quest with Reyna and Hedge he obvious evaporates Bryce, and Reyna and Hedge find out
They find out he’s gay as in canon, but they realize he’s trans when caking him in mud
Hedge just goes into dad mode about the situation and is like “son”, “sport”, “kiddo”, “my male child” etc
Reyna knows a little more about trans stuff than Jason, but she’s kind of in the same “ehhh I’m not really sure of a few things” boat, but she’s supportive and she’s like “I will beat anyone who gives you a dirty look up so fast”
Eventually they get to camp, and all that happens
Three days in the infirmary happens, and basically Nico has to tell Will for medical reasons that he’s trans because Nico needs stitches or something
Anyhow Will is like “Oh yeah cool me too, can you take your binder off now?”
And Nico is like “heh???”
Anyhow Will finds out Nico is binding with ace bandages and he’s like “no, don’t do that” and then he goes and finds a proper binder in Nico’s size which he gives to him after his stay is up
When they befriend one another they have a short conversation about gender and Will is discussing like gender theory 101 type stuff, and he’s like “wait why dont you know this- oh yeah you’re from the thirties- wait do you even know what nonbinary means??”
And Nico is just staring at Will like he has three heads for the whole conversation
So Will teaches Nico about gender and pronouns, and gender presentation vs gender identity, etc
And so Nico goes “wait so there are people like me who are also gay?”
And Will is like “I like boys and girls and everything in between so yeah”
And the whole enby thing doesn’t really stick with Nico at that point he’s just like “hmm interesting, so testosterone?”
It’s just not his biggest concern, he’s just happy to know there are in fact others like him, and no he’s not crazy for not being dysphoric over his period, and that’s normal too
And he’s just like “oh so that’s top dysphoria?”
And Will is like “yeah :/”
“Oh :/”
“Mhmm :/”
Anyhow they become like good friends and they start dating sort of on accident, like they’re too close to just argue they’re friends anymore, and at some point Will just shows Nico how to give him a T shot and it’s like chill, they’re chill
Anyhow one day someone is kind of confused by Nico’s gender so they use the word “they” and it makes Nico really happy for some reason, so he goes back to Will and he’s like “tell me about this whole nobinary thing again?”
And Will is like “yes absolutely”
And Nico goes “I think I might be nonbinary can we try new pronouns?”
And so they go through all sorts of new pronouns, and Nico decides he still likes he/him but he also likes they/them and xer/xem… They likes she/her too but Nico finds it too uncomfortable sometimes because it reminds him of dysphoria
Nico decides xyr uncomfortable with using she/her but they like using female gendered terms so he does that
(Listen, I know Will saying “this is my boyfriend” was a big moment but Will calling Nico his “wife” is 10/10)
Nico’s friends are all super supportive and they do their best to learn more about gender and such things in order to better support and care for Nico
They all use different pronouns for xem and some people alternate pronouns too, but Nico knows that takes more practice
But it’s just like good and positive in Nico’s life
And he begins to play with fashion a lot and xe finds out xyr love of skirts with tights and combat boots because it’s 10/10 the best fashion
Nico also loves their big jackets and they just looks so comfy all the time everyone is like “I want to be him” and Nico grows their hair out long again, and gets his ears pierced and xe’s just a nonbinary fashion icon
They are just so cool once they figure out gender more and Nico’s just happy to play around with xyr gender and he just enjoys it
Will doesn’t play around with gender so much, he’s 100% a binary trans guy but T helped make him comfortable enough in his femininity to wear skirts a little bit on the occasion (Will in a cat maid dress 10/10), but heels and skinny jeans for some reason are still big dysphoria triggers for him so he does have some limits on what he’ll wear
Will gets top surgery when he’s like 17 because Naomi is an extremely supportive parent
So that’s how Nico meets Will’s mom and she’s like “it’s so nice to finally meet you!” and Naomi just immediately falls in love with xem and Will is like “I know they’re amazing”
And Nico is just really supportive and they sort of role reverse and Nico plays nurse while Will recovers from top surgery and they has to like brush his teeth and stuff
The experience (despite the fact that Will had an easier recovery) assures Nico in how much he wants top surgery, and he’s sad he’ll have to wait another year until he’s 18 to get it done
Anyhow Hades finds out and agrees to sign the wavers, so once Will is healed up enough to wear he can put his own clothes on and stuff, Nico decides to go through with xyrs own top surgery then too
Reyna comes to help Will take care of Nico, and Jason does too
Originally Will was supposed to help more with Nico’s care but he wasn’t able to do as much as he thought so they had to phone their friends
Eventually they both heal up really well and they’re happy to be done with that
Nico spends time debating testosterone, while Will spends time debating lower surgery
During this time Nico starts art school and Will starts medical school
Meeting more nonbinary people makes Nico feel at home and he determines that xe doesn’t want to go on testosterone but it’s still a maybe in the future
Will however decides he does want lower surgery, so Will and Lou Ellen decide to get lower surgery together as friends so they can share in the pain (Lou Ellen is a trans woman as far as I’m concerned this is canon)
Nico takes some time off to do school from home so he can help the two of them, and Naomi comes to live with them as well for a bit
Will and Nico both finish school eventually and they decide to adopt trans kids to help them out more

Soccer Player! Levi vs. Baseball Player! Zeke Modern AU Headcanon
ok i took a break from the long-ass HC post request i was writing earlier on so have this. I also got the idea of Soccer Player! Levi from @ralvaille
And lol of course this will also have Rivetra
Levi and Zeke are both seniors
And yes, Levi still wants to murder Zeke in this AU
No he’s not overreacting he really wants to murder him
Anyway, the history is because Zeke almost put Levi’s childhood friend Erwin in a coma back in middle school since the asshole thought he’s good at playing baseball and accidentally hit Erwin in the head with the bat
Turns out Zeke IS good at baseball once he grew up
Levi tried to make him say sorry but Zeke refused because Erwin was in the way so it’s not his fault
That’s the start of a *lovely* relationship
Fast forward to uni years AND THIS FUCKING GORILLA HAD THE GUTS TO FLIRT WITH LEVI’S GIRLFRIEND (Student Body President Petra Ral :3)
Zeke approaches Petra whenever she’s studying in the library and tries to charm her with his nerdy theories since Petra is a literature major
They do bond well since he’s also in the same department (Zeke’s major is Political Science) and they even have some classes together
Zeke gives Petra some of his notes so she can maybe get a head start in some of their same classes
AND IT TAKES EVERYTHING IN LEVI NOT TO SHIFT FROM CRIMINOLOGY TO WHATEVER HE CAN ENROLL IN THE HUMANITIES DEPARTMENT
Erwin, who's also taking up criminology, tries to talk sense to Levi
Petra thinks it’s stupid that Levi’s even considering that since he’s already graduating.
Anyway... Petra, being an all-around nice person/sunshine/lovely hazelnut/basically the only good thing in Levi’s world, calms Levi down and says that Zeke’s just being nice and there’s no harm done
Usually one Petra smooch is enough to turn Levi’s frowny frown upside down
Zeke’s only doing this because he knows it gets on Levi’s nerves
...okay actually it turns out Zeke does end up having a bit of a crush on Petra because who wouldn’t???
The whole university always looks forward to the interactions of the school’s top soccer player and top baseball player
During sports events, Levi pushes his soccer team to do well so he can rub it in that they’re better than the baseball team
During practice, Levi tries to kick a bit harder when Zeke’s within the vicinity with the hopes of hitting him
The same for Zeke whenever Levi’s near. Sometimes his throws are “a bit off woops sorry Levi didn’t know u were there!!”
Petra is Tired™️ of these two boys
Zeke tries to get a rise out of Levi but he knows he’s no match bec. Levi is freakishly strong wtf??
But Zeke is a better scheming son of a bitch so he also has a fighting chance against Levi (but in a different way)
The last straw was when Zeke taught Petra how to smoke and Levi, being the clean freak he is, does NOT APPROVE. He never tries to control his girlfriend but if it’s something that he knows will be damaging to her health......
You can bet Zeke’s ass got whooped
Fast forward to Zeke, Erwin, Levi and all the other seniors’ graduation day and Petra’s attending of course. Zeke continues to try and get a rise out of Levi by asking Petra to take a lot of grad selfies with him
He knows he has enough photos but he asks for different variations like redoing throwing the graduation cap for an Instagram boomerang
Petra, high on happiness and pride since her boyfriend just graduated and she’s also happy for Zeke, didn’t mind and didn’t see through what Zeke was really aiming for
...Levi may or may not have broken Zeke’s nose and glasses in the middle of that 4th IG boomerang attempt

Dark Age Dark Age
ok so I finished Dark Age today and wanted to give me thoughts. Lemme tell you, I had miiiiixed fuckin feelings. Spoilers below the line
I couldn’t put the damn thing down, but jesus christ I felt so stressed and awful the whole time I was reading it. Too bleak and brutal for my taste personally. I know the books have always had a streak of that in them but this was too much for me. So to start off, here’s what I didn’t like (feel free to skip this chunk if you don’t want my whining - positive stuff and general thoughts to come after!):
I felt like there was too much rape and torture in this one, especially the former. It’s discussed waaaay more frequently and openly than in any of the other books, and after a while it’s just like... we get it. It’s war and these guys are bad guys. Can we talk about something else pls
Nothing good happened to... anyone we like? For the whole book? With a few minor exceptions. But a brief synopsis of the book could go like this: Darrow’s fucked, Orion’s fucked, Alexandar’s fucked, Dancer’s fucked, Daxo’s fucked, Mustang’s fucked, Lyria’s fucked, Volga’s fucked, Mustang’s fucked again, Sevro’s fucked, Pebble and Clown are fucked, Victra’s fucked, Darrow’s fucked again, Alexander’s fucked again, Screwface is fucked, Sefi’s fucked, Ephraim’s fucked... You get it. Practically the only good thing that happened to anyone was “somehow didn’t die in the face of certain extermination,” which is less satisfying than it is mildly relieving.
Very few of the quiet moments that I loved so much in the first trilogy. Conversations between Mustang and Darrow (I was gunning for a reunion at the end, didn’t even get that), Darrow and Sevro, etc etc. We got a few with Mustang and Kavax and Pax and Ephraim (who I like now??? and also rip? more on that later). Just everyone I love getting fucked
I feel like the Adrius clone thing is a cop-out. Adrius was one of my favorite characters from the original trilogy, but his arc was completed, his death was immensely satisfying, and bringing him back now seems cheap. It’s not like the book was lacking in villains
Which brings me to my last complaint: too many villains! Too many! Too much going on! The Society, which is itself fractured into different ‘groups’ (Atalantia vs. Ajax vs. Atlas vs. Lysander), the Red Hand, the Syndicate and the Boneriders (not enough for it to be Lilath, also have to have Clone Adrius), the Rim (and where the fuck was Dido, btw?), the Vox, the Ascomanni, Apollonius... Felt a bit all over the place
The bleakness was such that any victory by our folks that may come at the end of book 6 seems like it will just be insanely unrealistic
All that said, I think I’ll have to wait to see how 6 ties some of this stuff together to form a full opinion. I can see myself changing my mind about some of this stuff. Maybe a book 6 victory will be all the sweeter for how utterly depressing this book was. Ok! Whining over! Here’s are my neutral and positive thoughts!
Darrow, Virginia, Victra and Sevro are alive (for now). So are the kids, and so are Cassius, Lyria and Volga. And let me tell you, Pierce deffo did a good job of convincing me that anyone could die this time around.
Cassius lives! I know we all kind of called it, but still... nice to be right. At the end there, I kind of figured that either Darrow was toast, or Cassius was coming. I’m glad it was the latter
I WAS FUCKING RIGHT ABOUT LILATH! Right after reading IG I called that she survived the crash and became the Syndicate queen! All hail my powers of prediction. Definitely did not suspect a thing about clone Adrius though (was there any foreshadowing to that at all? Hit me up w/ those receipts if you have em)
I read the Day of Red Doves at work and felt so upset for... hours. Honestly how dare they.
Speaking of, I loved the Virginia POVs in this book, they did not disappoint! Still my favorite character by far, and I was happy to see things end on a hopeful note with her and Victra and Kavax and Pax
Ephraim and Lyria really came into their own in this book. I hated Ephraim in IG, and I was super bummed to see him go at the end of DA. Loved his friendship with Pax, TG for that kid taking his Zoladone away. Lyria turned into a badass, I loved seeing her almost singlehandedly take down the Red Hand, and I’m super interested to see where the Figment thing is going. Also love her and Volga and Victra’s bonding
Fuuuuuuck Lysander, fuck that stupid self-righteous prick. Fuck him especially for killing Alexandar. I know there’s more growth and story arc coming for him with the whole “erased memories/my lover of political convenience killed my parents and I hate her” thing, but I’m not here for a redemption arc rn. Put him in the ground. Lysander is the new Roque. Cassius says you’re welcome for keeping you alive, thanks for nothing, you absolute jackass.
Volga’s gonna be a power player in Book 6. She’s gonna win over the Obsidian and save everyone’s ass when all hope seems lost, and that is the one and only prediction I have for you at the moment.
I’m really hoping that book 6 will be a more focused conflict, and that for much or most of it, our faves will be together making their stand on Mars. I love the OGs (Darrow, Mustang, Sevro, Victra, Cassius), but they’ve always been at their best when they’re together, and I think it’d be a shame if we don’t get a big fuckin heap of that in book 6 after what we went through in Dark Age.
Thoughts? Predictions? Theories? Pushback on my complaints? Send it over. This goddamn book is all I’ll be thinking about for days.

Larry Vs Zarry and more rants
Okay this is a rant that no one asked for but no one in my social circle cares enough about this to hear me out so tumblr will be a decent substitute.
I hate larries. First they try to make everything about Larry like it is so far fetch but they are gripping onto that theory tight. They are so blind and so adamant and anything that debunks any of their theory sets them off. The entire Larry fandom is so toxic that they even affected harry and Louis’s friendship. To be very honest I never liked Louis because he craved so much attention especially in the early days. He probably saw that many fans were invested in Larry and decided to add fuel to the fire by doing stuff purposefully on cameras. It’s so ridiculous. He even admitted himself that he was insecure about being obselete when he left the band as it is pretty evident that the more popular members of the band did not include him. He wanted to be relevant and did this by hopping onto the Larry BS. After it got out of control and compromised their actual friendship and even his relationship with his gf then did he start denying all the Larry theories. Louis was just milking it. Did y’all noticed how harry ignored Louis the last 2 years in the band? They barely even talked. Y’all say its the management but y’all watch too much tv man. Those things don’t happen in real life to such an extreme level because that’s not humane and they know that they can get into a lot of trouble doing that. They won’t go so far by not allowing them to talk H doesn’t even glance at Louis. Y’all keep saying that Louis’s backhanded comments are sassy well they aren’t they are just straight up rude y’all clearly don’t know the difference. Watch drag race and see how sassy is done. Sassy is being witty but if u say the ‘joke’ again and again it’s just being mean bro. Anyways I’m not here to define what sassy is. H did not deserve all those comments in the early days especially the ones about his mum it’s not appropriate at all. If u notice, Z never participated in the ‘hot mum’ convo and stopped teasing H’s voice after doing some impressions of harry in 2011. Harry was just tolerant and a nice human so he didn’t do much about it. Of course as he got older he knew he didn’t have to put up with the bs Louis gives him and started to take matters into his own hands.
Not to go off on Louis I’m sure he is an decent human privately but whatever I see on camera I dislike. His fans are also delusional. Since I’m alr going off on Louis might as well say everything. The main reason why Louis fights to stay relevant was his limited vocal skills. He has a nice tone to his voice I admit. I quite like it. But it’s just so unreliable. I laugh everytime I see a Louis singing like an angel compilation appearing on my ig because even in those clips he was off tune. Imagine his normal live performances. Idk maybe I just have a more sensitive musical ear because of my musical background but literally almost everytime he sings it’s bad. His fans keep complaining about how he never really got many parts in songs during 1D and most were given to H and Z and even Liam. He prob would be given more parts if he sang with technique and consistency as good as Mitch grassi( who has a similar temperament to Louis) but he doesn’t. He has a shit range I prob have a wider range than he does (and I mean the lower range as well); he has shit technique as you can see his voice get more hoarse as time goes on as he pushes too hard for the notes and often strains to hit the notes; bad at runs and the one time he was given a run in a song he screws up during almost all live shows or doesn’t even sing the runs; often off tune like so off he literally has 3 lines and can’t stay on key I can continue you know. Of course I can understand if you’re insecure. (Maybe stop wasting time on fuelling Larry and practice ur technique? Attend vocal lessons?) you want to prove me otherwise? U can watch the live performance after he went solo. Lmao with no one to hide behind and singing with another inconsistent singer (bebe rexha no hate tho I love her songs but she has problems singing live sometimes) the performance was an utter mess. Okay enough with Louis talking abt him is hurting my brain.
The thing I like about the zarry fandom is that they’re so Low key and very patient and friendly. They are always trying to find new content to share and keeps to fandom only. They know that if Z and H knew about such speculations and theories we made, their dynamic may change as well So zarries keeps it to themselves and RESPECTS THEIR PRIVACY. That’s why we Low key panicked when the articles about harry being the inspiration behind fingers came out. You can support your fandom, you can come up with your theories but if you start going off on other fandoms randomly, you are being defensive for nothing. When larries say “I’m just sharing my opinion” but goes off at other fandoms for sharing their’s isn’t that hypocritical? I don’t know why these minute feuds happen there are more significant things happening don’t y’all have homework and exams to deal with? Why do you have to defend them so strongly? Now the actual ships. Larry were clearly best buddies in the early days. Zarry (maybe not as bff as Larry )but they were very comfortable around each other and were very close ( they slept in the same bed and cuddled during an interview like full on nuzzle into neck Shit) but if u see the interview when the boys were asked to identify who the food thief is, the boys were outing Harry being a food thief but Louis of course had to say some cheesy thing about how he can take his food. Liam was like but the other day you said... CLEARLY Louis had complained about Harry stealing food but once again he was MILKING LARRY. Have you seen Harry say anything like that to Louis? No not really. Maybe said he was funny once or sth. With Zayn, yes many occasions. Saying he is intelligent, funny, pretty, missing his eyes when the question was not even for him???? The list can go on. All Harry had done was deny the Larry rumours again and again and again. Zayn even stepped in multiple times to deny the rumours as well. I mean man watch zarrydocumentary, mah edats or any zarry channles and the Miami incident omg that was so compelling. The eating disorder era and harry not saying weigh like asfghjk y’all won’t know till y’all watch the vids man. What are Selection Inventions?
The rationale behind granting monopolistic and exclusive rights over a particular invention is to reward and accredit the inventor for inventing a novel invention that is susceptible to industrial application and is not obvious to the existent state of the art. These rights are, therefore, given instead of the disclosure made by the inventor to the state, which can later be used as a public source of information to contribute to the development of the civilization.
However, selection inventions contrast with the basic idea of novelty and prior-art since they stand for those inventions, which have a specific concept that is selected from a prior concept or a larger and much more generic concept of a particular invention that has great and more advantageous properties than that of the prior disclosed concept. Therefore, a selection invention is the one, which can be found to be a part of the prior art disclosure, but it hasn’t been disclosed with individual reference therein. These are not limited to only pharmaceutical patents but extend to other premises like engineering, biotechnology, telecommunications, etc. In France, China, and Japan, selection inventions are possible in the field of mechanical engineering, while in countries like Argentina – the same is restricted to a particular condition for processes and compounds.
A typical example of this involves the pharmaceutical patents that utilize a Markush-type formula to claim a compound. A Markush-type formula has numerous radicals with wide possibilities of potential substitutes that can be chosen in its place. The combinations of all the possibilities of such radicals may lead to a greater number of compounds, some of which have neither been studied nor been described in a particular Patent Application.
To illustrate a selection patent, consider that to make an invention ‘A,’ the process utilizes a temperature ranging between 20 degrees Celsius to 100 degree Celsius and a pressure range between 20 and 60 Pa. It is later found that invention A can be produced in greater quantity if a temperature of 25 degrees is coupled with 50 Pa. The same had not been tested nor described in the prior art. Therefore, a selection patent may involve, for example, the selection of individual elements, sub-sets, or sub-ranges, which have not been explicitly disclosed previously, within a larger known set or range.
Tracing the History of Selection Doctrine
The history of the selection invention doctrine can be traced back to the case of In Re Farben Industries, back in the year 1930. However, the modern-day interpretation of this concept can be attributed to Albert Einstein, who, during the development of his theory on Photo-electricity, worked with the German Patent Office. He provided his comments as a Grade-III Expect in a case of Patent Infringement, where he discussed the facts that a patent, which cannot be used without violating the scope of another ‘ruling patent,’ is known as a ‘dependent patent.’ These dependent patents are often based on the notion of ‘selection invention,’ where a selection of a narrow region having surprising effects is made within a broader known region.
Tests Evolved for Qualifying an Invention as a Selection Invention
The fundamental principle laid down for a selection patent can be understood from the classic espousal in the landmark case of IG Farbenindustrie (1930) 47 RPC 289 on the doctrine of allowing patents to cover old or obvious inventions wherein the new invention is founded from the selection from a class of elements. In this case, Justice Maugham J. laid down a three-step test for a selection invention to be valid as a patent, which is enumerated as follows:
The patent must be based on a substantial advantage or an avoided disadvantage secured through such a selection;
The entire combination of the selected members must possess the said advantage; and
The advantage of the selection made must essentially be peculiar to the selected group.
Also, a three-part novelty test was devised in the case of Bleach Additive vs. Akzo as per which the following factors should be satisfied to accord patentability to an invention:
The claimed range must be narrow;
It must be sufficiently distant from preferred known ranges; and
It must not be an arbitrarily chosen part of the prior art.
Jurisdiction Specific Application of Selection Invention Doctrine
To clarify the standpoint of these kinds of inventions, the United Nations Development Programme (UNDP) issued a document entitled Guidelines for Pharmaceutical Patent Examination: Examining Pharmaceutical Patents from a Public Health Perspective (the ‘Guidelines’), in the year 2015, which was an effort to promote access to medicines, which recommended that courts and patent office should implement newly heightened patentability requirements for follow-on pharmaceutical innovation that would be uniquely stringent and largely unprecedented..
The criteria for accepting selection patents differ as per the jurisdictional requirements in each territory. Consider, for example, the EPO Guidelines for examining a patent application. It states that an application would be admissible if the criteria for patentability are complied with as well as the selection of “individual chemical compounds from a known generic formula whereby the compound selected results from the selection of specific substituents from two or more ‘lists’ of substituents given in the known generic formula. The same applies to specific mixtures resulting from the selection of individual components from lists of components making up the prior art mixture.” Therefore, as per the EPO, the selection made in a numerical range would be acceptable. A numerical range is that wherein the disclosed patent includes a range of compounds from C1-C4 and the selection of C2 is specifically made. However, the same is admissible only if:
The selected sub-range is narrower when compared to the known range;
The selected sub-range is sufficiently far removed from any particular example disclosed in the prior art and from the endpoints of the known range disclosed therewith; and
The selected range is not an arbitrary specimen of the prior art, i.e., not a mere embodiment of the prior art, but another invention (purposive selection, new technical teaching).
Therefore, in the EPO, the acceptance of selection patents is founded on a fictitious concept of novelty as per which a prior disclosure is not considered to deprive the selected elements of the notion of novelty. However, such inventions are not protected in various jurisdictions like South Africa, Japan, Philippines, Singapore, New Zealand, Australia, Austria, Czech Republic, Estonia, Finland, Germany, the Netherlands, Portugal, Spain, Sweden, the UK, Belgium, Denmark, Turkey, Canada, the US, Panama, and Argentina.
Novelty Requirements in Different Jurisdictions
However, as mentioned above, the requirements of patentability may differ. In Germany, the standard of novelty is applied very strictly, which means that an invention may be declared as admissible by the EPO but at the same time may be rejected by German Courts. In the United Kingdom, the selection invention is patentable – provided the selection must possess a special advantage judged in the context of the inventive step requirement. Furthermore, in Canada, the unexpected advantages are primarily treated as a matter of utility (industrial application) under the ‘promise doctrine’ developed by the courts; while other jurisdictions do not recognize the concept of ‘selected inventions’ through special and distinct rules, for example, in Belgium, Denmark, Estonia, Finland, Germany, Italy, Norway, Portugal, Spain, and Turkey.
Where selection patents are granted and are permissible, it means that the coverage of that patented invention may be much wider than the disclosure made. However, it also means that the proprietor of the patent would receive protection on all the embodiments of the basic patent; however, the subsequently selected elements (although protected) would be considered as not disclosed and, hence, be considered novel in the subsequent invention. This stance was rejected by the Indian Supreme Court in the landmark case of Novartis AG vs. Union of India & Others 2013 wherein the Court held that “a monopoly is granted to a private individual in exchange of the invention being made public so that, at the end of the patent term, the invention may belong to the people at large who may be benefited by it. To say that the coverage in a patent might go much beyond the disclosure thus seems to negate the fundamental rule underlying the grant of patents.”
Problems that Need to be Addressed to Understand the Scope of Selection Patents
The area of selection patents is ambiguous because different jurisdictions have different practices about the subject matter. Also, there is no uniformity in defining these inventions. Therefore, in the event of a conflict between two different jurisdictions, the appropriate decree of the court cannot be anticipated. WASHINGTON — A long-awaited report by the Justice Department’s inspector general released on Monday sharply criticized the F.B.I.’s handling of a wiretap application used in the early stages of its Russia investigation but debunked President Trump’s accusations that former bureau leaders engaged in a politicized conspiracy to sabotage him.
Investigators uncovered “no documentary or testimonial evidence” that political bias affected how officials conducted the investigation, said the report, which totaled more than 400 pages. The F.B.I. had sufficient evidence in July 2016 to lawfully open the investigation, known as Crossfire Hurricane, and officials followed procedures in using informants to approach campaign aides, the inspector general, Michael E. Horowitz, determined.
But Mr. Horowitz also uncovered substantial dysfunction, carelessness and serious errors in one part of the sprawling inquiry: the F.B.I.’s applications for court orders approving a wiretap targeting Carter Page, a former Trump campaign adviser with ties to Russia. He found that one low-ranking F.B.I. lawyer altered a related document and referred the lawyer for possible prosecution.
By puncturing conspiracy theories promoted by Mr. Trump and his allies, yet sharply criticizing law enforcement actions that have not been the subject of public debate, Mr. Horowitz’s mixed findings may offer vindication for both critics and allies of Mr. Trump. The exhaustive report by an independent official is likely to stand as a definitive accounting of the F.B.I.’s actions in the early stages of the Russia investigation.
Attorney General William P. Barr, who was said to be skeptical of Mr. Horowitz’s conclusion that officials had a proper basis to open the Russia investigation, praised the inspector general but reiterated his longstanding complaints about the F.B.I. inquiry, saying the bureau’s “malfeasance and misfeasance” detailed in the report reflected a “clear abuse” of the wiretap application process.
“The inspector general’s report now makes clear that the F.B.I. launched an intrusive investigation of a U.S. presidential campaign on the thinnest of suspicions that, in my view, were insufficient to justify the steps taken,” Mr. Barr said in a statement that echoed his willingness to act as Mr. Trump’s defender at the end of the special counsel investigation that grew out of the Russia inquiry.
Mr. Horowitz’s findings on the wiretap application showed that when it mattered most — with the stakes the greatest and no room for error — F.B.I. officials on various teams still made numerous and serious mistakes in wielding a powerful surveillance tool. The discovery calls into question the bureau’s surveillance practices in routine cases without such high-stakes political implications.
“That so many basic and fundamental errors were made by three separate, handpicked teams on one of the most sensitive F.B.I. investigations that was briefed to the highest levels within the F.B.I., and that F.B.I. officials expected would eventually be subjected to close scrutiny, raised significant questions regarding the F.B.I. chain of command’s management and supervision of the FISA process,” the report said.
The report came on the same day that House Democrats moved forward with their impeachment inquiry into Mr. Trump, with a lawyer for the Judiciary Committee telling its members during a hearing that the president’s dealings with Ukraine were “so brazen” that there was no question that he had abused his power to advance his own political interests over the country’s.
The report, as well as Mr. Barr’s criticism, is certain to extend the debate over the legitimacy of the F.B.I.’s inquiry. Mr. Barr has publicly said he thinks the Trump campaign was subjected to “spying” and tapped John H. Durham, the United States attorney in Connecticut, to lead yet another investigation into the Russia investigation.
Though the report largely exonerated F.B.I. officials of the president’s most inflammatory accusations, Mr. Trump’s persistent attacks have nonetheless already damaged the bureau’s reputation. Top officials were fired, while others left the bureau.
Much of the report focused on the paperwork associated with the wiretapping of Mr. Page, who was first approved for targeting in October 2016, about a month after he had stepped down from the Trump campaign. The Justice Department obtained three renewals of court permission to eavesdrop on Mr. Page — two under the Trump administration.
The four applications contained dozens of significant inaccuracies, material omissions or assertions that were not backed in supporting documents, according to the report, which grouped them in a chart. The applications for the wiretap relied on historical information about Mr. Page’s contacts before 2016, and claims about his 2016 interactions with Russians came from a notorious dossier of opposition research collected by Christopher Steele, a former British intelligence agent paid by Democrats.
For example, the F.B.I. never told the main Justice Department, which in turn never told the court, that Mr. Page had for years been providing information to the C.I.A. about his prior contacts with Russian intelligence officials, including an encounter cited in the application as a reason to be suspicious of him. That made his history less suspicious, Mr. Horowitz suggested.
The F.B.I.’s omission of Mr. Page’s contacts with the C.I.A. relates to the criminal referral that Mr. Horowitz made about an F.B.I. lawyer assigned to assist the Russia investigation team. He found that the lawyer, Kevin Clinesmith, altered an email from the C.I.A. to a colleague during a renewal application.
An F.B.I. official who had to sign an affidavit attesting to the accuracy and completeness of a court filing had specifically asked about any relationship with the C.I.A. Mr. Clinesmith altered the email so that it stated that Mr. Page was “not a source,” contributing to the Justice Department’s failure to discuss his relationship with the C.I.A. in a renewal application.
Mr. Horowitz has referred his findings about Mr. Clinesmith to prosecutors for a potential criminal investigation for making a false statement. Mr. Clinesmith left the Russia investigation in February 2018 after the inspector general identified him as one of a handful of F.B.I. officials who expressed animus toward Mr. Trump’s election as president in internal texts. He resigned from the bureau in September.
In addition to the other issues with the wiretap application, the F.B.I. in January 2017 interviewed a primary source for important claims about Mr. Page in Mr. Steele’s dossier. In the interview, the source contradicted some of what Mr. Steele had written. But F.B.I. officials said only that they found the source “truthful and cooperative,” leaving the false impression in renewal applications that his account had confirmed rather than raised doubts about the dossier’s reporting.
Indeed, as recently as July 2018, when the Justice Department sent a letter to the court discussing certain errors or omissions in its Page wiretap applications, the report said, it continued to defend the reliability of Mr. Steele’s reporting and the court filings by portraying Mr. Steele’s source has having corroborated his dossier.
The report placed primary blame for the significant errors and omissions on sloppiness by F.B.I. case agents, including one unnamed investigator who mischaracterized information and failed to advise the Justice Department officials working on court filings of several important facts.
The inspector general found that this pattern was not intentional, but that explanations offered in defense of the agents — such as that they were busy with the Russia investigation at the time and “the Carter Page FISA was a narrow aspect of their overall responsibilities” — were unsatisfactory.
Mr. Horowitz took no position on whether the outcome would have been different — and the intelligence court would not have approved wiretapping Mr. Page or extending the surveillance for additional periods — without the misstatements and omissions.
Still, notwithstanding now-famous text messages sent by several other F.B.I. officials that indicated a dislike for Mr. Trump, the bureau’s top counterintelligence official, Bill Priestap, made the decisions to open the investigation and scrutinize four Trump campaign figures with links to Russia, and Mr. Horowitz found that he had a sufficient and lawful basis to do so.
“Priestap’s exercise of discretion in opening the investigation was in compliance with department and F.B.I. policies, and we did not find documentary or testimonial evidence that political bias or improper motivation influenced his decision,” the report said.
Mr. Trump’s frequent F.B.I. targets participated in Mr. Horowitz’s investigation, sitting for hours of interviews. That list includes James B. Comey, the former director; Andrew G. McCabe, the former deputy and acting director; James A. Baker, the former general counsel; Lisa Page, a former senior counsel to Mr. McCabe; and Peter Strzok, a former senior counterintelligence agent.
Mr. Horowitz had previously uncovered text messages that Ms. Page and Mr. Strzok had exchanged on their work phones expressing hostility toward Mr. Trump, but his report found no evidence that any investigative steps were influenced by their personal political opinions. He made a similar finding about the Hillary Clinton email investigation, which involved many of the same law enforcement officials.
A footnote cited other F.B.I. officials who supported Mr. Trump’s campaign and expressed hostility toward Mrs. Clinton. It quoted text messages celebrating his surprise electoral win, including one by an agent who later explained to the inspector general that he was glad Mrs. Clinton lost because “I didn’t want a criminal in the White House.” The report similarly does not accuse these officials of taking official actions based on their personal political opinions.
Mr. Trump’s allies have argued that law enforcement officials abused their powers by using opposition research to get a wiretap and that the Justice Department should have done more to alert the court that Mr. Trump’s political opponents had funded Mr. Steele’s efforts.
A lengthy footnote in the application told the court that the information was most likely opposition research but did not specifically name the funders: the Democratic National Committee and the Hillary Clinton campaign. Mr. Horowitz observed that is standard practice not to explicitly name Americans or American organizations in such sensitive documents; Mr. Trump, for example, is referred to as “Candidate #1.”
“The Carter Page FISA application did not identify by name Steele’s clients or the presidential candidates, which is consistent with the department’s general practice of not disclosing the true identities of U.S. persons who are not the surveillance targets in FISA applications,” Mr. Horowitz wrote.
Despite the particular attention it has received, the wiretap of Mr. Page was but a very small piece of a much larger, sprawling F.B.I. investigation into Russian interference. Investigators obtained nearly 500 search warrants and interviewed hundreds of witnesses, according to the special counsel’s report.
The report found that Mr. Steele’s information was not used in the opening of the Russia investigation, as Mr. Trump’s allies have frequently but falsely suggested as part of their claim that the F.B.I. spied on the Trump campaign as part of a politicized plot.
But the inspector general also determined that F.B.I. did not place informants or undercover agents in the campaign, and it did not ask them to “report on the Trump campaign.” Nor did the inspector general find evidence that undercover agents or informants were told to meet with Trump campaign officials before the opening of Crossfire Hurricane. Members told the inspector general that no investigative steps were before the actual opening of the investigation in late July 2016.
Instead, it confirms that the F.B.I. opened the inquiry after WikiLeaks began publicly releasing hacked Democratic emails and officials learned that a Trump campaign aide had previously bragged to a pair of Australian diplomats of knowing that Russia had dirt on Mrs. Clinton in the form of hacked emails it was willing to release anonymously to help Mr. Trump.
That campaign aide, George Papadopoulos, has subsequently accused the person who told him about Russia’s possession of those emails, a Maltese professor named Joseph Mifsud, of being an F.B.I. and C.I.A. asset engaged in a conspiracy to entrap the Trump campaign. But Mr. Horowitz is said to have found no evidence to corroborate that he worked for the F.B.I.
The inspector general also noted that the F.B.I. apparently requested information from another agency but that portion remains blacked out. It was previously reported that Mr. Mifsud did not work for the C.I.A., either.
Mr. Papadopoulos was later convicted of lying to the F.B.I. about his interactions with Mr. Mifsud. Mr. Trump has also raised the specter of a “deep state” conspiracy��involving Mr. Mifsud.
In addition, the inspector general looked at the role of a Justice Department official named Bruce G. Ohr, who has been vilified by Mr. Trump and his allies because he was in contact with Mr. Steele and because his wife worked for the political research firm that employed Mr. Steele.
The inspector general criticized Mr. Ohr for failing to keep his supervisors informed of his actions, but does not accuse him of being part of a conspiracy. The inspector general described Mr. Ohr making “consequential errors in judgment,” requesting meetings with senior law enforcement officials outside his area of responsibility, by making himself “a witness” in the investigation.
