CNN chief says Trump’s attacks are boosting morale
CNN President Jeff Zucker declared on Thursday that President Donald Trump’s comments about the channel being fake news are a “badge of honor” and that aggressive coverage of the new administration has boosted employee morale.
As Zucker was talking over a lunch with reporters at Porter House in the Time Warner Center in New York, Trump was hosting a fiery press conference featuring a memorable back-and-forth with CNN White House correspondent Jim Acosta, who tried to ask a question about the president’s attacks on CNN.
“I'm changing it from ‘fake news,’ to ‘very fake news,’” Trump quipped in response.
But both Trump and Acosta seemed to be enjoying the jousting, pointing to one of the odder patterns to emerge from the early days of Trump’s administration: the president engaging in all-out war with the media and both sides seeming energized by it — and, perhaps, benefiting from it.
When Trump made a quip about CNN’s low ratings, Acosta piped up that they actually weren’t bad. And, indeed, CNN’s ratings have been on the rise during the period when the White House has been shunning the network.
“They wear those insults as a badge of honor, because it means they are doing their jobs,” Zucker said, referring to the network’s reporters and employees. “I would say that morale is incredibly high ... They are not being intimidated, they are not backing down, they know they have my full support and it is a very exciting time, frankly, to be a journalist at CNN.”
Added Zucker, “If there is any issue, it is because they are exhausted. The pace has been nonstop, and it has not let up.”
In his back-and-forth with Trump, Acosta declared “just for the record, we don’t hate you,” while a twinkle-eyed Trump asked Acosta whether he was related to his pick for labor secretary, Alexander Acosta.
Later, Trump told Acosta to “ask Jeff Zucker how he got his job.”
According to New York magazine, Trump believes he helped Zucker get the top job at CNN because he mentioned that Zucker would be a good candidate to Turner Broadcasting’s CEO at the time, Phil Kent. At that point, Kent was said to have already decided on Zucker to take over the cable news channel, so Trump’s recommendation was moot.
Zucker, for his part, told reporters on Thursday that he last spoke to Trump in mid- to late December and that it was “not a good conversation.”
Zucker said that while newsroom morale is high, executives at the company are nonetheless concerned about the comments made by Trump and others during the campaign and since the election.
“I have wondered about that, and I frankly was concerned that when you have that constant drumbeat for a year, you know, the president of the United States saying it on a daily basis. I wondered what impact that would have,” Zucker said.
But CNN ordered a major brand study that was conducted throughout the month of January to examine what impact the attacks have had on its credibility with viewers and with the public.
“There has been no diminution whatsoever,” Zucker said the study showed. “The CNN brand is as strong as it has ever been. Incredibly trusted. And we have seen no impact whatsoever in all those attacks on the CNN brand.”
In fact, the presidential campaign and the first few weeks of the Trump administration have proven to be a boon to the bottom line for CNN and its competition. In many respects, Trump’s vitriol toward the media and the tough coverage of his administration reinforce themselves, driving coverage forward.
Zucker noted that, in the adults 25-54 demographic that media buyers buy ads against, CNN and Fox News are up more than 50 percent so far this year compared with the same period last year, while MSNBC is up by more than 30 percent. In prime time, CNN and MSNBC are averaging well over 1 million viewers this year, while Fox News is averaging nearly 3 million prime-time viewers, according to ratings data from Nielsen.
Trump himself seems fully aware of his role in boosting cable news. During his exchange with Acosta, he said “I know how good everybody’s ratings are right now but I think that actually — I think that’d actually be better [if the media were nicer].”
That ratings boom is affecting CNN’s revenue as well.
“CNN last year had its best year ever in terms of advertising,” Turner President David Levy told reporters Thursday, adding that so far no advertisers have been spooked by the president’s comments about the network. CNN is hoping to see $1 billion in profit this year, according to Zucker.
“The demand for CNN is incredibly high,” Zucker added. “These are very good times for us, and the money is following.”
Of course, Trump’s tangents have a side effect of being a distraction. While the back-and-forth arguments with members of the press make for entertaining TV, they also push more serious stories, such as Russia or Syria, below the fold, or out of prime time.
For now, it certainly appears as though the big news story of the day will be Trump’s extended press conference, with the questions surrounding Michael Flynn’s departure, and Rex Tillerson’s first meeting with his Russian counterpart stuck on the back burner.
Fox News Channel’s Shepard Smith, on his program Thursday afternoon, defended Acosta’s questioning of the president during the presser, and suggested that Trump's answers were meant to deflect from the hard questions.
“It is crazy what we are watching every day. He keeps repeating ridiculous throwaway lines that are not true at all, and sort of avoiding this issue of Russia as if we are fools for asking the question,” Smith said. “That you call us fake news and put us down like children for asking these questions on behalf of the American people is inconsequential. CNN chief says Trump’s attacks are boosting morale
CNN president Jeff Zucker declared on Thursday that President Donald Trump’s comments about the channel being fake news are a “badge of honor” and that aggressive coverage of the new administration has boosted employee morale.
As Zucker was talking over a lunch with reporters at Porter House in the Time Warner Center, Trump was hosting a fiery press conference featuring a memorable back and forth with CNN’s White House correspondent Jim Acosta, who tried to ask a question about the president’s attacks on CNN.
“I'm changing it from ‘fake news,’ to ‘very fake news,’ ” Trump quipped in response.
But both Trump and Acosta seemed to be enjoying the jousting, pointing to one of the odder patterns to emerge from the early days of Trump’s administration: the president engaging in all-out war with the media and both sides seeming energized by it – and, perhaps, benefiting from it.
When Trump made a quip about CNN’s low ratings, Acosta piped up that they actually weren’t bad. And, indeed, CNN’s ratings have been on the rise during the period when the White House has been shunning the network.
“They wear those insults as a badge of honor, because it means they are doing their jobs,” Zucker said, referring to the network’s reporters and employees. “I would say that morale is incredibly high . . . They are not being intimidated, they are not backing down, they know they have my full support and it is a very exciting time, frankly, to be a journalist at CNN.”
Added Zucker, “If there is any issue, it is because they are exhausted. The pace has been non-stop, and it has not let up.”
In his back-and-forth with Trump, Acosta declared “just for the record, we don’t hate you,” while a twinkle-eyed Trump asked Acosta whether he was related to his pick for labor secretary, Alexander Acosta.
Later, Trump told Acosta to “Ask Jeff Zucker how he got his job.”
According to New York Magazine, Trump believes he helped Zucker get the top job at CNN because he mentioned that Zucker would be a good candidate to Turner Broadcasting’s CEO at the time, Phil Kent. At that point, Kent was said to have already decided on Zucker to take over the cable news channel, so Trump’s recommendation was moot.
Zucker, for his part, told reporters on Thursday that he last spoke to Trump in mid to late December and that it was “not a good conversation.”
And Zucker said that while newsroom morale was high, executives at the company were nonetheless concerned about the comments made by Trump and others during the campaign and since the election.
“I have wondered about that, and I frankly was concerned that when you have that constant drumbeat for a year, you know, the President of the United States saying it on a daily basis. I wondered what impact that would have,” Zucker said.
But CNN ordered a major brand study that was conducted throughout the month of January to examine what impact the attacks have had on its credibility with viewers and with the public.
“There has been no diminution whatsoever,” Zucker said the study showed. “The CNN brand is as strong as it has ever been. Incredibly trusted. And we have seen no impact whatsoever in all those attacks on the CNN brand.”
In fact, the presidential campaign and the first few weeks of the Trump Administration have proven to be a boon to the bottom line for CNN and its competition. In many respects, Trump’s vitriol towards the media and the tough coverage of his administration reinforce themselves, driving coverage forward.
Zucker noted that, in the adults 25-54 demographic that media buyers buy ads against, CNN and Fox News were up more than 50 percent so far this year compared to the same period last year, while MSNBC was up by more than 30 percent. In primetime, CNN and MSNBC are averaging well over 1 million viewers this year, while Fox News is averaging nearly three million primetime viewers, according to ratings data from Nielsen.
Trump himself seems fully aware of his role in boosting cable news. During his exchange with Acosta, he said “I know how good everybody’s ratings are right now but I think that actually — I think that’d actually be better [if the media were nicer].”
That ratings boom is impacting CNN’s revenue as well.
“CNN last year had its best year ever in terms of advertising,” Turner president David Levy told reporters Thursday, adding that so far no advertisers have been spooked by the President’s comments about the channel. CNN is hoping to see $1 billion in profit this year, according to Zucker.
“The demand for CNN is incredibly high,” Zucker added. “These are very good times for us, and the money is following.”
Of course, Trump’s tangents have a side effect of being a distraction. While the back-and-forth arguments with members of the press make for entertaining TV, they also push more serious stories, such as about Russia or Syria, below the fold, or out of primetime.
For now, it certainly appears as though the big news story of the day will be Trump’s extended press conference, with the questions surrounding Michael Flynn’s departure, and Rex Tillerson’s first meeting with his Russian counterpart stuck on the back burner.
Fox News Channel’s Shepard Smith, on his program Thursday afternoon, defended Acosta’s questioning of the president during the presser, and suggested that Trump's answers were meant to deflect from the hard questions.
“It is crazy what we are watching every day. He keeps repeating ridiculous throwaway lines that are not true at all, and sort of avoiding this issue of Russia as if we are fools for asking the question,” Smith said. “That you call us fake news and put us down like children for asking these questions on behalf of the American people is inconsequential. The people deserve that answer, at very least.”

Evaluation question 4
How did you use media technologies in the construction and research, planning and evaluation stages?
1. Research
Youtube
During the research stages of my project the primary source of research came from Youtube, this was because it hosted everything from professional productions to amateur projects.This was especially useful, as it brought all the content i needed to use within my research into one place where i compiled various videos into a playlist, allowing me to access them quickly at any time.
Tumblr
After carrying out the research i used a Tumblr blog to compile all of my research, this was useful because of how it began to create a chronological timeline of the progress being made in the planning stage. It also was able to host a wide variety of content, anywhere from text to links to video/photos. This worked well in harmony with youtube, as i used youtube as a hosting service to upload all of the videos recorded for the blog.
Reddit and Audience research
When collecting the audience research there were a few methods we used to collect the data needed. Firstly we put various posts on forums like Reddit to gain random individuals feedback on the various conventions they’d like to see within a documentary. Though the limitation of this was that the people replying to the posts gave little constructive input and most just were there to take the mick. The more successful audience research was when i used my smartphone to film various students, asking them about the conventions of documentaries and which ones they would prefer to see in a production. This was extremely insightful and gave us the vital information needed for the planning stage.
2. Planning
WhatsApp
During the planning stages it was vital that the various aspects of the planning were shared between the two of us in the group and some of the actors that willingly agreed to participate. Because of this we opted to use WhatsApp on our phones which is a messaging service that incorporated file sharing within our group chat. This meant word files, images and videos could be easily shared around the group.
Google Docs
Possibly one of the most useful pieces of software in the planning stage was Google Docs, this was primarily due to its online multi edit function. What this meant is that two people could edit the same document simultaneously, so during evenings we could collaborate on scripts and plans while in a phone call to communicate.
Google maps
Google maps proved to be an essential tool during the planning stage, as it allowed us to find locations easily in the classroom without physically going out and looking for locations. It also allowed us to reference the locations shown on the Police.co.uk/kent/crime site showing crime rates to locations on google maps so we knew to film in areas where there were high crime rates to fit with the documentary.
3. Construction
Camera
During the construction stage the cameras we used were two sony a6300 cameras, as they had the ability to film in UHD 4k and 120fps HD for all of our slow motion shots. It also has amazing low light capabilities which was essential, as a lot of our scenes were filmed at night when lighting is typically the main problem faced.
Accessories
As well as using a tripod for the static shots, when we needed the extra stabilisation but did not want to have to set up a tripod every two minutes, I used my video mono pod which was more than stable enough for on the go filming on limited time frames.
Audio
In terms of the audio, we received a lot of negative feedback in the previous project because of wind noise and general bad quality audio, so in this project we used a Rode videomic Go that provided directional, clear audio coupled with a dead cat muffle to eliminate wind noise. This turned out to be a very versatile setup, as it worked well on the camera but also as an effective interview mic when used with a long extension cable.
Another microphone we used was a Snowball microphone on a desktop that provided clear audio for the voice overs laid over the top of the project. I would have also liked to used my Lav microphone which would have been very useful for close up audio when a microphone is needed to be kept out of shot, but i had limited success, as the microphone refused to work.
Transport
During filming we had various locations scattered all over the local areas to film at, coupled with a few scenes that were shot in the car. This meant that access to a car was vital during filming, without this we would have had to rely on others to drive us around which can be tedious because of their time restraints and having to organise far in advance. This would have slowed down and extremely limited filming.
Editing Software
While editing the project we used Adobe premiere pro, this was for a number of reasons that put it above other options out there. Firstly, it incorporated crucial colour grading into one program, saving having to import and export each individual clip after grading. It also has various interfaces for each aspect of editing (assembly, audio, colour grading) which allows each interface to be tailored for its specific usage, this helped save a lot of time when editing. Lastly, Premiere pro allows for customise-able shortcuts for tools like ‘trim’ or ‘move’, making the editing process much more efficient and less tedious.
Coupled with the editing software, we only used SRGB monitors to colour grade and edit the footage, as this provides 99% colour accuracy in the image. I did this because of issues faced in the previous project where low accuracy monitors caused a lot of the footage to have strange tints that weren’t noticed in the editing stages.
When selecting the music for the project, we used Audio Network, a service that provides a wide range of high quality music to be used freely. they could also be ordered by mood or genre which was especially useful when narrowing the choices down from lists of thousands of tracks.
Ancillary tasks
When creating the ancillary tasks we went out and took images with the a6300, where the images were imported to lightroom to give them the colour grade that fit with the documentary itself, creating a connection between the two. The edited images were then imported into Photoshop where text and logos were added to make the images into a poster and magazine double page spread.

4. Evaluation
Feedback
During the evaluation stage we used youtube to host the final product online where we then showed it to various members of our class to see their opinions on it about which aspects had worked and what could be improved if it were to be filmed again. This was filmed on our smartphones, as it did not need to be of high quality and this saved a lot of time, as the large camera takes a lot of post processing to bring it to the final product.
During the other questions i used a generic desktop microphone with audacity which created good enough audio for voice overs when used with a noise reduction filter.
Overall using a wide variety of media technologies alongside our knowledge of them has been essential to the quality of our final project, with each piece of technology providing a unique usage contributing to the level of success of the project.

Tomorrow’s cyber elite return to University of Cambridge for Inter-ACE cyber security challenge
Over 130 competitors from 18 of the UK’s leading cyber security universities will pit their skills against one another in a two-day cyber security competition organised by the University of Cambridge. Now in its third year, the Inter-ACE is supported by GCHQ’s National Cyber Security Centre to attract the best young minds into careers in the sector.
Up for grabs is £10,000 in cash prizes and the opportunity to compete against the best of the USA in ‘Cambridge2Cambridge’, a transatlantic contest to be held later this year.
The 130 competitors, organised into 34 teams from 18 UK universities, will face over 20 challenges set by experts from the University of Cambridge and sponsors including Context IS and Palo Alto Networks. The two-day event, taking place at the University of Cambridge on the 16th and 17th March 2018, will culminate in a ceremony dinner at Trinity College, Cambridge.
Inter-ACE will simulate a number of scenarios, including working to prevent a cyber-attack on the infrastructure of a fictional city and the results of a successful tap on an undersea data cable. Competitors will develop and hone penetrative testing skills. These skills include the binary reverse engineering of malware, breaking into a web application such as an online payment system, decoding secure communications and piecing together intercepted data.
Professor Frank Stajano of the University of Cambridge, the founder of Inter-ACE, said “Protecting IT and infrastructure means understanding how it can be attacked. The head of the National Cyber Security Centre, Ciaran Martin, is absolutely right in that a major cyber-attack on the UK is a now matter of “when, not if” and we must recognise that the UK faces an urgent skills shortage.
“Inter-ACE gives future cyber security professionals the opportunity to test their skills against the best and meet others in their field and future employers. This is about engaging with the next generation of cyber security talent, and raising awareness of this vital, interesting and exciting career choice.
“It’s also about making the good work of cyber security professionals much more visible. Like other initiatives such as NCSC’s CyberFirst programme, the interesting experiences of the University students taking part in this year’s event will help to inspire those currently at school to consider a rewarding career in this field.”
Chris Ensor, Deputy Director for Skills and Growth at the NCSC, said: “The InterACE competition is a fantastic way to encourage bright young minds to hone their cyber knowledge further and meet like minded people.
“The cyber threat is growing, and so making sure that young people have the cyber security skills to help protect us has never been more important. We at the NCSC hope the entrants will be inspired – and can perhaps inspire others – into starting a thrilling career defending the UK and helping make it the safest place to live and work online.”
Established through the UK’s National Cyber Security Strategy and supported by GCHQ’s National Cyber Security Centre, the competition is sponsored by Microsoft, BT, Palo Alto and Context IS.
The 18 universities sending teams to Inter-ACE are Queen’s University Belfast, the University of Birmingham, the University of Cambridge, Cardiff University, De Montfort University, the University of Edinburgh, Edinburgh Napier University, Imperial College London, the University of Kent, Lancaster University, Newcastle University, the University of Oxford, Royal Holloway University of London, the University of Southampton, the University of Surrey, University College London, the University of Warwick and the University of York.

“The basis for this project was to have an integrated home system that was easy for the whole family to use,” says Rob Sutherland, managing director for Inspired Dwellings. “Utilizing D-Tools extensive product library, our design team worked tirelessly to ensure that we had all the most up to date technology while the A/V equipment was put together offsite in our workshop and tested to ensure a seamless installation at the customer’s home.”
Luxury With No Boundaries The grand 12,000-square-foot home, which opens to a spacious foyer with a spiral staircase, includes a 14-seat home theater with three rows of chairs from Fortress Seating on risers for optimal sightlines, a JVC DLA-X500R 4K projector, and a 130-inch Screen Research screen.
All 14 rooms of the home feature distributed audio, while a family room boasts a 55-inch TV and surround sound system. Inspired Dwellings provided HDMI video distribution throughout the home and a Rako lighting system. An equipment closet houses a Middle Atlantic rack with a Control4 control system, Apple TV’s, a Sonos Zoneplayer, and centralized video sources including Blu-ray players and satellite set top boxes.
Inspired Dwellings was also tasked with providing the family’s data infrastructure with enough bandwidth to accommodate all the smart devices on the network, and a CCTV security system that spans the property, indoors and out.
Selection of Smart Systems
The Kent family working with Inspired Dwellings had a solid idea of what they wanted to accomplish and were specific in their request for it to include the latest technology. They were, however, open to suggestions that would make their home’s systems more user-friendly and enhance their overall technology experience.

1993: Version 1.0 of NCSA Mosaic, a graphical browser allowing easy access to websites, is released. The Web is now in the hands of millions of PC users.
1996:
The Communications Decency Act (CDA) prohibits posting "indecent" or "patently offensive" materials in a public forum on the Internet, including web pages, newsgroups, chat rooms, or online discussion lists. Section 230 states that Internet service and content providers are not liable for content posted by others on the Internet.
The Electronic Communication Transactional Records Act requires Internet Service providers to retain any "record” in their possession for 90 days “upon the request of a government entity” for the use in criminal investigations. (color code – data retention.)
The Child Pornography Prevention Act extends existing federal criminal laws against child pornography to computer media, outlawing all depictions (including computer simulations) of those "appearing to be" minors engaging in sexual activities.
1997:
The U.S. Supreme Court strikes down most of the CDA is an unconstitutional restrictionon Internet speech. The Court holds that the Internet is not a scarce resource (such as broadcasting) and is therefore entitled to the same First Amendment protection as print. (Reno v. American Civil Liberties Union)
All major Austrian Internet Service Providers (ISPs) take themselves offline to protest the police seizure of equipment belonging to the ISP V.I.P., following a year old tip from the German police about a pornographic post by a former user. Following this incident, Internet censorship in Austria has been very limited.
1998:
The Digital Millennium Copyright Act (DMCA) criminalizes the production and dissemination of technology, devices, or services that are used to circumvent measures that control access to copyrighted works, even when there is no infringement of copyright itself. This Act is criticized for providing the entertainment industry extraordinary latitude to undermine traditional limits to copyright such as fair use and the first sale doctrine. (In 2001, Dmitry Sklyarov, a Russian citizen, is arrested under the DMCA at a hacker convention in Las Vegas where he had given a talk describing the weaknesses in Adobe's electronic book software.)
The Child Online Protection Act (COPA) criminalizes making available on the Internet information that could be harmful to minors, defined as material that by "contemporary community standards" was judged to appeal to the "prurient interest" and that showed sexual acts or nudity (including female breasts). The Supreme Court strikes down the law in 2004 because it overly threatens adult speech, is overbroad, and would chill expression.
The Russian Federal Security Service (FSB) issues a decree that would require ISPs to install technology which would allow the FSB direct access to the communications of Internet users without a warrant.
A U.S. federal district court holds that school officials violated the First Amendment rights of a high school student when they suspended him for ten days due to content on his website, which used vulgar language to criticize the school. (Beussink v. Woodland R-IV School District)
1999: Filtering software screens outgoing messages from Bloomberg L.P.’s system because Michael Bloomberg, the company’s founder and chief executive officer, does not want communications that may be racist or offensive of religion to be disseminated from his company.
2000:
The Regulation of Investigatory Powers Act (RIPA) authorizes U.K. Home Security (as opposed to an independent court) to issue warrants for the interception of communications and requires Communications Service Providers to provide a “reasonable interception capability” in their networks. Many legal experts, including the Information Commissioner, believe that many of the provisions in the Act violate the European Convention on Human Rights.
Yahoo! Inc. is sued by France’s Union of Jewish Students and the International Anti-Racism and Anti-Semitism League because it sells Nazi memorabilia on its auction pages in violation of French law. A French court requires the California ISP to block French citizens’ access to the Nazi material. While the question of whether a US company can be sued under French law is in the courts, Yahoo voluntarily takes down many of the pages.
A lawsuit is brought against Napster, a file sharing service launched in 1999, by copyright holders who are concerned about the economic effects of freely distributing copyrighted material. Four years later Napster is essentially terminated when a judge rules for the copyright holders.
A school student sues his school district because he was suspended for creating a website that contained the mock obituaries of two of his friends. The court rules that the student should not have been suspended and suggests that the case was beyond the power of school authorities to regulate at all. (Emmett v. Kent School District)
Wyoming’s Internet Crimes Against Children Task Force forms to track child pornography for police agencies across the country. The group relies in part on software developed to read unique electronic codes, making it possible for law enforcement to monitor file-sharing networks.
2001:
A survey of studies of filtering software programs reveals that filters massively over-block a wide variety of Internet content.
After 9/11/2001, countries such as Switzerland, France, Spain, and Belgium, and the U.K. implement data retention laws, allowing logs to be kept of transactional header traffic data for an undetermined amount of time.
The Burmese government, notorious for having the world’s most comprehensive restrictions on Internet use, begins allowing limited email and Internet access to its citizens. All Burmese Internet traffic passes through government servers, which strictly limit which Web sites can be accessed (the total estimate is around 10,000).
U.S. Congress enacts the PATRIOT Act, which, among other things, broadens the use of wiretapping devices from telephone numbers to Internet and e-mail origins. It removes the warrant requirement for these taps so long as the government can certify that the information likely to be obtained is "relevant" to an ongoing investigation against international terrorism.
With the goal of limiting Internet access for children, America Online, Microsoft Corp.’s MSN, and Yahoo agree on a uniform labeling system to be used by Internet filtering software. Web browsers with activated filters can use the system to selectively block access to coded sites containing specific key words.
The Children’s Internet Protection Act (CIPA) forces libraries and schools that receive e-rate discounts or federal aid for Internet service to install content filtering software on their computers. While the Act is intended to block access to material such as pornography and bomb-making recipes, the filter software regularly blocks other kinds of speech, such as comedy, personal care, short poems, and health sites. In 2003 the U.S. Supreme Court upholds the Act.
After the 9/11 attacks, access to online information is blocked by at least 13 U.S. government agencies and three state websites, including New Jersey’s, which removes chemical storage details.
2002:
In Ashcroft v. Free Speech Coalition, the U.S. Supreme Court declares the 1996 Child Pornography Prevention Act unconstitutional.
2003
Kenyan lawmakers pass a law which makes it a criminal offense to collect, produce, make available on a website, or transmit (by email or voice-mail or any other telecommunication method) any record of information of a kind likely to be useful to a person committing or preparing to commit an act of terrorism. Critics warn the vague language of the Act will adversely impact Internet use for otherwise lawful purposes.
The Egyptian parliament criminalizes the “deliberate dissemination of news, statements, faulty or ill-motivated rumors or agitating news if the objective thereof is to disturb public order…”
Lawsuits are brought against the makers of several peer-to-peer (P2P) file-sharing programs (Morpheus, KaZaA, and Grokster). In 2005, Grokster is essentially terminated and Morpheus and KaZaA are put on notice that there will be no toleration of technologies that are designed primarily to circumvent the payment of royalties to the copyright holders.
The Indian government permits the blacking out of websites that promote hate content, slander, pornography, and gambling.
Congress passes the PROTECT Act which is intended to override the 2002 Supreme Court decision to strike down the Child Pornography Prevention Act. The PROTECT Act prohibits child pornography when the depiction is a computer-generated image that is, or appears virtually indistinguishable from, that of a minor engaging in sexually explicit conduct. In 2006, part of the Act is struck down by an appeals court, but the provisions prohibiting virtual child pornography remain standing.
2004:
The Supreme Court rules that certain provisions of Child Online Protection Act (COPA) are overbroad and unconstitutional and that private voluntary software is just as effective, especially in light of the fact that COPA could not have blocked minors’ access to foreign websites. (Ashcroft v. American Civil Liberties Union)
Google rejects advertisements for an award-winning documentary series, XXL Century, by Lorenzo Meccoli and Gabriele Zamparini because the ads violate Google’s policy against disparagement of an individual, group, or organization. The text of the ads included the phrase, “American Voices Against Bush.”
Trademark and defamation lawsuits are brought by companies after their disgruntled customers criticize their business on Internet “gripe sites.” While courts have consistently ruled in favor of the customers’ rights to post their grievances online, the suits are considered to have a chilling effect on speech because of the expenses involved.
2005:
Network Neutrality, a regulatory principle that prevents the owners of the internet infrastructure (the actual cables through which the signal travels) from discriminating against different service providers or users, is threatened when the FCC decides to deregulate cable and DSL Internet services so that the old “common carrier” neutrality regulations no longer apply.
Kazakhstan seizes all .kz Internet domains and closes one that is considered offensive and run by British satirist Sacha Baron Cohen.
A Florida county sheriff arrests a porn site owner on 300 obscenity-related charges, even though the site is hosted in the Netherlands, stating that anyone feeding a server or receiving information from a server in his county is subject to the county’s jurisdiction. The site became controversial after it started running photos, allegedly sent in by soldiers serving in Iraq and Afghanistan, showing scenes of dead men and women, purported to be insurgents.
2006:
Barbara Nitke, a New York photographer whose work includes explicit sexual images, claims that the Communications Decency Act’s (CDA) obscenity provision chills her freedom of expression, because it is defined in reference to “contemporary community standards,” which may vary between different states and are hard to apply to the Internet. (Nitke v. Gonzales) A special panel of the Second Circuit of Appeals in New York unanimously disagrees. The panel states that they the plaintiffs failed to show that the Act was substantially overbroad.
The Deleting Online Predators Act (DOPA) is introduced in Congress. The act would limit student access to networking websites and chatrooms by requiring public schools and libraries receiving federal funds for Internet access to provide a “technology protection measure.” While the bill purports to protect children from online sexual predators, it would also block technologies that are often used as educational tools, such as blogs and applications used in distance learning and for class forums. The act is never passed.
The Save the Internet campaign insists that that the new 2006 Telecommunications Actbe amended with a provision that would preserve Network Neutrality, a principle that prevents the owners of the internet infrastructure from disadvantaging certain data by slowing down Web content based on its source or destination.
Attorney General Alberto Gonzales asks Internet providers to retain records so as to aid investigations of criminals who abuse children and distribute images of the abuse through the Internet. Data retention legislation is introduced in Congress.
A state appeals court rejects Apple Computer Inc.’s bid to identify the sources of leaked product information that appeared on Web sites, ruling that online reporters and bloggers are entitled to the same protections as traditional journalists.
2007:
The United States District Court in the Eastern District of Pennsylvania issues a permanent injunction against enforcement of the Child Online Protection Act (COPA), finding that the statute facially violates the First Amendment because it, among other things, is impermissibly vague and overbroad. (American Civil Liberties Union v. Gonzales.)
Juicy Campus, a website which invites people to anonymously post gossip about college students, begins operations. The website features potentially libelous content, including claims that specific people are sexually promiscuous and drug addicted. The site garners criticism for abusive, degrading, and hateful speech. College students debate whether their schools’ servers should block access to the website. Tennessee State University, Hampton University and High Point University block the site. In early 2009, the website shutdown, citing financial problems including the inability to turn a profit.
2008:
Popular social networking website MySpace agrees to work with the attorney generals of 49 states plus the District of Columbia to come up with a plan to combat material considered harmful minors, including pornography, harassment, bullying, and identity theft; to better educate parents and schools about potential threats online; to work with law enforcement officials; and to develop new technology for age and identity verification on social-networking sites.
The Third Circuit upholds the lower court’s ruling that the Child Online Protection Act (COPA) on its face violates the First Amendment. (American Civil Liberties Union v. Mukasey.)
A high school junior, following a dispute with administrators at her high school over the scheduling of an event, posts from home a blog entry where she calls the school administrators “douchebags”, and invites readers to email and phone the administrators to rally support for the event. The school punishes the student by barring her from running for a position in student government for her senior year. The federal district court in Connecticut denies the student’s motion for an injunction against the bar on the grounds that the student’s First Amendment rights had not been violated. The court finds that the student’s blog posting are “lewd” under the standard established in Bethel School District v. Fraser, and thus not protected under the First Amendment. The Appellate Court upholds this ruling on the grounds that the student’s speech has the potential to cause substantial disruption. (Doninger v. Niehoff.)
In May 2008, the United States House of Representatives introduces H.R. 6123, also known as “The Megan Meier Cyberbullying Prevention Act.” This bill defines cyber-bullying as the “transmit[ting] in interstate or foreign commerce any communication, with the intent to coerce, intimidate, harass, or cause substantial emotional distress to a person, using electronic means to support severe, repeated, and hostile behavior.” (H.R. 6123). The bill provides that individuals found guilty of cyber-bullying will face criminal liability, fines, and/or potential imprisonment for no more than two years. (H.R. 6123).
2009:
The Supreme Court refuses to hear the government’s appeal of a 2008 Third Circuit ruling that the Child Online Protection Act (COPA) was unconstitutional.
2010:
Craigslist begins to censor its adult services section, succumbing to years of pressure from government officials who accuse the site of promoting sex crimes.
The Combating Online Infringement and Counterfeits Act is introduced in Congress. The bill would allow the Justice Department to block websites it deems to be in violation of copyright laws.
Obscenity on the Internet Federal obscenity laws apply to interstate and foreign issues, such as distribution; intrastate issues are mostly governed by state law. Today, materials considered "obscene" can be sent from a computer in California to someone across the U.S. as fast as a click of a button. The question is: What state governs the issue of obscenity when the Internet can reach multiple areas?
The Miller Test, which legally defines obscenity, is based on what is offensive in a certain "community," geographically defined as a city, state or region, not the United States as a whole. But the notion of "community" becomes blurred with the advent of the Internet as the geographic area of the Internet is nonexistent.

CNN chief says Trump’s attacks are boosting morale
CNN president Jeff Zucker declared on Thursday that President Donald Trump’s comments about the channel being fake news are a “badge of honor” and that aggressive coverage of the new administration has boosted employee morale.
As Zucker was talking over a lunch with reporters at Porter House in the Time Warner Center, Trump was hosting a fiery press conference featuring a memorable back and forth with CNN’s White House correspondent Jim Acosta, who tried to ask a question about the president’s attacks on CNN.
“I'm changing it from ‘fake news,’ to ‘very fake news,’ ” Trump quipped in response.
But both Trump and Acosta seemed to be enjoying the jousting, pointing to one of the odder patterns to emerge from the early days of Trump’s administration: the president engaging in all-out war with the media and both sides seeming energized by it – and, perhaps, benefiting from it.
When Trump made a quip about CNN’s low ratings, Acosta piped up that they actually weren’t bad. And, indeed, CNN’s ratings have been on the rise during the period when the White House has been shunning the network.
“They wear those insults as a badge of honor, because it means they are doing their jobs,” Zucker said, referring to the network’s reporters and employees. “I would say that morale is incredibly high . . . They are not being intimidated, they are not backing down, they know they have my full support and it is a very exciting time, frankly, to be a journalist at CNN.”
Added Zucker, “If there is any issue, it is because they are exhausted. The pace has been non-stop, and it has not let up.”
In his back-and-forth with Trump, Acosta declared “just for the record, we don’t hate you,” while a twinkle-eyed Trump asked Acosta whether he was related to his pick for labor secretary, Alexander Acosta.
Later, Trump told Acosta to “Ask Jeff Zucker how he got his job.”
According to New York Magazine, Trump believes he helped Zucker get the top job at CNN because he mentioned that Zucker would be a good candidate to Turner Broadcasting’s CEO at the time, Phil Kent. At that point, Kent was said to have already decided on Zucker to take over the cable news channel, so Trump’s recommendation was moot.
Zucker, for his part, told reporters on Thursday that he last spoke to Trump in mid to late December and that it was “not a good conversation.”
And Zucker said that while newsroom morale was high, executives at the company were nonetheless concerned about the comments made by Trump and others during the campaign and since the election.
“I have wondered about that, and I frankly was concerned that when you have that constant drumbeat for a year, you know, the President of the United States saying it on a daily basis. I wondered what impact that would have,” Zucker said.
But CNN ordered a major brand study that was conducted throughout the month of January to examine what impact the attacks have had on its credibility with viewers and with the public.
“There has been no diminution whatsoever,” Zucker said the study showed. “The CNN brand is as strong as it has ever been. Incredibly trusted. And we have seen no impact whatsoever in all those attacks on the CNN brand.”
In fact, the presidential campaign and the first few weeks of the Trump Administration have proven to be a boon to the bottom line for CNN and its competition. In many respects, Trump’s vitriol towards the media and the tough coverage of his administration reinforce themselves, driving coverage forward.
Zucker noted that, in the adults 25-54 demographic that media buyers buy ads against, CNN and Fox News were up more than 50 percent so far this year compared to the same period last year, while MSNBC was up by more than 30 percent. In primetime, CNN and MSNBC are averaging well over 1 million viewers this year, while Fox News is averaging nearly three million primetime viewers, according to ratings data from Nielsen.
Trump himself seems fully aware of his role in boosting cable news. During his exchange with Acosta, he said “I know how good everybody’s ratings are right now but I think that actually — I think that’d actually be better [if the media were nicer].”
That ratings boom is impacting CNN’s revenue as well.
“CNN last year had its best year ever in terms of advertising,” Turner president David Levy told reporters Thursday, adding that so far no advertisers have been spooked by the President’s comments about the channel. CNN is hoping to see $1 billion in profit this year, according to Zucker.
“The demand for CNN is incredibly high,” Zucker added. “These are very good times for us, and the money is following.”
Of course, Trump’s tangents have a side effect of being a distraction. While the back-and-forth arguments with members of the press make for entertaining TV, they also push more serious stories, such as about Russia or Syria, below the fold, or out of primetime.
For now, it certainly appears as though the big news story of the day will be Trump’s extended press conference, with the questions surrounding Michael Flynn’s departure, and Rex Tillerson’s first meeting with his Russian counterpart stuck on the back burner.
Fox News Channel’s Shepard Smith, on his program Thursday afternoon, defended Acosta’s questioning of the president during the presser, and suggested that Trump's answers were meant to deflect from the hard questions.
“It is crazy what we are watching every day. He keeps repeating ridiculous throwaway lines that are not true at all, and sort of avoiding this issue of Russia as if we are fools for asking the question,” Smith said. “That you call us fake news and put us down like children for asking these questions on behalf of the American people is inconsequential. The people deserve that answer, at very least.”
